Axiomatic Shifting Paradigms: Wittgenstein’S Language-Games, Gödel’S Incompleteness Theorem, Language, Law, And The Limits Of Formalism, Charles Edward Andrew Lincoln Iv

University of Arkansas at Little Rock Law Review

This Article shows how Ludwig Wittgenstein’s idea of “language-games” and Kurt Gödel’s Incompleteness Theorems mark the outer limits of legal formalism and other leading interpretive theories—textualism, originalism, and purposivism. It begins by tracing Wittgenstein’s progression from a “picture theory” of language to the view that social context drives meaning more than any simple correspondence between words and reality. Gödel’s work on formal systems, suggesting that mathematics—long held as the pinnacle of logical certainty—itself cannot be both consistent and complete, reinforces the notion that purely “logical” approaches cannot capture the full range of linguistic and social nuances at play in law. …

Patient Autonomy And Treatment Adherence In Esrd:A Study Of Provider & Nurse Perspectives On Barriers And Choices, Christina A. Larkin Jan 2025

Patient Autonomy And Treatment Adherence In Esrd:A Study Of Provider & Nurse Perspectives On Barriers And Choices, Christina A. Larkin

Doctor of Nursing Practice Projects

Missed dialysis treatments are commonly attributed to barriers such as transportation, mental health challenges, and limited health literacy. However, emerging evidence highlights the complexity of adherence behaviors, including psychological, relational, and ethical dimensions that remain underexplored—particularly from the perspective of dialysis providers and nurses. This qualitative descriptive study examined how nephrology providers and dialysis nurses perceive barriers to adherence, with a focus on patient autonomy, motivation, and decisionmaking.

Using Self-Determination Theory (SDT) as a guiding framework, an anonymous, open- ended survey was distributed to 17 clinicians via the Qualtrics platform. Responses were analyzed using deductive content analysis, categorizing findings into …

A Critical Approach To Analyzing And Addressing Worldview-Based Cultural Conflict Between Indigenous Peoples And Western Science In Education And Research, Deborah H. Williams Jan 2025

A Critical Approach To Analyzing And Addressing Worldview-Based Cultural Conflict Between Indigenous Peoples And Western Science In Education And Research, Deborah H. Williams

Sabbatical Projects

Intercultural conflict exists in science education and research, I argue as a result of differences between the Western scientific worldview and the Indigenous worldview. Native Americans are the most underrepresented group in STEM, and this has been the case, in my personal experience for over two decades. Western science is not universal or acultural, Indigenous peoples have their own ways of knowing founded on different philosophical assumptions and recognizing metaphysical phenomena and explanations that are rejected by Western science and the positivist/post-positivist paradigm. Through the power of colonial privilege, scientists, science departments, and science disciplines have been able to erect …

Popularizing Autogestión: Punk, Zapatismo, And Anarchist Ethics In Mexico City, Livia K. Stone Jan 2025

Popularizing Autogestión: Punk, Zapatismo, And Anarchist Ethics In Mexico City, Livia K. Stone

Faculty Publications – Sociology and Anthropology

Autogestión (self-management), has been a popular articulation of radical politics since its emergence in the 1960s. This article examines how Mexico City's anarcho-punk scene transformed autogestión in the 1990s from an anarcho-syndicalist principle into a unique ethical practice detached from industrial material production. It was then popularized and made more mainstream through university rock festivals. As these were Zapatista benefit concerts, autogestión became inadvertently attached to Zapatismo and detached from anarchism and punk. This history is a crucial one for understanding the political development of an entire generation of the political left in Mexico City who were young in the …

Adopted Into Debt?, Grace Palcic Jan 2025

Adopted Into Debt?, Grace Palcic

Indiana Journal of Law and Social Equality

While adoption procedures differ from state to state, every state uses some variation of the best interest of the child standard to determine the outcome of an adoption proceeding. To gather information for the best interest determination, states have created the home study process to investigate prospective adoptive families. A home study allows social workers and/or private adoption agencies to look at the needs of the child, the ability of the parents to care for the child, the existing familial dynamics, the safety of the physical home, the perceived moral character and reputation of the parents, mental and physical health …

Navigating Food Justice: Addressing Student Food Insecurity Challenges And Successes, Jayden F. Beed

Undergraduate Theses, Professional Papers, and Capstone Artifacts

Food insecurity is a huge and often ignored wicked problem affecting college students across the United States. This capstone project explores the issue through the lens of food justice, which focuses on equitable access to nutritious food regardless of socioeconomic status or cultural background. Using the University of Montana Davidson Honors College as a case study, the project investigates student food insecurity, identifies systemic barriers, and outlines actionable strategies for addressing the issue on college campuses. At the center of this project is the creation of the UM Honors Food Pantry, developed by Jayden Beed in collaboration with the Davidson …

Student Perspectives Of The Value Of General Education In Professional Studies: Investigating A Law School In Bangladesh, Fahim Abid Abid, Mahbuba Kamal, Nisharga Nirjan Jan 2025

Student Perspectives Of The Value Of General Education In Professional Studies: Investigating A Law School In Bangladesh, Fahim Abid Abid, Mahbuba Kamal, Nisharga Nirjan

GHEA21 Open Educational Resources

Legal education in Bangladesh has undergone changes, but the integration of general education remains limited. Countries leading the global legal arena prioritize general education in their evolving education systems. However, stakeholders in Bangladeshi legal education have not advocated for significant curricular reforms, resulting in the absence of quality graduates. While some universities have implemented general education programmes, the lack of emphasis on student perspectives hinders progress. This research addresses this gap by investigating the value of undergraduate law students at BRAC University (a leading university in Bangladesh) on the general education curriculum. The study employs a mixed-methods approach, combining a …

“From Craft To Collection: A Conservation Case Study On A Prisoner Of War Napoleonic Bone Model Guillotine”, Anna Shobe Jan 2025

“From Craft To Collection: A Conservation Case Study On A Prisoner Of War Napoleonic Bone Model Guillotine”, Anna Shobe

Scripps Senior Theses

For my thesis, I have the ambition of creating a sort of guide on the treatment and analysis of this model guillotine, first by filling in some historical background about the object, informed by prisoner accounts and scholarship around similar Napoleonic bone models. As well as the materiality of the object, which will be discovered through instrumental analysis using a Microfadeometer to test for light sensitivity of the bone itself and the colored pigments present and a Scanning Electron Microscope/Energy Dispersive X-ray Spectroscopy to attempt to test for the classification of said pigments. These methods will not only inform the …

The Structure Of Universal History: An Architectural Analysis Of The Museo Nacional De Antropología, Stella M.W. Robinson Jan 2025

The Structure Of Universal History: An Architectural Analysis Of The Museo Nacional De Antropología, Stella M.W. Robinson

Scripps Senior Theses

The Museo Nacional de Antropología (MNA) is the largest and most frequently visited museum in Mexico. This monument to the splendor of Mexico’s pre-Hispanic past claims to document the entirety of Mexico's past and contemporary Indigenous heritage within its 25 archaeology and ethnography rooms However, the architects reduce Indigenous architectural features into symbols of the pre-Hispanic past in their idealization of a mixed-race (mestizo) heritage to promote the modern Mexican nation as the successors of the Mexica (Aztec) empire. My architectural analysis dissects the museum's claims of hybridity through comparing the structure to several architectural precedents, including the Maya pre-Hispanic …

The Adelante Academy: A Pathway To Success For Fgli Latine High School Students In Santa Ana, Ca, Seleny Arroyo Ms.

Scripps Senior Theses

My thesis project focuses on the diverse experiences of first-generation, low-income (FGLI) Latine high school students in the Adelante Academy, a rigorous university preparatory program at Fairview High School, from 2016 to 2021. Fairview High School is a public high school in Santa Ana, CA. Rather than focusing on tracking student performance and post-secondary outcomes, I center the experiences of students—their beliefs, ideologies, academic goals, and overall takeaways—of participating in the Adelante Academy. I employ a three-part macro-meso-micro framework to situate and better understand the experiences of FGLI Latine students in the Adelante Academy from 2016 to 2021. This thesis …

How Raciolinguistic Ideologies Shape Afro-Anglophone Caribbean Students' Negotiations Of Their Linguistic Identities, Merlyn Andrea Vanderstarre Jan 2025

How Raciolinguistic Ideologies Shape Afro-Anglophone Caribbean Students' Negotiations Of Their Linguistic Identities, Merlyn Andrea Vanderstarre

Theses, Dissertations and Culminating Projects

During the last and current century, the United States has witnessed an increasing upward trend in immigration from the racially and linguistically diverse English-speaking or Anglophone Caribbean (Lorenzi & Batalova, 2022). However, there needs to be more research on Afro-Anglophone Caribbean (AAC) students recounting their experiences in schools in the United States. Framed by a raciolinguistic perspective and post-colonial theory, this qualitative study captures the experiences of seven (7) student participants from four (4) academy high schools in an urban school district in the U.S. Northeast, who provided insights into their linguistic identities and experiences in high schools in the …

Welcoming Historically Under-Represented Groups In Higher Education Through Awareness Of Standard English Ideology, John Hellermann, Lynn Santelmann, Jennifer Mittelstaedt, Janet Cowal, Steven L. Thorne

Applied Linguistics Faculty Publications and Presentations

In the context of changing demographics at regional universities (including our own), we highlight an ongoing project at our university that addresses the last area of acceptable bias in English-medium higher education: bias against speakers of other languages and non-standard dialects of English. We discuss the hegemonic aspect of the Standard Academic English used by default at most US institutions of higher education and its role in potential discrimination against users of languages other than English and dialects other than the Standard. Data from over 2000 surveys, 55 follow up interviews, and three focus groups from faculty, staff and students …

Movement Public Health: Addressing The Links Between Public Health And Carceral Systems, Marie Fatima Hyacinthe Jan 2025

Movement Public Health: Addressing The Links Between Public Health And Carceral Systems, Marie Fatima Hyacinthe

Yale Graduate School of Arts and Sciences Dissertations

This dissertation is an interdisciplinary exploration of the links between public health and carceral systems, the connections between academic scholarship and advocacy, and the role of public health research in social justice movements. This dissertation begins with in-depth interviews with academic researchers and anti-carceral organizers, as well as analyses of my own experiences taking part in protests and mutual aid work, which ground conversations on the meaning of safety and care, and the role of public health. The second chapter is a systematic literature review and synthesis where I analyze academic literature about public health and carceral systems, assessing it …

Russian Forms: Race, Sex, And The Making Of Russian Literature, Fiona Bell Jan 2025

Russian Forms: Race, Sex, And The Making Of Russian Literature, Fiona Bell

Yale Graduate School of Arts and Sciences Dissertations

This dissertation argues that the elaboration of Russian racial imaginaries was coterminous with the construction of the Russian literary canon and Russian literary theory. Beginning with the global debates concerning the abolition of slavery and serfdom in the 1850s and concluding with the first wave of emigration from the Soviet Union in the 1920s, the dissertation demonstrates how canonical Russian authors—Ivan Turgenev, Fyodor Dostoevsky, Viktor Shklovsky, and others—wrote fiction that, in mobilizing the racial implications of intimacy, kinship, and heredity, articulated arguments about racial difference and the conceptual “fit” of “race” for the Russian Empire. Literary authors make arguments about …

Associations Between Mental Health Conditions And Adverse Pregnancy Outcomes Among Active-Duty Servicewomen, Laura Manzo Jan 2025

Associations Between Mental Health Conditions And Adverse Pregnancy Outcomes Among Active-Duty Servicewomen, Laura Manzo

Yale Graduate School of Arts and Sciences Dissertations

Active duty servicewomen (ADSW) have increased risk for mental health conditions compared to civilian women. Civilian research demonstrates that women with mental health conditions experience serious pregnancy complications at rates 50% higher than those without mental health conditions. Although mental health conditions are the leading underlying cause of maternal mortality, there is limited research on the prevalence of perinatal mental health conditions among active duty servicewomen (ADSWs) or their association with adverse pregnancy outcomes. This study aimed to explore associations of mental health conditions and adverse pregnancy outcomes in a population of ADSW. Methods Department of Defense Birth and Infant …

‘Soñando En Un Futuro Mejor’: U.S. Empire, Racial Capitalism, And Garífuna And Afro-Caribbean Radicalism In Caribbean Honduras, 1920-1963, Cristian Jose Padilla Romero Jan 2025

‘Soñando En Un Futuro Mejor’: U.S. Empire, Racial Capitalism, And Garífuna And Afro-Caribbean Radicalism In Caribbean Honduras, 1920-1963, Cristian Jose Padilla Romero

Yale Graduate School of Arts and Sciences Dissertations

This dissertation argues that Afro-Caribbean and Garífuna radicals in 20th-century Honduras forged, at different times, radical, race-conscious, and sometimes anti-imperialist and nationalist politics that contested both U.S. corporate domination and the racialized exclusions of the U.S and Honduran nation-state. Focusing on the period between 1920 and 1963, it traces struggles across the Caribbean coastal cities of La Ceiba, Trujillo, Puerto Cortés, and Tela. By foregrounding Black and Indigenous working-class actors, like Centeno García and Alfonso Lacayo, it highlights how racial capitalism, labor radicalism, and anti-Black state and corporate repression intersected in Honduras’ banana economy. The stories of individuals like Centeno …

Research Manuscript Series

This report covers the archaeological investigations at site 38BU1834, which falls within the boundary of the Charlesfort/Santa Elena National Historic Landmark on Parris Island, South Carolina. Initial investigations involved a search for activity areas associated with the Spanish pottery kiln discovered in 1993 near the golf course clubhouse. Later work on the site focused on a pond or sinkhole containing a deposit of World War I era U. S. Marine Corps trash and the prehistoric period earth and shell mounds that line the periphery of the pond/sinkhole.

Disorienting "Western" Viewers With Nacer Khemir's Desert Trilogy, Kristian Peterson Jan 2025

Disorienting "Western" Viewers With Nacer Khemir's Desert Trilogy, Kristian Peterson

Philosophy Faculty Publications

In this essay, I explore tensions that arise when creating alternative cinematic visions of Muslim life, specifically frictions emerging from the goal of shifting public perception of the community and patterns of self-orientalization. Here, I complicate assumptions about the representation of Islam by looking at a self-articulated presentation of Muslims through the narrative feature series the Desert Trilogy, by Tunisian director Nacer Khemir (born 1948). I argue that Khemir is ensnared by ahistorical Islamic nostalgia and largely reinforces romantic orientalist aesthetics in his films. While his portrait of Muslims is much more “positive” than those in the broader archive, it …

Unveiling Raciolinguistic Ideologies: Pre-Service Teachers’ Insights On Refugee Integration In Schools, Tuba Yilmaz, Rosanna Ellis

Australian Journal of Teacher Education

This study investigates pre-service teachers' ideologies about refugee students' belonging and integration in Türkiye and examines how these ideologies shape their anticipated pedagogical practices. Using the framework of raciolinguistic ideologies, the study highlights how linguistic and cultural hierarchies influence educational practices, often perpetuating systemic exclusion. Data were collected through in-depth interviews with 13 pre-service teachers from various educational programs, utilizing a qualitative, phenomenological design. The findings reveal a predominant reliance on deficit-based perspectives, with refugee students framed as linguistically deficient and culturally "othered." While participants expressed professional commitments to inclusivity, their approaches often emphasized assimilation into Turkish norms, reflecting cultural …

Impact Of Academic Advising On Student Satisfaction And Persistence, Michelle Pickett Jan 2025

Impact Of Academic Advising On Student Satisfaction And Persistence, Michelle Pickett

Dissertations of Practice

Enhancing college student success is a critical challenge for higher education. Traditionally measured by retention and graduation rates, student success is now viewed through a more holistic lens. This dissertation of practice examines the impact of developmental academic advising on student satisfaction and persistence at a four-year regional public university in the Midwest, focusing on first-year students. Using a quantitative approach, this study addresses gaps in the literature by examining the impact of developmental advising on student satisfaction and persistence.

Findings indicate that while developmental academic advising positively impacts student satisfaction with their advising experience, it does not significantly influence …

Through Their Own Eyes: A Mixed Methods Study On Perceptions And Reflections Of Culturally Responsive Teaching Self-Efficacy Of North Carolina Elementary School Teachers, Bria C. Wright

Doctor of Education Dissertations

Historical inequities disproportionately impacting historically marginalized communities continue to persist in classrooms today. Culturally responsive teaching plays an important role in addressing these inequities by recognizing and affirming diverse cultural identities. The purpose of this study was to explore elementary school teachers’ culturally responsive teaching self-efficacy (CRTSE) perceptions. This mixed methods convergent parallel study examined CRTSE across five domains: culturally congruent instruction, cross-cultural communication, culturally relevant curricula, cultural diversity knowledge, and cultural caring learning communities. Quantitative data were collected from 147 North Carolina elementary teachers using the CRTSE Scale, and qualitative data were gathered through semi-structured interviews with 16 participants. …

Understanding tropical climatology is essential to comprehending the atmospheric connections between the tropics and extratropical latitudes weather and climate events. In this review paper, we emphasize the advances in key areas of tropical climatology knowledge since the end of the 20th century and offer a summary, assessment, and discussion of previously published literature. Among the key areas analyzed here, we explore the advances in tropical oceanic and atmospheric variability, such as El Niño–Southern Oscillation and the Madden-Julian Oscillation, and how those teleconnection events have helped us to better understand variabilities in tropical monsoons, tropical cyclones, and drought events. We also …
