Post-9/11 culture provided an opportunity for companies to rebrand themselves and their products as American. In doing so, they supported the president’s directive to consume, gave Americans a concrete way to express their support for their country, and made a tidy profit in the process.
Network Neutrality Between False Positives And False Negatives: Introducing A European Approach To American Broadband Markets, Jasper P. Sluijs
Network Neutrality Between False Positives And False Negatives: Introducing A European Approach To American Broadband Markets, Jasper P. Sluijs
Federal Communications Law Journal
Network neutrality has become a contentious issue both in Europe and the United States. Regulators on both sides of the Atlantic face digital divides in their society, and are confronted with potentially conflicting policy goals-to incentivize private investment in next-generation broadband while maintaining "neutral" and competitive broadband networks.
This Article compares nascent American and European network neutrality policy in terms of regulatory error costs. Emerging markets, such as broadband, are more likely to be affected by regulatory errors, and these errors have graver consequences in emerging markets than in regular markets. U.S. telecommunications policy traditionally has advanced a trial-and-error approach …
Universal Service In The United States: A Focus On Mobile Communications, Steven G. Parsons, James Bixby
Universal Service In The United States: A Focus On Mobile Communications, Steven G. Parsons, James Bixby
Federal Communications Law Journal
The concept of universal service, providing affordable telecommunications to all citizens, has a long and changing history in the United States. Prior to the Telecommunications Act of 1996, efforts to achieve universal service were largely based on a complex web of implicit subsidies to basic landline local exchange residential service. The Act expanded and codified the concept of universal service and made the subsidies largely explicit. This Article evaluates the possible economic rationales for subsidizing voice communications and find them lacking. This Article argues that the weak rationale for subsidizing basic voice communications makes it critical that U.S. universal-service policy …
Soldiers Of Conscience : Conscription And Conscientious Objection In The United States And Britain During World War I, Timothy Mark La Goy
Soldiers Of Conscience : Conscription And Conscientious Objection In The United States And Britain During World War I, Timothy Mark La Goy
Legacy Theses & Dissertations (2009 - 2024)
Conscience and the freedom to exercise conscience have long been cherished civil liberties in western democracies. However, during World War I, traditional concepts of conscience and conscientious objection to military service were challenged by the demands of conscription and militarism in the United States and Britain. This dissertation examines the definition, context, and exercise of conscience by conscientious objectors (COs) during the war. This study finds that conscience existed in a dynamic state. COs were compelled by changing circumstances to reevaluate and restate their objections as they responded to changing circumstances in army camps, guardhouses, and prisons.

Managing Public Higher Education Restructuring: Understanding College And University Cost Structures, G. Thomas Sav
Managing Public Higher Education Restructuring: Understanding College And University Cost Structures, G. Thomas Sav
Economics Faculty Publications
This paper focuses on understanding college and university costs as a prerequisitefor successfully managing ongoing issues associated with restructuring publiclyprovided higher education. Restructuring is well underway as a result ofglobalization, the European led Bologna Declaration, and U.S. nationallycompetitive forces. It potentially affects the mix and level of products that collegesand universities produce. To capture the possible cost implications of thosechanges, multi-product cost functions are empirically estimated for four levels ofU.S. public colleges and universities: doctoral, master, bachelor, and associatedegree granting institutions. Scale and scope estimates are derived for researchand three teaching outputs, including undergraduate, graduate, and professionaleducation. Findings regarding product …

International Students’ Engagement With Effective Educational Practices : A Cross-National Comparison, Daniel Edwards, Hamish Bennett Coates, Ali Radloff
International Students’ Engagement With Effective Educational Practices : A Cross-National Comparison, Daniel Edwards, Hamish Bennett Coates, Ali Radloff
Higher education research
International students in USA universities have higher levels of engagement with their institution when compared to international students enrolled in Australasian universities. ❚ The largest difference between USA and Australian international students was related to student and staff interactions. ❚ The growth in engagement with their institution between first and later year students among the international cohort is more prominent among those enrolled in USA than those in Australia or New Zealand. ❚ Among Australasian higher education students the international student group on average have higher levels of engagement than domestic students. ❚ When compared cross-nationally, the engagement score difference …
Foreign Sovereign Immunity And Domestic Officer Suits, Curtis A. Bradley, Jack L. Goldsmith
Foreign Sovereign Immunity And Domestic Officer Suits, Curtis A. Bradley, Jack L. Goldsmith
Faculty Scholarship
Under international law, official-capacity suits brought against a foreign state’s officers are treated as suits against the state itself and thus as subject to the state’s immunity, even in suits alleging human rights abuses. This immunity regime differs from the immunity regime that applies in the United States in suits brought against state and federal officials for violations of federal law. Despite the federal government’s sovereign immunity and the immunity of state governments under Eleventh Amendment jurisprudence, courts often allow suits against federal and state officers for their official actions. This essay attempts to explain why the immunity rules differ …

Mapping The American Shareholder Litigation Experience: A Survey Of Empirical Studies Of The Enforcement Of The U.S. Securities Law, James D. Cox, Randall S. Thomas
Faculty Scholarship
In this paper, we provide an overview of the most significant empirical research that has been conducted in recent years on the public and private enforcement of the federal securities laws. The existing studies of the U.S. enforcement system provide a rich tapestry for assessing the value of enforcement, both private and public, as well as market penalties for fraudulent financial reporting practices. The relevance of the U.S. experience is made broader by the introduction through the PSLRA in late 1995 of new procedures for the conduct of private suits and the numerous efforts to evaluate the effects of those …

My thesis examines the transparency initiatives of the ten states that received the most amount of funding from the federal government via The American Reinvestment and Recovery Act of 2009 (ARRA). Transparency is defined for reader ease and ARRA is analyzed fully to get a background on the implications and goals of the act. Included in this, is a statistical analysis concerning all states in the United States along with their transparency score reported. Furthermore, the ten states that received the most funding are put through an in-depth analysis to determine the means for funding. Discussion concerning the political nature …

Rethinking Treaty Shopping: Lessons For The European Union, Reuven S. Avi-Yonah, C. H. Panayi
Book Chapters
Whilst treaty shopping is not a new phenomenon, it remains as controversial as ever. It would seem that the more countries try to deal with it, the wider the disagreements as to what is improper treaty shopping and what is legitimate tax planning. In this paper, we reassess the traditional quasi-definitions of treaty shopping in an attempt to delineate the contours of such practices. We examine the various theoretical arguments advanced to justify the campaign against treaty shopping. We also consider the current trends in treaty shopping and the anti-treaty shopping policies under the OECD Model and the US Model. …

For the past thirty-five years, the debate on fundamental tax reform in the United States has centered on whether some type of consumption tax would replace all or part of the federal income tax. In my opinion, this debate has now been decided. Given recent budgetary developments and the impending eligibility of the baby boom generation for Social Security and Medicare, we cannot dispense with the revenue from the corporate and individual income tax. Moreover, we will need huge amounts of additional revenue, and most informed observers believe that the only plausible source for such revenues is a federal value-added …

Caregivers of individuals with disabilities in the United States have been reported to experience additional hardships than families with typical children as they attempt to balance family and work (Parish, Rose, Grinstein-Weiss, Richman, & Andrews, 2008). In this study, 31 caregivers of individuals with intellectual disabilities from the United States and 225 from the Czech Republic completed a qualitative quality of life survey. Similarities in the two groups were found in reported gains and losses from caregiving responsibilities. Differences in perceived spirituality, personal sense of peace and serenity, life optimism, ability to rejoice in life, personal life perspective, health, financial …

With the global use of International Financial Reporting Standards (IFRS), the United States is facing the dilemma of whether to convert to these standards or converge them with U.S. Generally Accepted Accounting Principle (GAAP) in an effort to remove the major differences between standards. One set of global financial reporting standards would improve the comparability of financial statements around the world, but the Securities & Exchange Commission believes the standards need further improvement, before the U.S. takes any major steps to convert. I conducted research, focusing on professional journals, publications from the Big Four accounting firms, and standards issued by …

Up, Up, And Away: The Dynamics Of Innovation In The Us Air Cargo Transportation Industry, Janet K. Tinoco, Ryan Johnson
Management, Marketing and Operations - Daytona Beach
In 1978 the United States (US) Congress passed the Airline Deregulation Act, allowing all-cargo airlines to compete in an industry that was heretofore highly regulated and stagnant. As companies came and went, successful carriers realized that innovation was necessary to survive. This study analyzes the dynamics of innovation over the industry’s life cycle using intellectual property (IP) data. Results indicate that despite having the characteristics of a commodity, the industry follows a reverse life cycle. Furthermore, FedEx and United Parcel Service (UPS) hold the highest levels of innovation while dominating the market, signifying that innovation should be integrated into the …
