School of Theology and Seminary Faculty Books

What does it mean to consider the world of AI through a Christian lens? Rapid developments in AI continue to reshape society, raising new ethical questions and challenging our understanding of the human person. Encountering Artificial Intelligence draws on Pope Francis's discussion of a culture of encounter and broader themes in Catholic social thought in order to examine how current AI applications affect human relationships in various social spheres and offers concrete recommendations for better implementation. The document also explores questions regarding personhood, consciousness, and the kinds of relationships humans might have with even the most advanced AI. Through these …

How Viable Is Viability? Artificial Womb Technology And The Threat To Abortion Access, James E. Brown Jan 2024

How Viable Is Viability? Artificial Womb Technology And The Threat To Abortion Access, James E. Brown

Michigan Journal of Gender & Law

The viability standard plays an important role in abortion access around much of the United States. In fact, before the Dobbs decision, the viability standard was the constitutional gatekeeper to abortion access and was uniform across the entire nation. Unfortunately, the Supreme Court has removed the constitutional right to abortion altogether. Nevertheless, I will provide an argument as to why Dobbs does not signal the end of viability-based abortion around the U.S. I will prove the importance of the viability standard even in a post-Dobbs society, highlighting its operation within various state laws, such as Michigan’s Prop. 3, as well …

Complicated Grief: An Arts-Based Trauma-Informed Approach, Jessica J. Porter

Community Engagement Student Work

Traumatic loss due to violent death, a death that results from the intentional use of physical force or power, can result in mental health struggles and stigma. Complicated grief, due to traumatic loss, can be felt at both the individual and the community level. A comprehensive community project proposal was presented to a panel of reviewers in the grief, loss, and bereavement community. This proposal was developed to bring awareness to complicated grief, reduce the stigma around suicide and violent death, as well as provide opportunities to grieve safely and healthily. Through artistic expression and a sense of belonging, these …

How The Supreme Court Ghosted The Phosita: Amgen And Legal Constructs In Patent Law, Timothy R. Holbrook Jan 2024

How The Supreme Court Ghosted The Phosita: Amgen And Legal Constructs In Patent Law, Timothy R. Holbrook

Sturm College of Law: Faculty Scholarship

This essay is an invited response to The Ghost in the Patent System: An Empirical Study of Patent Law’s Elusive “Skilled Artisan,” by Professors Laura Pedraza-Fariña and Ryan Whalen. In their piece, Pedraza-Fariña and Ryan Whalen offer an empirical study and use it to argue for a new conception of the Person Having Ordinary Skill in the Art (PHOSITA), patent law’s nod to the “reasonable person” construct.

As Professors Pedraza-Fariña and Whalen suggest, the PHOSITA should be understood as a crucial concept in patent law, warranting more scholarly attention. Pedraza-Fariña and Whalen provide that attention. They assert, based on an …

The Nineteenth Amendment And Dobbs, Paula A. Monopoli Jan 2024

The Nineteenth Amendment And Dobbs, Paula A. Monopoli

Faculty Scholarship

There was a surge in legal scholarship around the Nineteenth Amendment to the United States Constitution—the Woman Suffrage Amendment—leading up to its centennial in August 2020. But this scholarly interest around the Nineteenth peaked two years before the U.S. Supreme Court’s historic decision in Dobbs v. Jackson Women’s Health Organization in June 2022. This paper revisits the Nineteenth Amendment in light of the Court’s decision in Dobbs. It argues that the Nineteenth should be understood as a ban on sex discrimination that extends beyond the right to vote. The Amendment expands the scope of women’s citizenship as a matter of …

A Holistic Approach To Exploring The Root Factors Of Work Zone Accidents, Bahaa Chammout, Muaz O. Ahmed, Islam H. El-Adaway, William Lieser Jan 2024

A Holistic Approach To Exploring The Root Factors Of Work Zone Accidents, Bahaa Chammout, Muaz O. Ahmed, Islam H. El-Adaway, William Lieser

Civil, Architectural and Environmental Engineering Faculty Research & Creative Works

Work zones are crucial for infrastructure maintenance and improvement. However, ongoing projects within work zones sometimes can place workers and drivers in dangerous situations. Despite safety regulations, work zone accidents persist with notable severity and frequency. Previous research has explored work zone accident causation, but it has not provided a comprehensive understanding of the factors that impact work zone safety. This paper addresses this research gap by following a multistep methodology. First, a systematic literature review (SLR) was conducted to identify a comprehensive list of 37 factors impacting work zone safety. Second, social network analysis (SNA) was employed to analyze …

Fisheries Research Report No. 346: West Coast Demersal Scalefish Resource Synopsis 2024, Emily A. Fisher, David Fairclough

Fisheries Research Reports

The West Coast Demersal Scalefish Resource (WCDSR) comprises over 100 species that inhabit inshore (20-250 m deep) and offshore ( > 250 m deep) waters of the West Coast Bioregion (WCB; north of Kalbarri to east of Augusta).

The WCB is predominantly a temperate oceanic zone with these waters influenced by the Leeuwin Current that transports warm, low-nutrient water southward along the western edge of the continental shelf.

To monitor and assess the WCDSR, indicator species have been selected using a risk-based approach that considers their inherent vulnerability to fishing, level of targeting and catch taken by fishers, and the amount …

Millennium School: An Experiment In Transpersonal Education For Early Adolescents, Jenny Wade Jan 2024

Millennium School: An Experiment In Transpersonal Education For Early Adolescents, Jenny Wade

International Journal of Transpersonal Studies Advance Publication Archive

This article describes the design, curriculum, culture, and values of an experiment in transpersonal education for young adolescents, the Millennium middle school in San Francisco, CA. The overarching design of the school was to help children exiting the latency period of child development, who exhibit the rudiments of Wade’s Authentic consciousness or Maslow’s Self-actualization motive stage, consolidate that level rather than losing it, as the vast majority do, because of social pressures that make earlier stages of development more adaptable in most contemporary societies. Early adolescence is a time when peer pressure, individuation from the family, and puberty are strong …

Trees And The Love Of God, David M. Belnap, Nalini M. Nadkarni Jan 2024

Trees And The Love Of God, David M. Belnap, Nalini M. Nadkarni

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

Trees play real and metaphorical roles in the beliefs and holy scriptures of many world religions, and believers and non-believers throughout the world are uplifted spiritually by trees. In the Book of Mormon, a tree with delicious, sweet fruit appeared in two visions and one parable. Respectively, the tree represents the love of God as seen through the life and sacrifice of Jesus Christ and symbolizes spiritual growth as one experimentally nourishes faith from a seed. Trees and fruit in the world around us can remind us of important lessons from these teachings and help keep us focused on the …

Island Blue Spaces: A Deeper Exploration, Nicole Kras

Publications and Research

Preliminary research has shown that blue spaces provide many benefits to health and well-being. In response to the call for a deeper investigation into this area of inquiry, the current study seeks input from those (N=37) who live on islands in the Northeast region of the United States. Previous findings about the significance of having access to nature, identifying it as a favorite part and most influential reason for living on an island, were rearmed. Distinctions between island and mainland life were highlighted, emphasizing the importance of community. This study also brought to light participants’ grave concerns about issues such …
