Orienting Toward Party Choice: A Simple Self-Determination Tool For Mediators, Robert A. Baruch Bush, Dan Berstein

Hofstra Law Faculty Scholarship

This paper introduces a new method and tool for mediators to use as a way of keeping party self-determination foremost in their practice. The tool is based on the "checklist" model used to ensure best practices for healthcare professionals in hospitals, and also on discourse analysis methods to identify key markers of party actions to exercise self-determination in mediation sessions. The self-determination checklist is a simple way for mediators to orient their interventions so as to support the parties' own deliberation and decision-making efforts.

What does it mean to be situated in a place, an environment? How might one conceptualize or reflect on emplacement? One might seek the origin story: how did we get here? What are we doing here? What obligations to the future of persons arise? Asia offers two distinct approaches, bridged by Buddhism and more recently Yoga. This essay will look at human-earth relations from five perspectives. The first two, Hinduism and Jainism, arise from the Indian subcontinent. Two others, Confucianism and Daoism, arise from China. Buddhism and Yoga serve as a bridge between India and China, the former during antiquity …

All ETDs from UAB

Tumor suppressor gene TP53 is the most frequently mutated gene across human cancers (~50%). Patients with Li-Fraumeni syndrome (LFS) who carry germline p53 mutations exhibit a diverse spectrum of childhood- and adult-onset malignancies. Despite over 40 years of dedicated studies to understand the role of p53 in tumor prevention, there are still many unanswered questions regarding the underlying mechanisms of p53. Previous studies have supported the notion that p53 exerts its tumor-suppressive function through its transcriptional activities. Therefore, strategies to enhance p53’s functions in tumor suppression via manipulating of downstream target gene activities in cancers show promising. To better investigate …

Pancreatic Ductal Adenocarcinoma (PDAC) is one of the most lethal malignancies with a five-year survival of ~10%. Recent studies in the US population suggest PDAC as the fourth leading cause of cancer-related deaths in 2022. ST6 β-galactoside α2,6-sialyltransferase (ST6GAL1) is a glycosyltransferase which is known to be upregulated in cancer. It acts as a master regulator of a cell by being the predominant sialyltransferase catalyzing the addition of a bulky negatively charged sialic acid to the galactose sugar in an α2,6-linkage. Due to this, the sialic acid changes the structure and function of cell surface receptor proteins and regulates signal …

Neurological injuries occur in epidemic proportions worldwide. Neuronal injuries are events resulting in damage to the central nervous system (CNS) that impair neurological function. Subsequent impairments in neuronal function can be rapid, existing immediately after injury, or progressive and chronic impairments that persist for the lifetime of the survivor. CNS injury constitutes a broad class of environmental and pathophysiological insults ranging from blunt-force trauma to the brain or spinal cord, to acute ischemic and hemorrhagic strokes, and insults resultant from neurotoxic agents. While divergent in initial cause, many of these insults share underlying pathophysiological outcomes including excitotoxic cell signaling, neuroinflammation, …

Magic! Missed Or Miracle?, Curt C. Anderson Jan 2023

Magic! Missed Or Miracle?, Curt C. Anderson

All ETDs from UAB

Truth default theory holds that people do not expect or notice deception unless they are triggered to think outside their natural tendency to believe others (Levine, 2020). It follows that people may not notice something deceptive or seemingly impossible if they are not first primed to raise suspicion. This study tests truth-default theory and triggering in the context of magic tricks. It hypothesized that people could watch two magic tricks performed without realizing they just witnessed something impossible because they were not primed to be aware of the presence of the possibility of deception. The research design is a three-group …
