Reimagining The Law Of Self-Employment: A Comparative Perspective, Jayesh M. Rathod, Michal Skapski

U.S. employment law has traditionally disfavored bright-line rules to distinguish between traditional “employees” and independent contractors, instead relying on more flexible criteria, to be applied on a case-by-case basis. This fluidity has enabled employers to structure these relationships – and the corresponding bundle of worker rights and benefits – in ways that serve their own material and normative interests. Indeed, recent employment law literature has noted a dramatic shift towards independent contracting and contingent worker schemes in the U.S., even when the actual workplace dynamics are more akin to an employer-employee relationship. Spanish-English code-switching is a prevalent and significant form of communication in bilingual and bicultural communities. Authors who wish to reflect and validate cultural and linguistic diversity in their written works may incorporate code-switching in their texts. The purpose of this study is to explore the growing trend of the inclusion of the Spanish language in English-based books written for children in the United States. This study is an examination of the stories four social studies teachers told after participating in one international professional development program. Drawing on theories of postcolonialism, this narrative inquiry uses interviews, observations, and artifacts to investigate if and to what degree travel to and study in China influences the understandings of one group of in-service social studies teachers. This Article examines agency-level activity during the preproposal rulemaking phase—a time period about which little is known despite its importance to policy outcomes—through an analysis of federal agency activity in connection with section 619 of the Dodd–Frank Act, popularly known as the Volcker Rule. By capitalizing on transparency efforts specific to Dodd–Frank, I am able to access information on agency contacts whose disclosure is not required by the Administrative Procedure Act and, therefore, not typically available to researchers.

The doctrine for deciding when to apply the Federal Rules of Civil Procedure to state claims heard in federal court has become a quagmire of exceptions and ephemeral distinctions, in large measure due to the persistent difficulty courts have in separating substantive rules from procedural ones in an era where special procedural rules are often used as an essential regulatory tool in state governance. A growing number of customers use online consumer review as a means to express their opinions about the purchasing experience or the products through online feedback forums. The online forum not only provides customers with a powerful communicative tool but also impacts potential customers’ intention to patronize a brand or its association by publishing compliments or complaints. Identifying Requirements For The Invasion Of A Tick Species And Tick-Borne Pathogen Through Ticksim, Holly Gaff, Robyn Nadolny

Ticks and tick-borne diseases have been on the move throughout the United State over the past twenty years. We use an agent-based model, TICKSIM, to identify the key parameters that determine the success of invasion of the tick and if that is successful, the success of the tick-borne pathogen. We find that if an area has competent hosts, an initial population of ten ticks is predicted to always establish a new population. The establishment of the tick-borne pathogen depends on three parameters: the initial prevalence in the ten founding ticks, the probability that a tick infects the longer-lived hosts and …

Quick And Dirty: Some Psychosocial Costs Associated With The Dark Triad In Three Countries, Peter K. Jonason, Norman P. Li, Anna Z. Czarna

Research Collection School of Social Sciences

The current study provides the first examination of the relationship between life history indicators and the Dark Triad traits in an international sample drawn from the U.S. (n = 264), Singapore (n = 185), and Poland (n = 177). In all three samples, the Dark Triad traits were associated with psychosocial costs, although there were more links in the Singaporean and Polish samples than in the American sample. In the U.S., the quality of one’s romantic relationships and psychopathy were negatively correlated. Narcissism was higher in the Polish and American samples than in the Singaporean sample. This study examines teachers' attitudes towards integrating technology in Saudi Arabia and the United States. A case study approach was used to identify several factors that challenge teachers and schools to adapt or integrate technology. And, the case study also reveals similarities and differences between the preparation and practice of teachers in Saudi Arabia and in the United States.

The data was collected through semi-structured interviews distributed to ten teachers from Saudi Arabia and the United States. These interviews were analyzed to determine teachers' attitudes in both countries and to compare and contrast these results. Findings reveal that teachers from …

Revised; American Psychiatric Association) and (BPSD) there are many behavioral, physiological, and psychological issues that have been correlated with the progression of the Alzheimer’s disease and other dementias. The Results-Based Leadership Group surveyed 470 companies and discovered that the top 25companies with effective leadership practices dedicated twice as much effort to leadership development as did other companies, indicating a strong relationship between success and leadership development. The problem explored in the current study was the lack of qualitative analyses of the U.S. Air Force Development Team processes. This thesis qualitatively examines the personal career outcomes of major presidential primary candidates from 1976-2008. It argues that the primary process fundamentally changed with the introduction of reform in the 1970s. It has continued to evolve into the "spectacle primary," a system whereby mere participation, not necessarily electoral success, can convey manifold benefits to subsequent careers in the public or private sectors. It also finds far less risk in primary participation than conventional wisdom might assume. We identified a novel rhabdovirus, American bat vesiculovirus, from postmortem tissue samples from 120 rabies-negative big brown bats with a history of human contact. Five percent of the tested bats were infected with this virus. The extent of zoonotic exposure and possible health effects in humans from this virus are unknown.

Second Amendment doctrine is largely becoming a line-drawing exercise, as courts try to determine which “Arms” are constitutionally protected, which “people” are permitted to keep and bear them, and in which ways those arms and people can be regulated. But the developing legal regime has yet to account for one potentially significant set of lines: the city limits themselves. In rural areas, gun crime and gun control are relatively rare, and gun culture is strong. This Article, written for a symposium on compliance issues in financial-services firms, focuses on the role of the chief compliance officer (“CCO”). Contrasting the position with that held by a firm’s general counsel or Chief Legal Officer (CLO), the article argues that a CCO’s position holds distinct challenges. Additionally, although internal compliance systems and personnel may be characterized as functional substitutes for external regulation, assessing the strengths and weaknesses of internal compliance requires a willingness to look deep within firms. The article argues that the law and regulation may enhance firms’ incentives to invest in effective internal compliance but may …

America’s rabbis currently structure their employment market with rules that flagrantly violate the Sherman Act. The consequences of these rules, in addition to the predictable economic outcomes of inflated wages for rabbis and restricted consumer freedoms for the congregations that employ them, meaningfully hinder Jewish communities from seeking their preferred spiritual leader. Although the First Amendment cannot combat against this privately-orchestrated (yet paradigmatic) restriction on religious expression, the Sherman Act can. This Essay was written for the Yale Law Journal Online Symposium on the future of section 5 of the Voting Rights Act after Shelby County v. Holder. Professors Guy-Uriel E. Charles and Luis Fuentes-Rohwer argue that voting rights activists ought to be prepared for a future in which section 5 is not part of the landscape. Over the last 35 years approximately forty truth commissions have investigated human rights violations and abuses in a wide range of countries and communities. Each of these forty commissions provides different lessons on how investigating and testifying about past abuse can lead to healing and change. I have participated in two of the more remarkable Truth and Reconciliation processes, the first as an observer, the other as an advisor. The higher education systems throughout the continent of Africa are undergoing unprecedented challenges and are considered in crisis. African countries, including Ghana, all have in common ties to their colonial legacy whereby they are confronted with weak policies put in place by their colonizers.
