Why Equity Follows The Law, Adam J. Macleod Jan 2024

Why Equity Follows The Law, Adam J. Macleod

Faculty Articles

Renewed attention to equity in higher education is welcome because true equity helps us to reason together well. When administered correctly, the jurisprudence of equity models civil discourse and, therefore, can teach us how to carry out civic engagement reasonably. Equitable interpretation of the law teaches us how to understand each other charitably. And equity’s deference to law teaches us how to reason well together about our practical problems. Law is the practical reasoning that we do together. Equity serves the ends of justice by serving law, rather than undermining it. These functions of equity in adjudication point toward a …

Is The Women's Treaty A Paper Tiger? Indian Courts' Application Of The United Nations Treaty, Amanda L. Stephens Jan 2024

Is The Women's Treaty A Paper Tiger? Indian Courts' Application Of The United Nations Treaty, Amanda L. Stephens

Faculty Articles

This Article examines whether the United Nations ("U.N.") Treaty, the Convention on the Elimination of All Forms of Discrimination Against Women ("CEDAW'), is a "paper tiger"-a law that seems powerful but is in fact weak and ineffectual. While some scholars question the Treaty's effectiveness based on statistical studies, others point to legal reforms in state parties as evidence of its success. Neither provides a nuanced middle ground by examining the CEDAW at a micro rather than a macro level. This Article fills this gap by conducting a qualitative analysis of 10 Indian judicial opinions. Specifically, the Article explores how the …

Corporate Takeover: A New Clash In The Old Struggle Between Corporate Rights And Public Health, John J. Locurto, Rachel Radke, Xyruz Villariz, Jasmine Ann Castillejos Jan 2024

Corporate Takeover: A New Clash In The Old Struggle Between Corporate Rights And Public Health, John J. Locurto, Rachel Radke, Xyruz Villariz, Jasmine Ann Castillejos

Faculty Articles

Corporations have used the federal courts to secure many of the same constitutional rights as individuals. As corporate rights proliferate so does corporate power to influence and resist laws that protect the public. One such law is the Patient Protection and Affordable Care Act—legislation that reformed health insurance coverage with important implications for public health.

The ACA has been a frequent target of litigation. Recent corporate lawsuits have invoked the Religious Freedom Restoration Act to challenge the ACA’s preventive care mandate, which requires health plans to cover preventive services without cost sharing. In Braidwood Management, Inc. v. Becerra, a …

Youth Literacy And Social Practices In A Gaming Club, Abdul R. Siddiqui Jan 2024

Youth Literacy And Social Practices In A Gaming Club, Abdul R. Siddiqui

Theses and Dissertations

One of the growing phenomena of our digital age is the proliferation of digital fan spaces (Gee, 2018). Dedicated to a specific fandom or activity, these spaces have allowed participants to play competitively, share videos with each other, create fanfiction, provide feedback to one another and engage in a host of literacies around something they share an affinity for (Black, 2009; Gee, 2017a). Through advances in technology, access to multiple tools and highly specialized knowledge of specific subjects, youth can now create communities in online spaces where they can engage in complex activities with their friends and fellow gamers without …

Effects Of Low-Cost, Low-Tech Tools For Riparian Restoration On Prairie Streams In Western South Dakota, James Andrew Joseph Bolyard Jan 2024

Effects Of Low-Cost, Low-Tech Tools For Riparian Restoration On Prairie Streams In Western South Dakota, James Andrew Joseph Bolyard

Electronic Theses and Dissertations

Despite making up less than two percent of the overall landscape in the arid and semi-arid western US, riparian areas are a crucial resource for agriculture, livestock, and wildlife. However, many have impaired function and reduced riparian cover. Low-Cost, Low-Tech Tools (LCLTT) are a subset of Process-Based Restoration (PBR) used for riparian restoration that were chosen for their cost-effectiveness and minimal technical requirements. LCLTT has been tested in mountainous areas of the western US but only recently implemented in the Northern Great Plains (NGP). Given their novelty as an approach toward restoration for the region, professional restoration and landowner communities …

This research undertook an interdisciplinary approach, integrating bioengineering, microbiology, molecular biology, and systems biology to investigate bacterial dynamics behavior. Specifically, it delved into the development of microfluidic devices for biological applications such as bacterial cell counts, real-time observation of plant roots (here, specialized lectin-coated microbeads are used that mimic root characteristics), and soil microbe interactions. Furthermore, Next-Generation Sequencing and systems biology methodologies were employed to explore the intricate, multifaceted survival mechanisms of Escherichia coli persister population. Studying and quantifying persisters or testing for the existence of VBNC (viable but nonculturable) is challenging. These experiments require precise counts. It has been …

The Relationship Of Macronutrient Intake With Growth In Children With Type 1 Diabetes Mellitus, Jessica L. Freeling Jan 2024

The Relationship Of Macronutrient Intake With Growth In Children With Type 1 Diabetes Mellitus, Jessica L. Freeling

Electronic Theses and Dissertations

Child growth, a sensitive metric of overall health, results from the intricate interplay of nature and nurture. While the importance of nutrition in child growth is well established, growth trajectories exhibit substantial individual variability, influenced by sex and age, and often characterized by nonlinear patterns. Inadequate nutrition or disease can hinder growth, with potential for recovery upon proper nutrition or acute disease resolution. However, chronic disease or persistent malnutrition may lead to permanent growth perturbation. Notably, before the advent of insulin, chronic stunting and wasting were hallmarks of Type 1 diabetes mellitus (T1DM), though the specific impacts under modern standard …

The Benefits Of Prenatal Education Via Virtual And Mobile Applications Before, During, And After Pregnancy: A Quality Improvement Project, Lindsay Farland

Master's Theses and Capstones

Background: The advancements of technology has led to a substantial increase in the use of pregnancy applications among expecting parents. Studies indicate that a majority of pregnant individuals utilize virtual education platforms for various purposes, including accessing information on nutrition, exercise, baby development, and pregnancy symptoms. Despite the potential benefits, participation in these platforms remains low, emphasizing a need for enhanced resources and engagement strategies. Research shows that engagement with antenatal education through mobile applications can lead to improved maternal and fetal outcomes, such as reduced rates of caesarean births and fewer complications related to hypertension or preeclampsia.

Embodied Ecologies And Legal Wars: The Use Of Force, Ukraine, And Feminist Perspectives On International Law, Gina Heathcote Jan 2024

Embodied Ecologies And Legal Wars: The Use Of Force, Ukraine, And Feminist Perspectives On International Law, Gina Heathcote

Saint Louis University Law Journal

In this article, I examine the international law on the use of force alongside a feminist analysis of the ongoing Russian aggression in Ukraine. I draw on records of mushroom foraging to evidence how everyday practices of communities are destroyed by military aggression that disrupts the embodied ecologies reproduced in intergenerational human and nonhuman encounters. The mushrooms foraged in Ukraine, the mushrooms destroyed during military encounters, and the mushrooms growing beside land mines provide an aperture for shifting both feminist and international legal accounts of armed conflict. I argue that ecologies of harm produce means to understand the gendered violence …

Flattening The Learning Curve For International J.D. Students, Sylvia Lett Jan 2024

Flattening The Learning Curve For International J.D. Students, Sylvia Lett

Saint Louis University Law Journal

Non-U.S. lawyers entering U.S. law schools in accelerated J.D. degree programs (known as the “AJD” – Advanced Juris Doctor Program at Arizona Law) face particular challenges adapting to 1L legal research, analysis, and communication classes. First, English is not the typical lingua franca for AJD students, many of whom come from civil law countries and are faced with the challenge of learning legal writing methods for an American common-law legal system. Second, AJD students earn a U.S. J.D. degree in only two years because these accelerated programs give one year of “credit” for their non-U.S. law degrees. As a consequence, …

The Role Of Historic Preservation In St. Louis Vacancy Solutions, Mary Webb Jan 2024

The Role Of Historic Preservation In St. Louis Vacancy Solutions, Mary Webb

Saint Louis University Law Journal

The homes of St. Louis, Missouri reflect the diverse backgrounds of the families who built them. As the need for labor grew during the City’s “brick boom,” families from the American South and from around the world immigrated to St. Louis, bringing unique architectural history with them. This history is now threatened by St. Louis’s rising vacancy rates.

The long-term impacts of racial zoning ordinances, restrictive deed covenants, and redlining have led to dense vacancy in North St. Louis neighborhoods. Crime, public health, and economic concerns follow vacant properties, adversely impacting North St. Louis individuals, families, and businesses.

Demolition has …

This Article highlights the work of Thomas Hawk and Paul Lyons, who have studied the concept of “pedagogical caring” in higher education. The …

The Strange Persistence Of Originalism, Mark A. Hannah, Francis J. Mootz Iii Jan 2024

The Strange Persistence Of Originalism, Mark A. Hannah, Francis J. Mootz Iii

Saint Louis University Law Journal

Originalism has positioned itself as the au courant doctrine of legal interpretation. Proponents argue that originalism is a core element of our democratic identity and should be adopted by every judge. The originalist tenet—that the meaning of a legal text is the ordinary meaning the text had at the time of its enactment—purportedly provides an objective basis for judging with integrity. Despite originalists’ grandiose claims, critics have lodged many well-reasoned objections that problematize originalists’ goals and methods. Why, then, has originalism gained such widespread prominence? In this article, we offer a rhetorical analysis that explains its ascendance and strange persistence. …

Labor, Authorship, And Unionism In The Age Of Artificial Intelligence, Alexa M. Benson Jan 2024

Labor, Authorship, And Unionism In The Age Of Artificial Intelligence, Alexa M. Benson

Saint Louis University Law Journal

The rapid improvement of writing and art created by artificial intelligence (AI) is often discussed as either a revolution in productivity and efficiency, or a uniquely destructive tool that will render human creative labor obsolete. A significant barrier to either claim is that AI-generated works are fundamentally incompatible with copyright as expressed in the United States Constitution and the Copyright Act. It is not clear whether the process of training AI models on copyrighted works is consistent with copyright doctrine. Moreover, the notion of granting copyright protection to AI-generated works conflicts with the constitutional, philosophic, and economic rationales for copyright …

Journal of Occupational Therapy Education

The dual-entry nature of occupational therapy has been a point of discussion for many years with explorations into the profession’s support for the different degree programs and definitions of entry-level practice being the primary foci in the literature. There has been no comparison of the expectations of occupational therapy educators and practitioners of entry-level doctorate and master’s students upon graduation despite differences in curricula and emphasis on advanced skills. This study utilized a descriptive quantitative survey to ask current educators and practitioners (n=124) to indicate their level of expectations of the two types of graduates for sixteen different clinical and …

Strategic Diplomacy: The Singapore Case, Country Report For The Project On ‘Strategic Diplomacy For 21st Century Defence And Statecraft’, Evelyn Goh, Wee-Kiat Lim

CCX Research

How does Singapore conduct strategic diplomacy despite being a small and constrained state? This report first identifies the major long-term drivers affecting Singapore’s security, both at the domestic level (rapidly ageing population, immigrant assimilation, and growing societal fault-lines) and at the international or systemic level (changing global order, power of technology, slow collective action on climate change). Then it analyses how Singapore strategists deal with two of their most prominent problem-sets: (i) positioning Singapore in relation to the US-China rivalry and the changing international order; and (ii) tackling climate change as a collective action problem. Both problem-sets illustrate how Singapore …
