The Effects Of Exercise On Women's Self-Esteem, Wendy Laurie Biddle May 1982

The Effects Of Exercise On Women's Self-Esteem, Wendy Laurie Biddle

Ellmer School of Nursing Theses & Dissertations

The effects of a 12-week session of aerobic dancing were examined on two groups of women, assigned into fit and unfit groups. The subjects had voluntarily enrolled in aerobic dancing prior to the study. Self-Esteem scores were obtained using the Rosenberg Self-Esteem Scale during the first and tenth or eleventh weeks of the session. Pretest and posttest scores were analyzed along with the variables of age, marital status, weight loss, and smoking habits. A significantly higher gain score (posttest score subtracted from pretest score) was found on those women who attended three weekly classes compared to those who attended two …

Surrogate Gestation And The Protection Of Choice, Louise E. Graham Jan 1982

Surrogate Gestation And The Protection Of Choice, Louise E. Graham

Law Faculty Scholarly Articles

Proponents of surrogate gestation contracts base their case on both the constitutional privacy rights of persons involved in the contract and the notion that contractual agreements are capable of sufficiently protecting all interests involved. This article first speculates on how courts might handle surrogate gestation contracts under existing laws and offers arguments for and against such contracts. Although some commentary on the contractual aspect of the agreement exists, little attention has been given to the privacy arguments of the parties. The major focus of this article, therefore, is upon the nature of the privacy claims asserted by the prospective parents …

Community Property After Hisquierdo V. Hisquierdo, Marie Stefanini Newman Jan 1982

Community Property After Hisquierdo V. Hisquierdo, Marie Stefanini Newman

Elisabeth Haub School of Law Faculty Publications

This Comment will briefly discuss California's community property system, and the standards traditionally required by the Supreme Court for federal pre-emption of state property law. It will also examine the Supreme Court's interpretation of the Railroad Retirement Act which led the Court to conclude that the Supremacy Clause of the United States Constitution and demanded federal pre-emption in this case. It will discuss the Hisquierdo test for federal pre-emption, which the Supreme Court has since used to override state community property systems. Finally, it will evaluate whether the case was correctly decided.

University of Miami Law Review

In this article, the author examines the potential ramifications of the Family Protection Act, a bill recently introduced in the Senate by Senators Jespen and Laxalt. Women's Status And Roles In Contemporary Japanese Society, Schon Beechler Jan 1981

Women's Status And Roles In Contemporary Japanese Society, Schon Beechler

Honors Papers

The combination of modernization and industrialization and the persistence of traditional attitudes serves to create a unique set of tensions and strains within the Japanese social system. The position of women is one such area in which the conflicting demands of this system are especially evident. Women in contemporary Japanese society are still expected to be "good wives and mothers" yet they are also often required to participate in the workforce in an economy beset by spiraling inflation. Even those women who are not forced to work by necessity have found that the importance of their wife/mother role has been …

1 Corinthians 11:2-16: Exegesis Case Study, Roger J. Humann Jan 1981

1 Corinthians 11:2-16: Exegesis Case Study, Roger J. Humann

Consensus

Corinthians 1: 11-14. However one chooses to outline 1 Corinthians, it is evident that ch. 7-10 basically revolve around questions put to Paul by the congregation in Corinth. Ch. 11-14 focus on the worship life of the church: women in the church1 Cor 11:2-16 (cf. 14:33-36); the Lord's Supper, 11:17-34; and the use of spiritual gifts, 12:1-14:40. Whether in 11:2-16 Paul is answering a question put to him by the church or simply directing himself to a particular irregularity of which he had become aware, we do not know. In this section the apostle interweaves two themes, one dealing with …

Women's Liberation: Is It Smashing The Hothouse?, Wendy Tarnoff Jan 1980

Women's Liberation: Is It Smashing The Hothouse?, Wendy Tarnoff

Honors Papers

Since this paper has concentrated on the cultural and societal influences on women's roles, and how these affect their criminal behavior, these variables rather than exclusively economic ones, will be presented now in relatively economic homogeneous contexts. The remaining discussion will, therefore, compare the patterns and trends of female criminal behavior in England-Wales and Japan with those in the United States. A final note will be made on some research done by Safilios-Rothschild in Greece concerning socio-cultural changes which have occurred in Greece, and how they have affected the commission of "honor crimes."

Roe V. Wade And The Lesson Of The Pre-Roe Case Law, Richard Gregory Morgan Aug 1979

Roe V. Wade And The Lesson Of The Pre-Roe Case Law, Richard Gregory Morgan

Michigan Law Review

The politically unsettled and judicially confused law of abortion in 1971 and 1972, when the Court twice heard arguments and deliberated Roe, should have warned it not to decide the case. By doing so; the Court thrust itself into a political debate and stunted the development of a thoughtful lower-court case law. If the Court did perceive the warnings but continued toward a decision anyway, perhaps trusting that its own considerable wits would devise an answer the lower courts had not, the result suggests that the judicial system's axioms deserve more respect than they received. This Article, by showing …

The Abortion-Funding Cases And Population Control: An Imaginary Lawsuit (And Some Reflections On The Uncertain Limits Of Reproductive Privacy), Susan Frelich Appleton Aug 1979

The Abortion-Funding Cases And Population Control: An Imaginary Lawsuit (And Some Reflections On The Uncertain Limits Of Reproductive Privacy), Susan Frelich Appleton

Michigan Law Review

Two issues are before us today: (I) the meaning of the term "medically necessary" in a public hospital's charter and (II) the constitutionality of state action that provides free medical treatment to indigent pregnant women seeking an abortion but denies them such assistance for prenatal care and childbirth. On the basis of recent Supreme Court authority, we find that such action violates neither the hospital's charter nor the United States Constitution.

Public Support For Pro-Choice Abortion Policies In The Nation And States: Changes And Stability After The Roe And Doe Decisions, Eric M. Uslaner, Ronald E. Weber Aug 1979

Public Support For Pro-Choice Abortion Policies In The Nation And States: Changes And Stability After The Roe And Doe Decisions, Eric M. Uslaner, Ronald E. Weber

Michigan Law Review

"The Supreme Court," according to the legendary Mr. Dooley, "follows the election returns." In 1973, the Court's two landmark decisions, Roe v. Wade and Doe v. Bolton, struck down statutes in the forty-six states where abortions were not permitted under any circumstances or were allowed only to save the life of the woman during the first three months of pregnancy. There had been a considerable increase in the level of support for the pro-choice position among the public in the few years preceding Roe and Doe. But did the decisions themselves lead to even more public support for …

The Juridical Status Of The Fetus: A Proposal For Legal Protection Of The Unborn, Patricia A. King Aug 1979

The Juridical Status Of The Fetus: A Proposal For Legal Protection Of The Unborn, Patricia A. King

Michigan Law Review

What claims to protection can be asserted by a human fetus? That question, familiar to philosophy and religion, has long haunted law as well. While the philosophical and theological issues remain unresolved, and are perhaps unresolvable, I believe that we can no longer avoid some resolution of the legal status of the fetus. The potential benefits of fetal research, the ability to fertilize the human ovum in a laboratory dish, and the increasing awareness that a mother's activities during pregnancy may affect the health of her offspring create pressing policy issues that raise possible conflicts among fetuses, mothers, and researchers. …

Joint Custody, Carolyn S. Bratt Jan 1979

Joint Custody, Carolyn S. Bratt

Law Faculty Scholarly Articles

Shared custody has traditionally been looked upon with disfavor by the courts. Similarly, some professionals in the field of child development oppose the concept of shared custody. There are, however, several advantages to shared custody. The legal system benefits, as judges escape the unenviable task of playing Solomon. The child benefits because both parents continue to have a voice in the child’s upbringing, and the child continues to enjoy the love, advice, and companionship of both parents. In addition, because both parents share the responsibility of child raising, neither is faced with the loss of self-esteem which results from being …

Sexual Harassment And Title Vii: The Foundation For The Elimination Of Sexual Cooperation As An Employment Condition, Michigan Law Review May 1978

Sexual Harassment And Title Vii: The Foundation For The Elimination Of Sexual Cooperation As An Employment Condition, Michigan Law Review

Michigan Law Review

Ten years after the enactment of Title VII, the federal judiciary confronted its first Title VII case in which sexual harassment was the primary allegation. In the next three-and-one-half years, six more claims of sexual harassment reached federal district courts, 4 and three federal circuit courts of appeal reviewed lower court holdings.

Neither these cases nor the considerable journalistic and academic attention they received reveals a consensus regarding the appropriate application of Title VII to cases of sexual harassment. This Note, therefore, examines the application of Title VII to the problem of sexual harassment and suggests a coherent framework for …
