Antidiscrimination And Affirmative Action Policies: Economic Efficiency And The Constitution, Edward M. Iacobucci Apr 1998

Antidiscrimination And Affirmative Action Policies: Economic Efficiency And The Constitution, Edward M. Iacobucci

Osgoode Hall Law Journal

This article assesses the economic efficiency of race-based antidiscrimination and affirmative action policies with a view to assessing relevant Canadian and American constitutional law. The article reviews economic arguments about why antidiscrimination laws may be efficient in addressing externalities, in hastening the exit of bigoted employers from the market, and in preventing the potentially inefficient use of race as a proxy for information; affirmative action may be efficient in accounting for differential signaling costs across race. The article concludes that economic analysis supports the approach in section 15 of the Charter which generally bans discriminatory government action, but recognizes that …

The United States And The Netherlands: A Study Of Early Cold War Cooperation, Michael R. Hirman Apr 1998

The United States And The Netherlands: A Study Of Early Cold War Cooperation, Michael R. Hirman

History Theses & Dissertations

This thesis examines the policy that the United States utilized between 1945 and 1950 to enlist Dutch support for post-war European organizations and the place of this relationship within United States overall Cold War policy. The Netherlands willingness to cooperate and further United States objectives significantly contributed to the development of economic reconstruction and military security in Western Europe. In addition the United States unprecedented vision for a multilateral defense treaty came to fruition in part through Dutch support and compliance. However, the Dutch also had to make some historic changes. The United States opposed the Dutch attempt to retake …

Next, it presents an analysis of the intelligence community during the Cold War era. Finally, it analyzes the contending arguments and theories on the future of the American intelligence community.

This review takes an in-depth look at the principle groupings that characterize current thought on the future role of intelligence. The two principal schools of thought on …

Christians On The Oregon Trail: Churches Of Christ And Christian Churches In Early Oregon, 1842-1882, Jerry Rushford

Churches of Christ Heritage Collection

The Restoration Movement originated on the American frontier in a period of religious enthusiasm and ferment at the beginning of the nineteenth century. The first leaders of the movement deplored the numerous divisions in the church and urged the unity of all Christians through a restoration of New Testament Christianity. The Protestant Reformation had gone astray, they felt, and the various denominations must be directed back to primitive Christianity. They believed that this would be possible if everyone would wear the name "Christian" and return to the Biblical pattern of the New Testament church in doctrine, worship, and practice. Those …

(First Paragraph) Planning has been a part of the American landscape since the establishment of the first colonial outposts, but it was not until the early twentieth century that the field's protagonists organized and professionalized. Also a relatively recent phenomenon is the field of American planning history, which for many years was the neglected stepchild of urban history and the distant cousin of architectural history. Over the past decade, however, a steady outpouring of interdisciplinary research has garnered for the field well-deserved recognition within the academy. At a time when more established disciplines are increasingly torn by ideological differences and …

Leadership, Gender, And Division I Athletics, A Study Of Athletes' Needs Based On Gender, Carol Knerr Jan 1998

Leadership, Gender, And Division I Athletics, A Study Of Athletes' Needs Based On Gender, Carol Knerr

Honors Theses

Athletics is a significant area where leadership can be observed and studied. Through my experience in athletics up to the college level, I have noticed that coaches coach differently depending on if they are coaching male or female athletes. For example, I have noticed that coaches of male sports teams sometimes yell, scream, and directly insult their players in order to motivate them. This technique seems to work for the men but generally might not be as successful for female athletes. This is simply an observation that is not backed up by research. Some research has been done on different …

Silent Partners: The Economic Life Of Women On The Frontier Of Colonial New York, Aileen Button Agnew Jan 1998

Silent Partners: The Economic Life Of Women On The Frontier Of Colonial New York, Aileen Button Agnew

Doctoral Dissertations

The Hudson-Mohawk frontier of eighteenth-century New York made both a boundary and a meeting place for several cultures. The shops and retail spaces of this borderland provided a common space for the convergence of women and their work with the more visible male-dominated economy. As recorded in local account books, black, white, and Indian women took part in many aspects of local commerce. As retailers, as producers, and as consumers, women participated in the world of business and accounts.

Settled in the seventeenth-century by the Dutch, this part of New York had long been occupied by Iroquoian tribes. Trade between …

In The Name Of The Father: The Continuity And Paradox Of Puritan Theology And Pastoral Authority, Patricia J. Hill-Zeigler Jan 1998

In The Name Of The Father: The Continuity And Paradox Of Puritan Theology And Pastoral Authority, Patricia J. Hill-Zeigler

Doctoral Dissertations

American scholars have long been interested in the intellectual and social impact of the eighteenth-century religious revival, the Great Awakening. This dissertation uses a colonial family as a case study of the significance of this major colonial event. It traces and compares the intellectual and theological development of Michael Wigglesworth, and his two sons, Samuel and Edward. The Wigglesworth family represents both the foundation of Puritan thought in the seventeenth century and the transformation of that thought in the eighteenth century. Michael Wigglesworth (1631-1705), a tutor and Fellow at Harvard College and pastor of the church in Malden, Massachusetts, was …

Skillful Women And Jurymen: Gender And Authority In Seventeenth-Century Middlesex County, Massachusetts, Edith Murphy Jan 1998

Skillful Women And Jurymen: Gender And Authority In Seventeenth-Century Middlesex County, Massachusetts, Edith Murphy

Doctoral Dissertations

Through analysis of about one thousand cases that appeared before the Middlesex County, Massachusetts, court between 1649 and 1679, this dissertation asks how authority, derived from patriarchal power, operated on the day-to-day level in colonial New England society. It argues that women were integral to colonial communities and to the effective maintenance of social order. While gender determined the roles people played in colonial society, and women were subordinate to their husbands and fathers, women and men shared agency in efforts to maintain social order.

The dissertation begins by tracing the process by which cases came to the county court, …

Summary Adjudication In United States Civil Procedure, Mary J. Davis Jan 1998

Summary Adjudication In United States Civil Procedure, Mary J. Davis

Law Faculty Scholarly Articles

This article uses one of the high profile mass tort cases of recent decades, the complex silicone gel-filled breast implant products liability litigation, to evaluate summary adjudication measures. Recognizing that not all claims filed are complex tort claims (just the most interesting ones), where commercial claims present the opportunity for use of summary proceedings, those will be discussed as well, particularly regarding mechanisms by which security for a creditor-plaintiffs claim can be obtained prior to a favorable verdict.

While preparing this Report, it became clear that the author has a particular view of what constitutes a "summary adjudication" procedure, but …

Cooperation, Conflict, Or Coercion: Using Empirical Evidence To Assess Labor-Management Cooperation, Ellen J. Dannin Jan 1998

Cooperation, Conflict, Or Coercion: Using Empirical Evidence To Assess Labor-Management Cooperation, Ellen J. Dannin

Michigan Journal of International Law

Since the 1980s there has been strong interest in labor-management cooperation. That interest was reflected even in government attention, for example, through projects by the U.S. Department of Labor's Bureau of Labor-Management Cooperation. Under the leadership of Undersecretary Stephen Schlossberg, the Bureau's "Laws Project" examined the impact of labor law on labor-management cooperation. The Dunlop Commission issued a report strongly in favor of labor-management cooperation, and National Labor Relations Board (NLRB) Chair William B. Gould has spoken favorably of it. More recently, the government issued a report on state and local initiatives in this area.

The role of leptin in humans remains controversial. Leptin concentrations are highly correlated with body fat stores. We tested whether or not this relation was consistent across the range of body composition encompassing the lean as well as the obese. Individuals participating in community-based comparative research in Nigeria (n = 363), Jamaica (n = 372), and the United States (Maywood, IL; n = 699) had their plasma leptin concentrations and body compositions (with bioelectrical impedance analysis) measured. All participants identified themselves as being black. Body mass index (in kg/m2) ranged from 14 to 62. Large differences in mean plasma leptin …

A Historical Perspective On The Development Of An Ethnic Minority Consciousness In The Spanish-Language Press Of The Southwest, Nicolás Kanellos Jan 1998

A Historical Perspective On The Development Of An Ethnic Minority Consciousness In The Spanish-Language Press Of The Southwest, Nicolás Kanellos

Ethnic Studies Review

Various scholars have treated ethnic newspapers in the United States as if they all have evolved from an immigrant press.(i) While one may accept their analysis of the functions of the ethnic press, there is a substantial and qualitative difference between newspapers that were built on an immigration base and those that developed from the experience of colonialism and racial oppression. Hispanics were subjected to "racialization"(ii) for more than a century through such doctrines as the Spanish Black Legend and Manifest Destiny during the nineteenth and early twentieth century. They were conquered and incorporated into the United States and then …

England's Contaminated Land Act Of 1995: Perspectives On America's Approach To Hazardous Substance Cleanups And Evolving Principles Of International Law, Michael P. Healy Jan 1998

England's Contaminated Land Act Of 1995: Perspectives On America's Approach To Hazardous Substance Cleanups And Evolving Principles Of International Law, Michael P. Healy

Law Faculty Scholarly Articles

An important contemporary problem in environmental regulation concerns the cleanup of property that is an unfortunate legacy of the modem industrial age—acres of land affected by past inadequate disposals of toxic substances. The United States began to address this problem in 1980 with the enactment of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). CERCLA establishes both a liability regime for assigning the costs of cleaning up lands contaminated by the release of hazardous substances and regulatory requirements defining how those cleanups are to be pursued. In 1995, England enacted the Contaminated Land Act (alternatively referred to as the …

In The Belly Of The Beast: A Comparison Of The Evolution And Status Of Prisoners' Rights In The United States And Europe, Roberta M. Harding

Law Faculty Scholarly Articles

Another epidemic has hit the international community. This one, however, is not derived from an unknown bacterial agent. Instead, it originates from a variety of social agents. The epidemic? The explosion in the number of people incarcerated in the global community. As of June 1997, the United States' prison population exceeded 1,700,000. This figure is consistent with the United States' status as one of the world's largest jailers. Like the United States, Europe's prison population has escalated. The growth in France's prison population is representative of the epidemic's trans-Atlantic scope.

The Article is divided into several sections. The first section …

Anchors And Flotsam: Is Evidence Law 'Adrift'?, Richard D. Friedman Jan 1998

Anchors And Flotsam: Is Evidence Law 'Adrift'?, Richard D. Friedman

Reviews

Difference, as well as distance, yields perspective. A comparison of legal systems may search for common underlying principles, or for lessons that one system might learn from another. But it may also be aimed primarily at illuminating one system by light shed from another. This is the aim of Evidence Law Adrift, Mirjan Damagka's elegant study of the common law system of evidence, and he is ideally suited for the task. Born and schooled in Continental Europe, he has lived and taught in the United States for twenty-five years. His relation to the common law system of evidence is, I …

The Liability Of The Automobile And Motorcycle Manufacturers And Their Suppliers For Defective Products In The United States Compared To Germany, Daniel Karl Robyn Jan 1998

The Liability Of The Automobile And Motorcycle Manufacturers And Their Suppliers For Defective Products In The United States Compared To Germany, Daniel Karl Robyn

LLM Theses and Essays

This thesis deals with the lability of automobile and motorcycle manufacturers, as well as their suppliers, in situations where a defective product causes a harmful event. Specifically, it compares the product liability laws of the Federal Republic of Germany to those of the United States of America. Before entering into the details of legal doctrine, the introductory note provides background information on the social and economic aspects of automobile use in those two countries. Next, Chapter I describes the liability regime governing claims against German motor vehicle manufacturers and their suppliers. Chapter II focuses on the comparable law in the …
