The Promise And The Reality: Exploring Virtual Schooling In Rural Jurisdictions, Michael Barbour Jan 2011

The Promise And The Reality: Exploring Virtual Schooling In Rural Jurisdictions, Michael Barbour

Education Faculty Publications

The history of online learning at the K-12 level is almost as long as its history at the post-secondary level, with the first virtual school programs beginning in the early 1990s. While these opportunities were designed as a way to provide rural students with access to more specialized courses, as opportunities have become organized into virtual or cyber schools the nature of students served by these institutions have broadened. Unlike online learning in general, much less is known about virtual schooling – even less of which is based on systematic research. Regardless, the growth and practice of virtual schooling has …

Opt-Out Voting, Michael J. Pitts Jan 2011

Opt-Out Voting, Michael J. Pitts

Hofstra Law Review

This article proposes a new system of casting ballots at elections: opt-out voting. Opt-out voting would change the default rule for voting. Currently most registered voters go to a polling place to select a candidate. In contrast, opt-out voting would randomly pre-select a candidate for each registered voter and then allow the registered voter to switch the ballot to his or her preferred candidate. This article theorizes that switching to opt-out voting could lead to an increase in voter turnout, especially in local elections. This article argues that increasing participation, particularly on the local level, would be a positive change …

The Crisis Exposed By Pari Passu, Preston M. Torbert Jan 2011

The Crisis Exposed By Pari Passu, Preston M. Torbert

Hofstra Law Review

This article is one practitioner's reaction to Gulati and Scott's The Three and A Half Minute Transaction: Boilerplate and the Limits of Contract Design. It notes that current contract drafting practices, especially for sovereign debt instruments, create a crisis: that is, a danger and an opportunity. The danger is the offshoring of contract drafting. The opportunity is to substantially improve contract drafting by establishing in a law school a laboratory program for creative innovation in contract drafting. The article suggests issues that such a program could adddress: the implications of the canons of interpretation for drafting, the problem of …

Wall Street As Yossarian: The Other Effects Of The Rajaratnam Insider Trading Conviction, J. Scott Colesanti Jan 2011

Wall Street As Yossarian: The Other Effects Of The Rajaratnam Insider Trading Conviction, J. Scott Colesanti

Hofstra Law Review

Without warning, the patient sat up in bed and shouted, ‘I see everything twice!’

And thus Yossarian, the war-weary bomber pilot of the masterful novel, Catch-22, was able to malinger in an Italian hospital even longer while nervous doctors attended to the strange malady of his neighbor.

The storied literary diversion may highlight the good fortune of those evading government prosecution of financial crimes in 2011, a year that fulfilled the promise that observers of hedge fund discipline would similarly see things twice. To wit, in May 2011, a Manhattan jury convicted billionaire hedge fund entrepreneur Raj Rajaratnam of fourteen …

Homestead National Monument, Vegetation Mapping Project [Poster], Kelly Kindscher, Hayley Kilroy, Jennifer Delisle, Quinn Long, Hillary Loring, Kevin Dobbs, Jim Drake

United States National Park Service: Publications

Homestead National Monument was created in 1936 to celebrate the significance of the Homestead Act of 1862, which granted 160 acres of free land to claimants. This was one of the most significant and enduring events in the westward expansion of the United States. The site is the first tract homesteaded under the act by Daniel Freemen, and encompasses 184 acres in Gage County, west of Beatrice, Nebraska.

This unique site also hosts the oldest prairie restoration in the National Park system and the second-oldest tallgrass prairie restoration known. This park unit also has a small remnant of native tallgrass …

Gilt Expression Alters Tumorigenic Molecules And Hla Class Ii Presentation In Human Melanoma Cells, Jessica D. Hathaway Jan 2011

Gilt Expression Alters Tumorigenic Molecules And Hla Class Ii Presentation In Human Melanoma Cells, Jessica D. Hathaway

MUSC Theses and Dissertations

Melanoma is the 6th most common cancer is the United States and accounts for 79% of skin cancer related deaths. While treatments such as surgery, radiation, and chemotherapy have been effective in dealing this disease in its early stages, these treatments often fail in treating late stage metastatic melanoma. Immunotherapies have been shown successful in treating a small percentage of patients with late stage melanoma, but these treatments do not provide a long-lasting CD8+ response to effectively clear the tumor. The majority of the melanoma cells either express or can be induced to express HLA class II proteins. An optimum …

Islamic Perspectives On The Crusades: Past And Present, Robert Noel Duprez Jr. Jan 2011

Islamic Perspectives On The Crusades: Past And Present, Robert Noel Duprez Jr.

Master's Theses and Capstones

It is important that scholars use a variety of researching methods when analyzing the effect of the Crusades, how they affected Islamic perspectives of the West during the period 1095--1291, and their imprint on today's world. Western scholars with a Euro-centric point of view have accomplished the overwhelming amount of research on the Crusades. It is not until the last decade that Islamic scholars have taken an interest in the Crusades, and their affect on the Muslim world.

This study came to the following conclusions: 1) Scholarship on the Crusades has mainly represented a Euro-centric viewpoint, 2) Contemporary Muslim scholarship …

The United States of America sought the extradition of the applicant to face terrorism-related charges. The applicant had been taken into custody by the Pakistani Intelligence Agency, the ISI, and held in a secret detention centre for approximately fourteen months before he was released and repatriated to Canada. He had been interrogated by American FBI agents while in Pakistan and had given them a statement. He also gave a statement to CSIS following his return to Canada, and shortly after that gave a second statement to FBI officials. The applicant sought a stay of proceedings of the extradition hearing on …

Defining Civil Disputes: Lessons From Two Jurisdictions, Elizabeth Thornburg, Camille Cameron Jan 2011

Defining Civil Disputes: Lessons From Two Jurisdictions, Elizabeth Thornburg, Camille Cameron

Articles, Book Chapters, & Popular Press

Court systems have adopted a variety of mechanisms to narrow the issues in dispute and expedite litigation. This article analyses the largely unsuccessful attempts in two jurisdictions - the United States and Australia - to achieve early and efficient issue identification in civil disputes. Procedures that rely on pleadings to provide focus have failed for centuries, from the common (English) origins of these two systems to their divergent modern paths. Case management practices that are developing in the United States and Australia offer greater promise in the continuing quest for early, efficient dispute definition. Based on a historical and contemporary …

Buried Treasure Or Buried Hope? The Status Of Mexico-U.S. Transboundary Aquifers Under International Law, Gabriel E. Eckstein Jan 2011

Buried Treasure Or Buried Hope? The Status Of Mexico-U.S. Transboundary Aquifers Under International Law, Gabriel E. Eckstein

Faculty Scholarship

Transboundary aquifers found along the 2,000 mile-long border between Mexico and the United States are not governed by any treaty. Yet, these aquifers are the primary source of water for many of the twelve million people who live in this parched region. The region’s groundwater, however, is being over-exploited and contaminated, which is threatening the very life that it currently sustains. As populations continue to expand and current rates of haphazard development persist, the absence of an agreement for the management and allocation of this critical resource could lead to bi-national economic, social and environmental tragedies. This study reviews groundwater …

Another Word On The President's Statutory Authority Over Agency Action, Nina A. Mendelson Jan 2011

Another Word On The President's Statutory Authority Over Agency Action, Nina A. Mendelson

Articles

In this short symposium contribution, I attempt first to add some further evidence on the interpretive question. That evidence weighs strongly, in my view, in favor of Kagan's conclusion that the terminology does not communicate any particular congressional intent regarding presidential directive authority. Assessed in context, the "whole code" textual analysis presented by Stack does not justify the conclusion that Congress, by delegating to an executive branch official, meant to limit presidential control. Independent agencies excluded, interpreting the terms of simple and presidential delegations to speak to directive authority fails, in general, to make sense of the various statutes. Absent …
