Exploration of destructive developments in American law and society show that family law is completely askew. Although family law deals with the most intimate and basic personal relationships, it applies a legal process based on autonomous individual public and private economic rights to those intimate relational realities. It is a hallowed expression of male virtues and a paradigmatic example of the use of the law to protect vested interests and shape society, rather than a reflection of reality.

To Settle Is To Conquer: Spaniards, Native Americans, And The Colonization Of Santa Elena In Sixteenth-Century Florida, Karen Lynn Paar

Sixteenth-century Spaniards believed that “to settle is to conquer,” and they brought this tradition established during the Reconquest of the Iberian peninsula from the Moors to their conquest and colonization of the Americas. The Spaniards’ multi-faceted approach to settlement proved remarkably enduring as shown by the mid-1560s effort of Pedro Menendez de Aviles to claim La Florida, which then included much of the present-day southeastern United States. Within this territory Santa Elena, now known as Parris Island, South Carolina, came into the focus of French and Spanish monarchs as the political and religious battles raging in Europe in the mid-sixteenth …

A Woman's Field Is Made At Night: Gendered Land Rights And Norms In Burkina Faso, Michael Kevane, Leslie C. Gray

Gendered social norms and institutions are important determinants of agricultural activities in southwestern Burkina Faso. This paper argues that gendered land tenure, in particular, has effects on equity and efficiency. The usual view of women as holders of secondary, or indirect, rights to land must be supplemented by a more nuanced understanding of tenure. Women's rights are in fact considerably more complex than the simple right to fields from their husbands. The South African land reform program is aimed at redressing inequalities in access to land and security of tenure. The intention is to redress the racially biased land policies of the past by developing a long-term national land reform program. Land reform is viewed as one of the key means for positively changing people's lives. The land reform program has identified specific beneficiaries that are to be targeted in particular projects. Ethnographic Inquiry Of Social Support Throughout Women's Labor And Childbirth Experiences, Nancy Jane Pinder Saks Dnsc, Msn, Rn

The purpose of this study was to explore the phenomenon of social support throughout labor and childbirth in order to develop descriptive theory based on the behaviors of the labor and childbirth convoy. Utilizing ethnographic methodology, five women and their support convoys were observed throughout the women's labor and childbirth experience. Word processing and the ETHNOGRAPH software were used for data management, and constant comparative coding methodology was employed for data analysis. Affirmative, affective and aid-giving behaviors were enacted by all convoy members. Consistently, social support was found to be communicated to the laboring woman by her lay supporters by …

The centenary of Western Australian Women's suffrage in 1999 has seen a resurgence in interest in the history of women in W.A. While there exists a substantial body of historical resources, extensive guides to these resources are lacking. The majority of general histories of Australian women and Australian suffrage rarely treat W.A. in much detail.

The Emerging Female Hero In The Fiction Of Alice Walker, Ntozake Shange, Ursula Le Guin, And Barbara Kingsolver., Rebecca S. Phillips

Novels written by Alice Walker, Ntozake Shange, Ursula Le Guin, and Barbara Kingsolver between 1971 and 1993 demonstrate a pattern of female heroism that both continues and revises the male monomyth as described by Joseph Campbell. The motifs these women's novels share with the traditional monomyth include: (1) the quest itself; (2) mysterious parentage; (3) the magical guide; (4) the slaying of the monster; (5) the boon; (6) (sometimes) the sacred marriage and the return. Since 1970, the United States has seen an explosion in the rate of women working and a change towards equality in men's and women's roles. In 1980, Helal Mobasher Liaey gave a survey to measure what Utah State University students thought were proper roles for women, in categories ranging from occupations to decision making. He did this research at a time when traditional and egalitarian role views were still furiously clashing, especially in Utah, which is generally considered to be one of the most conservative states in the country since it is primarily LDS. In this paper, I examine the relationship between women and the Irish state, particularly how the nationalist state has defined and controlled women through their reproductive capabilities. I outline the factors that have contributed to the construction of women's identity and how women have resisted the limitations of this construction in a variety of ways. The issue of abortion is an excellent point on which to base the discussion of women in Ireland because of it extraordinary impact on Irish society. Legislative Approaches To Reducing The Hegemony Of The Priestly Model Of Medicine, Nancy K. Kubasek

This Article presents the case that the legal culture in many ways undergirds the priestly model's hegemony over the therapeutic relationship between a woman and her doctor. To the extent that law provides this fundamental support, it legitimizes the mistreatment of women, especially with respect to their reproductive health. The implications are that the movement toward a more just legal culture necessitates the extirpation of this support.

Across Australia, government sponsored Rural Women's Networks have been established to encourage rural women to look beyond their individual context and to identify as part of a much larger group of women, all with common concerns. These networks have encouraged women to view themselves as legitimate participants in a patriarchal society and to realise that the traditional male culture of farming is redundant. Fiona M. Haslam-McKenzie, a lecturer in the Faculty of Business at Edith Cowan University, reviews the recognition given to women on the farm.

Under the artificial constraints of strict scrutiny, however, the courts are free to veto the government's choice of more effective, race-conscious means. The Supreme Court's unfortunate and ill-conceived adoption of strict scrutiny as the constitutional standard for reviewing race-conscious affirmative action should be reconsidered for several reasons. This Article examines those reasons.

The aim of this national case study, a synthetic summary of the work and evidence on women in a tribal, Muslim, Arabian, rapidly changing society, is to contribute to the intersection of the Middle Eastern and women-in-development literatures by situating women first within tribal and Islamic settings and then in the context of rapid changes in political and economic circumstances during the past thirty years. This study on sexuality among women in rural Giza, Egypt, is part of a broader project on women's health and reproductive morbidity conducted by the Population Council’s Reproductive Health Working Group. Reproductive tract infections (RTIs) and other ailments associated with reproduction among women in the rural community surveyed suggest that a heavy burden of disease is being borne by women living in underprivileged areas in this region. This research on sexuality has been conducted within a conceptual framework that uses a socio-cultural approach to health and illness. In this essay I reconsider abortion in order to bridge what initially seem to be two opposing frameworks: first, the conception of abortion as an issue of women's bodily integrity and liberty, and second, the acknowledgement of the existence and meaning of intrauterine life. The abortion choice is indeed deeply and necessarily tied to women's bodily integrity. I will discuss how taking away women's ability to control their decision not to become mothers can be severely damaging to their very sense of self, for this denial of decisionmaking divides women from their wombs and uses their wombs for a purpose …
