Shadows Of Prejudice: The History Of The Right To Counsel And The Strickland's Pursuit Of Justice3 Amidst Forgotten Witnesses And Disregarded Evidence, Reem Haikal J.D., Ll.M

Ohio Northern University Law Review

In the United States’ criminal justice system, persistent problems with ineffective legal representation reveal significant systemic issues and injustices, underscoring the urgent need for meaningful reform. This paper argues that the United States’ criminal justice system faces deep-rooted problems due to ineffective legal representation, as evidenced by the evolution of the right to counsel, the challenges posed by the Strickland standard, and contemporary criticisms of legal defense practices. Through an analysis of historical developments, landmark legal decisions, and case studies, it becomes evident that meaningful reform is essential to address systemic injustices and ensure the constitutional guarantee of effective assistance …

Black Hole Of Administrative Law: The Threat Of An Ever-Expanding Major Questions Doctrine To The Judiciary, Fred B. Jacob Feb 2025

Black Hole Of Administrative Law: The Threat Of An Ever-Expanding Major Questions Doctrine To The Judiciary, Fred B. Jacob

St. John's Law Review

(Excerpt)

Below, this essay explores how an aggressive major questions doctrine could extend its reach to judicial interpretation and the implications of doing so. Indeed, had the Court applied the major questions doctrine to its own judicial holdings in seminal cases such as Bostock v. Clayton County or Allen v. Milligan, it would have flunked. This is also true for West Virginia’s creation of the doctrine itself, which claimed newfound authority to transform administrative law despite Congress’s significant legislative attention to agency rulemaking.

Expansion of the major questions doctrine to cases arising in the courts’ original jurisdiction would …

The Role Of Astrocytes In Probabilistic Decision-Making, Julia Pai Feb 2025

The Role Of Astrocytes In Probabilistic Decision-Making, Julia Pai

Arts & Sciences Electronic Theses and Dissertations

To flexibly navigate an uncertain world, animals need to be able to maintain internal representations of the values of good and bad things in the environment and to flexibly update their internal representations from experience. The purpose of this thesis work is to 1) develop tools and methodology to quantitatively study aversion-motivated behavior, and to 2) investigate the role of astrocytes, a non-neuronal brain cell type, in mediating experience-guided decision- making. The first part of this thesis describes a novel paradigm we developed to use dermal laser stimulation as an aversive stimulus for quantitatively studying motivated behavior in rodents and …

Culture And Attachment Preference Among Young Adults In Egypt And The United States, Musheera Anis Abdellatif Feb 2025

Culture And Attachment Preference Among Young Adults In Egypt And The United States, Musheera Anis Abdellatif

School of Education Faculty Publications

We explored the relationship between cultural values, recollected early caregiving experiences and young adult attachment preference. Young adults in Egypt (N = 209) and the United States (N = 554) ranked their current attachment preference, rated their collectivist and individualist beliefs, and recalled the relative contributions of their early caregivers. Egyptian students scored higher than US students on collectivism and recalled more involvement from non-parental caregivers. Most participants reported a preference hierarchy (82% Egypt & 84% US). Surprisingly, individualism was negatively associated with maternal attachment ratings and with having a clear principal attachment relationship, whereas higher collectivism predicted …

Displaced: An Ethnography Of Language And Identity Loss, Ariel Caroline Wilsey-Gopp Feb 2025

Displaced: An Ethnography Of Language And Identity Loss, Ariel Caroline Wilsey-Gopp

Dissertations and Theses

Through ethnography and personal narrative, I explore the language and identity loss of one person, my father, in order to understand the complex issues surrounding the effects of symbolic and structural violence on language and identity development. Through personal narrative, fieldwork, and interviews, I tell the story of one person, born in wartime during Nazi occupied Serbia, and follow the guiding questions: how does language get lost and what are the effects? Drawing on methodology set forth by empirical ethnographical work as well as more recent theory around epigenetics and trauma, my research synthesizes into focus three pillars of understanding …

The Military Order Of The Serpent And Philippine War Memory, 1904-1974, Eric Jason Kriner Feb 2025

The Military Order Of The Serpent And Philippine War Memory, 1904-1974, Eric Jason Kriner

Student Theses and Dissertations

The Military Order of the Serpent (M.O.S.) was an American anti-Filipino minstrel fraternity and veterans' organization comprised of members of the United Spanish War Veterans. To commemorate the Philippine-American War, the group dressed in Filipino blackface and paraded around the United States from 1904 to 1974. Publicly, the group’s narrative arc posited that Filipinos, by virtue of their contact with the United States Military, underwent a rapid, three-phased evolution from savage to civil. Privately, they celebrated one of the war’s atrocities, and expressed their racist hostilities and amalgamationist anxieties. During the 1920s, when Filipino emigration to the United States began …

Determining Spatial Responses Of Fishers (Pakania Pennanti) To Mechanical Treatments Of Forest Stands For Fuel Reduction, Tessa R. Smith, Eric M. Gese, R. David Clayton, Patricia A. Terletzky, Kathryn L. Purcell, Craig M. Thompson

Wildland Resources Faculty Publications

Historical forestry practices (e.g., fire suppression, heavy timber logging) have contributed to a discernable change in stand composition of western forests in the U.S., which now comprise a tinderbox mixture of increased surface and ladder fuels, dense stands, and fire-intolerant species. Forest managers are mitigating this concern by implementing silviculture practices (e.g., selective logging, thinning, prescribed burning) to reduce fuel loads and improve stand resiliency. Concern for habitat specialists, such as the fisher (Pekania pennanti), have arisen as they may be negatively influenced in the short-term by modifications to their environment that are needed to ensure long-term habitat …

In inflammatory diseases or following an injury, dysregulated inflammation is a common driver of pain and tissue damage. Macrophages are immune cells that contribute to the initiation, maintenance, and resolution of inflammation due to their phenotypic plasticity in response to signals from inflammatory microenvironments. Macrophages infiltrate and polarize toward a pro-inflammatory phenotype (M

Cholesterol-enriched plasma membrane domains are known to serve as signaling platforms in a diverse array of cellular processes. However, the link between cholesterol homeostasis and mutant APC-KRas-associated colorectal tumorigenesis remains to be established. Thus, we investigated the impact of Apc-Kras on 1) colonocyte plasma membrane cholesterol homeostasis, order, and receptor nanoclustering, 2) colonocyte cell proliferation, and 3) whether these effects are modulated by select membrane active dietaries (MADs). We observed that oncogenic APC-KRas increased membrane order by perturbing cholesterol homeostasis when cell proliferation is upregulated, in part by altering the expression of genes associated with cholesterol influx, export and de …

Estrogen Receptor-Α Ablation Reverses Muscle Fibrosis And Inguinal Hernias, Tanvi Potluri, Tianming You, Ping Yin, John Coon, Jonah J Stulberg, Yang Dai, David J Escobar, Richard L Lieber, Hong Zhao, Serdar E Bulun Feb 2025

Estrogen Receptor-Α Ablation Reverses Muscle Fibrosis And Inguinal Hernias, Tanvi Potluri, Tianming You, Ping Yin, John Coon, Jonah J Stulberg, Yang Dai, David J Escobar, Richard L Lieber, Hong Zhao, Serdar E Bulun

Faculty, Staff and Student Publications

Fibrosis of the lower abdominal muscle (LAM) contributes to muscle weakening and inguinal hernia formation, an ailment that affects a noteworthy 50% of men by age 75 and necessitates surgical correction as the singular therapy. Despite its prevalence, the mechanisms driving LAM fibrosis and hernia development remain poorly understood. Using a humanized mouse model that replicates the elevated skeletal muscle tissue estrogen concentrations seen in aging men, we identified estrogen receptor-α (ESR1) as a key driver of LAM fibroblast proliferation, extracellular matrix deposition, and hernia formation. Fibroblast-specific ESR1 ablation effectively prevented muscle fibrosis and herniation, while pharmacological ESR1 inhibition with …

Background: Lymphopenia and failure of lymphocytes to mount an early IFN-γ response correlate with increased mortality in COVID-19. Given the essential role of CD4 helper and CD8 cytotoxic cells in eliminating viral pathogens, this profound loss in lymphocytes may impair patients' ability to eliminate the virus. IL-7 is a pleiotropic cytokine that is obligatory for lymphocyte survival and optimal function.

Methods: We conducted a prospective, double-blind, randomized, placebo-controlled trial of CYT107, recombinant human IL-7, in 109 critically ill, patients with lymphopenia who have COVID-19. The primary endpoint was to assess CYT107's effect on lymphocyte recovery with secondary clinical endpoints including …

Sleep-Wake Variation In Body Temperature Regulates Tau Secretion And Correlates With Csf And Plasma Tau, Geoffrey Canet, Brendan P. Lucey, Et Al. Feb 2025

Sleep-Wake Variation In Body Temperature Regulates Tau Secretion And Correlates With Csf And Plasma Tau, Geoffrey Canet, Brendan P. Lucey, Et Al.

2020-Current year OA Pubs

Sleep disturbance is bidirectionally associated with an increased risk of Alzheimer's disease and other tauopathies. While the sleep-wake cycle regulates interstitial and cerebrospinal fluid (CSF) tau levels, the underlying mechanisms remain unknown. Understanding these mechanisms is crucial, given the evidence that tau pathology spreads through neuron-to-neuron transfer, involving the secretion and internalization of pathological tau forms. Here, we combined in vitro, in vivo, and clinical methods to reveal a pathway by which changes in body temperature (BT) over the sleep-wake cycle modulate extracellular tau levels. In mice, a higher BT during wakefulness and sleep deprivation increased CSF and plasma tau …

Retinoic Acid Antagonizes Estrogen Signaling To Maintain Adult Uterine Cell Fate, Yan Yin, Meade Haller, Lauren Goldinger, Shivani Bharadwaj, Emily So, Vivian Robles-Pinos, David Chen, Liang Ma

2020-Current year OA Pubs

Classical tissue recombination experiments demonstrate that cell-fate determination along the anterior-posterior axis of the Müllerian duct occurs prior to postnatal day 7 in mice. However, little is known about how these cell types are maintained in adults. In this study, we provide genetic evidence that a balance between antagonistic retinoic acid (RA) and estrogen signaling activity is required to maintain simple columnar cell fate in adult uterine epithelium. Transdifferentiation of simple columnar uterine epithelium into stratified cervicovaginal-like epithelium was observed in three related mouse genetic models, in which RA signaling was perturbed in the postnatal uterus. Single-cell RNA sequencing analysis …

School of Nursing and Midwifery

Aim To pragmatically investigate rectal emptying difficulty in women to identify if managing their symptoms with an innovative device is more effective and satisfactory than their usual care. Background Rectal emptying difficulty has a mostly unknown influence on women and frequently a hidden issue. Self-management alternatives are underappreciated. Despite the magnitude of the problem and its influence on women’s lives and healthcare, non-surgical alternatives have received little attention. Methods This cohort study of 35 female participants, recruited via secondary care outpatient clinics, used composite questionnaires before and after an 8-week intervention using the device. The questionnaire comprised of a quality …

Identifying Research-Based Practices For Increasing Peer Interaction In Children With Hearing Impairment: A Review Of The Literature, Amal Aldawoud Feb 2025

Identifying Research-Based Practices For Increasing Peer Interaction In Children With Hearing Impairment: A Review Of The Literature, Amal Aldawoud

International Journal for Research in Education

Establishing peer interaction is critical for all childhood development, especially for children with hearing impairment (HI), who tend to experience a lot of difficulties in interaction. Practices aiming to promote peer interaction in children with HI need to be informed by evidence from quality research. This paper aims to review and evaluate research studies that focus on interaction between children with HI and their peers (with or without HI) in self-contained and inclusive classrooms. Seven empirical studies published in peer-reviewed journals from 1990 to 2023 were examined and evaluated, using the Council for Exceptional Children (CEC, 2014) quality indicators. Several …

Towards A Biblical Theology Of Natural Theology, Armen Oganessian Feb 2025

Towards A Biblical Theology Of Natural Theology, Armen Oganessian

Liberty Theological Review

This article aims to construct a biblical theology of natural theology through an examination of the Book of Job. This examination will employ a three-pronged approach. Firstly, it will place the Book of Job within the overarching redemptive-historical narrative of Scripture. Secondly, it will analyze the book's structure, viewing it as crucial for interpreting its message on natural theology. Finally, it will examine Job's dialogue with his companions (chapters 3:1-31:40) as a discussion of natural theology. This tripartite analysis will demonstrate that Job’s author prompts readers to assess the conversation between Job and his friends within the framework of the …

Public Theology And Political Polarization: Environmental Policy, Jean Golicz, Leonard S. Momeny Feb 2025

Public Theology And Political Polarization: Environmental Policy, Jean Golicz, Leonard S. Momeny

Liberty Theological Review

The purpose of this article is to explore the impact of public theology on potentially polarizing political views. Specifically, the historical and contemporary interpretations of the Lynn White Thesis (1966) are examined as well as the practical implications for developing environmental policies that align with a biblical worldview. The authors propose the application of multiple paradigms to the study of religiosity and environmental activism as a way of addressing the complexity and diversity of various viewpoints. Understanding the multiple ways Jesus operated in an equally contentious and polarized society creates a path forward for churches. By rejecting the supposition that …

James' Warning Against Inauthentic Faith: Confronting The Actions Of The Wealthy (James 5:1-6), Joseph Daniel Peters, Bradley Wayne Ellison Feb 2025

James' Warning Against Inauthentic Faith: Confronting The Actions Of The Wealthy (James 5:1-6), Joseph Daniel Peters, Bradley Wayne Ellison

Liberty Theological Review

The primary message of James is that one’s faith should be reflected by their actions. The author of James argues that helping the needy is what pure religion and genuine faith looks like (1:27; 2:14-18). He contrasts this with his description of the wealthy who oppress the poor by hoarding their wealth and defrauding their employees of their wages (5:1-6). The author criticizes the oppressive and greedy actions of the wealthy, arguing that their actions will testify against them and lead to their misery. One major question is whether these wealthy are within the church (i.e., self-identify as Christians). If …

Defending The Doctrine Of Hell, Jordan P. Ballard Feb 2025

Defending The Doctrine Of Hell, Jordan P. Ballard

Liberty Theological Review

The doctrine of hell, or the final state of the wicked, has become one of the most objectionable Christian doctrines because it depicts God as vengeful and wrathful, which is offensive to human sensibilities. As an extension of the problem of evil, where God is put on trial for allowing what may appear to be gratuitous pain and suffering in the world, many Christians and non-Christians alike wonder how a loving God could consign people to suffering in hell forever. After all, why didn’t God make a world where all would be saved if He is truly loving? Belief in …

A Man After Yahweh-Chemosh's Own Heart: Syncretism And Davidic Allusions In The Story Of Jephthah, J. Christian Doling

Liberty Theological Review

Jephthah's story has caused no small amount of confusion among scholars as they wrestle with what to make of Jephthah's oath and subsequent sacrifice of his daughter. Some have believed that Jephthah was acting in accordance with Yahweh's wishes, others believe that he was acting out of selfish interest. However, there are two aspects of the literary makeup of the Jephthah story that can help shed some light on the subject. Firstly, the story is filled with Davidic allusions, and the second aspect is syncretism. The Davidic allusions paint Jephthah as a prefigurement of David. In other words, David and …

A Review Examining The Factors Contributory To The Socialization Of A Culture Of Environmental Stewardship, Colby Nixon Feb 2025

A Review Examining The Factors Contributory To The Socialization Of A Culture Of Environmental Stewardship, Colby Nixon

Undergraduate Research and Engagement Symposium

Environmental stewardship is an ambiguous but significant term meaning that responsibility for the environment — and its quality — is shared between all individuals who interact with it. As a culture-wide phenomena, it is correlated with a mutualistic relationship with nature and the Earth. My study responds to a question as to which and how variables contribute to a societal mindset of environmental stewardship. This review synthesizes numerous studies across diverse cultures and contexts to examine trends therein. In doing so, I discovered that religion, policy, human development, linguistics, and economic roles play a part in socializing environmental stewardship into …
