Show And Tell: Writing Constitutional Law Casebooks When The Law Doesn't Matter, William D. Araiza

Writing a constitutional law casebook today presents significant challenges. One reason among several stands out: law matters less—indeed, sometimes very little—to those charged with interpreting our constitutional law and implementing our constitutional system.

This Essay examines this challenge and explains how my contribution to the constitutional casebook genre attempts to answer it. It argues that the current moment requires instructors, and the books they use, to “show”—that is, to demonstrate to their students both the handiwork of those interpreters and implementers and alternative pathways. Sometimes, however, practical considerations preclude such showing. In those situations, “telling” may be required. But regardless …

Myxobacteria are prolific producers of specialized metabolites and key contributors to microbial interactions within soil and other environments, yet fundamental questions remain about the conservation of their biosynthetic capacities and the dynamics that shape their coexistence with neighboring microorganisms. This dissertation addresses these gaps through three integrated research directions. In Chapter 2 we utilized a pan-genome framework across eleven genera and 195 sequenced genomes,including ten newly reported isolates, and found five BGCs were identified as the conserved BGCs across the Myxococcota. These clusters encode metabolites with established ecological functions, none of which are known toxins, suggesting selective maintenance of signaling …

The third-person accusative clitics in Brazilian Portuguese (BP) are virtually extinct in spoken language and informal writing, although formal texts and contexts still retain them. Speakers often mark third-person direct objects using the stigmatized full pronouns (syncretic with the nominative forms), null objects, or full noun phrases (NPs), also referred to as lexical NPs. The realization of these forms is not arbitrary; it is influenced by the semantic properties of the referents, particularly animacy (mainly humanness) and specificity. Animate referents [+animate] tend to be realized with overt pronouns, whereas inanimate [–animate] ones tend to be used with null objects. This …

Nutrient enrichment from wastewater effluent and runoff is a major driver of eutrophication in freshwater systems, increasing the need for effective and ecologically beneficial treatment strategies. Constructed wetlands (CWs) offer a nature-based solution for reducing nitrogen (N) and phosphorus (P) while simultaneously supporting habitat and biodiversity. However, most CW research has focused on traditional species such as cattails and bulrushes, with limited quantitative data on the performance of Texas native plants. This study evaluated the nutrient uptake potential and stress tolerance of two Texas native species—buttonbush (Cephalanthus occidentalis) and Maximilian sunflower (Helianthus maximiliani)—in simulated, recirculating wetland systems.

This study addresses some of the primary deficits of a localization/homogenization workflow for composite materials by focusing on the visualization and enhancement of models based on GMC and HFGMC, with emphasis on their implementation within the NASMAT ecosystem.

This thesis details the development of two dynamic, ParaView-based plugins that convert large hierarchical simulation outputs into interactive insights. While NASMATDiscreteElement systematizes RUC creation with transparent parametrization in a reproducible GUI, NASMATExplorerRUC enables the inspection of deeply nested datasets through accurate cell picking and synchronizes comparisons between parent and child views. Existing research shows that individuals monitor for prospective memory (PM) targets strategically by heightening monitoring in relevant contexts where PM targets are likely to occur, and relaxing monitoring in irrelevant contexts where PM targets are unlikely to occur. To date, the study of strategic monitoring has been done in paradigms in which participants receive explicit contextual information to help guide their monitoring. Moving and holding-still (holding) have been posited to be separately controlled. The paretic arm after stroke exhibits different abnormalities during rest vs. movement, providing an opportunity to ask whether control of these behaviors is independently affected in stroke. We quantified resting postural abnormalities in human stroke patients by measuring their biases in force production as they held their hand still in various locations in a planar workspace and then assessed whether these resting force biases influenced reaching in the same workspace. Cellulose nanocrystals (CNCs) coupled with polymers featuring a high density of amine functional groups, such as polyethylenimine (PEI), exhibit significant metal-capturing capabilities. Rendered animal fat has applications in a vast number of industries, with the potential to be used as a feedstock for the biodiesel/renewable diesel industries. Nevertheless, rendered fat samples occasionally contain concentrations of metals/inorganic contaminants above the suitable threshold for use in this application. Thus, a cost-effective solution to remove light metal/inorganic contaminants from rendered fat samples is desirable.

The Northern Great Plains (NGP) is one of the largest intact grasslands remaining in the world. These two studies examine a few of the ecological concerns on the NGP today. First, the woody encroachment of conifers into grasslands and the effects of wildfires. Second, the effects of bison (Bison bison) reintroduction on plant communities. Unloved Ecologies is an exhibition of ceramic sculptures that stage encounters between human and nonhuman bodies. Through it, I investigate the intersections of queer identity and ecology to reevaluate what society often deems “unlovable.” By working with the language of Queer Ecology, I explore the tensions between protection and vulnerability, as well as between cultivated order and wild resistance. Dynamic 3D videos are now widely used in VR, AR, and telepresence, where users often want to change the style or appearance of objects such as clothing over a whole sequence. However, editing such dynamic 3D content is still hard, because appearance, geometry, and motion are tightly coupled, so even a simple color change must stay consistent in all views and at all time steps. Existing editing methods based on 4D Gaussian Splatting often work in a frame-by-frame way, which is slow and makes it difficult to keep temporal and multi-view consistency.

This thesis work presents the design, testing, and validation of a continuum-legged biped robot equipped with a kangaroo inspired tail for enhanced stability and adaptability. Unlike traditional rigid link robots, this one expands on soft-legged robots and utilizes tendon-driven continuum robots to mimic octopus and kangaroo behavior for locomotion. The robot uses a hierarchical hybrid control framework to implement walking, obstacle avoidance, vaulting, and push recovery behaviors. To test the performance of the robot four sets of experiments were conducted to validate these systems and evaluate how they performed. This project sheds light on mental health issues within the Black community and the need for faith communities to intentionally address mental health issues in communities of color. Black men are oppressed by an interplay of cultural, historical, societal, and economic factors that impact their well-being. Racial discrimination and oppression are non-medical drivers exacerbating mental health disorders among Black men. The influences of culture and faith fabricate barriers to help-seeking behavior, and mistaken perceptions of masculinity cause many men to suffer in silence. Federated learning (FL) using the federated averaging (FedAvg) algorithm has shown great advantages for large-scale applications that rely on collaborative learning, especially when the training data is either unbalanced or inaccessible due to privacy constraints. We hypothesize that FedAvg underestimates the full extent of heterogeneity of data when the aggregation is performed. We propose Precision-Weighted Federated Learning (PW) a novel algorithm that takes into account the second raw moment (uncentered variance) of the stochastic gradient when computing the weighted average of the parameters of independent models trained in a FL setting. This reflective artist’s statement by Alisa Gorshenina (Alice Hualice) intertwines autobiographical narrative with the creative context of four works produced during and after her politically forced displacement from Russia. Gorshenina recounts a lifelong pattern of resisting external pressures—from expectations to relocate for education and career advancement to demands that she flee Russia following the 2022 invasion of Ukraine. In this deeply personal and politically charged epistolary essay, Joanna Zabielska reflects on the intersecting forms of erasure occurring within European cultural institutions and at the continent’s militarized borders. Herbivore foraging behavior plays a critical role in shaping grassland structural heterogeneity, with selection often driven by forage biomass and nutritive value. Currently, it is thought that herbivores primarily select areas that are greater in nutritive value, and low in biomass. More specifically, disturbances like fire and grazing have been thoroughly studied showing that recently burned and grazed areas are not only higher in nutritive value but disproportionately selected by herbivores in comparison to undisturbed areas. However, most studies address only narrow ranges of defoliation, comparing intensely defoliated sites (< 10 cm) to those that are either not defoliated or have experienced a much longer time since defoliation, thereby decreasing grazing pressure as biomass increases. However, one of the most widely used methods of defoliation in grasslands, mowing, hasn’t been thoroughly studied for its effects on nutritive value, and how it impacts herbivore selection. In the twenty-first century, slavery is still alive in the United States, but thankfully, it is increasingly unwell. States across the country, in places both expected and unexpected, have begun to pass amendments to their state constitutions that seek to finish the job started over 150 years ago by the Thirteenth Amendment. Whereas that amendment included an exception, providing for slavery and involuntary servitude as punishment for a crime, these new state amendments contain total prohibitions. But these prohibitions have thus far proven unable to end the blight of prison slavery merely through their text. This Article asks why and …

Prescription rates of fluoxetine, the most dispensed selective serotonin reuptake inhibitor, have been rising among the juvenile population. Since adolescence is a critical developmental period in which the brain undergoes pruning, chronic increases in serotonin levels may lead to long-term neurobiological changes in brain regions responsible for emotional regulation. Thus, using mice as a model system, this thesis evaluated how adolescent fluoxetine exposure (AFE) influences the expression of serotonin transporters (SERT) in the adult hippocampus and prefrontal cortex.
