Recent litigation brought or threatened against the administration of President Obama has brought to prominence the question of standing by Congress or its members to sue the President for nondefense or non-enforcement of federal law. While scholars divide over the normative propriety of such suits, the Court has never issued a definitive pronouncement on their viability. Nevertheless, the Court’s rulings when the issue has arisen have displayed a distinct pattern. While the Court has not formally repudiated suits of this nature, neither has it issued a decision that hinges on the presence of congressional standing. On the contrary, the Court …

IMPORTANCE: Brain death is the irreversible cessation of function of the entire brain, and it is a medically and legally accepted mechanism of death in the United States and worldwide. Significant variability may exist in individual institutional policies regarding the determination of brain death. It is imperative that brain death be diagnosed accurately in every patient. The American Academy of Neurology (AAN) issued new guidelines in 2010 on the determination of brain death.
OBJECTIVE: To evaluate if institutions have adopted the new AAN guidelines on the determination of brain death, leading to policy changes.

Do College Rankings Matter? Examining The Influence Of “America’S Best Black Colleges” On Hbcu Undergraduate Admissions, Willis A. Jones

College rankings have become a ubiquitous part of American higher education. As the popularity of rankings has increased, so have the number of research studies attempting to better understand the impact rankings have on college/university admissions outcomes. In the past, these studies have focused almost exclusively on elite national universities and liberal arts colleges. This study broadens research in this area by examining how the introduction of U.S. News and World Report’s “America’s Best Black Colleges” section influenced undergraduate admissions among historically black colleges and universities (HBCUs). The findings suggest that college rankings have little correlation with admissions outcomes …

OBJECTIVE: To investigate if a national pediatric primary care quality improvement collaborative (QIC) could improve and sustain adherence with process measures related to diagnosis and management of children with genetic disorders.
METHODS: Thirteen practices in 11 states from the American Academy of Pediatrics' Quality Improvement Innovation Networks participated in a 6-month QIC that included regular educational opportunities, access to genetic professionals, and performance feedback. The QIC identified 11 aims related to improving diagnosis and management of children with genetic disorders. The practices evaluated adherence by reviewing patient records at baseline, monthly for 6 months (active improvement period), and then once …

How may the stature and security of the United States, so passionately a concern for many and so profoundly important to the character and direction of our emerging global society, be pursued responsibly? This question is the burden of this article, in which the author examines and rejects a number of policy options to the challenges he sees Washington now facing. He rejects these policy options because he finds them miscast, incomplete, counterproductive, or representative of symptoms rather than causes. The presentation, pathology, and prognosis of pancreatic neuroendocrine tumors (PNETs) in Asian patients have not been studied in large cohorts. We hypothesized that the clinicopathological features of PNETs of Chinese patients might be different from those of US patients. The objectives of this study were to address whether PNETs in Chinese patients exhibit unique clinicopathological features and natural history, and can be graded and staged using the WHO/ENETS criteria.

The Grass Is Not Always Greener: Congressional Dysfunction, Executive Action, And Climate Change In Comparative Perspective, Hari M. Osofsky, Jacqueline Peel

Partisan climate change politics, paired with a legislative branch that is often deeply divided between two parties, has led to congressional gridlock in the United States. Numerous efforts at passing comprehensive climate change legislation have failed, and little prospect exists for such legislation in the foreseeable future. As a result, executive action under existing federal environmental statutes—often in interaction with litigation—has become the primary mechanism for national-level regulation of greenhouse gas emissions from motor vehicles and power plants.

On September 16, 2008 following heavy losses on its holdings of Lehman Brothers commercial paper in the wake of the Lehman bankruptcy filing, The Reserve Primary Fund “broke the buck"when its net asset value fell below the $1.00 per share target traditionally maintained by money market mutual funds (MMMFs). The resulting losses to investors in the Primary Fund sparked a panic among prime (nongovernment) MMMF investors more generally as they became aware that it was possible to lose money in accounts that were typically viewed as safe. Within a week, roughly $300 billion had been withdrawn from prime MMMFs. To …
