The Eu-Palm Oil Disputes: A Turning Point In Trade And Climate Jurisprudence?, Pallavi Arora Jan 2024

The Eu-Palm Oil Disputes: A Turning Point In Trade And Climate Jurisprudence?, Pallavi Arora

Indian Journal of International Economic Law

This article critically analyses the panel reports of the World Trade Organisation (WTO) in the EU–Palm Oil disputes, which challenge key elements of the European Union’s Renewable Energy Directive II and its accompanying Delegated Regulation. These disputes raise foundational questions at the intersection of international trade law and climate governance, including the treatment of non-product-related process and production methods (NPR-PPMs), the extraterritorial reach of trade-related climate measures, the role of international standards under the Agreement on Technical Barriers to Trade (TBT Agreement), the degree of deference granted to WTO Members in adopting (alleged) climate measures, and the extent to which …

The Neurological Consequences of Combat Blast-Induced Neurotrauma (BINT) Pose Important Clinical Concerns for Military Service Members and Veterans. Previous Studies Have Shown that Low-Intensity Blast (LIB) Results in BINT with Multifaceted Characteristics in Mice Exposed to Open-Field Blast in Prone Position. Although the Prone Position is Natural for Rodents, Experimental Models of Blast using This Position Do Not Represent Common Scenarios of Human Standing While Being Exposed to Blast during Deployment or Military Training. in This Study, We Used Our Previously Developed BINT Mouse Model of Open-Field LIB with Mice in an Upright Position and Then Used Quantitative Proteomics and …

Opening India To International Competition In Government Procurement Markets: Cepa With Uae A Breakthrough?, Jędrzej Górski, Kanishka Bhukya Jan 2024

Opening India To International Competition In Government Procurement Markets: Cepa With Uae A Breakthrough?, Jędrzej Górski, Kanishka Bhukya

National Law School of India Review

The India-UAE Comprehensive Economic Partnership Agreement (‘CEPA’) is a landmark in India’s public procurement policy, introducing substantial liberalisation commitments for the first time. Historically insulated from international procurement obligations, India’s previous agreements, such as with Japan, were limited in scope. The CEPA, concluded in 2022, includes Chapter 10, which mandates significant procurement reforms. This article assesses whether the CEPA signifies a transformative change or a minor adjustment. Part II explores the global framework for public procurement under International Economic Law (‘IEL’) and Global Administrative Law (‘GAL’), focusing on the WTO Government Procurement Agreement (‘GPA’) standards. It details GPA’s non-discrimination and …

Universal Civil Jurisdiction And International Law: A Response To B.S. Chimni, Chimène Keitner Jan 2024

Universal Civil Jurisdiction And International Law: A Response To B.S. Chimni, Chimène Keitner

National Law School of India Review

The exercise of various forms of jurisdiction, and the delineation of a political entity’s jurisdictional reach over persons, places, and conduct, can sharpen and entrench inequities within and between states. One can thus aptly characterize certain exercises of jurisdiction, and particularly certain forms of extraterritorial jurisdiction, as assertions of imperial and/or hegemonic power. Importantly, however, jurisdiction can also be invoked to redress certain power inequities by providing access to judicial remedies for conduct that has evaded other forms of regulatory control. In addition, while certain assertions of extraterritorial prescriptive jurisdiction can represent overreaching by powerful states, the practice of disclaiming …

Colonialism, Jurisdiction, And Sovereignty In Palestine, Usha Natarajan Jan 2024

Colonialism, Jurisdiction, And Sovereignty In Palestine, Usha Natarajan

National Law School of India Review

Knowledge production is never neutral, and academia – much like international laws and institutions among other social structures – is a key conduit for the efficient operations of power. Israel’s longstanding occupation and settler colonialism in Palestine challenges mainstream accounts of the international laws of jurisdiction, whereas Chimni’s TWAIL analysis better accounts for and predicts the imperial operations of such laws and points to fruitful evolution towards fairness and justice.10 I elaborate by considering firstly the exercise of jurisdiction during occupation and settler colonialism, and secondly the exercise of universal jurisdiction by states. I conclude with some thoughts on jurisdiction …

Third World Statehood Before The ‘Third World’: Imperialism, Sovereignty, And The Making Of Latin America, Eric Loefflad Jan 2024

Third World Statehood Before The ‘Third World’: Imperialism, Sovereignty, And The Making Of Latin America, Eric Loefflad

National Law School of India Review

Engaging BS Chimni’s claim that the genealogies of colonial capitalism are vital to uncovering the substantive realities that animate formalistic conceptions of jurisdiction, I argue that the independence of Latin America forms an important, yet under- theorised, site for articulating these genealogies. This is especially significant given the general lack of materialist analysis of this history in both Latin American International Law (LAIL) and Third World Approaches to International Law (TWAIL’). Filling this lacuna, I argue that while Latin American polities emerged as bounded territorial states, their recognition as such must be understood in relation to how Europe and the …

Molecular Imaging Nanoprobes And Their Applications In Atherosclerosis Diagnosis, Huari Kou, Hu Yang Jan 2024

Molecular Imaging Nanoprobes And Their Applications In Atherosclerosis Diagnosis, Huari Kou, Hu Yang

Chemical and Biochemical Engineering Faculty Research & Creative Works

Molecular imaging has undergone significant development in recent years for its excellent ability to image and quantify biologic processes at cellular and molecular levels. Its application is of significance in cardiovascular diseases, particularly in diagnosing them at early stages. Atherosclerosis is a complex, chronic, and progressive disease that can lead to serious consequences such as heart strokes or infarctions. Attempts have been made to detect atherosclerosis with molecular imaging modalities. Not only do imaging modalities develop rapidly, but research of relevant nanomaterials as imaging probes has also been increasingly studied in recent years. This review focuses on the latest developments …

Over the past decade, boldine, a naturally occurring alkaloid found in several plant species including the Chilean Boldo tree, has garnered attention for its efficacy in rodent models of human disease. Some of the properties that have been attributed to boldine include antioxidant activities, neuroprotective and analgesic actions, hepatoprotective effects, anti-inflammatory actions, cardioprotective effects and anticancer potential. Compelling data now indicates that boldine blocks connexin (Cx) hemichannels (HCs) and that many if not all of its effects in rodent models of injury and disease are due to CxHC blockade. Here we provide an overview of boldine's pharmacological properties, including its …

Gender In The Making Of The Constitution: Proposals For A Feminist Inquiry Into Indian Constitutional History, Achyut Chetan Jan 2024

Gender In The Making Of The Constitution: Proposals For A Feminist Inquiry Into Indian Constitutional History, Achyut Chetan

National Law School Journal

A feminist inquiry into the framing of the Indian Constitution must retrieve and see the interventions of the women members of the Constituent Assembly for what they historically represent, namely, a feminist authorial voice that was developed over a period of time by the pre-Independence women’s movement in India. For a proper understanding of this voice, we must understand the gendered character of the Constituent Assembly, its architecture, its procedures, the dynamics of the gendered relations among its members, and above all, the performative aspects of the debates. This inquiry must also investigate the language employed by the members and …

Ghost-Hunting In Al And The Law, Meghan J. Ryan

Faculty Journal Articles and Book Chapters

Generative AI is booming. This technology offers amazing opportunities for growth in various business sectors and creates the opportunity for swift progress on medical innovations, climate change, world hunger, and innumerable other areas. AI also poses a number of challenges, though, such as replacing human workers and exacerbating pernicious biases. Another major concern about generative AI is singularity-the idea that this technology could surpass human intelligence and subjugate us or render us extinct. Although some commentators discount this possibility, the fact that AI experts such as Geoffrey Hinton, Sam Altman, and Elon Musk share the singularity concern should at least …

A Biblical Framework For Understanding And Responding To Ai, David J. Mulder Jan 2024

A Biblical Framework For Understanding And Responding To Ai, David J. Mulder

Faculty Work Comprehensive List

This chapter is about developing a biblically informed, theologically sound perspective on what it means to be human in a world where artificial intelligence (AI) seems to be omnipresent and nearly omnipotent. Along the way, we will consider the history of AI, the current state of AI, and a biblical view of AI. However, to land in a place where we have some solid understanding of a biblically informed perspective on the role of technology, we need to begin with our own imaginations.

Executive Summary 2022-23: Real Food And Climate Emissions Analysis At Santa Clara University, Abby Crowley, Isabelle Solórzano

Sustainable Food Systems Fellowship

Dining service providers at institutions of higher education have large purchasing power. This presents colleges and universities with an opportunity for improving equity and sustainability in local, national, and global food systems. Recognizing this opportunity and responsibility, Santa Clara University has pledged to reduce carbon emissions and advance issues of sustainability and environmental justice in campus food purchases, amongst many other operations.

To track progress and identify areas for improvement, SCU has collaborated with the food justice organization Real Food Challenge (RFC) and the carbon and nitrogen emissions calculator Sustainability Indicator Management & Analysis Platform (SIMAP) to analyze the amount …

Evaluation Of Information Visualization In Digital Intelligence Product, Dejan Ulcej, Anja Podlesek Jan 2024

Evaluation Of Information Visualization In Digital Intelligence Product, Dejan Ulcej, Anja Podlesek

Journal of Strategic Security

Digital technology has impacted how strategic intelligence products are designed and distributed to political security decisionmakers. Information visualization helps improve the processing of intelligence information. This experimental study investigated whether a prototype digital intelligence report that uses visuals is processed more efficiently and results in a better user experience than a printed intelligence product that contains primarily text. A sample of 72 participants working as decisionmakers in a private company was divided into two equal groups. One group received the digital version of the report, and the other received the printed version. The time it took to read the report, …

Historical Analogy And The Role Morality Of Reason-Giving, Darrell Miller Jan 2024

Historical Analogy And The Role Morality Of Reason-Giving, Darrell Miller

Articles

The Supreme Court has turned ever more to analogical reasoning from history and tradition to decide significant matters of public policy. Nowhere is this phenomenon more evident than in the Court’s 2022 decision in New York State Rifle and Pistol Association v. Bruen.

The Court’s crafting of a Second Amendment test that turns almost entirely on the strength of analogies—and on a topic of such intense public salience—has thrust analogical reasoning to the forefront of judicial and academic debate. While many have questioned the workability of Bruen’s focus on historical analogs, this Essay is less concerned about the pragmatics of …

The Natural Law Origins Of Private And Public Law, Richard Epstein Jan 2024

The Natural Law Origins Of Private And Public Law, Richard Epstein

Articles

This article attempts to counter the widespread skepticism that surrounds any appeal to natural law principles, starting with Roman law at one end and the appeal to general law under Swift v. Tyson on the other. It steers a systematic middle course between moral absolutism, which treats all relationships as fixed and immutable, and modern realist positions that insist the infinite variety of legal approaches to most legal problems proves that there is no solid core to either natural law or general law. The natural law positions set out the basic relationships for marriage and family, for alluvion and avulsion …

The Trouble With Classifications, Aziz Huq Jan 2024

The Trouble With Classifications, Aziz Huq

Articles

The Supreme Court relies increasingly on anticlassification rules to implement the Constitution’s various commands of evenhanded state treatment. These rules direct attention to whether an instance of a forbidden classification is present on the face of a challenged law. They contain two necessary steps. First, a court defines a general category of impermissible terms. Second, a court ascertains whether an instance of the category is found in enacted text—so triggering the familiar strict scrutiny analysis. So defined, anticlassification rules now dominate equal protection, free speech, “dormant” Commerce Clause, and even free exercise jurisprudence. The Roberts Court celebrates these doctrinal tests …
