Our Constitutional Commons, Blake Hudson, Brigham Daniels Jan 2015

Our Constitutional Commons, Blake Hudson, Brigham Daniels

Journal Articles

While much has been written about the U.S. Constitution, very little, if anything at all, has been said about the ways in which the Constitution shares attributes with the commons. This article examines the Constitution and the efforts to influence the shape and scope of its application through the lenses developed by scholars for assessing both common good and public good resources. Focusing on these interrelated lenses provides a unique perspective on both the U.S. Constitution and those attempting to influence its text and its interpretation. The synergy and interaction between the common good and public good dimensions of the …

Isolated Wetland Commons And The Constitution, Blake Hudson, Michael Hardig Jan 2015

Isolated Wetland Commons And The Constitution, Blake Hudson, Michael Hardig

Journal Articles

Isolated wetlands provide great ecological and economic value to the United States. While some states provide protection for isolated wetlands, a great many do not. These wetlands are also left outside the ambit of federal wetland regulatory protections under the Clean Water Act, with its murky jurisdictional reach. Notwithstanding jurisdictional questions under current federal statutes, the U.S. Supreme Court has gone so far as to call into question the constitutionality of federal isolated wetland regulation. This Article makes a normative argument that, in the absence of state or local programs providing holistic isolated wetland protection, federal action is needed. The …

This paper uses content analysis to compare corporate social responsibility (CSR) communication strategies on the websites of Fortune 500 companies both in China and the United States. This study aims to determine how CSR communication strategies differ between China and the United States by comparing the purpose, main stakeholders, types of CSR programs, compliance with the International CSR standards, and the existence of CSR annual reports. This study is based on recent discussion and theory-building efforts in public relations literature regarding evolving CSR practices. The overarching theoretical framework will be the so-called stakeholder theory and CSR communication strategy. The results …

Culturally Relevant Booktalking: Using A Mixed Reality Simulation With Preservice School Librarians, Janice Underwood, Sue Crownfield Kimmel, Danielle Forest, Gail K. Dickinson

Teaching & Learning Faculty Publications

The role of school librarians is often overlooked in advancing a respect for cultural diversity among youth, yet librarians are in key positions to champion for social justice reform in educational settings. In this qualitative study, we examine preservice school librarians' experiences with booktalking multicultural literature in a mixed reality simulation environment, as a vehicle to introduce social justice issues. Our purpose was to explore the booktalking experience as a means of developing preservice librarians' understanding of culturally relevant pedagogy, a stance concerned with developing cultural competence and critical consciousness. Our findings revealed that preservice librarians gained different levels of …

The Role Of Social Media In U.S. County Governments: The Strategic Value Of Operational Aimlessness, Barry A. Cumbie, Bandana Kar Jan 2015

The Role Of Social Media In U.S. County Governments: The Strategic Value Of Operational Aimlessness, Barry A. Cumbie, Bandana Kar

Faculty Publications

This study investigates the influence of citizens' socio-economic characteristics on the presence of social media in county-level government. E-government is ostensibly citizen-driven and therefore variation in an area's demographics would likely impact a government's utilization of emerging technology, such as social media. Despite its transformative potential and widespread adoption, e-government development beyond basic stages has been sluggish. Social media is transforming the nature of interaction among individuals and organizations and has the potential to overcome some of the restrictive challenges of e-government. Understanding if, how, and to what end governments are harnessing social media will help make e-government a citizen-driven, …

Consumer Jeopardy In An Emerging Technology: Direct-To-Consumer Personal Genome Testing, Matthew A. Van Patton Jan 2015

Consumer Jeopardy In An Emerging Technology: Direct-To-Consumer Personal Genome Testing, Matthew A. Van Patton

MUSC Theses and Dissertations

On November 23, 2013, the Food and Drug Administration (FDA) sent a letter to 23andMe, a direct-to-consumer genetic testing company, ordering the company to cease and desist selling the "Personal Genome Service," a direct-to-consumer health-related genetic test. The FDA cited the company for using an unapproved medical device. However, the FDA used concerns regarding consumer/patient safety to justify its action. Using a grounded theory methodology, this work explores perceptions of safety related to direct-to-consumer personal genome testing using topic-specific academic literature and news source articles related to the actions of the FDA and 23andMe. This work suggests that complete and …

Skin Color And Social Practice: The Problem Of Race And Class Among New Orleans Creoles And Across The South, 1718-1862, Andrew N. Wegmann Jan 2015

Skin Color And Social Practice: The Problem Of Race And Class Among New Orleans Creoles And Across The South, 1718-1862, Andrew N. Wegmann

LSU Doctoral Dissertations

The purpose of this study is to uncover the story of the New Orleans Creoles of color—the mixed-race, francophone middle class of New Orleans and the surrounding area before the Civil War. It shows how the people who became the New Orleans Creoles of color worked endlessly, over three colonial and territorial regimes and nearly 150 years, to define themselves according to the ever-changing cultural, social, and racial landscapes before them. It places this local history in the wider context of the North American continent and the Atlantic World—the space within which these people actually lived. In so doing, it …

From Prisons To Asylums, And Back : Mental Health Policy In The Age Of Neoliberalism, Michele Martin Jan 2015

From Prisons To Asylums, And Back : Mental Health Policy In The Age Of Neoliberalism, Michele Martin

Honors Theses

This thesis seeks to explain why rates of severe mental illness in the criminal justice system have risen steadily throughout the past three decades, despite an increasing acknowledgement of the importance of mental health to overall health. Legislative, scientific, and societal advances have aimed at increasing access to and bolstering the quality of mental health care. Yet, the large numbers of severely mentally ill persons residing in the criminal justice system imply care in the community is not adequately serving their needs, or that, for whatever reason, they are not seeking care. I begin my analysis by considering mental health …

Retention And Graduation Rates At Public Research Universities: Do Medical Centers Affect Rates?, Sara C. Jewell

MPA/MPP/MPFM Capstone Projects

Retention and six-year graduation rates have increased in relevance and importance within the last decade. As costs for post-secondary education continue to rise, the need to graduate on time becomes more important to both the student and the institution. Public, four-year, research universities currently have a 63 percent six-year graduation rate over the past decade (U.S. Department of Education). An average 20 percent of the students entering these same institutions are leaving after their freshman year (U.S. Department of Education). Institutions across the United States have started prioritizing these measures of success.

The goal of this research study is to …
