Engaging With Abdullahi An-Na'im's Philosophy On Islam And Human Rights, Mashood A. Baderin

Emory International Law Review

Abdullahi Ahmed An-Na‘im is one of the leading scholars and contributors on the subject of Islam and human rights. In fact, he remains one of the most cited authorities in the subject area. His contributions on the subject span more than three decades during which he has engaged with almost every topical issue on the subject. He has been described as one of the non-Western jurists from “the South” “who ha[s] made substantial contributions to the theory and practice of human rights” generally.

There can be little doubt that Abdullahi An-Na‘im has been one of the most influential voices on …

This perspective provides an analytical tool to understand the importance of preserving and empowering diverse cultures and peoples. In a globalized world, there is an increasing recognition of the contributions of diverse cultures and nations, including indigenous, to the economic development and the cultural heritage of humankind. The Article focuses on the importance of the resolution of a historical and ongoing ethnic conflict between the people of Tawantinsuyu, especially the Quechua and Aymara, and the descendants of Spanish conquistadores who continue to pursue policies to …

The Disaster Chain: Counter-Mapping Global Value Chains, Peer Zumbansen Jan 2022

The Disaster Chain: Counter-Mapping Global Value Chains, Peer Zumbansen

Northwestern Journal of International Law & Business

Abstract: Prevailing accounts by consultancies and logistics scholars present global value chains [GVCs] as an expression of contemporary international economic integration and connectivity. As such, they are considered crucial to the pursuit of economic growth and prosperity. At the same time, GVCs are deemed susceptible to “disruptions” through natural catastrophes, restrictive trade policies or pandemics. Left out of the standard narratives, even in light of the experience of the global Coronavirus pandemic, is the actual, as such disruptive impact of global value chain capitalism on human and natural lives. Dominant depictions of global value chain governance treat labor, environment and …

Persecution And Labor Migrations Due To Corporate “Environmental” Exploitation: Waiting For The Unhrc’S Binding Treaty On Transnational Business Activities?, Riccardo Vecellio Segate Jan 2022

Persecution And Labor Migrations Due To Corporate “Environmental” Exploitation: Waiting For The Unhrc’S Binding Treaty On Transnational Business Activities?, Riccardo Vecellio Segate

Loyola University Chicago International Law Review

Policy debates on the rights and international status of climate refugees, environmental migrants, or environmentally displaced persons have unleashed detailed scholarly commentaries over the last decade, and virtually all standpoints have been scrutinized in literature already. Nevertheless, one aspect of this debate has gone somewhat off the radar in recent years: the (co-)responsibilities of incorporated subsidiaries of transnational corporations in triggering or exacerbating pseudo-environmentally motivated mass-movements of workers and related strata of the populations domiciled where these corporations operate. Despite such neglect, mentioned exploitative occurrences only increased in recent years, and the trend speaks for their further expansion …

The Temporality Of Law In Traditional China And Its Contemporary Implications, Tao Wang Jan 2022

The Temporality Of Law In Traditional China And Its Contemporary Implications, Tao Wang

Loyola University Chicago International Law Review

Temporality of law is of great significance in traditional Chinese juridicopolitical thought, and its influence plays a crucial role in China's state building and governance. The existing temporal phrases from the West are not sufficient for explaining the symbol-oriented legal system in traditional China. Formalist law overlooks the temporal elements intrinsic to the legal system and results in the failure of governance. This Article applies a historical culture paradigm to analyze the temporality of law in traditional China by using plurality, sociality, and rhetoric as indicators to demonstrate the contestation of temporal categories in penality, socialization of seasonal time, and …

Ground Penetrating Radar And Public Archaeology At Eastonville Memorial Gardens Cemetery, Richard Ott Jan 2022

Ground Penetrating Radar And Public Archaeology At Eastonville Memorial Gardens Cemetery, Richard Ott

Electronic Theses and Dissertations, 2020-2023

This thesis explores the intersection of geophysical prospection methods such as ground penetrating radar (GPR) and public archaeology through a case study with the descendant community of Eatonville Memorial Gardens, an African American cemetery located in Central Florida. This moves beyond traditional uses of GPR, such as focusing on locating unmarked burials by engaging the descendant community in each stage of the research project. This expanded focus is advocated for because cemeteries serve as ancestral landscapes providing such communities with a sense of place and history. The maintenance and care of such places often reflect the same social conditions affecting …

La Olla Y Los Patios: An Ethnography Of Place, Selfhood, Violence, And Rehabilitation In Bogotá, Andrés Romero Jan 2022

La Olla Y Los Patios: An Ethnography Of Place, Selfhood, Violence, And Rehabilitation In Bogotá, Andrés Romero

Wayne State University Dissertations

In the early hours of May 28, 2016, the mayor of Bogotá, along with the Colombian military and SpecialForces, seized the biggest olla or open-air drug market in Colombia at the time. The olla known as “El Bronx” was a three-block area in downtown Bogotá and where over 2,000 people found shelter under the authority of paramilitary affiliated crime bands controlling the city’s drug trade. Widely depicted by the media and the broader polity as an “inferno,” El Bronx was regarded as a space where those socially relegated outside of the human were encumbered by seemingly endless transgression and drug …

Preparation programs can develop educator capacity to implement frameworks to support students with high-intensity needs (HIN) through Virtual Mentor Demonstration Sites (MDS) which provide an opportunity to highlight High Leverage Practices within an multi-tiered system of supports (MTSS). Utilizing MDS can grow and sustain educator capacity by showcasing exemplar practices and highlighting student results in high-need schools. Focused on improving outcomes of students through collaboration of special educators and related service providers (e.g., school psychologists, speech-language pathologists), an innovative personnel preparation program developed a network of MDS designed to scale-up knowledge and skills gained through participation in an interdisciplinary graduate …

Symposium: Can Intellectual History Be Done Otherwise?, Mohamed Arafa, Shahzad Bashir, Nader El-Bizri, Nauman Faizi, Lena H. Salaymeh Jan 2022

Symposium: Can Intellectual History Be Done Otherwise?, Mohamed Arafa, Shahzad Bashir, Nader El-Bizri, Nauman Faizi, Lena H. Salaymeh

Faculty & Staff Publications

Using Shahzad Bashir’s open-access publication A New Vision for Islamic Pasts and Futures as a baseline, this symposium debates whether and how intellectual history can be done otherwise. Mohamed ‘Arafa follows Bashir’s invitation to explore the potential of open-ended historiographies when he thinks about the viability of a flexible method to interpret Sharī͑a. Nader El-Bizri interrogates whether the assemblage of personal experiential accounts offered by Bashir can be framed within the discourse of intellectual history at all. Nauman Faizi reads Bashir’s approach as a radical attempt to open up hermeneutical possibilities. Lena Salaymeh suggests that modern aesthetics can contribute to …

Water Disconnection And Billing Policy In Central Illinois, Melissa Heil, Rebekah Bollin, Luke Gallagher Jan 2022

Water Disconnection And Billing Policy In Central Illinois, Melissa Heil, Rebekah Bollin, Luke Gallagher

Faculty Publications - Geography, Geology, and the Environment

Over ten percent of American households face unaffordable water bills. When households have overdue bills, they are usually subjected to service disconnection by the water utility. Water disconnection policy is set at the local level, which can result in spatial variation with respect to how lenient or strict disconnection policies are. Examining the case of the central Illinois region, this paper introduces a methodology for 1) chronicling this variation and 2) analyzing which populations are most affected by strict billing and disconnection policies.

Strengthening An Understanding And Practice Of Spiritual Transformation For Sunday School Teachers Of Ellis Chapel Baptist Church, Patterson Springs, Nc, Linda Williams Lockhart Jan 2022

Strengthening An Understanding And Practice Of Spiritual Transformation For Sunday School Teachers Of Ellis Chapel Baptist Church, Patterson Springs, Nc, Linda Williams Lockhart

Doctor of Ministry Projects

The spiritual formation process can be clearly viewed through the lives of those who lived during the biblical era. People desire to change; however, the problem is that they do not know how because training in the spiritual formation process is not present within many churches today. This project was designed to train selected Sunday School teachers of Ellis Chapel Baptist Church through a four-week spiritual transformation process, hoping to strengthen their understanding of becoming image-bearers and practitioners of the Gospel that Jesus taught and exemplified. Through utilizing spiritual disciplines in journaling, training sessions, and assessments, selected teachers became aware …

A Program Of Race Betterment: The Emergence And Evolution Of Eugenic Ideas In Michigan, Branden Mceuen Jan 2022

A Program Of Race Betterment: The Emergence And Evolution Of Eugenic Ideas In Michigan, Branden Mceuen

Wayne State University Dissertations

Contemporary concerns with technologies like CRISPR and the proliferation of state laws restricting abortion have led people to wonder if we are witnessing a return of eugenics. I analyze the development and evolution of eugenic ideas and policies throughout the 20th century, using the state of Michigan as a frame of reference. In examining the eugenic theories and policies psychiatrists and physicians endorsed, I demonstrate that eugenics was a key component of preventive public medicine in the first two decades of the 20th century. I show how they educated the public on eugenics based on both environmentalist and hereditarian ideas …

An Unchanted Life Of Self-Silencing An Artifactual Autoethnography Introducing “Trauma-Induced Subconscious Self-Silencing”, Katherine L. Olson Jan 2022

An Unchanted Life Of Self-Silencing An Artifactual Autoethnography Introducing “Trauma-Induced Subconscious Self-Silencing”, Katherine L. Olson

All Graduate Theses, Dissertations, and Other Capstone Projects

Why do we say we’re fine when we’re not? To others and to ourselves? Why does our body nonverbally communicate socioculturally derived “normalcy” and wellbeing when we feel horrible? And why might we ignore messages our body tries to send us? Why do we silence ourselves? These questions transcend interpersonal communication and point at intrapersonal denial of embodied struggle. Using a new method, artifactual autoethnography, I attempt to understand self-silencing behavior through a communicative perspective and assess why self-silencing behavior is so difficult to break. I revisit a novel I wrote when I was 16 years old, Unchanted, to see …

Challenges In Adoption Of Knowledge Sharing Within Logistics In The U.S. Army, Johnny Felix Charles Jan 2022

Challenges In Adoption Of Knowledge Sharing Within Logistics In The U.S. Army, Johnny Felix Charles

Walden Dissertations and Doctoral Studies

U.S. Army leadership published doctrinal directives regarding knowledge management and knowledge sharing principles for organizational implementation. Despite implications for the national security mission of the Army, the logistic community has not uniformly executed these principles. The purpose of this study was to determine why Army logisticians have not uniformly adopted knowledge sharing. The conceptual framework for this explanatory case study consisted of the Baconian method of research-then-theory using abductive reasoning. The research question was used to examine the possible challenges facing logisticians in the adoption and implementation of knowledge sharing. The conceptual lens for this framework comprised recording adequate engagement …

Innate Property: The Danger Of Incongruency Between Law And The Biological And Behavioral Roots Of Property And Possessiveness, Aaron Schwabach Jan 2022

Innate Property: The Danger Of Incongruency Between Law And The Biological And Behavioral Roots Of Property And Possessiveness, Aaron Schwabach

Cardozo Law Review de•novo

Property law is, in some areas, dangerously out of step with property expectations. Property—the idea that a place, object, or idea can belong to a person—is at the root of the world’s economies and thus also at the root of much of its laws. Property is neither solely a creature of positive law, nor of some abstract natural law with a moral underpinning, but rather may be biologically determined, much as Noam Chomsky proposed for languages in Aspects of the Theory of Syntax.1 The idea that ownership is at least behaviorally, and perhaps to some extent instinctively, determined has been …

Built Environment And Well-Being Of Stem Women Employed In The Petroleum Sector, Natalie Robinson Jan 2022

Built Environment And Well-Being Of Stem Women Employed In The Petroleum Sector, Natalie Robinson

Walden Dissertations and Doctoral Studies

Male-dominated occupations have received increased attention concerning the environmental health and retention of its specialized workforce. Research studies on the impact of the environment suggest that ecological and infrastructure conditions of the workplace affect the psychological health and physical well-being of employees across both public and private industries. Presently, in the context of the oil and gas and engineering field, there is a literature gap in exploring whether workplace conditions or adverse circumstances in male-dominated built environments negatively affect the psychological well-being and retention of women employed in Science, Technology, Engineering, and Math (STEM) occupations. For the current qualitative study, …

Motivational Communication Strategies For Virtual Teams, Monica Metri Jan 2022

Motivational Communication Strategies For Virtual Teams, Monica Metri

Walden Dissertations and Doctoral Studies

Organizational leaders may not communicate effectively to motivate their virtual teammembers to achieve goals. Leaders who lack communication strategies to motivate virtual team members can lead to dissatisfied employees and increased timelines to achieve project goals for their organization. This may adversely impact the accurate and timely achievement of goals, reducing profits and thereby, shareholder returns. Grounded in Herzberg's two-factor theory, the purpose of this multiple case study was to explore leaders' communication strategies to motivate virtual team members to achieve project goals. The participants consisted of eight virtual team leaders in the northeastern United States who successfully implemented communication …

The Ceramic Sequence For Vista Alegre, Quintana Roo, Mexico., Carrie Tucker

Electronic Theses and Dissertations, 2020-2023

This thesis creates a ceramic chronology for the site of Vista Alegre, a Middle Preclassic-Postclassic Maya port site on the northern coast of Quintana Roo, Mexico. As a member of the Proyecto Costa Escondida (PCE), I analyzed a sample of ceramic material (14,326 sherds) from three off-structure test units and their extensions (Pozos 8, 8A, 10, 12, 12A, and 12B). I completed "type: variety-mode" identification for 13,114 identifiable sherds with the help of the PCE and the Yucatán INAH ceramoteca facility, and I found a total of 101 established ceramic types and varieties, and twenty-five "specials" for which only the …

Assessing Patient Safety Culture In United States' Hospitals, Abdulmajeed Azyabi

Electronic Theses and Dissertations, 2020-2023

Patient safety is founded on continuous learning because there is an urgent need to report and learn from errors, accidents, near misses, and adverse events. The traditional approach to patient safety, based on forming mortality committees and investigating accidents, will no longer be effective. Frameworks, surveys, and assessment tools have been developed over the last decade to assist organizations in measuring and understanding their culture. This a retrospective cross-sectional study included 67,010 respondents from Agency for Health care Research and Quality (AHRQ) 2018 comparative database was analyzed using partial least squares structural equation modeling (PLS-SEM). This research explored whether the …

Teaching Sustainability: Does Style Matter?, Fethiye Ozis, Shannon Lynn Isovitsch Parks, Deborah Sills, Mustafa Akca, Christine Kirby

Faculty Journal Articles

Purpose – This paper aims to analyze how a tangram activity improved students’ abilities to explain sustainability, articulate a positive perception of sustainable design and relate sustainability with innovation in engineering design. Design/methodology/approach – The concept of paradigm shift was introduced in the classroom by using a tangram activity to help students understand that sustainable design requires out-of-the-box thinking. Instructors from three institutions teaching various levels of sustainability courses to engineering majors used the activity to introduce sustainable design, then measured the understanding and appreciation of the concepts introduced through the tangram activity with pre- and post-activity surveys. Findings – …

Sheltered Cohort: A Restorative Approach To Relational Conflict And Disempowering Policies At A Men’S Homeless Shelter, Shaun A. Sletten Jan 2022

Sheltered Cohort: A Restorative Approach To Relational Conflict And Disempowering Policies At A Men’S Homeless Shelter, Shaun A. Sletten

Graduate Theses/Dissertations

Although homeless shelters provide refuge, they also present several challenges that can negatively affect an individual's sense of internal and external control. A mix-method design was used to explore and address these challenges. Participants (N = 12) were recruited from a men’s homeless shelter via the snowball method. To identify the challenges, in-person, semistructured interviews were conducted. Participants discussed barriers that included being around others who displayed abnormal and deviant behavior, and disparaging policies that censored and restricted basic decision-making processes. Once the challenges were identified, a restorative technique called circles was utilized to increase participants' self-efficacy and satisfaction …

Burmese Buddhist Monks, The Seventh Precept, And Cognitive Dissonance, Heather Maclachlan Jan 2022

Burmese Buddhist Monks, The Seventh Precept, And Cognitive Dissonance, Heather Maclachlan

Department of Music Faculty Publications

Burmese Theravada Buddhist monks have varying degrees of involvement with music; this study of 22 monks from across Burma/Myanmar reveals that most of them often listen to recorded music. At the same time the monks acknowledge that Buddhism’s Seventh Precept is (or ought to be) a guide for their behavior, agreeing that to be “attached” to music is to violate their monastic rule. They therefore experience cognitive dissonance, and they respond to this dissonance in predictable ways - that is, in ways documented by researchers working with Western populations. They differ, however, in their phenomenological experiences of attachment.

Changing Faces And Persistent Patterns For Education In The New Latinx Diaspora, Edmund T. Hamann, Linda Harklau Jan 2022

Changing Faces And Persistent Patterns For Education In The New Latinx Diaspora, Edmund T. Hamann, Linda Harklau

Department of Teaching, Learning, and Teacher Education: Faculty Publications

The study of education in the New Latino/a/x1 Diaspora (NLD) was initiated in the 1990s with an understanding that education research from regions where the Latino/a/x presence is long-standing might not always fit well for places where Latino/a/x populations were newer and where histories of discrimination, political organizing, and resistance were much more limited. This chapter is the fourth in a series of "bigger picture" examinations of the status of education in the NLD over the past two decades (following Hamann, Wortham, and Murillo [2002] and Hamann and Harklau [2010, 2015]). Like previous iterations, this chapter points to gaps …
