Trust In Science: The Crisis Of Expertise As An Ideological, And Not Only A Scientific Controversy, David S. Caudill Jan 2022

Trust In Science: The Crisis Of Expertise As An Ideological, And Not Only A Scientific Controversy, David S. Caudill

Faculty Publications

Within the so-called "culture wars" dividing our nation politically, there is a law-related division over the trustworthiness of consensus science-the so-called "crisis of expertise." When the science concerning climate change, mask-wearing, or vaccinations becomes politicized, it loses its mooring in scientific evidence and impacts the effectiveness of regulatory law. Perhaps counter-intuitively, however, the solution is likely not to wear "Because Science" t-shirts while insisting on "cold, hard facts" and diagnosing as stupid those who believe the scientific theories of marginalized, minority-view scientists. Indeed, a certain level of modesty-regarding the uncertainties and tentativeness of even the best science-is necessary for the …

Disarmament, Demobilization, And Reintegration In Colombia: Lost Human Rights Opportunities For Ex-Combatants With Disabilities, Minerva Rivas Velarde, Janet E. Lord, Michael Ashley Stein, Thomas Shakespeare

Articles

This article examines whether and how the circumstances of Colombian ex-combatants with disabilities were recognized in the disarmament, demobilization, and reintegration (DDR) processes in the period following the adoption of the 2016 peace agreement. Our results suggest severe procedural and substantive shortcomings during the drafting of the peace agreement and the implementation of the DDR processes that exacerbated the exclusion of ex-combatants with disabilities from available opportunities for their social, economic, and political reintegration. We conclude that a better understanding of the disabling impact of conflict and the exp

Aging In Nigeria: A Growing Population Of Older Adults Requires The Implementation Of National Aging Policies, Kingsley Chima Mbam, Cal J. Halvorsen, Uzoma Odera Okoye Jan 2022

Aging In Nigeria: A Growing Population Of Older Adults Requires The Implementation Of National Aging Policies, Kingsley Chima Mbam, Cal J. Halvorsen, Uzoma Odera Okoye

Harvey A. Friedman Center for Aging

While the continent of Africa currently has the lowest share of adults aged 60 and older in its population among all world regions, the total number of older Africans is projected to triple between 2020 and 2050. Nigeria—Africa’s leading economy and most populated country—has the highest number of older people in the continent and the 19th highest across the globe, with the population of Nigerians aged 65 and older projected to nearly triple by 2050. However, the increase in older Nigerians is occurring against the backdrop of extreme poverty, unsolved development problems, socioeconomic inequality, the HIV/AIDS epidemic, and a decline …

Blast Zone, Eleanor M. Thorp

Theses and Dissertations

My works emphasize the animistic qualities of extracted or displaced stones. This paper will explore my practice in relationship to practices of image reading, and drawing images within images, particularly rocks. I will use traditions of landscape painting, geological study, and Persian image making to talk about displacement of materials and stones.. I will explain how viewers can be trapped inside of the rock and my use of pastels, rock mediums, colored pencils, and my fingers to build these rocky landscapes.

Cadent Diffusion: Permeating The Membrane, Isabella M. Kubo Jan 2022

Cadent Diffusion: Permeating The Membrane, Isabella M. Kubo

Theses and Dissertations

cadent diffusion: permeating the membrane explores and documents KUBO's journey of cultivating a sustainable and curious artistic practice during their Master’s program in Richmond, Virginia (Powhatan Land) from the Fall of 2020 to the Spring of 2022.

KUBO's practice is the affirmation between life and change in an attempt to work along the forces of singularity; to free lines, scores, concepts, and events from structures that otherwise bind them. The cadent diffusion is the rhythm in this force. Or perhaps, it is the force itself.

A Gun For Every Woman, Gentë Retkoceri Jan 2022

A Gun For Every Woman, Gentë Retkoceri

Theses and Dissertations

Six centuries ago in Kosova, my home country, unmarried women known as sworn virgins, were forced to adopt a male persona and carry a gun to protect themselves. But today, guns have become tools of oppression and violence against women. And while the legal system carries penalties for domestic violence, marital rape is excluded. To shine a light on, and expose the topic of hidden violence, my thesis uses artivism to address a sensitive but provocative issue, exhibiting a large-scale sculpture of a gun, designed to provoke raw emotions; to challenge visitors to consider the terror felt by women threatened …

Stakeholder Knowledge And Perceptions Of Free-Roaming Equids And Their Management At A Western U.S. Land-Grant University, Hollee S. Wood, S. Nicole Frey, Terry A. Messmer

Human–Wildlife Interactions

The horse (Equus ferus caballus), originally native to North America, became extinct on the continent approximately 10,000 years ago. Horses that migrated from North America to Eurasia across the Bering Strait continued to evolve and were domesticated along with burros (E. asinus). Both species were then transported to the Americas where they were intentionally released or escaped into the wild, forming feral herds. The Wild Free-Roaming Horses and Burros Act of 1971 (WFRHBA) provided federal oversight and protection for feral horses and burros (hereafter, free-roaming equids) that inhabited designated areas on public lands in the western …

The Perspective Of Riverkeepers And Environmental Groups On Poor Water Quality In Georgia, Jacob A. Crawford Jan 2022

The Perspective Of Riverkeepers And Environmental Groups On Poor Water Quality In Georgia, Jacob A. Crawford

College of Graduate Studies: Theses & Dissertations

Riverkeepers and environmental groups currently face the complex task of defending watersheds. In Georgia, these efforts are complicated by the vast geographical and racial diversity within the state. This study examined the riverkeepers and environmental groups need to improve advocacy abilities to defend communities they serve from poor water quality, what communities in Georgia are being impacted by poor water quality, what disconnects exist between riverkeepers, environmental groups, and governmental agencies, and how COVID-19 has challenged the riverkeepers and environmental groups. Using qualitative interviews with eleven riverkeepers and environmentalists, the findings suggest that collaboration with riverkeepers, enforcement of current policy, …

Secondary English Teachers’ Experiences Of Agency: Connections To Shifting Educational Contexts During Covid-19, Kristina Lee

Theses and Dissertations

The COVID-19 pandemic caused schools around the world to enter uncharted territory. Due to the unprecedented nature of the educational crisis, it was important to examine how teacher agency may have been affected. Teacher agency can have important implications for school climate, policy, and the experience of stakeholders. The main focus of this study was to cultivate an understanding of secondary English teachers’ perceptions of agency as they navigated teaching throughout the COVID-19 pandemic. An ecological framework was used to examine teachers’ experiences of agency in the context of COVID-19. The study utilized a basic qualitative design with in-depth interviews …

Establishment’S Political Priority To Free Exercise, Marc O. Degirolami Jan 2022

Establishment’S Political Priority To Free Exercise, Marc O. Degirolami

Faculty Publications

Americans are beset by disagreement about the First Amendment. Progressive scholars are attacking the venerable liberal view that First Amendment rights must not be constricted to secure communal, political benefits. To prioritize free speech rights, they say, reflects an unjust inflation of individual interest over our common political commitments. These disagreements afflict the Religion Clauses as well. Critics claim that religious exemption has become more important than the values of disestablishment that define the polity. Free exercise exemption, they argue, has subordinated establishment.

This Article contests these views. The fundamental rules and norms constituting the political regime—what the Article calls …

Preventing Kernicterus: Racial Equity For Neonatal Jaundice, Sarah Christensen Jan 2022

Preventing Kernicterus: Racial Equity For Neonatal Jaundice, Sarah Christensen

Doctor of Nursing Practice Projects

Neonatal jaundice is a common phenomenon among infants worldwide but the condition may progress to severe hyperbilirubinemia and if this progression is left unchecked, kernicterus may result. Kernicterus is the result of bilirubin toxicity that has reached the brain. It may result in irreversible hearing loss, brain damage, and death. Black and African American infants represent twenty five percent of reported kernicterus cases in the United States. This racial health disparity represents a practice gap that this project aims to highlight and address through provider education. Midwives and paraprofessionals at a midwifery organization in the Pacific Northwest were invited to …

Multilayered Agency And Religion: A Study Of The Catholic Bishops Conference Of The Philippines (1986–1998), Christian Santos

Theses

The present thesis examines the core issue of how to understand and situate the agency of a religious actor in International Relations (IR). This is investigated through a case study of the Catholic Bishops Conference of the Philippines (CBCP) in two comparative policy contexts: agrarian land reform and family planning. The CBCP is a permanent institution within the Catholic Church as a collective of the bishops of the Philippines. The research employs analytic eclecticism as the method to integrate select works from four principal scholars: Colin Wight, Adrian Pabst, Atalia Omer and Mariano Barbato. Wight’s tripartite multilayered framework of agency …

Civil Rights In Times Of Uncertainty (The Anthropocene), Jeffrey Omari Jan 2022

Civil Rights In Times Of Uncertainty (The Anthropocene), Jeffrey Omari

Law Faculty Scholarship

Although there have been significant civil rights gains made in recent decades, the United States is now experiencing a resurgence of many of the societal ills that have plagued the country for decades. From an insurrection that was seemingly inspired by white supremacist ideology to ongoing examples of police brutality against Black people, anti-Asian violence, anti-LGBTQ violence, and recurring islamophobia, the country sits at an apparent crossroads. There is an urgent need to advance a civil rights agenda that addresses the impact of these societal ills on the affected communities. At the same time, however, we are confronting these ills …

The Effects Of Cultural Competency Training On Providers Knowledge, Skills And Attitudes Towards The Latino Population, Jennifer L. Peppiatt

DNP Projects

Background: Providers in the United States (U.S.) healthcare system need to understand the cultural values, beliefs, and traditions of the growing Latino population. As a result, academic institutions are incorporating cultural competency training in their curricula. However, a noticeable knowledge gap exists for those currently practicing in the healthcare arena, impacting patient and provider satisfaction and healthcare outcomes.

Purpose: The purpose of the study was to obtain a baseline assessment of the cultural competence of a select group of Advanced Practice Providers (APPs) caring for the Latino population at the University of Kentucky and provide a targeted educational intervention, followed …

A Human Rights Approach To Cultural Property: Repatriating The Yaqui Maaso Kova, Kristen A. Carpenter Jan 2022

A Human Rights Approach To Cultural Property: Repatriating The Yaqui Maaso Kova, Kristen A. Carpenter

Cardozo Arts & Entertainment Law Journal

The article argues that current legal frameworks for repatriating cultural property, such as the 1970 UNESCO Convention, are insufficient because they are state-centric and fail to address the rights and interests of Indigenous Peoples. It advocates for a human rights approach, emphasizing the UN Declaration on the Rights of Indigenous Peoples, to remedy past injustices and ensure the repatriation of sacred objects like the Yaqui Maaso Kova. This approach prioritizes Indigenous Peoples' rights to religion, culture, and self-determination over state interests.

Nong Hin District in Loei Province was chosen to be the study site. The study was conducted in three seasons: winter, summer and monsoon. There were three experiments in each season: 1) non-relocation (control), 2) relocation from an indoor to an outdoor condition, and 3) refrigeration before relocation. There …

United States Immigration Law As A Social Determinant Of Health: A Mixed-Methods Systematic Review, Natalia Castellanos González Jan 2022

United States Immigration Law As A Social Determinant Of Health: A Mixed-Methods Systematic Review, Natalia Castellanos González

Public Health Theses

Background: Rapidly changing immigration policies and anti-immigrant rhetoric have impacted the services available and the health outcomes of undocumented immigrants. Research focusing on the health of noncitizens usually employs a cultural frameworks approach, focusing on individual behaviors or outcomes rather than structural barriers and limitations. This analysis is not adequate for explaining the origins of community-level and structural inequities, and there are existing gaps in research documenting the ways in which policies and changes impact immigrants’ health-seeking behaviors and overall health. Methods: This thesis employed a mixed methods-mixed research synthesis approach to carry out a systematic review. Article selection followed …

Prescriptive Faith: Carceral Health Beyond The Prison Walls, Shamar S. Smalls Jan 2022

Prescriptive Faith: Carceral Health Beyond The Prison Walls, Shamar S. Smalls

Public Health Theses

Individuals who are exposed to the carceral system—specifically, solitary confinement are uniquely vulnerable to psychological and physical health conditions. However, the relationship between solitary confinement and physical health conditions are relatively underexamined, compared to mental health disorders. This analysis examines the potential for a risks’ association between solitary confinement and cardiovascular disease risk factors. Additionally, this study examines the relationship between spirituality as a self-efficacious coping measure for health-related outcomes. A cross-sectional analysis of 302 survey participants with a prior history of incarceration in a housing study (New Haven, CT) with a prior history of incarceration from Fall 2017 – …

Synergistic Epidemic: A Case Study Of Covid-19 And Substance Use Disorder In New London, Ct, Mary Tate Jan 2022

Synergistic Epidemic: A Case Study Of Covid-19 And Substance Use Disorder In New London, Ct, Mary Tate

Public Health Theses

The onset of the COVID-19 pandemic in March 2020, complicated the already ineffectual delivery of health care for historically hard-to-reach populations. Those who face housing insecurity, substance use disorders, unemployment, or uncertain immigration and insurance status were abandoned, as the mainstream U.S healthcare system struggled to cope under the pressure of the novel virus. While parallel public health crises were put on hold to deal with COVID-19, the pandemic collided with and exacerbated the ongoing opioid crisis. Using New London, CT as a case study, this project set out to address a gap in literature on the potential syndemic effect …

Cherokee Abstract Artist Leon Polk Smith: A Convergence Of Traditions, Danielle Montanino

Dissertations and Theses

This paper analyzes how Leon Polk Smith's Indigenous roots and upbringing in Indian Country had a significant impact on his artistic practice in a time of discrimination and segregation in the United States. Through examination contextualizing his work within the history and political events of the Cherokee, Chickasaw, and Choctaw Nations it is revealed how Polk Smith developed a formal language that could navigate both worlds and be viewed through a pure abstraction lens or a lens embodying his Indigenous traditions. In addition to his Indigenous philosophies, Mesoamerican Inca Nation’s cultural motifs further ground Polk Smith’s Indigenous aesthetic, and avant-garde …

African American English As A Predictor Of Ethnic And Ethnolinguistic Identity In Adolescence, Giahna L. Glasco

Dissertations and Theses

This study’s purposes were to provide support for the Social identity theory of African American English (Vietze & Glasco, 2022) and the meanings African American English (AAE) speakers assign to their dialect. The study was primarily based on Tajfel’s (1979) social identity theory that proposes individuals derive a sense of self from group membership. The qualitative analyses examined ethnic and language group memberships. Ethnic identity development (Phinney, 1992), and ethnolinguistic identity theories (Giles and Johnson, 1987) guided narrative and content analyses of Kiese Laymon’s memoir, Heavy: An American Memoir (Laymon, 2018). The sample included 21 African American English conversations …

The Real And The Digital: Female Agency And Resisting The Male Gaze In Lynn Hershman Leeson’S Works, Kelly Chou

Dissertations and Theses

This thesis focuses on three major feminist works by multimedia artist, Lynn Hershman Leeson (b. 1941), that grapple with the construction and potential of female identity. Considering the works within the context of Laura Mulvey’s seminal text “Visual Pleasure and Narrative Cinema,” this paper will attempt to elucidate how Hershman Leeson’s works have engaged with the male gaze and its social and cultural implications on female identity in visual spheres. This research demonstrates how Hershman Leeson’s efforts to understand the limitations and boundaries for women reflect the same phenomenons observed by Mulvey within “Visual Pleasure.” Rejecting this, Hershman Leeson also …

Coupled Structure-Function Responses To Disturbance: High Structural Complexity Resistance Supports Primary Production Resistance, Kerstin M. Niedermaier Jan 2022

Coupled Structure-Function Responses To Disturbance: High Structural Complexity Resistance Supports Primary Production Resistance, Kerstin M. Niedermaier

Theses and Dissertations

The capacity of forests to resist structural change and retain material legacies–the biotic and abiotic resources that persist through disturbance–is crucial to sustaining ecosystem functioning after disturbance. However, the role of forest structure as both a material legacy and feature supporting carbon (C) cycling stability following disturbance has not been widely investigated. We used a large-scale disturbance manipulation to ask whether LiDAR-derived canopy structures as material legacies drive 3-year responses of NPP to a range of disturbance severity levels. As part of the Forest Resilience Threshold Experiment (FoRTE) in northern Michigan, USA we simulated phloem-disrupting disturbances at a range of …

Associations Between Years Of Teaching Experience And Classroom Management Practices, Responsivenss, And Acceptability To A Coaching Intervention, Nicole M. Peterson

Theses and Dissertations

This study aimed to bridge the research-to-practice gap related to in-service supports and professional development by identifying factors associated with teacher use of evidence-based classroom management practices and responsiveness to a coaching intervention. Years of teaching experience was identified as a teacher-level intervention determinant with a strong research base in the classroom management literature; however few studies used direct observation of behavior to report difference among teacher behavior. This study used quantitative statistical methods to analyze data from a multi-year parent study investigating the effects of a coaching intervention (BEST in CLASS-Elementary) aimed at increasing the use of evidence-based practices …
