Chicago-Kent Law Review
In both Canada and the United States, the constitutional right to a jury trial includes the right to select a jury from a representative cross-section of the jury-eligible population. This article compares and contrasts how this right has been interpreted in the two countries through the lens of recent controversies. In Part I, the article examines how the Supreme Court of Canada and the United States Supreme Court have defined the representative cross-section component of the right to a jury trial in the two respective countries. Preventing Juror Misconduct In A Digital World, Thaddeus Hoffmeister
Chicago-Kent Law Review
This article examines the reform efforts employed by common law countries to address internet-related juror misconduct, which generally arises when jurors use technology to improperly research or discuss a case. The three specific areas of reform are (1) punishment, (2) oversight, and (3) education. The first measure can take various forms ranging from fines to public embarrassment to incarceration. The common theme with all punishments is that once imposed, they make citizens less inclined to want to serve as jurors. Therefore, penalties should be a last resort in preventing juror misconduct.

Is China Destined To Play High-Politics In East Asia?, M.A. Karim

The aim of this paper is to project China’s emerging trend towards high-politics in East Asia that is ostensibly generated by regional geopolitical dynamics. Hegemonic transition, replacing hegemonic stability, may seemingly be activating the dynamics. There is almost an inexorable move towards high-politics due mainly to presence of issues that are likely to trigger conflict, possibly a limited war. These issues range from flash points to populist nationalism, economic interdependence, and a competition for supremacy in the Western Pacific. The paper concludes by highlighting likely resultant hi-politics, action-reaction cycles, polarizations and alignments by arraying of forces, probability of a limited …

Race, Immigration Reform, And Heteropatriarchal Masculinity: Reframing The Obama Presidency, Seth N. Asumah

In this article, I argue that the macroscopic nature and complexity of race, hegemonic masculinity, and immigration issues in the United States put President Obama in a double bind for any attempt to secure reforms—situations which produce limited options and exposure to penalties in reaching solutions.

Kenneth Anger’s Invocation of My Demon Brother (1969), Emile de Antonio’s In the Year of the Pig (1968), Jonas Mekas’s Diaries, Notes, and Sketches: Also Known as Walden (1969) and Haskell Wexler’s Medium Cool (1969) constitute historical artifacts as well as discursive interventions intended to shape a vision of the nation. Therein emerged varying imbrications of ideology and the volatility of the era, along with palpable disharmony that scholars have identified between the youth movement’s cultural and political camps.1 In each case, the film’s avant-garde status did not, in and of itself, confer liberatory ideology. Gambling in the United States has been in existence since the 1800’s. For over two hundred years, gambling has brought in revenue and entertainment for consumers in the United States. As the population has diversified and the technology has advanced, the access to gambling has grown to be convenient and accessible for the consumer to enjoy. The purpose of this qualitative study was to explore the barriers and motivators from gamblers who sought recovery programs in Spanish. Fourteen current members of Spanish Gamblers Anonymous group were interviewed in small focus groups. The findings indicated that those who sought Spanish recovery …
