Tribal Sovereign Immunity: Absolute Authority Or Accountability, Kekek Jason Stark
Tribal Sovereign Immunity: Absolute Authority Or Accountability, Kekek Jason Stark
Public Land & Resources Law Review
In the wake of the recent United States Supreme Court decision of Trump v. United States, the Court determined that the President as Chief Executive is immune from conduct associated with official acts.3 The question that emanates from this opinion is how will this decision affect Indian Country and tribal court determinations of tribal sovereign immunity? This article will attempt to address this question. I begin with the Anishinaabe story of Bebaamosed miinawaa Gawigoshko’iweshiinh (The Trickster and the Little Scary Bird)5 in an attempt to understand the complicated nature of tribal sovereign immunity.
Discovering The Doctrine Of Discovery, Douglas Lind
Discovering The Doctrine Of Discovery, Douglas Lind
Public Land & Resources Law Review
The doctrine of discovery is a concept in crisis. A principle of public international law associated with the so-called Age of Discovery, the doctrine of discovery is commonly said to have authorized European nations to claim the lands of indigenous peoples and establish settlements on the basis of “discovery” alone. Today, with good reason, the doctrine is widely condemned. The United Nations has denounced it as “the very foundation of genocide.” Describing its manifest injustices against indigenous cultures, dominion, and sovereignty as “devastating, far-reaching and intergenerational,” the UN Economic and Social Council has called for the doctrine to be categorically …

Uses And Abuses Of Johnson V. M’Intosh In Native American Land Rights Cases: Investigative Insights From The Indian Law Justice Files, John P. Lavelle
Public Land & Resources Law Review
The 200th anniversary of the foundational Indian law decision Johnson v. M’Intosh has come and gone, with many scholars contributing criticism and commentary. The dominant focus has been the case’s notorious embrace of the so-called “doctrine of discovery,” an odious theory for rationalizing European nations’ claims of superior rights to lands occupied by Indigenous Native American peoples. Commanding less attention, however, is the Johnson decision’s core protective legal feature, i.e., its reinforcing the United States government’s duty to guard against the alienation of Indian lands through private, unauthorized acquisitions.

The Relationship Between Language And Musical Skill Development In Individuals With Complex Communication Needs: Implications For Interprofessional Pedagogical And Research Practice, Lisa Pierce-Goldstein
Educational Studies Dissertations
The relationship between music and language has long fascinated scholars and educators. Observational and experimental research has yielded evidence of music’s positive impact on language development. However, research has largely focused on individuals who primarily use speech to communicate. Individuals with complex communication needs (CCNs), who use augmentative and alternative communication (AAC) to communicate, are underrepresented in the literature.
Purpose: The primary purpose of this study is to gain a deeper understanding of the relationship between language development and musical skill development in individuals with complex communication needs using alternative assessment tools: the Communication Matrix (CM; i.e., language) and the …

Advances In The Mechanisms Of The Effects Of Pseudomonas Spp. Proteases On Gelatinization Of Dairy Products And Regulation Strategies, Shengjia Liu, Kairu He, Hui Li, Yongqiang Li, Xinyi Li, Rina Wu, Junrui Wu, Sanjun Zhao
Journal of Food Science and Biotechnology
Gelatinization of dairy products has long been a common problem caused by heat-resistant protease contamination.Despite the high-temperature sterilization process,heat-resistant proteases secreted by Pseudomonas spp.can survive under extreme conditions. These enzymes can break down the peptide bonds of proteins in milk, resulting in the bitter taste and gelatinization of milk, which seriously affects the quality and shelf-life of dairy products. In view of the complex gelatinization mechanisms of dairy products and the lack of in-depth investigation, the author systematically outlined the characteristics, enzyme activity detection methods, and influencing factors of Pseudomonas spp.proteases, delved into the mechanisms underpinning the protease-induced gelatinization of dairy products, and summarized the control measures and novel …

Will Anyone Play With Me? Building Resilience Through Community Play With Transgender And Gender Diverse Young Adults, Lee Lebeda
Expressive Therapies Theses
The recent increase in anti-trans legislature in the United States has negatively impacted the mental health of transgender young adults nationwide. Current research suggests that creative expression in a group setting may be uniquely suited to help transgender people combat the negative mental health effects of internalized anti-trans messaging. Based on this research, a community engagement project was designed for transgender young adult participants to explore resilience building through drama therapy-informed community play. Three play-based support groups, facilitated by a drama therapy graduate student who identified as a peer to the participants, were offered to transgender young adults in their …

Synthesis Of Mindful Inspiration, Syncretism, And Unionism Yields The Mind Method For Alleviating Public School Teacher Burnout, Walt Durand
Mindfulness Studies Theses
Public school teachers face the risk of burnout. Mindfulness has been suggested for addressing the chronic stress that can lead to teacher burnout. However, criticisms have been raised regarding the sometimes problematic nature of mindfulness programs (MPs) for public school teachers. For example, MPs may be perceived as religious and therefore not appropriate for secular public schools. Additionally, MPs may not be designed with enough of an ethical framework and may not do enough to authentically help teachers address the systemic challenges they face. In response to these limitations, this paper suggests the synthesis of the following MP enhancements to …

Objective
Unilateral vocal fold paralysis (UVFP) due to recurrent laryngeal nerve injury (RLN) is a major cause of voice disorders. We have recently identified three biomolecules (agrin, acetylcholine, and neuregulin) with the potential to promote reinnervation after RLN injury. This study aimed to determine if a gelatin injectable with the reinnervating biomolecules will induce site-specific amplification of neurotrophic factor release and reinnervation after RLN injury in unilateral vocal fold paralysis.
Methods
C57BL/6 mice underwent RLN transection with the following treatment allocations: saline control (N = 16), biomolecule cocktail only (N = 16), and biomolecule-infused gelatin (N = …

Brain development begins with neurogenesis in progenitor zones and ends with expansive, intricately-patterned cellular diversity in the adult brain. We took advantage of bioelectric interactions between DNA and embryonic tissue to perform "stereo-tracking," a developmental targeting strategy that differentially labels cells at different depths within progenitor zones. This 3D labeling was achieved by delivery of plasmids with distinct electrokinetic mobilities in utero. We applied stereo-tracking with light sheet imaging in the cerebellum and identified that Purkinje cells follow embryonically committed developmental trajectories, linking distinct progenitor zone subfields to the mature topography of the cerebellar cortex. We additionally identified an unexpected …

A Retrospective Cohort Study Of Valproate And Infertility In Men With Epilepsy Or Bipolar Disorder Using International Health Data, Lance Watkins
A Retrospective Cohort Study Of Valproate And Infertility In Men With Epilepsy Or Bipolar Disorder Using International Health Data, Lance Watkins
Peninsula Medical School
Valproate is highly effective at treating epilepsy and bipolar disorder. It faces prescribing restrictions in men due to concerns it causes testicular dysfunction and infertility. These mostly stem from animal models – the human evidence is limited and conflicting. We report the largest ever retrospective cohort study of infertility in men with epilepsy or bipolar disorder, using real-world healthcare data from TriNetX. 91,917 of the men are exposed to valproate, and 535,803 unexposed. Cohorts are propensity score matched for a comprehensive set of baseline covariates, and survival analysis is undertaken using Cox-proportional hazards models. No significant difference is seen between …

Biophobia And Pet Ownership: Can Having A Pet Mitigate Our Fear And Aversion Towards Nature?, Alexia Barrable
The International Journal of Ecopsychology (IJE)
Biophobia, which we defined as fear, disgust, or aversion toward natural environments or organisms, has received little empirical attention when compared to biophilia, despite its implications for human and planetary wellbeing. This mixed-methods study explores the relationship between pet ownership, biophobia, and nature connectedness among 373 English- speaking adults. Quantitative findings reveal that (M = 26.4) exhibit significantly lower levels of biophobia than non-pet owners (M = 30.1; U = 5179, Z = -2.95, p = .002, R = 0.27), although no significant differences in nature connectedness were found across pet ownership (U = 7033, Z = 0.31, p = …

Misandry And Men’S Equity In Selected Novels By Female Authors, Omar Abbas Sallal
Misandry And Men’S Equity In Selected Novels By Female Authors, Omar Abbas Sallal
Alustath Journal for Human and Social Sciences
This study aims to shed light on the concept of misandry in selected novels by Octavia E Butler and Margaret Atwood. Several previous studies dealt with the concept of misogyny in detail and depth, so it became necessary to present a different point of view. This study reached the following results, analysing the female and male characters to accurately determine the concept of misandry. This study gives a different model of female novelists’ novels to inform the reader of the existence of two sides of female writers, and the novelist Suanne Laqueur was taken as a counter example to the …
