Carving Out A Sense Of Place: The Making Of The Marble Valley And The Marble City Of Vermont, Michael Louis Austin Jan 2002

Carving Out A Sense Of Place: The Making Of The Marble Valley And The Marble City Of Vermont, Michael Louis Austin

Doctoral Dissertations

The making of the Central Valley of Vermont created a sense of identity for the region. Strategically between two Native American confederations, the area was also enmeshed in European settlement to the north, south, east and west. At first conventional farming was the engine of growth in the Central Valley, but the Erie Canal and the rich soil from the Midwest undercut Rutlands agriculture. Rutland switched its economy to sheep. By the 1850s, that too had failed. With the infrastructure of railroads and technology, the rich mineral resources of the region could be exploited and organized on a national scale. …

Exploration Of The Nature Of The Work Done By United States Marshals Service Employees In The District Of Nevada, Michael Robin Schlaerth

UNLV Retrospective Theses & Dissertations

For the first time in its 212 year history, the United States Marshals Service created a position for employees specifically designated to assist district offices experiencing administrative and operational problems. This move was promoted by a recruiting session in April of 2001 which was designed entirely to train individuals for the job entitled GS-082. This move is the result of the agency's overall need for more labor. However, while these agents carry the title of "Deputy Marshal", they do not require the same intense training of the standard GS-1811 agents, as their duties do not demand it. Employees in the …

Music Collections In American Public Libraries, Linda B. Fairtile, Karen M. Burke

University Libraries Faculty and Staff Publications

This article presents a broad survey of music collections in public libraries in the United States. Characteristics common to the majority of American public libraries are discussed, including origin, funding, and mission as an educational institution. Using a 1949 survey compiled by Otto Luening, Music Materials and the Public Library, as a basis for comparison, the authors surveyed seven libraries representing one or more of the following communities: small towns, school districts with nationally recognized music education programs, large cities, and locations associated recognizably "American" musical styles (e.g., New Orleans and jazz). The results this informal web survey demonstrate …

Legal And Policy Implications For A New Era: The War On Terror, Jeffrey F. Addicott Jan 2002

Legal And Policy Implications For A New Era: The War On Terror, Jeffrey F. Addicott

Faculty Articles

The attacks on September 11, 2001 marked the beginning of the War on Terror. A conclusive body of evidence pointed directly to al-Qa’eda’s terrorist organization as the perpetrators of the arrack and to Afghanistan’s Taliban as the State-supporter of the terrorist organization. Al-Qa’eda terrorists use religion, most often radical Islamic fundamentalism, to justify the mass murder of innocent individuals–demonstrating they have no regard for human life, let alone the human rights and fundamental freedoms of others. Armed with the Congressional Joint Resolution, United Nations (“U.N.”) Resolution 1368, and the North Atlantic Treaty Organization (“NATO”) Resolution, the United States and its …

A History Of The Concepts Of Zion And New Jerusalem In America From Early Colonialism To 1835 With A Comparison To The Teachings Of The Prophet Joseph Smith, Ryan S. Gardner

Theses and Dissertations

This thesis discusses the role that the idea of Zion has played in the first three centuries of American religion. Millenarian themes, such as building New Jerusalem, were common religious themes in seventeenth- to nineteenth-century America. Understanding the doctrine of The Church of Jesus Christ of Latter-day Saints regarding this vital subject will be helpful for historians, scholars, and teachers.

When the Puritan colonists came to the New World in the early seventeenth century, they sought not only a land of religious liberty, but also a land of ultimate religious achievement: the establishment of Zion and/or New Jerusalem. Many of …

First, what learning objectives should be included in each of the six core accounting classes; second, what will constitute valid measurements as to the learning objectives; third, what recommendations should be included in the applicable curriculum guides for the …

U.S. Humanitarian Demining In The Middle East, Stacy L. Smith Dec 2001

U.S. Humanitarian Demining In The Middle East, Stacy L. Smith

The Journal of Conventional Weapons Destruction

The United States seeks to relieve human suffering caused by landmines and unexploded ordnance (UXO) while promoting U.S. foreign policy interests. U.S. objectives are to reduce civilian casualties, create conditions for the safe return of refugees and displaced persons to their homes and reinforce an affected country’s stability. The U.S. seeks to accomplish these objectives by helping to establish and support sustainable indigenous mine action capabilities in mine-affected nations where appropriate. Since fiscal year 1993, the United States has committed almost $500 million (U.S.) to global mine action initiatives, including research and development and survivor assistance. Nearly $90 million (U.S.) …

Assessing Causation In Breast Implant Litigation: The Role Of Science Panels, Laural L. Hooper, Joe S. Cecil, Thomas E. Willging

Law and Contemporary Problems

In two recent cases, federal judges appointed panels of scientific experts to help assess conflicting scientific testimony regarding causation of systemic injuries by silicone gel breast implants. This article will describe the circumstances that gave rise to the appointments, the procedures followed in making the appointments and reporting to the courts, and the reactions of the participants in the proceedings.

Too Many Probabilities: Statistical Evidence Of Tort Causation, David W. Barnes Oct 2001

Too Many Probabilities: Statistical Evidence Of Tort Causation, David W. Barnes

Law and Contemporary Problems

Medical scientific testimony is often expressed in terms of two different probabilities: 1. The increased probability of harm if a person is exposed, for example, to a toxin. 2. The observed relationship is an artifact of the experimental method. This article demonstrates that neither probability, taken alone or together, measures whether the "preponderance of the evidence" test is met.

The Decline And Fall Of Saint Mary's Of The Barrens: A Case Study In Contraction Of An American Catholic Religious Order - Part One, Richard J. Janet Ph.D. Oct 2001

The Decline And Fall Of Saint Mary's Of The Barrens: A Case Study In Contraction Of An American Catholic Religious Order - Part One, Richard J. Janet Ph.D.

Vincentian Studies

The closing of Saint Mary’s of the Barrens Seminary offers an example of the reaction of religious orders to the Second Vatican Council. In the United States especially, there was conflict between orders’ missions and their members’ individual identity as tied to specific works. Saint Mary’s Seminary formed hundreds of churchmen and provided a “unifying spirit” to apostolates. It closed due to declining enrollment and changes in the American church’s culture. When it did, Vincentians disagreed on what to do with apostolates. Details on the decision to close Saint Mary’s and the apostolates’ fate are provided from surveys and reports.

Scientific Models Of Human Health Risk Analysis In Legal And Policy Decisions, Douglas Crawford-Brown Oct 2001

Scientific Models Of Human Health Risk Analysis In Legal And Policy Decisions, Douglas Crawford-Brown

Law and Contemporary Problems

The quality of scientific predictions of risk in the courtroom and policy arena rests in large measure on how the two differences between normal practice and the legal/policy practice of science are reconciled. This article considers a variety of issues that arise in reconciling these differences, and the problems that remain with scientific estimates of risk when these are used in decisions.

Causation And The Law: Preemption, Lawful Sufficiency, And Causal Sufficiency, Richard Fumerton, Ken Kress Oct 2001

Causation And The Law: Preemption, Lawful Sufficiency, And Causal Sufficiency, Richard Fumerton, Ken Kress

Law and Contemporary Problems

This article briefly describes the normative/nonnormative distinction, and how one might invoke this distinction to locate a nonnormative dimension of actual causation. After briefly introducing Richard Wright's concept of a necessary element in a set of conditions for an effect, the article notes ambiguities in the critical concepts of necessity and sufficiency that he deploys. The article suggests the most plausible interpretation of Wright's use of different modal concepts.

The Admissibility Of Differential Diagnosis Testimony To Prove Causation In Toxic Tort Cases: The Interplay Of Adjective And Substantive Law, Joseph Sanders, Julie Machal-Fulks

Law and Contemporary Problems

This article uses the differential diagnosis opinions to explore a pair of interrelationships. The basic causal framework employed by most courts in toxic tort cases is presented. A key to understanding the developing case law in this area is to appreciate the degree to which the courts have adopted the interpretive conventions of science in assessing admissibility.

Economy And 'New Economy' In The United States And Germany, Phillip J. Bryson Jul 2001

Economy And 'New Economy' In The United States And Germany, Phillip J. Bryson

Faculty Publications

The expression "New Economy" is used inconsistently. This Article review the driving forces of the US boom of the 1990s, examining the changes introduced in the period and before, focusing on the IT sector and new technologies. The "New Economy" is not just the new sectors, but changes in the overall economy emanating from them. These changes will not evaporate in an economic slowdown. Comparisons of the USA with Germany and Europe illustrate that the "New Economy" will also continue to develop there on the foundations already laid.
