Protecting Women From Domestic Violence: A Comparative Perspective, Mollie Whitehead '04 Jan 2004

Protecting Women From Domestic Violence: A Comparative Perspective, Mollie Whitehead '04

Res Publica - Journal of Undergraduate Research

Domestic violence against women is a social problem that occurs in nearly every corner of the world. Recently, some states have begun to recognize that women must be protected from abuse by family members and intimates. While policies and practices designed to protect women have emerged in a number of countries, many lag behind on the issue. This paper will examine the causal factors behind the variation in protection for women. The literature on women and politics suggests that women’s representation may increase the level of protection against domestic violence because female legislators are more likely to put women’s issues …

Leaders' Influence On School Reculturing: A Case Study Of An International School, Brian C. Matthews Edd Jan 2004

Leaders' Influence On School Reculturing: A Case Study Of An International School, Brian C. Matthews Edd

Dissertations

Organizational theorists and even practitioners are beginning to use the construct of organizational culture to analyze and characterize the complexities and challenges of organizational life. The construct has been used to metaphorize, frame, interpret, and understand various aspects of organizational life, including leadership and the change process. The literature indicates that leaders can influence an organization by attending to its cultural dimensions. Much of this literature, however, is theoretical and speculative, and the empirical work has focused, for the most part, on business. The overarching purpose of this qualitative study was to enrich understanding of the culture construct and its …

On The Historical School Of Jurisprudence, Robert E. Rodes Jan 2004

On The Historical School Of Jurisprudence, Robert E. Rodes

Journal Articles

Legal theory has tended to treat the Historical School as a poor relation, but it has important contributions to make. Developed in opposition to the one-size-fits-all form of natural law that eventuated in the Code Napoleon, it attributes law to a Volksgeist, the spirit of a people, as developed in the peculiar historical experience of that people. The original German proponents of the school had trouble explaining the reception of Roman law in Germany, but despite the importation of technical elements from without, a people's laws are in fact part of their culture and of their spiritual heritage as these …

A Tri-Cultural Look At Legitimacy And Illegitimacy Using An Evolutionary Model, Mara D. Giles Jan 2004

A Tri-Cultural Look At Legitimacy And Illegitimacy Using An Evolutionary Model, Mara D. Giles

Nebraska Anthropologist

The rules for legitimacy and illegitimacy are not universal, yet every culture classifies its children into valid and invalid A review of the literature, including Teichman, Hendrix, and Davis, has indicated that legitimacy is a status of marriage. This status is determined by several factors including race, class, inheritance patterns, lineage systems, the role of fathers, and the position of women. European and subSaharan African cultures use these factors differently to validate the boundaries separating the legitimate from the illegitimate. Until as recently as thirty years ago, English culture asserted that a man had to be proven to be the …

Comparison Of The Traditional And Contemporary Extended Family Units Of The Hopi And Lakota (Sioux): A Study Of The Deterioration Of Kinship Structures And Functions, Benjamin Grant Purzycki Jan 2004

Comparison Of The Traditional And Contemporary Extended Family Units Of The Hopi And Lakota (Sioux): A Study Of The Deterioration Of Kinship Structures And Functions, Benjamin Grant Purzycki

Nebraska Anthropologist

Drawing on a body of classical and contemporary ethnographic resources, one finds a number of coriflicting conclusions and assumptions in not only the evolutionary role of the extended family and its functions, but also-in a post-colonial context-how these units as well as their roles and functions change. When comparing a number of sources, we find that extended families are explained in diametrically opposed terms (e.g. some say extended families result from hunter-gatherer societies while others attribute it to agricultural groups), creating conflicting theory obviously not considered together as often enoughhence the necessity of comparative study between traditionally agricultural Hopi and …

Native American Survival In A Colonial United States, Charles Marr Jan 2004

Native American Survival In A Colonial United States, Charles Marr

Nebraska Anthropologist

The persecution of Native Americans in the United States has not yet come to an end. There are many policies still in place that lead to the reduction of the unique culture of the Native Americans. This can have disastrous impacts for their own survival and well being. These policies reduce their language, culture, selfdetermination, their knowledge of the environment, and increases their poverty. The United States government can help to solve these problems by eliminating the Bureau of Indian Affairs and forming a think-tank that would be composed of Tribal leaders, lawyers who specialize in Native American Law, and …

Trips' Rebound: An Historical Analysis Of How The Trips Agreement Can Ricochet Back Against The United States, Donald P. Harris

Northwestern Journal of International Law & Business

Recently, scholars and commentators around the world have reexamined the role intellectual property rights (IPRs) play in hindering or helping developing countries. These scholars have questioned the doctrine the IPRs help developing countries by promoting economic development, increasing foreign direct investment, stimulating domestic innovation, and improving access to new technologies, and have concluded that imposing "Western-styled" intellectual property regimes (e.g., the U.S. patent regime) on developing countries harms those countries. In particular, such regimes fail to bring any of the purported benefits, while they impose many costs, including preventing people from obtaining life-saving drugs. This Article argues that it is …

Beyond Rights: Legal Process And Ethnic Conflicts, Elana A. Baylis Jan 2004

Beyond Rights: Legal Process And Ethnic Conflicts, Elana A. Baylis

Michigan Journal of International Law

Unresolved ethnic conflicts threaten the stability and the very existence of multi-ethnic states. Ethnically divided states have struggled to build structural safeguards against such disputes into their political and legal systems, but these safeguards have not been able to prevent all conflict. Accordingly, multi-ethnic states facing persistent ethnic conflicts need to develop effective dispute resolution systems for resolving those conflicts. This presents an important question: what kinds of processes and institutions might enable ethnic groups to resolve their conflicts with each other and the state? This Article explores that question, reviewing the interdisciplinary literature on ethnic conflicts, the legal literature …

The Moo As An Arcade: Minimalism And Interpretive Literary Games, Steven E. Jones, Neil Fraistat Jan 2004

The Moo As An Arcade: Minimalism And Interpretive Literary Games, Steven E. Jones, Neil Fraistat

English Faculty Publications

Classic arcade videogames are engaging and immersive for counter-intuitive reasons, precisely because they are schematic and iconic, because they require a collaborative act of imagination on the part of the player, and because playing them is about being part of a shared arcade-based culture. As we have found in our own experiments in the Romantic Circles MOO, graphic minimalism forces us to maintain gameplay in a wider contextual setting. It’s not just retro fashion that gives these games their continued appeal; it’s that we are called on to make something of what is only sketchily suggested, and optimally we do …

Advertisers And Consumers In Transition, Katherine Sredl, Nataša Renko Jan 2004

Advertisers And Consumers In Transition, Katherine Sredl, Nataša Renko

School of Business: Faculty Publications and Other Works

Globalization of consumption and advertising is a dominant aspect of the post-socialist economic and social transition in Central and Eastern Europe. Yet we are only beginning to understand how consumers and local advertisers make sense of this, the role of historical infl uences, and the meaning of current outcomes. Croatia is an excellent site for researching this. How local advertisers and consumers adjust to globalization, and adjust its forces to their culture, will in no small way determine Croatia’s future, socially, economically, and politically. Through a year of ethnographic fi eldwork in Croatia, the authors hope to unlock the local …
