“He Asked If I Knew Anything About The Universe. And I Told Him No”: Alien Abductions In American Literature, Stephen James Fleming Jan 2016

“He Asked If I Knew Anything About The Universe. And I Told Him No”: Alien Abductions In American Literature, Stephen James Fleming

Theses & ETDs

Stories about aliens saturate American culture, but few critics explore them as figures that span decades and genres and that reveal a great deal about the people who are drawn to alien imagery. This thesis examines aliens in two ways: as very real extraterrestrial beings sexually assaulting abductees and assimilating into humanity; and as fictional responses to our fears of the racial Other. I speak to cultural studies scholars, since the abduction masterplot takes on the issues of social anxieties, conspiracy, politics, and entertainment history, also found in canonical literature. The first chapter traces the evolution of nonfiction abduction narratives, …

“Buy With Your Heart, Not Your Head”: Mr. Blandings Builds His Dream House And Consumption In The Postwar United States, Joy E. Feagan Jan 2016

“Buy With Your Heart, Not Your Head”: Mr. Blandings Builds His Dream House And Consumption In The Postwar United States, Joy E. Feagan

Theses & ETDs

This thesis examines the various reproductions of Eric Hodgins’ story, Mr. Blandings Builds His Dream House, released in text, film, and radio between 1946 and 1951. Exploring the differences in the narrative across time and media, I argue, provides a better understanding of the various media that reproduced the story, as well as the mediadriven consumerism of the early cold war period. What was the relationship between media (print, film, and radio) and mass consumption in the post-World War II United States? And what were the consequences of this evolving relationship? I credit the origins of this relationship to postwar …

“Foreign In A Domestic Sense”: An Examination Of Changes And Continuities In Factors Shaping Puerto Rican Emigration To The U.S. Mainland, Gerina Gjergji Jan 2016

“Foreign In A Domestic Sense”: An Examination Of Changes And Continuities In Factors Shaping Puerto Rican Emigration To The U.S. Mainland, Gerina Gjergji

Theses & ETDs

This thesis examines emigration from Puerto Rico to the mainland U.S. with the aim of uncovering the factors that account for the large exodus of people from 1898 to present. A review of how major theories of migration have developed over the twentieth and twenty-first centuries suggests several potential explanatory factors. The case analysis is based on the study of Puerto Rican economic and political history, which shapes the socio-economic conditions that drive migration. After a review of earlier waves of migration, the analysis focuses in more depth on the current cycle of migration. An appraisal of migratory movements, government …

“It Looks Like You Who Are Behind A Fence:” Exceptional Landscapes Of American Incarceration From Deer Island To Topaz, Michael Dorney Jan 2016

“It Looks Like You Who Are Behind A Fence:” Exceptional Landscapes Of American Incarceration From Deer Island To Topaz, Michael Dorney

Theses & ETDs

This senior thesis attempts to tell a spatial history of Japanese American Internment (1942-46), a historical episode that saw the United States federal government expropriate, incarcerate, and forcefully migrate 120,000 Japanese Americans during World War II. My first chapter situates the “Internment Camps” (as they are referred to in the majority of Internment historiography), within a longer history of expropriation, incarceration and forced migration, reaching as far back as British colonial Massachusetts and the Deer Island “Internment Camp” (1675-76). This chapter is designed to give the reader a deeper appreciation for the historical breadth of this distinct chapter in the …

Arsenic In Drinking Water And Lung Cancer Mortality In The United States: An Analysis Based On Us Counties And 30 Years Of Observation (1950-1979)., Hamid Ferdosi, Elisabeth K Dissen, Nana Ama Afari-Dwamena, Ji Li, Rusan Chen, Manning Feinleib, Steven H Lamm Jan 2016

Arsenic In Drinking Water And Lung Cancer Mortality In The United States: An Analysis Based On Us Counties And 30 Years Of Observation (1950-1979)., Hamid Ferdosi, Elisabeth K Dissen, Nana Ama Afari-Dwamena, Ji Li, Rusan Chen, Manning Feinleib, Steven H Lamm

Epidemiology Faculty Publications

Background. To examine whether the US EPA (2010) lung cancer risk estimate derived from the high arsenic exposures (10-934 µg/L) in southwest Taiwan accurately predicts the US experience from low arsenic exposures (3-59 µg/L). Methods. Analyses have been limited to US counties solely dependent on underground sources for their drinking water supply with median arsenic levels of ≥3 µg/L. Results. Cancer risks (slopes) were found to be indistinguishable from zero for males and females. The addition of arsenic level did not significantly increase the explanatory power of the models. Stratified, or categorical, analysis yielded relative risks that hover about 1.00. …

The Role Of Brazil And The United States In The International Promotion Of The Right To A Healthy Environment, José Adércio Leite Sampaio, Beatriz Souza Costa Jan 2016

The Role Of Brazil And The United States In The International Promotion Of The Right To A Healthy Environment, José Adércio Leite Sampaio, Beatriz Souza Costa

University of Baltimore Journal of International Law

This article has the objective of analyzing the role played by Brazil and the United States in protecting the right to a healthy environment at an international level, especially at the World Trade Organization level. First, we must try to identify the fundamental right to a healthy environment, in its internal dimension and as a human right, at the international level. We used the bibliographic technique and deductive methodology to develop the research. The results at the conclusion evidence that the behavior of political and economic agents has a direct impact on the level of environmental protection. In the United …

Social Disparities In Exposure To Point-Of-Sale Cigarette Marketing, Mohammad Siahpush, Evi A. Farazi, Jungyoon Kim, Tzeyu L. Michaud, Aaron Yoder, Ghada Soliman, Melissa Tibbits, Minh N. Nguyen, Raees A. Shaikh Jan 2016

Social Disparities In Exposure To Point-Of-Sale Cigarette Marketing, Mohammad Siahpush, Evi A. Farazi, Jungyoon Kim, Tzeyu L. Michaud, Aaron Yoder, Ghada Soliman, Melissa Tibbits, Minh N. Nguyen, Raees A. Shaikh

Journal Articles: Epidemiology

While most ecological studies have shown that higher levels of point-of-sale (POS) cigarette marketing are associated with larger proportions of residents from lower socioeconomic and minority backgrounds in neighborhoods, there are no studies that examine individual-level social disparities in exposure to POS cigarette marketing among smokers in the United States. Our aim was to examine these disparities in a Midwestern metropolitan area in the United States. We conducted a telephone survey to collect data on 999 smokers. Cigarette marketing was measured by asking respondents three questions about noticing advertisements, promotions, and displays of cigarettes within their respective neighborhoods. The questions …

Theses and Dissertations--Public Health (M.P.H. & Dr.P.H.)

Rationale: Diabetes mellitus (DM) is recognized as a common comorbid condition for tuberculosis (TB). Those with comorbid conditions are more likely to develop active TB, to have trouble with treatment, and to have more severe symptoms.

Objective: To measure the prevalence and distribution of latent tuberculosis infection (LTBI) and DM control in the United State and test their association when measured by tuberculin skin test (TST) or QuantiFERON®-TB Gold In-Tube blood test (QFT-GIT) and by HbA1c, respectively. Literature Review: One-third of the world population is infected with TB. Ten percent of TB cases worldwide are linked to diabetes mellitus. Studies …

Securities/Administrative Law—Internal Reporters Who Blow The Whistle: Are They Protected Under The Dodd-Frank Act’S Anti-Retaliation Provision?, Kristin Goodchild Jan 2016

Securities/Administrative Law—Internal Reporters Who Blow The Whistle: Are They Protected Under The Dodd-Frank Act’S Anti-Retaliation Provision?, Kristin Goodchild

Western New England Law Review

In 2010, Congress enacted the Dodd-Frank Wall Street and Consumer Protection Act (the “Dodd-Frank Act”), which was a sweeping piece of legislation that required the implementation of new rules and regulations throughout the financial industry. Interpretative ambiguity exists within the Dodd-Frank Act’s whistleblower program, which provides a definition of who qualifies as a whistleblower, and an anti-retaliation provision, which is intended to protect whistleblowers from retaliation. The ambiguity arises because a whistleblower is defined as an individual who makes a report to the Securities and Exchange Commission (the “SEC”). However, the anti-retaliation provision describes three categories of protected whistleblowing activities, …

Environmental Law—Cercla Enforcement: Terminology And Meaning Of “Treatment” Arranger Liability, Daniel J. Depasquale Jan 2016

Environmental Law—Cercla Enforcement: Terminology And Meaning Of “Treatment” Arranger Liability, Daniel J. Depasquale

Western New England Law Review

CERCLA arranger liability was forever changed by the Supreme Court decision in Burlington Northern & Santa Fe Ry. Co. v. United States, 556 U.S. 599 (2009). In the aftermath, EPA has been hamstrung with the difficulty of substantiating a Potentially Responsible Party’s (“PRP”) intent to arrange for disposal of a hazardous substance, as well as attempting to overcome the ever-increasing scientific capabilities of PRPs to demonstrate that proportionality of damages is appropriate for a given Superfund site. This Article is the first in depth analysis teasing apart what it means for a PRP to arrange for disposal, as opposed to …

Public Health Law—Remedying And Regulating The Unintended Consequences Of Subtherapeutic Dosing Of Livestock With Antibiotics: Can The Epa’S Implementation Of The Clean Water Act Reign In The Problem?, Chris Erchull, Laura Fisher Jan 2016

Public Health Law—Remedying And Regulating The Unintended Consequences Of Subtherapeutic Dosing Of Livestock With Antibiotics: Can The Epa’S Implementation Of The Clean Water Act Reign In The Problem?, Chris Erchull, Laura Fisher

Western New England Law Review

The way in which the United States has come to practice agriculture has changed drastically over the past century. As urban populations have grown and rural populations dwindled, research focused on raising production levels and decreasing costs led to the increasingly common practice of low-dose and long-term application of antibiotics to animals being raised for slaughter. Such use of antibiotics continues to have far-reaching consequences impacting human, animal, and environmental health and wellness. This article examines the fractured federal oversight of the use of antibiotics in industrial agriculture and proposes an interpretation of provisions of the Clean Water Act as …

Constitutional Law—Free Speech And Genetically Modified Food Labeling: A Proposed Framework For Determining The Controversial Character Of Compelled Commercial Speech, Richard W. Keidel Jan 2016

Constitutional Law—Free Speech And Genetically Modified Food Labeling: A Proposed Framework For Determining The Controversial Character Of Compelled Commercial Speech, Richard W. Keidel

Western New England Law Review

Food is an inextricable ingredient of life. Today, food manufacturers use modes of genetic modification to produce foodstuffs. As a result of the citizenry’s increased awareness of this fact, states are requiring food manufacturers to disclose which of their products are genetically modified. However, within the context of the First Amendment to the United States Constitution, state-mandated labeling of genetically modified food stands on an infirm foothold. The constitutionality of these disclosure requirements turns on whether state-mandated, genetically modified food labels are uncontroversial. Moreover, under the commercial speech doctrine, it is unclear how a court should assess and what a …

El Español En Los Estados Unidos: Panorama De Estudios Sociolingüísticos, Lotfi Sayahi, Juanita Reyes, Cecily Corbett

Languages, Literatures and Cultures Faculty Scholarship

The aim of this paper is to present the principal areas of sociolinguistic research concerning Spanish spoken in the United States. In doing so, we focus on a variety of topics ranging from macro-sociolinguistic issues, such as the sociology of language, to micro-sociolinguistic features having more to do with language variation and change. In our discussion of bilingualism and sociology of language, we explore the situation faced by Spanish speakers in the United States, including discussions of language policies and bilingual education. We also examine cases of contact between various dialects of Spanish in the United States, and some variable …

Black And Blue: Media Attention In Red Vs. Blue States, An Analysis Of Violence Against Lgbt Between 2004 And 2015, Chelsea Green, Hasan T. Arslan Jan 2016

Black And Blue: Media Attention In Red Vs. Blue States, An Analysis Of Violence Against Lgbt Between 2004 And 2015, Chelsea Green, Hasan T. Arslan

Student-Faculty Research Projects

Violence against any person is unacceptable; however, there seems to be a tacit collusion with perpetrators when the media non-reports or under-reports incidents of violence in which the victims are targeted because of their actual or perceived LGBT identity. One wonders if the political and religious broad brush strokes of a state influence the response of the media within that state. Close examination of this data will determine if there are discrepancies between the two types of states regarding their portrayal of anti-LGBT attacks. How does the governmental bias of a state influence the coverage of these attacks? All states …

Prosecuting Rape Victims While Rapists Run Free: The Consequences Of Police Failure To Investigate Sex Crimes In Britain And The United States, Lisa Avalos Jan 2016

Prosecuting Rape Victims While Rapists Run Free: The Consequences Of Police Failure To Investigate Sex Crimes In Britain And The United States, Lisa Avalos

Michigan Journal of Gender & Law

Imagine that a close friend is raped, and you encourage her to report it to the police. At first, she thinks that the police are taking her report seriously, but the investigation does not seem to move forward. The next thing she knows, they accuse her of lying and ultimately file charges against her. You and your friend are in shock; this outcome never entered your minds. This nightmare may seem inconceivable, but it has in fact occurred repeatedly in both the United States and Britain—countries that are typically lauded for their high levels of gender equality. In Britain, where …

Law Enforcement As A Form Of Development: Community Policing In The United States, Michael Reynolds Jan 2016

Law Enforcement As A Form Of Development: Community Policing In The United States, Michael Reynolds

MA IDS Thesis Projects

The evolution of crime throughout time has required a development of alternative policing methodologies in the United States. One result of this is community policing, where problem solving became foundational to solving crime, transitioning from reactionary to prevention-based policing tactics. However, serious issues with community policing persist. This paper considers the role of police officers as development actors, introducing a foundational philosophy of development and formulating new principles and suggestions for modern police tactics.

Deference To The Executive, Julian Arato Jan 2016

Deference To The Executive, Julian Arato

Book Chapters

This chapter examines the practice of deference to the executive, by national courts, in the context of interpreting treaties. When faced with an issue of treaty interpretation, to what extent must a national court engage in its own independent analysis, and to what extent ought the court give weight to interpretations advanced by the executive branch? And if deference to the executive is permissible as a matter of international doctrine, what considerations ought to guide the manner of deference, and the determination of how much deference is appropriate? I argue that international law does not formally preclude national judicial deference …

Quantifying The Impact Of Human Visitation In Two Cave Chambers On Mona Island (Puerto Rico): Implications For Archaeological Site Conservation, R. M. Vieten, A. Winter, Alice V.M. Samson

KIP Articles

Recent archaeological research has discovered well preserved historic and pre-Columbian art covering numerous walls inside caves on Mona Island. Human visits can pose a serious threat to the long term conservation of these fragile engravings and paintings by increasing condensation corrosion rates. The quantification of environmental changes to caves related to human visitation is relevant for prediction of condensation corrosion processes and cave site management policies. This study addresses the threat of increased condensation corrosion to cave art. Data collected in two caves show changes in cave air temperature (T), relative humidity (RH) and CO2 partial pressure (pCO2) caused by …

Currently there are estimated to be approximately 3.7 million contact lens wearers in the United Kingdom and 39.2 million in North America. Contact lens wear is a major risk factor for developing an infection of the cornea known as keratitis due to poor lens hygiene practices. While there is an international standard for testing disinfection methods against bacteria and fungi (ISO 14729), no such guidelines exist for the protozoan Acanthamoeba, which causes a potentially blinding keratitis most commonly seen in contact lens wearers, and as a result, many commercially available disinfecting solutions show incomplete disinfection after 6 and 24 …

The Duty Of Corporate Directors To Tie Executive Compensation To The Long-Term Sustainability Of The Firm, Alberto Salazar, Muthana Mohamed Jan 2016

The Duty Of Corporate Directors To Tie Executive Compensation To The Long-Term Sustainability Of The Firm, Alberto Salazar, Muthana Mohamed

Osgoode Legal Studies Research Paper Series

Executive compensation is said to be for performance and, in liberal market economies, the board of directors along with compensation committees have largely been in charge of safeguarding pay for performance. This executive compensation system is legally protected by the business judgment rule (a strong judicial deference) and has recently been supplemented with shareholders’ ‘say on pay’. Further legal or government intervention has been deemed unnecessary. However, such system has resulted in extremely excessive executive compensation, outrageous pay disparities between executives and workers, poor or short-term performance, recurrent corporate failures and economic recession. This paper explores the need for a …

Protecting Online Privacy, Stephanie D. Winkler

Theses and Dissertations--Communication

Online privacy has become one of the greatest concerns in the United States today. There are currently multiple stakeholders with interests in online privacy including the public, industry, and the United States government. This study examines the issues surrounding the protection of online privacy. Privacy laws in the United States are currently outdated and do little to protect online privacy. These laws are unlikely to be changed as both the government and industry have interests in keeping these privacy laws lax. To bridge the gap between the desired level of online privacy and what is provided legally users may turn …

Differences In Memory Functioning Between Children With Attention-Deficit/Hyperactivity Disorder And/Or Focal Epilepsy., Sylvia E Lee, Michelle Y Kibby, Morris J Cohen, Lisa Stanford, Yong Park, Suzanne Strickland

Publications

Prior research has shown that attention-deficit/hyperactivity disorder (ADHD) and epilepsy are frequently comorbid and that both disorders are associated with various attention and memory problems. Nonetheless, limited research has been conducted comparing the two disorders in one sample to determine unique versus shared deficits. Hence, we investigated differences in working memory (WM) and short-term and delayed recall between children with ADHD, focal epilepsy of mixed foci, comorbid ADHD/epilepsy and controls. Participants were compared on the Core subtests and the Picture Locations subtest of the Children's Memory Scale (CMS). Results indicated that children with ADHD displayed intact verbal WM and long-term …

Forgetting Nature: The Importance Of Including Environmental Flows In International Water Agreements, Amy Hardberger Jan 2016

Forgetting Nature: The Importance Of Including Environmental Flows In International Water Agreements, Amy Hardberger

Faculty Articles

From the moment States created political boundaries to define their territory, they have shared water. There are 263 transboundary lake and river basins worldwide and 300 known transboundary aquifer systems. Whenever sharing is present, the opportunity for conflict is too. Climate change and increasing population are only two factors that may lead to increasing conflict if attention is not given to these situations. Thankfully, sharing water also creates an opportunity for cooperation. Throughout the world, there are increasing examples of conflict and cooperation regarding shared water resources. International water agreements can promote regional peace and security and encourage economic growth. …
