Settler colonialism continues to shape present injustices of Indigenous Peoples. The settlers of Nevada County do not recognize the historical past of colonialism and how it has changed the Nisenan Tribes relationship to these lands/waters. Or how colonization still thrives in Nevada County through settler relationships with these lands/waters. Settler colonialism is ongoing, it is not an event that happened during the gold rush. Phylogenetic And Geographic Relationships Of Cheilostome Bryozoans In The Eastern Pacific, Hannah E. Lee

The phylum Bryozoa is an incredibly diverse group of marine invertebrates with a widespread global distribution that is well suited for evolutionary studies but whose phylogenetic relationships are still poorly understood. Although recent studies on bryozoan taxonomies and phylogenies have increased, there is still a lack of assessment of species found at shallow water (<1 m) to intertidal depths. In this study, I aimed to expand the taxonomic sampling and assessment of the phylogenetic diversity of cheilostome bryozoans along the California coastline by utilizing mitochondrial DNA as well as inferring potential correlations between species presence and dispersal range both within and between rocky outer coast and sheltered harbor habitats. Illumina high-throughput sequencing was used to produce mitogenomes for cheilostome bryozoan samples collected off rocks from two rocky intertidal sites and off settlement panels from two harbor sites. Phylogenetic analyses generated evolutionary hypotheses of species relationships alongside geographic mapping of their distribution. This study identified 15 distinct species that represent 10 different families to form the first comprehensive phylogeny for multiple bryozoan families in California across a total range of approximately 973 km of coastline. Three genetically distinct species were found at multiple sites that are separated by a combination of rocky shores and sandy beaches, which indicates that the dispersal range of these species are not limited by geographic barriers along the coast of California. These results provide a future opportunity for further integration of this data with the phylogenies generated in this study to examine more robust evolutionary hypotheses for the phylogenetic and geographic relationships of Californian bryozoan species.

Using hermeneutical methodology, this paper examines some of the legal fictions that form the foundation of Federal Indian Law. The text of the U.S. Supreme Court’s 1823 Johnson v. M’Intosh opinion is evaluated through the lens of the Convention on the Prevention and Punishment of the Crime of Genocide to determine the extent to which the Supreme Court incorporated genocidal principles into United States common law. The genealogy of M’Intosh is examined to identify influences that are not fully apparent on the face of the case. Asymmetric cell division and migration are critical for neural stem cell differentiation and brain development. When these processes are dysregulated in neural progenitor cells (NPCs), developmental defects and diseases like glioma can result. Lgl1 is a tumor suppressor gene that was first characterized in Drosophila neuroblasts (Strand et al., 1994). It is best known for its regulation of asymmetric cell division through its association with the Par complex. The PI3K/AKT signaling cascade is involved in cellular migration and is also regulated by Par signaling. Many academic institutions and disciplines are also focused on recruiting and retaining students from socially marginalized communities in the name of equity, inclusion, and diversity. Despite this, some institutions in practice prioritize image, status, and wealth while deprioritizing resources, care, and support for students and their learning conditions. This thesis explored the feasibility of electrifying a food market in an urban city in Nigeria with a hybrid biogas-powered mini-grid. Under the Energizing Economies Initiative of the Rural Electrification Agency of Nigeria, nine markets in the country currently receive constant access to electricity via hybrid mini-grid systems. As a majority of these systems are diesel-solar-battery systems, this thesis explored the use of biogas generators as a substitute for diesel generators in hybrid mini-grids for food markets. Advancements in bioacoustics field studies have further elucidated spatial, temporal, and behavioral aspects of otherwise-cryptic species, as well as offering insights into species communication. The discovery of high-frequency vocalizations in North American flying squirrels in particular has allowed researchers to use ultrasonic acoustic recorders to detect these cryptic species in the wild. Investigations into vocalizations of northern flying squirrels (Glaucomys sabrinus) and southern flying squirrels (G. volans) have highlighted call type variation between species and the potential use of recorders as a tool to examine vocal activity patterns. Juvenile Chinook Salmon (Oncorhynchus tshawytscha) migrating through the Sacramento – San Joaquin Delta (the Delta) in central California have higher mortality rates than salmonids migrating through other west coast estuaries. Some hypotheses for high mortality rates include entrainment into water export facilities, physical alterations of the river system, and predation. Of these factors, predation is considered the least understood but may have the largest impact. Predation from large populations of non-native piscivorous fishes in the Delta is believed to effect abundances of Central Valley Chinook salmon, however sufficient data supporting this hypothesis is scarce. The American Bullfrog (Rana catesbeiana) is a highly invasive species that has successfully colonized habitats around the world. The genetic variability of immune genes within invasive populations, like that of bullfrogs, may contribute to how resistant a population is to pathogens. Biodiversity-ecosystem function (BEF) research aims to explain how species and their environments interact with each other. Microbial communities engage in vital biogeochemical pathways in a variety of natural ecosystems, and yet there are large knowledge gaps about the specific metabolic pathways in which they are involved. Degradation specifically contributes to nitrogen cycling globally through the breakdown of large organic nitrogen compounds into small inorganic nitrogen that is necessary for the survival of many other organisms. For millennia, humans and wildlife coevolved in a myriad of landscapes influencing each other through social interactions. Humans may be providing non-verbal signals in their facial features with gaze and head orientation that are perceived by non-human animals. The ability to follow human eye gaze and head orientation could enable non-human animals to access valuable resources, for example, birds provided with supplemental food. Direct or indirect contact between domestic populations of animals and wildlife carries an inherent risk for transmission of pathogens that cause infectious disease. In Humboldt and Del Norte counties of northern California, ongoing conflict between ranchers and Roosevelt elk groups results from elk use of ranching pastures and pastures on private land. Fecal samples from elk in association with cattle, cattle, and from elk not in known association with cattle were assessed for the presence of bacteria Salmonella enterica and pathogenic Escherichia coli to assess whether association with cattle increases risk of infection for elk. Legal regimes in the United States generally conceptualize obligations as attaching along one of two pathways: through the entity or the individual. Although these dual conceptualizations made sense in an ordinary pre-modem world, they no longer capture the financial system land scape, now that artificial intelligence has entered the scene. Originalism, together with textualism, has been of growing interest to legal scholars and jurists alike. Discerning and putting forth the views of “the founders” has become part and parcel of effective advocacy, particularly regarding constitutional questions. Arizona is no exception, with its courts explicitly giving originalism primacy over all other interpretive doctrines for discerning the meaning of an ambiguous provision of its Constitution.

e United States has long treated poverty and disability as separate legal and social categories, a division grounded in widespread assumptions about the “deserving” and “undeserving” poor. In the case of disability, individuals generally are not thought to be morally responsible for their disadvantage, whereas in the case of poverty, individuals are assumed to be at fault for their disadvantage and are therefore less deserving of aid. This Article argues that recent advances in brain and behavioral science undermine the factual basis for those assumptions. Poverty inhibits brain development during childhood and, later in life, adversely affects cognitive capacities that …

In the last year, headlines have heralded the introduction of several radical new technologies that promise to revolutionize procreation and transform our understanding of reproduction. In March 2021, for example, scientists revealed that mouse embryos had been grown in" artificial wombs" for 11 days, roughly half the animal's natural gestation period. According to Jacob Hanna, the biologist at the Weizmann Institute of Science in Israel who led the research team: "This sets the stage for other species. Social movements use legal tools to create narratives. Those narratives support social agendas which certain movements leverage to mislead their followers and potential followers. In this Article, we examine one influential anti-vaccine organization, the Informed Consent Action Network (ICAN), that uses its far-reaching platform to create false narratives around legal action. Again and again, this anti-vaccine group misrepresented both the legal and the factual meanings of court decisions, settlements, and other legal actions to create a narrative to galvanize its followers and influence newcomers. ICAN filed lawsuits that make anti-vaccine arguments—even when the legal framework did not fit doing so—and …

Robinhood and its imitators activated millions of new investors. Perhaps we should applaud them for finally resurrecting the retail investor after a decades-long decline. There are, however, reasons for concern. Robinhood racked up record fines in the run-up to its IPO. Its users are young, inexperienced, and prone to speculating in risky investments. Given these concerns, this Article considers how to protect this new class of “ultra-retail investors” while also leaving regulatory breathing room for these new market participants. Scholars often presume that administrative dysfunction is a deviation from the norm of regularity in administrative law. This presumption is reinforced by courts who defer to agencies on the basis of a legal fiction of idealized regularity. In reality, irregularities are common in policymaking and they make agencies vulnerable to dysfunction. Irregularities are not bugs, but features of the administrative state. Sometimes, a national emergency makes political influence unavoidable and urges departures from usual regulatory processes. At other times, however, the framing of a problem as a national emergency is a pretextual justification to pursue a pre- determined political goal …

Policymakers and lawyers posit formal citizenship as the key to inclusion. Rather than presume that formal citizenship will necessarily promote equality, this Article examines the relationship between citizenship, racial equality, and nationalism. It asks: What role does formal citizenship play in excluding noncitizens and Asian, Latinx, and Muslim citizens racialized as foreigners? What effects does it have on the meaning of being American as a non-White citizen? The Article argues that commitments to colorblind equality and democratic self-governance of the nation stand in contradiction to aspirations to protect all persons within the nation. Restorative practices (RP) in K-12 schools in the United States have grown exponentially since the early 1990s. Developing against a backdrop of systemic racism, RP has become embedded in educa- tion practice and policy to counteract the harmful and persistent patterns of disparities in school discipline experienced by students of color. Within this legal, social, and political context, the em- pirical evidence that has been gathered on school-based restora- tive justice has framed and named RP as a behavioral interven- tion aimed at reducing discipline incidents—that is, an “alternative” to punitive and exclusionary practices. Legal scholars have long been fascinated by the topic of government secrecy. Yet they have largely focused their attention on federal secrecy, rarely exploring secrecy in other contexts. This Article addresses this gap. It turns its attention to state and local government secrets, applying the lens of federal secrecy to the subfederal regime. In doing so, it identifies a troubling new development in state and local law: the migration of powerful federal secrecy protections, initially developed to shield the national security state, into the state and local context. Few contest the importance of a robust transparency regime in a democratic system of government. In the United States, the “crown jewel” of this regime is the Freedom of Information Act (FOIA). Yet despite widespread agreement about the importance of transparency in government, few are satisfied with FOIA. Since its enactment, the statute has engendered criticism from transparency advocates and critics alike for insufficiently serving the needs of both the public and the government.
