Noncompete Law, The Uniform Act, And The Ftc Proposed Rule, Stewart J. Schwab
Noncompete Law, The Uniform Act, And The Ftc Proposed Rule, Stewart J. Schwab
University of Florida Journal of Law & Public Policy
This Article summarizes the Uniform Restrictive Employment Agreement Act and compares it to the proposed Federal Trade Commission rule that bans noncompete agreements. The Uniform Act regulates the whole family of restrictive employment agreements, including noncompetes but also confidentiality agreements, nonsolicitation agreements, no-recruit agreements, payment-for-competition agreements, and training-repayment agreements. By contrast, the FTC rule covers only noncompete agreements and their functional equivalents. Both the Uniform Act and the FTC rule cover all workers, including employees and independent contractors. While the FTC rule bans noncompetes for all workers, the Uniform Act bans agreements for low-wage workers (defined as those earning less …
Why Didn't You Leave?: Resolving The Circuit Split On Admitting Battered Woman Syndrome Testimony For Duress Defenses, Dylan Uhrig
Why Didn't You Leave?: Resolving The Circuit Split On Admitting Battered Woman Syndrome Testimony For Duress Defenses, Dylan Uhrig
University of Florida Journal of Law & Public Policy
In 1979, Lenore Walker developed the theory of Battered Woman Syndrome. Walker’s theory provided a framework for understanding the rationales and actions of those trapped in abusive relationships. Since then, expert testimony on Battered Woman Syndrome has been held admissible in a number of contexts in the criminal justice system. Yet, the federal circuit courts are divided on the admissibility of expert testimony concerning Battered Woman Syndrome when used to support a duress defense. This Note provides a brief overview of the theory of Battered Woman Syndrome and its criticisms. This Note then discusses the decisions and reasoning constituting the …

The Impact Of Changing Joining Rates On The Western Australian Sheep Flock, Kate Pritchett
The Impact Of Changing Joining Rates On The Western Australian Sheep Flock, Kate Pritchett
Animal production and livestock research reports
Given the poor seasonal conditions and low prices experienced in 2023/24, the Western Australian (WA) sheep industry is experiencing a period of very poor industry sentiment often compared to that seen in the 1990’s following the collapse of the wool reserve price scheme.
These difficult times mean producers have had to make production decisions for their businesses which may have flow on effects for the entire state flock. One commonly discussed option by industry and consultants was to join less ewes to reduce the feed burden on farm and help mitigate losses due to low prices. This computer modelling aimed …
Role Of Wave3 As An Actin Binding Protein In The Pathology Of Triple Negative Breast Cancer, Lamyae El Khalki, Khalid Sossey-Alaoui
Role Of Wave3 As An Actin Binding Protein In The Pathology Of Triple Negative Breast Cancer, Lamyae El Khalki, Khalid Sossey-Alaoui
Faculty Scholarship
Breast cancer, a prevalent global health concern, has sparked extensive research efforts, particularly focusing on triple negative breast cancer (TNBC), a subtype lacking estrogen receptor (ER), progesterone receptor, and epidermal growth factor receptor. TNBC's aggressive nature and resistance to hormone-based therapies heightens the risk of tumor progression and recurrence. Actin-binding proteins, specifically WAVE3 from the Wiskott–Aldrich syndrome protein (WASP) family, have emerged as major drivers in understanding TNBC biology. This review delves into the intricate molecular makeup of TNBC, shedding light on actin's fundamental role in cellular processes. Actin, a structural element in the cytoskeleton, regulates various cellular pathways essential …

Medieval Art, Modern Politics, Brigitte Buettner, William J. Diebold
Art: Faculty Books
Medieval Art, Modern Politics is an innovative volume of twelve essays by international scholars, prefaced by a comprehensive introduction. It examines the political uses and misuses of medieval images, objects, and the built environment from the 16th to the 20th century. In case studies ranging from Russia to the US and from catacombs, mosques, cathedrals, and feudal castles to museums and textbooks, it demonstrates how the artistic and built legacy has been appropriated in post-medieval times to legitimize varied political agendas, whether royalist, imperial, fascist, or colonial. Entities as diverse as the Roman papacy, the Catholic Church, local arts organizations, …
Ethics Of The Other Through Theodicy: A Study Of Emmanuel Levinas, Sunghun Choi
Ethics Of The Other Through Theodicy: A Study Of Emmanuel Levinas, Sunghun Choi
Master's Theses
The Problem
Drawing upon Emmanuel Levinas’s Judaic, philosophical, and experiential influences, Levinas formulates an “ethics of the Other” as a response to the quandary of suffering and evil, presenting it as an alternative to theodicy.
The Purpose
The purpose of this study is to explore Levinas’s philosophy by examining his response to the criticisms levied against theodicy, while also investigating the potential coexistence of his philosophy with theodicy and the warrant for such a critique, as well as the claim that an “ethics of the Other” can function as a legitimate replacement for theodicy.
Conclusions
This thesis argues that while …
The Nature And Role Of Health Laws In The Writings Of Ellen G. White, Lehel Somogyi
The Nature And Role Of Health Laws In The Writings Of Ellen G. White, Lehel Somogyi
Master's Theses
The Topic
Since the founding of their denomination, Seventh-day Adventists have advocated a particular concept of health based on the visions and writings of denominational co-founder Ellen G. White (1827–1915). According to her writings, certain natural laws are crucial for maintaining health. These laws are often called “the laws of health” or “the eight laws of health” and include principles such as diet, exercise, water, temperance, and hygiene. In Seventh-day Adventist circles, Ellen G. White is usually perceived as the originator of these health principles. Some scholars suggest that she simply borrowed her health principles from other contemporary health reformers. …

How Can Chatbots Improve The Gender Gap In Information Systems?, Rebecca Berthelsen, Cherileigh L. Chandler, Lauren Dean, Mark Keith, Ryan M. Schuetzle, Degan Kettles, Greg Anderson
Faculty Publications
The underrepresentation of women in STEM fields, including information systems (IS), is an ongoing issue that warrants our efforts to understand why a gender gap exists in this domain and what can be done to mitigate it. Prior research shows that women often have lower levels of self-efficacy than men regarding information systems tasks, which may explain the discrepancy between genders. In a previous study, we explored the effectiveness of a chatbot programming tutor in building self-efficacy of IS students and found that chatbot usage, which was self-reported, improved self-efficacy for all students but had a greater effect on self-efficacy …
Movement Behavior And Metapopulation Connectivity Of Stream Salamanders In Response To Disturbance Events, Kathryn M. Greene
Movement Behavior And Metapopulation Connectivity Of Stream Salamanders In Response To Disturbance Events, Kathryn M. Greene
Theses and Dissertations--Biology
Metapopulations are shaped by the dispersal between populations in a landscape. Disturbance events can disrupt this connectivity resulting in local population extinction. For my dissertation, I used a combination of empirical and theoretical techniques to examine dispersal in response to disturbance and assessed it’s population-level consequences. My research used capture-mark-recapture sampling techniques to evaluate stream salamander movement in response to (1) a supraseasonal drought and (2) mountaintop-removal-mining (MTR) and valley-filling (VF) and (3) agent-based simulation modeling to evaluate population extinction risk in response to varying dispersal and mortality rates.
First, I evaluated the effects of a supraseasonal drought, a severe …
Eliciting The Effect Free Roaming Cats Have On Native Hawaiian Wildlife Using Stable Isotope Analysis, Erin Salano
Eliciting The Effect Free Roaming Cats Have On Native Hawaiian Wildlife Using Stable Isotope Analysis, Erin Salano
Theses and Dissertations--Biology
This study measured the concentration of the stable isotopes Carbon and Nitrogen within the tissues of free-roaming and indoor cats on the Hawai’ian islands. This study aimed to determine whether cats are consuming more human provisioned or wild food sources and whether their diet is having a negative impact on endemic species; with a focus on assessing impacts on conserved bird populations. We hypothesized that human provisioned food sources have higher levels of carbon due to the amount of corn fillers within them, while wild food sources are more Nitrogen rich. We found that indoor and feral cats sampled from …

Navigating Asynchronous Online Learning: The Impacts Of Active Learning And Assigned Group Work On Student Motivation, Belonging, And Inclusion, Shea Elisabeth Carr
Theses and Dissertations--Biology
Motivation, belonging, and inclusion are all critical factors for student success but can be difficult to support in asynchronous online courses. Active learning and required group work have been shown to increase student motivation in in-person and synchronous online courses, but little is known about their impact in online asynchronous settings. This dissertation aimed to 1) evaluate the effect of active learning on student motivation in an online asynchronous setting and 2) evaluate the impact of assigned group work on student motivation and perceptions of belonging and inclusion within the context of an online, asynchronous physiology laboratory course. It was …
Elucidating The Effect Of Jak/Stat Signaling On Initiation Of Individualization, Sepideh Dadkhah
Elucidating The Effect Of Jak/Stat Signaling On Initiation Of Individualization, Sepideh Dadkhah
Theses and Dissertations--Biology
The JAK/STAT pathway is renowned for its involvement in diverse cellular processes, yet its precise role in the later events of spermiogenesis needs to be clarified. Spermiogenesis unfolds in the testis, where synchronized spermatid development occurs within two somatic cyst cells before being released into the seminal vesicle. Prior to this release, spermatid bundles undergo individualization, where F-actin investment cones accumulate at the nuclei of elongated spermatids and move down the length of the interconnected cysts, stripping away excess organelles and cytoplasm, resulting in individual spermatids that are then coiled and released into the testis lumen. Individualization depends on JAK/STAT …
Co-Divergence Of Lemur Hosts And Gut Microbiomes Across Multiple Evolutionary Scales, Mariah E. Donohue
Co-Divergence Of Lemur Hosts And Gut Microbiomes Across Multiple Evolutionary Scales, Mariah E. Donohue
Theses and Dissertations--Biology
This dissertation bridges micro- and macroevolutionary approaches to understand the co-diversification of animal hosts and their gut microbiomes at different evolutionary timescales. I examined these dynamics using wild lemurs, a diverse Primate clade endemic to the island of Madagascar.
First, I tested the relative effects of host phylogenetic relationships, diet, and habitat in shaping the gut microbiome through deep evolutionary time and across distinct microbial kingdoms. I designed a natural experiment sampling feces from rainforest and dry forest lemur communities with similar phylogenetic assemblages and considerable variation in dietary strategy. Then, I amplified and sequenced two metabarcoding genes, the V4 …
The Evolution Of The Metazoan Circadian Molecular Mechanism And The Conservation Of Canonical Circadian Elements, Olivia Waldridge
The Evolution Of The Metazoan Circadian Molecular Mechanism And The Conservation Of Canonical Circadian Elements, Olivia Waldridge
Theses and Dissertations--Biology
The temporal organization of biological activities through circadian rhythms is pivotal for the survival of organisms. Significant progress has been made in understanding the molecular foundations of animal circadian clocks through the characterization of key components such as Clock, Bmal1/Cycle(Cyc), Period (Per), Timeless, and Cryptochrome (Cry) in several model organisms. To determine the universality of this conservation, we investigated the sequences of these genes and their paralogs across 46 animal species that encompass multiple phyla in the metazoan kingdom to resolve the relative timing of duplication and loss events that have diversified core clock components in the metazoan kingdom. Using …

As artificial intelligence becomes more prevalent, regulators are increasingly turning to legal measures, like "a right to explanation," to protect against potential risks raised by AI systems. However, are eXplainable AI (XAI) tools-the artificial intelligence tools that provide such explanations-up for the task?
This paper critically examines XAI's potential to facilitate the right to explanation by applying the prism of explanation's role in law to different stakeholders. Inspecting the underlying functions of reason-giving reveals different objectives for each of the stakeholders involved. From the perspective of a decision-subject, reason-giving facilitates due process and acknowledges human agency. From a decision-maker's perspective, …
Strategies And Emerging Mechanisms In Managing Pseudomonas Aeruginosa Biofilm-Associated Antibiotic Resistance In Renal Catheters, Ahmed Fadhil Kadhim
Strategies And Emerging Mechanisms In Managing Pseudomonas Aeruginosa Biofilm-Associated Antibiotic Resistance In Renal Catheters, Ahmed Fadhil Kadhim
Al-Esraa University College Journal for Medical Sciences
Strategies and mechanisms in controlling Pseudomonas aeruginosa resistance to biofilm-associated with renal catheters are a serious concern. Renal catheters are widely used in hospitals for numerous urological disorders. However, they are the main cause of bacterial infections, especially P. aeruginosa, when used for a long time. The mechanism of biofilm-associated antibiotic resistance of P. aeruginosa in renal catheters is complex and has not been efficiently managed. This review debates certain strategies and mechanisms associated with P. aeruginosa biofilm antibiotic resistance in cases with renal catheters, including the prevention of biofilm formation, eradication of biofilm, and reducing biofilm-associated antibiotic resistance and …

Perceptions Of Young Members Of The Aeta Community About Their Intellectual Property Rights For Their Traditional Knowledge Systems: Uniquely Magbukun, Juan Kristopier D. Angeles, Xyra M. Angeles
Asia-Pacific Intellectual Property Management and Innovation Book Series
Traditional knowledge systems are innovative and practically address the needs of Indigenous peoples. In the past decades, efforts from various stakeholders have been made to acknowledge Indigenous peoples in policy debates on intellectual property (IP) dialogues. Sharing of ideas and community experiences was practiced among indigenous communities, such as the Aeta community of the Magbukun tribe in Bataan. The said Aeta community has long opened its door to researchers and nonlocals. However, due to the educational assimilation among the young participants, they formed this call for mimicry and recognition of their tradition that made them believe that both public and …

Context-Aware Machine Learning For Low-Burden Brain-Computer Interfaces, T. Warren De Wit
Dissertations
We are interested in the utility that artificially intelligent mobile systems such as drones offer to personnel in fast-paced, high-stakes situations such as disaster relief that demand real-time situational awareness. Ideally, these assistive systems place no additional cognitive or physical burden on their user; rather, they should respond to the user's intent with minimal physical or cognitive impact. Artificial intelligence (AI) and machine learning (ML) are already widely applied in both brain-computer interfaces (BCI) and drone navigation. We propose leveraging the robust computer-vision based AI that exists on modern drones to use objects as waypoints and fly a reconnaissance drone …
