On the heels of the U.S. Supreme Court’s decision in West Virginia v. Environmental Protection Agency, the “major questions” doctrine quickly came to be perceived as a significant impediment to the finalization of the Securities and Exchange Commission’s proposed rule on climate-related disclosures.
This Article presents a new argument against finalization, an argument that does not require the application of the major questions doctrine. This argument finds its authority in the policy objectives and the one policy constraint found in the statutes that underlie the proposed rule. The Uniform Law Commission recently approved the Model Public-Health Emergency Authority Act (MPHEAA or the Act or the Model Act). The MPHEAA grants governors specific and plenary powers to issue public health emergency orders while also ensuring executive branch transparency and accountability. The Act improves public health emergency preparedness by resecuring the legal foundation for states to respond effectively to future emergencies. However, more work is needed to enhance data collection and support vulnerable populations in emergencies.

The Supreme Court held in Olmstead v. L.C. ex rel. Zimring, 527 U.S. 581, 581 (1999) that it is a violation of the Americans with Disabilities Act (ADA) for states to rely on institutionalized care when home and community-based care is more appropriate. Yet, over a quarter of a century later, states persist in institutionalizing youth experiencing behavioral health disabilities. This article explores Olmstead’s impact thus far on deinstitutionalization of youth behavioral health care, and the limits of Olmstead as a vehicle for lasting change. The Behavioral Origins Of Phylogenic Responses And Ontogenic Habits, W. David Stahlman, Kenneth J. Leising

An examination of innate behavior and its possible origins suggests parallels with the formation of habitual behavior. Inflexible but adaptive responses-innate reflexive behavior, Pavlovian conditioned responses, and operant habits-may have evolved from variable behavior in phylogeny and ontogeny. This form of "plasticity-first" scientific narrative was unpopular post-Darwin but has recently gained credibility in evolutionary biology. The present article seeks to identify originating events and contingencies contributing to such inflexible but adaptive behavior at both phylogenic and ontogenic levels of selection. In ontogeny, the development of inflexible performance (i.e., habit) from variable operant behavior is reminiscent of the genetic accommodation of …

การนำเรื่องไปประกาศในราชกิจจานุเบกษาประเทศไทยเป็นมาตรการการเปิดเผยข้อมูลข่าวสารของทางราชการเพื่อให้ประชาชนได้รับทราบในเรื่องสำคัญที่อาจมีผลกระทบต่อสิทธิและเสรีภาพ ตลอดจนความเป็นอยู่ของประชาชน โดยเรื่องที่จะลงประกาศในราชกิจจานุเบกษาสามารถจำแนกออกเป็น 4 ประเภท คือ ประเภท ก ฉบับกฤษฎีกา ประเภท ข ฉบับทะเบียนฐานันดร ประเภท ค ฉบับทะเบียนการค้า และประเภท ง ฉบับประกาศและงานทั่วไป แต่ทั้งนี้ เรื่องที่ลงประกาศในราชกิจจานุเบกษาดังกล่าวมีการเปิดเผยข้อมูลส่วนบุคคลไว้ด้วย จึงมีประเด็นปัญหาว่า การเปิดเผยข้อมูลส่วนบุคคลดังกล่าวเป็นไปตามหลักการประมวลผลข้อมูลเท่าที่จำเป็นตามกฎหมายคุ้มครองข้อมูลส่วนบุคคลหรือไม่ วิทยานิพนธ์ฉบับนี้จึงศึกษาเกี่ยวกับกิจกรรมที่มีการประกาศข้อมูลส่วนบุคคลและรายการข้อมูลส่วนบุคคลในราชกิจจานุเบกษาประเทศไทยแต่ละประเภท โดยเปรียบเทียบกับกิจกรรมที่มีการประกาศใน United Kingdom Gazette และ New Zealand Gazette ซึ่งสามารถสรุปผลการศึกษาใน 2 ประเด็นดังนี้ (1) ประเด็นเรื่องกิจกรรมที่มีการประกาศข้อมูลส่วนบุคคล โดยราชกิจจานุเบกษาประเทศไทยทั้ง 4 ประเภท มีการประกาศกิจกรรมที่มีการประกาศข้อมูลส่วนบุคคลมากกว่า United Kingdom Gazette และ New Zealand Gazette แต่ไม่ได้มีจำนวนมากกว่าอย่างที่มีนัยสำคัญ และ (2) ประเด็นเรื่องรายการข้อมูลส่วนบุคคล โดย (ก) ราชกิจจานุเบกษาประเทศไทย ประเภท ก เปิดเผยรายการข้อมูลส่วนบุคคลมากกว่า United Kingdom Gazette และ New Zealand Gazette ซึ่งโดยส่วนใหญ่เปิดเผยเหมาะสมกับกิจกรรมที่ประกาศแล้ว แต่กิจกรรมประกาศรายชื่อผู้สมัครรับเลือกตั้งอาจเป็นการเปิดเผยมากเกินความจำเป็น (ข) ราชกิจจานุเบกษาประเทศไทย ประเภท ข ไม่ได้เปิดเผยรายการข้อมูลส่วนบุคคลน้อยกว่า United Kingdom Gazette และ New Zealand Gazette ซึ่งโดยส่วนใหญ่เปิดเผยเหมาะสมกับกิจกรรมที่ประกาศแล้ว แต่กิจกรรมในกลุ่มงานสถาปนาและถอดถอนอาจเป็นการเปิดเผยมากเกินความจำเป็น (ค) ราชกิจจานุเบกษาประเทศไทย ประเภท ค ไม่ได้เปิดเผยรายการข้อมูลส่วนบุคคลน้อยกว่า United Kingdom Gazette และ New Zealand Gazette และเปิดเผยเหมาะสมกับกิจกรรมที่ประกาศแล้ว และ (ง) ราชกิจจานุเบกษาประเทศไทย ประเภท ง เปิดเผยรายการข้อมูลส่วนบุคคลมากกว่า United …

กลยุทธ์การบริหารวิชาการของโรงเรียนประถมศึกษาตามแนวคิดความเป็นพลเมืองกับความยุติธรรมทางสังคม, กนกวรรณ การุญ

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อ 1) เพื่อศึกษากรอบแนวคิดการบริหารวิชาการของโรงเรียนประถมศึกษาและกรอบแนวคิดความเป็นพลเมืองกับความยุติธรรมทางสังคม 2) เพื่อศึกษาสภาพปัจจุบันและสภาพที่พึงประสงค์และความต้องการจำเป็นในการพัฒนาการบริหารวิชาการโรงเรียนประถมศึกษาตามแนวคิดความเป็นพลเมืองกับความยุติธรรมทางสังคม 3) เพื่อพัฒนากลยุทธ์การบริหารวิชาการโรงเรียนประถมศึกษาตามแนวคิดความเป็นพลเมืองกับความยุติธรรมทางสังคม ดำเนินการวิจัยโดยใช้ระเบียบวิธีวิจัยแบบผสมวิธีพหุระยะ (Multiphase Mixed Methods Design) ใช้วิธีเก็บรวบรวมข้อมูลเชิงคุณภาพ (Qualitative Data) และข้อมูลเชิงปริมาณ (Quantitative Data) กลุ่มตัวอย่างที่ใช้ในการวิจัยครั้งนี้คือ โรงเรียนประถมศึกษา สังกัดสำนักงานคณะกรรมการการศึกษาขั้นพื้นฐาน 393 โรงเรียน ผู้ให้ข้อมูลคือ ผู้บริหารโรงเรียน 281 คน และครูกลุ่มบริหารวิชาการ 429 คน เครื่องมือที่ใช้ในการวิจัยได้แก่ แบบสอบถามและแบบประเมิน สถิติที่ใช้ในการวิเคราะห์ข้อมูลคือ ค่าความถี่ ค่าร้อยละ ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน ค่าดัชนีความต้องการจำเป็น และการวิเคราะห์เนื้อหาจากการสนทนากลุ่ม ผลการวิจัยพบว่า 1) กรอบแนวคิดการบริหารวิชาการโรงเรียนประถมศึกษา ประกอบด้วย 3 งาน คือ (1) การพัฒนาหลักสูตร (2) การจัดการเรียนรู้ และ (3) การวัดและประเมินผล กรอบแนวคิดความเป็นพลเมืองกับความยุติธรรมทางสังคม ประกอบด้วย 7 ด้าน คือ (1) สิทธิในการแสดงออกอย่างเสรีของปัจเจกบุคคล (2) สิทธิการมีกรรมสิทธิ์ในทรัพย์สิน (3) สิทธิทางการเมือง (4) สิทธิในความมั่นคงทางสังคมและได้รับบริการทางสังคม (5) ความยุติธรรมเชิงความเชื่อมโยง (6) ความยุติธรรมเชิงกระจายทรัพยากร และ(7) ความยุติธรรมเชิงวัฒนธรรม 2) สภาพปัจจุบันของการบริหารวิชาการของโรงเรียนประถมศึกษาตามแนวคิดความเป็นพลเมืองกับความยุติธรรมทางสังคม โดยภาพรวม มีค่าเฉลี่ยอยู่ในระดับมาก โดยด้านการพัฒนาหลักสูตรในสิทธิทางการเมืองมีค่าเฉลี่ยสูงที่สุด สภาพที่พึงประสงค์โดยภาพรวมอยู่ในระดับมาก โดยด้านการพัฒนาหลักสูตรในสิทธิทางการเมือง และสิทธิในความมั่นคงทางสังคมและได้รับบริการทางสังคมมีค่าเฉลี่ยสูงที่สุดเท่ากัน ทั้งนี้ค่าดัชนีความต้องการจำเป็นของการพัฒนาการบริหารวิชาการของโรงเรียนประถมศึกษาตามแนวคิดความเป็นพลเมืองกับความยุติธรรมทางสังคมสูงที่สุด คือ ด้านการวัดและประเมินผลในสิทธิในการแสดงออกอย่างเสรีของปัจเจกบุคคล สิทธิการมีกรรมสิทธิ์ในทรัพย์สิน และสิทธิในความมั่นคงทางสังคมและได้รับบริการทางสังคม 3) กลยุทธ์การบริหารวิชาการของโรงเรียนประถมศึกษาตามแนวคิดความเป็นพลเมืองกับความยุติธรรมทางสังคม ประกอบด้วย 3 กลยุทธ์หลัก ดังนี้ (1) พลิกโฉมการวัดและประเมินผลที่เสริมสร้างความเป็นพลเมืองกับความยุติธรรมทางสังคม ประกอบด้วย 2 กลยุทธ์รอง (2) พลิกโฉมการจัดการเรียนรู้ที่เสริมสร้างความเป็นพลเมืองกับความยุติธรรมทางสังคม ประกอบด้วย 2 …

การวิจัยและพัฒนาครั้งนี้มีวัตถุประสงค์ 1) สำรวจมโนทัศน์ที่คลาดเคลื่อนในวิชาชีววิทยาเรื่องพันธุศาสตร์ของนักเรียนมัธยมศึกษาปีที่ 4 2) พัฒนาและตรวจสอบคุณภาพของแบบสอบวินิจฉัยสี่ระดับในวิชาชีววิทยาเรื่องพันธุศาสตร์ 3) พัฒนาระบบการทดสอบเพื่อวินิจฉัยมโนทัศน์ที่คลาดเคลื่อนในวิชาชีววิทยาโดยใช้แบบสอบวินิจฉัยสี่ระดับร่วมกับการสะท้อนข้อมูลย้อนกลับด้วยคอมพิวเตอร์ออนไลน์ สำหรับนักเรียนมัธยมศึกษาปีที่ 4 และ 4) ตรวจสอบคุณภาพของระบบ การวิจัยแบ่งเป็น 3 ระยะ ได้แก่ ระยะที่ 1 สำรวจมโนทัศน์ที่คลาดเคลื่อน ระยะที่ 2 พัฒนาและตรวจสอบคุณภาพแบบสอบวินิจฉัยสี่ระดับพร้อมสร้างข้อมูลย้อนกลับ และระยะที่ 3 พัฒนาระบบวินิจฉัยออนไลน์ สำหรับตัวอย่างวิจัยและวิธีการวิจัยในระยะที่ 1 สำรวจมโนทัศน์ที่คลาดเคลื่อนจากนักเรียน 160 คน ด้วยแบบสอบสองระดับชนิดปลายเปิด ระยะที่ 2 พัฒนาและทดลองใช้เครื่องมือแบบสอบวินิจฉัยสี่ระดับฉบับร่าง 33 ข้อ กับนักเรียน 420 คน วิเคราะห์คุณภาพด้วยสถิติเชิงบรรยาย ได้แก่ ค่าเฉลี่ย ร้อยละ ความถี่ ส่วนเบี่ยงเบนมาตรฐาน ค่าความเบ้และความโด่ง การวิเคราะห์ความยากและอำนาจจำแนกตามทฤษฎีการทดสอบแบบดั้งเดิมและทฤษฎีการตอบสนองข้อสอบ การวิเคราะห์ความสอดคล้องกลมกลืนของโมเดลการตอบสนองข้อสอบ การวิเคราะห์ความเที่ยงแบบความสอดคล้องภายในด้วยค่าอัลฟ่าของครอนบาค และการวิเคราะห์ความตรงตามเกณฑ์สัมพันธ์เทคนิคคิดออกเสียงโดยใช้ค่าคัปปาของโคเฮน จากนักเรียน 57 คน จากนั้นคัดเลือกแบบสอบสมบูรณ์ 11 ข้อ และสร้างข้อมูลย้อนกลับแบบทั่วไปและข้อมูลย้อนกลับเพื่อการปรับปรุง ส่วนในระยะที่ 3 พัฒนาระบบวินิจฉัยออนไลน์ด้วย Google Workspace และตรวจสอบคุณภาพระบบโดยผู้เชี่ยวชาญ 5 ท่าน และประเมินความพึงพอใจของผู้เชี่ยวชาญและความพึงพอใจของตัวอย่างนักเรียนที่ใช้ทดสอบระบบจำนวน 140 คน ผลการวิจัยสรุปได้ดังนี้: 1) ผลการสำรวจมโนทัศน์ที่คลาดเคลื่อน พบว่า นักเรียนมีมโนทัศน์ที่คลาดเคลื่อนในวิชาชีววิทยาเรื่องพันธุศาสตร์จำนวน 24 รายการ โดยในมโนทัศน์ที่ 1 เรื่องลักษณะทางพันธุกรรม พบมโนทัศน์ที่คลาดเคลื่อนมากที่สุดคือ "ลักษณะเด่นคือลักษณะที่มองเห็นได้ชัดเจน และเป็นลักษณะที่ต้องการของบุคคล เช่น จมูกโด่งเป็นลักษณะเด่นเพราะสวย ส่วนลักษณะด้อยคือลักษณะที่พบได้มากหรือไม่แตกต่างจากกลุ่ม" ซึ่งพบในนักเรียนคิดเป็นร้อยละ 29.38 2) ผลการพัฒนาแบบสอบวินิจฉัยสี่ระดับ พบว่า แบบสอบวินิจฉัยสี่ระดับที่พัฒนาขึ้น มีคุณภาพผ่านเกณฑ์ตามทฤษฎีการทดสอบแบบดั้งเดิมและทฤษฎีการตอบสนองข้อสอบ และได้มีการคัดเลือกข้อสอบที่มีคุณภาพ เพื่อนำไปพัฒนาแบบสอบที่ใช้ในระบบวินิจฉัย จำนวน 11 ข้อ จากแบบสอบวินิจฉัยสี่ระดับ ฉบับร่างจำนวน 33 …

Tin whiskers are metal strands that spontaneously form on tin surfaces and can grow up to a centimeter long. These whiskers can cause electrical shorts by breaking off and landing on circuit boards, yet there is limited simulation and analysis data regarding their shorting probability. This thesis presents a software tool developed using Unity, Blender, and FreeCAD to simulate the behavior of tin whiskers on PCBs. The tool accurately represents PCBs and whiskers, applying various forces to predict whisker landing positions and the impacted metal faces. This study looked at the effects of visual features like complexity, grouping, and similarity on numerosity estimations. I hypothesized that complex visual stimuli would be more difficult to accurately estimate than simple visual stimuli. Additionally, I hypothesized that stimuli that were visually similar or displayed in spread out, distributed patterns would have more accurate estimations compared to visually random or closely grouped stimuli. Lastly, this study was designed to assess the combined effects of these visual features on numerosity estimation accuracy. Carpal tunnel syndrome (CTS) is the most common peripheral entrapment neuropathy but current conservative treatments are unsatisfactory. Recently, clinical trials using ultrasound-guided regenerative injection with 5% dextrose water or platelet-rich plasma have reported clinically and statistically significant benefits compared to current conservative treatments for the treatment of CTS. Regenerative injection for CTS is increasingly being utilized, proportional to the worldwide expansion of skills in the use of ultrasound guidance for precise injection and localization, and due to accumulating evidence that it enhances the success rate of conservative treatment, and reduces the rate of surgery. Caves offer a unique opportunity to study the ecology and evolution of life in extreme environments, particularly with respect to understanding patterns of diversity. Most cave-obligate species are dispersal limited and have restricted ranges, often endemic to a single or a few cave systems. However, a few species have particularly broad distributions suggesting that they either are not dispersal limited or perhaps represent a species complex of morphological similar but genetically distinct species. Genetic variation often precedes adaptation, so the mechanisms that maintain this variation are a central topic in evolutionary biology. Gambusia holbrooki, or eastern mosquitofish, possesses a rare polymorphism for melanistic coloration. Melanics and typical silver males were examined for differences in behavioral and physiological traits that may impact the persistence of the melanism trait. No differences in standard metabolic rate were found via closed-chamber respirometry, but a detour task indicated that melanic males possess greater cognitive flexibility. Effects of the social environment on stress and reproductive traits were also evaluated by pairing males and comparing cortisol levels and sperm quality …

Advancements in metal additive manufacturing have enabled the production of metal lattice structures. The customizability of the lattice topology offers the potential to yield lightweight materials with highly tailored thermal and mechanical properties. Eastern Box Turtles (Terrapene carolina carolina) are susceptible to many threats, including development, urbanization, and disease. A novel Ranavirus has been attributed to mortality in both captive and wild box turtles, including one known occurrence in a captive box turtle in Alabama, but no further assessment has been made. The aims of this study were to assess if Frog Virus 3-like Ranavirus infects wild box turtles and if its prevalence is related to urbanization in North Alabama, USA. Chemical cues emanating from predators can play a key role in aquatic predator-prey interactions and food webs. Understanding how prey respond to these risk cues is therefore critical for understanding the direct effects of predators on prey populations and their indirect effects on communities. To respond adaptively, prey must accurately assess the risk of predation associated with perceived chemical cues, an oft-documented phenomenon. Habitat suitability models were utilized to direct survey efforts for Plethodon dunni in Northern California. Two models were created, one using traditional statistical methods (GLM or Generalized Linear Modeling) and the other using a machine learning method (MaxEnt or Maximum Entropy modeling). Plots were selected from areas of agreement and disagreement between the models to carry out presence surveys. The MaxEnt model yielded better predictions than the GLM model. The two models had three variables in common (annual temperature range, precipitation of driest month, and precipitation seasonality) and predicted suitable habitat within the known range of P. dunni. As opportunistic foragers, the Eastern North Pacific population (~20,000) of gray whales (Eschrichtius robustus) feed on diverse benthic and planktonic invertebrates in northern Alaska foraging grounds before they undertake one of the largest yearly migrations of any mammal to breed in Baja California, Mexico. While most of the population travels to the summer foraging grounds in Alaska, a sub-group of whales (~230) called the Pacific Coast Feeding Group (PCFG) summer between British Columbia, Canada, and northern California. Lewis’s woodpeckers (Melanerpes lewis) are described as "burn specialists" due to their preference for breeding in recently burned pine forests in the western US. However, despite increasing fire activity, this species experienced a 48% range-wide decline between 1968 and 2019, which raises questions about their adaptability to altered fire regimes in the region. Transmedia storytelling is the vehicle for narratives to become immersive to their audience through different modalities. The Walt Disney Company employs this form of storytelling by placing any one of its films in the context of attractions and live-action performances, or vice-versa, creating a convergent culture that will follow these products through every medium.
