Should Criminal Juries Give Reasons For Their Verdicts?: The Spanish Experience And The Implications Of The European Court Of Human Rights Decision In Taxquet V. Belgium, Stephen C. Thaman Apr 2011

Should Criminal Juries Give Reasons For Their Verdicts?: The Spanish Experience And The Implications Of The European Court Of Human Rights Decision In Taxquet V. Belgium, Stephen C. Thaman

Chicago-Kent Law Review

This article uses the European Court of Human Rights judgment of Taxquet v. Belgium, decided by the Grand Chamber in 2010, which held that in some cases the trial jury's failure to give reasons for its verdict of guilt could constitute a violation of the right to a fair trial under Article 6 of the European Convention of Human Rights, as a springboard for discussing whether or not criminal trial juries in Europe and the United States should be more accountable for their verdicts. The article explains the special jury verdicts traditionally used in Europe and the new Spanish requirement …

Glass Cages In The Dock?: Presenting The Defendant To The Jury, David Tait Apr 2011

Glass Cages In The Dock?: Presenting The Defendant To The Jury, David Tait

Chicago-Kent Law Review

The architecture of the courtroom provides insights into the philosophy of justice espoused by the community—it embodies particular perspectives about the presumption of innocence, the dignity of the person, the right to effective representation, and more generally, the right to a fair trial. The physical position of the accused in a criminal trial, the subject of this Article, varies considerably between jurisdictions, from a privileged place at the defense table to a dock isolated from other courtroom participants. The legal issues associated with the place of the accused are particularly evident when the dock is enclosed in glass. This Article …

Searching For The Soul Of American Medicine : What Three High-Quality, Low-Cost Health Care Systems Can Teach U.S. Policymakers, Benjamin A. Paul Apr 2011

Searching For The Soul Of American Medicine : What Three High-Quality, Low-Cost Health Care Systems Can Teach U.S. Policymakers, Benjamin A. Paul

Honors Theses

"The United States health care system is broken." This common refrain has been echoed by policymakers and politicians, Democrats and Republicans, and liberals and conservatives alike. They point to the unacceptably high number of uninsured Americans, out of control costs, and questionable quality as just some of the problems that afflict American health care. Before the passage of the Patient Protection and Affordable Care Act in March, 2010, over 45 million Americans were without health insurance coverage.1 Health care spending currently accounts for 17% of this country‘s gross domestic product. In contrast, most industrialized European countries cover all of their …

Networks Of Resistance : Black Virginians Remember Civil War Loyalties, Amanda Kleintop Apr 2011

Networks Of Resistance : Black Virginians Remember Civil War Loyalties, Amanda Kleintop

Honors Theses

On June 22, 1877, William Charity explained his neighborhood’s Civil War loyalties to special commissioner Isaac Baldwin of the Southern Claims Commission (SCC): “The colored people were mostly all for the union.” Charity, a free black Virginian, recognized that “mostly” did not mean all. He went on to suggest: “some of them were blind.” As a self-identified Unionist, Charity had difficulty envisioning a black man who was not loyal to the Union cause and emancipation during the Civil War. Current debates, however, have seized on those black Virginians Charity called “blind,” taking the “mostly” Unionist majority for granted. Like Charity, …

Sisters And Smallpox: The Daughters Of Charity As Advocates For The Sick Poor In Nineteenth-Century Los Angeles, Kristine Ashton Gunnell Ph.D. Apr 2011

Sisters And Smallpox: The Daughters Of Charity As Advocates For The Sick Poor In Nineteenth-Century Los Angeles, Kristine Ashton Gunnell Ph.D.

Vincentian Studies

The Daughters of Charity were “the key provider of social service in [Los Angeles] before 1880,” opening southern California’s first hospital in 1858. They served anyone, regardless of religion and brought different religious and cultural groups together to help people who were sick. During the smallpox epidemics from the 1860s through the 1880s, the Daughters partnered with officials of Los Angeles to treat the poor. Kristine Gunnell explains how the desire to cut costs, theories of containing disease, and racial and class biases led to the city’s initially inhumane treatment of poor patients. Acting as advocates for the poor, the …
