The Sticks Of Judah And Joseph: Reflections On Defending The Kingdom, Joseph M. Spencer Jan 2022

The Sticks Of Judah And Joseph: Reflections On Defending The Kingdom, Joseph M. Spencer

Faculty Publications

I wish to pursue two tasks simultaneously in this essay. First, in line with its title, I will address a very old matter of interpretation. I aim to explain as definitively as possible how to make sense of the relationship between Ezekiel 37:15–19, with its talk of the sticks of Judah and Joseph, and the claims of the Restoration, which include somehow connecting the stick of Joseph to the Book of Mormon. Second, in line with the subtitle of this essay, I wish to draw a crucial lesson from the history of how Latter-day Saints have dealt with this issue …

Nearly a million people dead and counting. More than 77 million infected, a little less than one-fifth of the total infections worldwide. The United States has had more deaths than any other country, and its COVID-19 death rate of 276 per 100,000 people is the highest among the world’s wealthiest nations. Blacks, Hispanics, and Native Americans are hospitalized and die at significantly higher rates than whites. Some bright lights exist too, one being the speedy development of vaccines and their deployment in 2021 – although there, too, both the national government and the states have sometimes stumbled. Another is legislative …

Zombie Laws, Howard M. Wasserman Jan 2022

Zombie Laws, Howard M. Wasserman

Lewis & Clark Law Review

A judicial declaration of constitutional invalidity does not erase a challenged law. Such a law is “dead” in that enforcement efforts will not succeed in court, where judicial precedent binds and dictates the outcome in future litigation. But such a law is “alive” in that it remains on the books and may be enforced by a departmentalist executive acting on an independent constitutional judgment. Judge Gregg Costa has labeled these statutory remainders “zombie laws.”

This Article describes several principles that define constitutional litigation, how those principles produce zombie laws, and the scope and nature of zombie laws. It then describes …

Requiring Majority Winners For Congressional Elections: Harnessing Federalism To Combat Extremism, Edward B. Foley Jan 2022

Requiring Majority Winners For Congressional Elections: Harnessing Federalism To Combat Extremism, Edward B. Foley

Lewis & Clark Law Review

Congress should enact a law requiring a candidate for a seat in Congress to receive a majority of votes in order to win the election. Congress should let states determine what particular procedure to use to determine whether a candidate wins a majority, as there are significantly different methods of identifying a majority winner. While this simple piece of legislation might seem inconsequential—many Americans assume, erroneously, that elections already require majority winners—it in fact would cause states to undertake a form of experimentation in the details of electoral system design that would have the effect of counteracting the threat that …

Protecting The Sublette Antelope Migration: An Analysis Of The Evolution Of The Legal Tools Employed To Protect The Sublette Antelope Herd From Fencing Obstructions, Colin Reynolds Jan 2022

Protecting The Sublette Antelope Migration: An Analysis Of The Evolution Of The Legal Tools Employed To Protect The Sublette Antelope Herd From Fencing Obstructions, Colin Reynolds

Lewis & Clark Law Review

A biological marvel of the natural world, each year a small herd of pronghorn antelope—called the Sublette herd—migrate over 300 miles through a mix of public and private land in Wyoming. The Sublette herd’s annual movement constitutes one of the largest remaining “big game” migrations within the continental United States. Unfortunately, this migration faces an increasing number of obstacles threatening its long-term viability; chief among them being fencing obstacles. This Comment examines the evolution of the legal tools the federal government, the state of Wyoming, and everyday citizens can use to protect the Sublette herd’s migration.

Domsetic Terrorism: Not Actually A Crime, But Desperately In Need Of A Federal Response, Rebecca K. Tucker Jan 2022

Domsetic Terrorism: Not Actually A Crime, But Desperately In Need Of A Federal Response, Rebecca K. Tucker

Lewis & Clark Law Review

Since the founding of the United States, the U.S. Government has dealt with national security threats, both external and internal. While there are federal laws in place to protect the nation against external actors, these instruments cannot be turned directly inward to address the rising threat of domestic terrorism. This Comment explains the issues with that approach and concludes by proposing specific solutions, focusing on the need for a coordinated response from the agencies and departments tasked with the investigation, intelligence, and prevention of domestic violent extremism and terrorism.

In March 2020, the world faced not only a public health emergency but also one of the most profound shocks to the global economy in the modern era — a shock deeper and broader than any other in eighty years. Never before had virtually all of the world’s economies suffered a contraction at the same time (Tooze, p. 5). Global output decreased by nearly 3.4% in 2020, the largest contraction since the Second World War. The United States saw the largest recorded demand shock in its history (-32.9%), and the unemployment rate peaked around 15% during 2020, higher than at …

Background: One in five young children globally suffer the consequences of stunted growth and development and millions experience deficiencies in zinc, iron, iodine, vitamins A and B12, nutrients found bioavailable in fish foods. Small-scale fisheries have the potential to generate income and augment fish consumption while being environmentally sustainable if appropriately managed. However, those engaged in small-scale fisheries are often marginalized, poor, and malnourished. The Samaki Salama project seeks to better understand and address these challenges through a three-arm, longitudinal matched cluster study which evaluates the impact of an integrated nutrition social marketing and modified fishing trap intervention.

What happens to international institutions when expectations about their function and purpose shift? Must such institutions give way as states reconsider the settlements on which those institutions are based, or can they adapt (or be adapted) to new geopolitical realities? Or to put it most bluntly, as the geopolitical balance of power shifts, must law give way to power? At a very deep level, these are the questions animating Gregory Shaffer's "Governing the Interface of U.S.-China Trade Relations," published in the American Journal ofInternationalfaw. 1 As the ballooning rivalry between the United States and China stretches and strains institutions like …

10-Minute Ebd: Factors Impacting Gingival Margin Position Following Esthetic Crown Lengthening, I-Ting (David) Lee

The Journal of the Michigan Dental Association

The esthetic crown lengthening procedure aims to address gingival concerns and achieve harmonious crown proportions. This article explores factors influencing gingival margin position post-surgical intervention, focusing on patients with excessive gingival display. The PICO question investigates gingival changes six months post-surgery. A comprehensive literature search using keywords such as "esthetic crown lengthening" and "gummy smile" identifies relevant articles. Results indicate varied outcomes, emphasizing the importance of individualized approaches. Notably, factors like flap margin suture placement impact tissue rebound. This study underscores the complexity of esthetic crown lengthening, emphasizing the need for tailored strategies to ensure optimal outcomes.

Problem

During the Colonial period, hair was one of the designated phenotypic markers of racial group membership used to assign or deny privilege. Privileges are still assigned to people based on their racial group membership and their proximity to Whiteness. As such, Hair remains a salient part of Afro-Latina women’s lives and identities, with its influences seen in the personal, social, and mental realms. How an Afro-Latina wears her hair can have legal, social, and intrapersonal consequences. The subsequent treatment of Afro-Latinas because of their hairstyle can affect how they view themselves and even how they relate to others, especially …

Indicators Of Typology In The Narrative Of Elijah: An Investigation Into The Predictive Nature Of Biblical Theology, JôNatas De Mattos Leal

Dissertations

Elijah is among the most popular prophets in the Judeo-Christian tradition. In Judaism, the hope for his return has evolved into a plethora of legends in which he functions as a helper to the righteous in the present and avenger to the wicked in the future eschaton. In Christianity, the expectation involving his return has also a multitemporal dimension, but its fulfilment is typologically oriented. More often, scholars study the fulfilment of the Elijah typology from the NT perspective in a backward movement. This dissertation investigates this typology in a forward movement going from the OT to the NT while …

Relating physiological stress to habitat quality could refine conservation efforts. Habitat quality, which is often inferred from patch occupancy or demographic rates, might be measured in a more timely and nuanced way using metrics of physiological stress. To understand whether stress-associated hormones vary with metrics of habitat quality, we measured fecal glucocorticoid metabolite (FGM) levels in the American pika (Ochotona princeps), a small mammal with well-defined habitat (talus), which can vary in quality depending on the presence of subsurface ice features. In spring and fall 2018, we collected feces noninvasively from pika territories in taluses “with” or “without” subsurface ice …

Closed-loop Vagus Nerve Stimulation (VNS) based on physiological feedback signals is a promising approach to regulate organ functions and develop therapeutic devices. Designing closed-loop neurostimulation systems requires simulation environments and computing infrastructures that support i) modeling the physiological responses of organs under neuromodulation, also known as physiological models, and ii) the interaction between the physiological models and the neuromodulation control algorithms. However, existing simulation platforms do not support closed-loop VNS control systems modeling without extensive rewriting of computer code and manual deployment and configuration of programs. The CONTROL-CORE project aims to develop a flexible software platform for designing and implementing …

Navassa: Property, Sovereignty, And The Law Of The Territories, Joseph Blocher, Mitu Gulati Jan 2022

Navassa: Property, Sovereignty, And The Law Of The Territories, Joseph Blocher, Mitu Gulati

Faculty Scholarship

The United States acquired its first overseas territory—Navassa Island, near Haiti—by conceptualizing it as a kind of property to be owned, rather than a piece of sovereign territory to be governed. The story of Navassa shows how competing conceptions of property and sovereignty are an important and underappreciated part of the law of the territories—a story that continued fifty years later in the Insular Cases, which described Puerto Rico as “belonging to” but not “part of” the United States.

Contemporary scholars are drawn to the sovereignty framework and the public-law tools that come along with it: arguments about rights and …

Barriers To Entry And Justice Ginsburg’S Criminal Procedure Jurisprudence, Lisa Kern Griffin Jan 2022

Barriers To Entry And Justice Ginsburg’S Criminal Procedure Jurisprudence, Lisa Kern Griffin

Faculty Scholarship

In her nearly thirty years on the United States Supreme Court, Justice Ruth Bader Ginsburg issued momentous decisions and significant dissents concerning constitutional guarantees of equality. She is best known for her leadership – as an advocate, scholar, judge, and justice – on issues of gender discrimination. Although one might expect related commitments to civil liberties to shape cases concerning the criminal justice process, Justice Ginsburg’s mark on constitutional criminal procedure appears comparatively faint.

Felon Re-Enfranchisement And The Problem Of “Lost” Rights, Josh Feinzig Jan 2022

Felon Re-Enfranchisement And The Problem Of “Lost” Rights, Josh Feinzig

Faculty Scholarship

By conditioning the restoration of political rights on financial repayment, states have prevented hundreds of thousands of citizens with felony convictions from participating politically—profoundly altering the shape of the American electorate. Courts have upheld the practice by treating restoration as an exercise of legislative grace to nonmembers of the political community. Critics argue that the practice conditions political participation on wealth status and is therefore subject to heightened review.

This Essay traces the disagreement back to an overlooked first-order question: how should the juridical status of a disenfranchised citizen’s “lost” rights be understood? The conventional position assumes that disenfranchisement casts …

Economic Development Strategies For Michigan Small Towns: How Placemaking, Agritourism, And Public Libraries Can Stimulate Small-Town Michigan Economies, Natalie Davenport

SPNHA Review

There have been increased efforts in recent years to diversify self-sustainable economies in small towns in the United States. Small towns face unique issues that are absent in high-density urban areas, such as declining populations and an over-reliance on one sector for their economic wellbeing. The specific research question this paper explores is what tools, strategies, and policy decisions can Michigan small-town communities do to strengthen their economic base? There are several strategies, policy decisions, and partnerships that can be created to promote economic development within small towns. Many small towns need to reform their existing zoning laws to allow …

Consumers shop at multiple retailers for different needs, and it is understood that many choose a retailer for an experience and others will shop at another retailer for better savings. In a time where E-commerce is at an all-time high, retailers need to consider how they compare against online retailers in the apparel sector. In this study, three retailers were compared against one another since they are all swimwear competitors. As these retailers adjust to store and production shortages, it is important to understand how the quality of clothing will keep sales consistent. Consumers are likely to keep shopping at …

Pandemics And Animal Welfare: A Mixed-Methods Inquiry Into How The Covid-19 Pandemic Has Affected The Companion Animal Industry In Northwest Arkansas, Sabrina G. Cox, Isabel Whitehead

Discovery, The Student Journal of Dale Bumpers College of Agricultural, Food and Life Sciences

The first cases of coronavirus reported in the United States came in January 2020 (World Health Organization, 2020). In the two years since then, countries around the world have been affected by COVID-19 and the subsequent social, economic, and mental health issues. Previous research shows that the animal healthcare field is already overrun with burnout, substance abuse, depression, and increased levels of stress (Gardner and Hini, 2006), and the pandemic has only compounded these issues (Mair et al., 2020). Observing a lack of meaningful reporting on the issues affecting veterinary staff led the researchers to investigate staff members’ practices, day- …

A Critique Of Frederick Nietzsche's Philosophy On Law, God, And Morality, Rebekah Vaughn Jan 2022

A Critique Of Frederick Nietzsche's Philosophy On Law, God, And Morality, Rebekah Vaughn

Undergraduate Honors Theses

Friedrich Nietzsche is the last of the modern philosophers. His philosophy has influenced fields such as literature, psychology, and ethics. Nietzsche’s philosophy on ethics is primarily what will be covered. Nietzsche wishes to sever the connection between western civilization and God. He sees that people may no longer believe in God, but they still follow Christian morality. Nietzsche argues for a new morality, one humanity will create themselves. His famous line “God is dead” is an expression of what humanity needs to do with God. Nietzsche then argues the Overman will take over humanity, leading towards a world with a …

Gender, Voting Rights, And The Nineteenth Amendment, Paula A. Monopoli Jan 2022

Gender, Voting Rights, And The Nineteenth Amendment, Paula A. Monopoli

Faculty Scholarship

One hundred years after the woman suffrage amendment became part of the United States Constitution, a federal court has held—for the first time—that a plaintiff must establish intentional discrimination to prevail on a direct constitutional claim under the Nineteenth Amendment. In adopting that threshold standard, the court simply reasoned by strict textual analogy to the Fifteenth Amendment and asserted that “there is no reason to read the Nineteenth Amendment differently from the Fifteenth Amendment.” This paper’s thesis is that, to the contrary, the Nineteenth Amendment is deserving of judicial analysis independent of the Fifteenth Amendment because it has a distinct …

The Theory Of Mind Hypothesis Of Autism, Kendall Smith Jan 2022

The Theory Of Mind Hypothesis Of Autism, Kendall Smith

Undergraduate Honors Theses

Present theory of mind research suggests that autistic individuals demonstrate deficits in theory of mind capabilities. A literature review was conducted to investigate the claim made by the theory of mind hypothesis of autism that theory of mind deficits are responsible for the social deficits present in autistic individuals. It was concluded that this hypothesis was prematurely accepted as an explanatory model for autism when it is better described as a symptom of autism. Alternative explanations for autistic social deficits such as executive function deficits and the theory of weak central coherence were analyzed. Implications and suggestions for future research …
