Interpretation Of Pathological Arbitration Agreements: Non-Existing And Inaccessible Elements, Morten Frank

In the following, I will initially present the terminological and analytical framework for handling pathological arbitration agreements (Part II). Against this background, I will analyze case law from USA (Part III), Singapore and Hong Kong (Part IV), and England (Part V) in order to establish under which circumstances Solution 1, Solution 2 and Solution 3 apply in respect of arbitration agreements containing non-existing and inaccessible elements. Finally, Part VI considers an adjoining—although fundamentally different—interpretation situation across jurisdictions. Part VII provides a summary as well as concluding remarks on the drafting of arbitration agreements.

[excerpt] I recently was asked whether the Constitution requires a peaceful transfer of power following an election. Sadly, the questions is not merely theoretical. President Trump has stated that, if he loses the upcoming election, it will be through fraud. And he has made it clear that he will be unrestrained in his response to any efforts to oust him from office through an election he pronounces fraudulent.

BACKGROUND: Research has the potential to influence US social policy; however, existing research in this area lacks a coherent message. The Model for Dissemination of Research provides a framework through which to synthesize lessons learned from research to date on the process of translating research to US policymakers.
METHODS: The peer-reviewed and grey literature was systematically reviewed to understand common strategies for disseminating social policy research to policymakers in the United States. We searched Academic Search Premier, PolicyFile, SocINDEX, Social Work Abstracts, and Web of Science from January 1980 through December 2019. Disability And Health Outcomes Of Eastern European Immigrants To The United States, Ina Palii

Eastern European immigrants are one of the largest groups of immigrants in the United States. However, little is known about their health outcomes after arrival to the US. This study addresses the importance of differentiating Eastern European immigrants as a distinct category of immigrants with health outcomes that may differ from those born in the US, or other immigrants. This study examined the health of Eastern European immigrants in the United States, by focusing on three measures of disability – ambulatory, independent living, and self-care difficulties – and comparing them to US-born Whites and to other immigrants. This study looked at state public land acreage, average median income, poverty rates, and unemployment rates to analyze the significance of their impact on obesity in the United States. Percentage of public land for each state was gathered from a data overview of 2018, data for the economic factors of influence were from 2017-2019, and obesity rate information was collected from 2019. The hypothesis was that there would be a negative relationship to obesity with public land and average median income; and a positive relationship to obesity with poverty and unemployment rates. AIM: To assess whether an enhanced category combining suicides with non-suicide drug self-intoxication fatalities more effectively captures the burden of self-injury mortality (SIM) in the USA among US non-Hispanic black and Hispanic populations and women irrespective of race/ethnicity.
METHODS: This observational study used deidentified national mortality data for 2008-2017 from the CDC's

The Sources And Consequences Of Political Rhetoric: Issue Importance, Collegial Bargaining, And Disagreeable Rhetoric In Supreme Court Opinions, Michael A. Zilis, Justin Wedeking

How do political actors use rhetoric after an initial policy battle? We explore factors that lead Supreme Court justices to integrate disagreeable rhetoric into opinions. Although disagreeable language has negative consequences, we posit that justices pay this cost for issues with high personal significance. At the same time, we argue that integrating disagreeable rhetoric has a deleterious effect on the institution by reducing majority coalition size. Examining opinions from 1946 to 2011 using text-based measures of disagreeable rhetoric, we model the language of opinion writing as well as explore the consequences for coalition size. Feminism in the contemporary United States is a diverse field of thought with several strains of ideological leanings, including liberal, neoliberal, and the contested conservative feminism. Each is uniquely situated in the American context due to the heavy influence of American values and culture-specific definitions of justice, success, and progress. Entrenched in the Western conceptions of secularism and advancement, “modern” feminism in the United States prides itself as the example of peak progressivism, yet does so without critically engaging with its definition of modernity or secularism.
