Intertribal Conflicts And Customary Law Regimes In North Africa: A Comparison Of Haratin And Ait 'Atta Indigenous Legal Systems, Anna Natividad Martinez Jan 2004

Intertribal Conflicts And Customary Law Regimes In North Africa: A Comparison Of Haratin And Ait 'Atta Indigenous Legal Systems, Anna Natividad Martinez

Tribal Law Journal

The Haratin people of North Africa are subjects in crisis; they are people whose origins are debated and whose social status is scorned. As an indigenous population in the midst of regional turmoil, they have been subject to removal, forced labor and economic deprivation. Their exploitation by both French colonial forces and other indigenous populations (namely Arabs and Berbers) has displaced the Haratin way of life and has subsumed their legal culture.

Diné Bi Beenahaz'Áanii: Codifying Indigenous Consuetudinary Law In The 21st Century, Kenneth Bobroff

Tribal Law Journal

The fundamental laws of the Diné, "the People" in the Navajo language, were placed by the Holy People long before Spaniards arrived in the New World. Since Coronado first traveled to Navajo Country almost five centuries ago, Diné have resisted European assaults on Navajo Law. On November 1, 2002, the Navajo Nation Council acknowledged the survival of the fundamental laws of the Diné, recognizing four specific constituent elements — traditional law, customary law, natural law, and common law – and explaining the principles of each.

Profile Of The Sayisi Dene Nation Of Tadoule Lake In Northern Manitoba, Kwesi Baffoe

Tribal Law Journal

The cultural groups among the Aboriginal peoples of Northern Canada correspond to climatic latitudinal divides. Above the tree line, where the boreal forest meets the tundra, are the Inuit whose territory stretches far into the arctic. South of the tree line are the Dene, and below them are the Cree nations of the prairies. The goal of this paper is to concentrate on the nature of the particular culture of the Dene People.

The Social Network And Attachment Bases Of Loneliness, David M. Ouellette Jan 2004

The Social Network And Attachment Bases Of Loneliness, David M. Ouellette

Theses and Dissertations

This thesis tests Robert S. Weiss's 1973 theory of loneliness, which claims two types of loneliness: emotional and social. Emotional loneliness is the affective reaction to the absence of a close attachment bond. Social loneliness stems from inadequate integration into a social network. Undergraduate residents of a university dormitory completed questionnaires on loneliness, attachment, personality, and relationships with other dorm residents. Patterns of relational ties among participants were evaluated using social network analysis, specifically density, tie strength, and four forms of centrality. Results reveal that, while controlling for neuroticism, the network measure of outdegree and the two attachment dimensions accounted …

The Scale Of Pottery Manufacture During The Old Kingdom, Sarah L. Sterling Jan 2004

The Scale Of Pottery Manufacture During The Old Kingdom, Sarah L. Sterling

Anthropology Faculty Publications and Presentations

The existence of specialized craftsmen — including stonemasons, coppersmiths, carpenters, jewelers and potters — in ancient Egypt arises in part from the general industries spawned from the elaborate monumental constructions that characterize the Old Kingdom (ca. 2600-2100 BCE). Pottery vessels in particular are one of the most abundant kinds of artifacts known from ancient Egypt, with functions ranging from formal presentation to baking bread, to grains and olive oil storage. While not all pottery is associated with monumental architecture, the emergence of specialized or semi-specialized potters is likely due to the same socioeconomic factors that gave rise to such famous …

On The Historical School Of Jurisprudence, Robert E. Rodes Jan 2004

On The Historical School Of Jurisprudence, Robert E. Rodes

Journal Articles

Legal theory has tended to treat the Historical School as a poor relation, but it has important contributions to make. Developed in opposition to the one-size-fits-all form of natural law that eventuated in the Code Napoleon, it attributes law to a Volksgeist, the spirit of a people, as developed in the peculiar historical experience of that people. The original German proponents of the school had trouble explaining the reception of Roman law in Germany, but despite the importation of technical elements from without, a people's laws are in fact part of their culture and of their spiritual heritage as these …

Public Intellectuals In Latin America: Writers And Politics [And] Quetzalcoatl's Feathers, Maria Odette Canivell Jan 2004

Public Intellectuals In Latin America: Writers And Politics [And] Quetzalcoatl's Feathers, Maria Odette Canivell

Electronic Theses and Dissertations 2000 - 2009

The role of the Intellectual in Latin America has been marked by his/her political activism. Whether engaging in nation-building like Sarmiento or Marti; or fighting against corruption and tyranny, like Vargas Llosa or the group of Chilean intellectuals who helped bring democracy back to Chile, intellectuals in Latin America leave the relative isolation of the academic world to enter the political arena. This doctoral work, divided in two parts (an academic essay and a novel), explores the struggle of intellectuals, in particular writers, who are required to function as high level politicians due to structural weaknesses in the political systems …

Re-Visiting Briarwoods: Determining Reliability Of Assessing Population Health From Fragmentary Remains, Deborrah C. Pinto Jan 2004

Re-Visiting Briarwoods: Determining Reliability Of Assessing Population Health From Fragmentary Remains, Deborrah C. Pinto

Electronic Theses and Dissertations 2000 - 2009

The Briarwoods Site (8PA66) was first excavated by Jeffrey M. Mitchem and Dr. Stephen J. Gluckman, from the University of South Florida, in 1980. It was a burial mound with scattered human skeletal fragments on the surface. The salvage excavation had to be expedited due to the fact that a building development on the site was in progress. Iscan and Gomez (1982) suggested that there were skeletal elements recovered that provided evidence for the existence of Paget's disease (Osteitis deformans ) in the population. However, this study reanalyzes the elements and using new technology such as Computed Tomography scans shows …

Spider Woman Rules No More? The Transformation And Resilience Of Aztec Female Roles, Rhianna C. Rogers Jan 2004

Spider Woman Rules No More? The Transformation And Resilience Of Aztec Female Roles, Rhianna C. Rogers

Electronic Theses and Dissertations 2000 - 2009

Archival documents have shown Spain's attempts at Christianizing the Aztecs and illustrated Spanish justifications for the destruction of traditional Aztec beliefs and gender roles. Analyzing these documents, it becomes apparent that female roles were transformed along the lines of Spanish and Christian ideologies of a proper woman. An examination of the initial nature of Aztec-Spanish relations, with a specific emphasis on the religiosity and mentalities of both the conquered and the conquerors, provides a direct correlation between transformation of native women's social status and initial contacts with European patriarchal customs. Focusing on the reciprocating system of duality existing between men …

Veil And The State: Debating The Unveiling And Re-Veiling Of Women In Twentieth-Century Iran, Masoud. Talachian Jan 2004

Veil And The State: Debating The Unveiling And Re-Veiling Of Women In Twentieth-Century Iran, Masoud. Talachian

Electronic Theses and Dissertations 2000 - 2009

Hijab, the Islamic dress code, in Muslim communities is a sensitive and controversial issue. It embodies religious doctrine and patriarchal policies. However, in Iran this concept entails a more exclusive significance due to the strict nature of the Shiite faith, which is prevalent in Iran, along with a volatile political system and harsh practices of patriarchy and male domination that are legitimized by Iranian culture and traditions. The legacy of veiling in Iran is not a product of Islam and Islamic laws. Such a practice had existed in Iran centuries before the appearance of Islam in Mecca. The veil predates …
