The Case For United States Reparations To African Americans, Adrienne D. Davis
The Case For United States Reparations To African Americans, Adrienne D. Davis
Scholarship@WashULaw
The political and juridical viability of reparations for descendants of enslaved black people is emerging as a highly contested concept in U.S. debates about justice and law. For decades, reparations have been an essential part of the international discourses of war and human rights.
Becoming Mormon Men: Male Rites Of Passage And The Rise Of Mormonism In Nineteenth-Century America, Bruce R. Lott
Becoming Mormon Men: Male Rites Of Passage And The Rise Of Mormonism In Nineteenth-Century America, Bruce R. Lott
Theses and Dissertations
The evidence presented in this thesis supports a view of the first Mormon men as coming from the agrarian majority of early nineteenth-century American farmers and artisans who embraced a set of manly ideals that differed significantly, in many ways, from those embraced by their middle-class contemporaries. These men's life writings attest to boyhood experiences of working alongside their fathers as soon as they were physically able, and subsequently of acting as substitute farmers and breadwinners as well as being put out to work outside the direct supervision of their fathers. Such experiences enabled them to frequently follow in the …

The Market And Ethics: The Case Of The 1994 Decision By The Clinton Administration To Delink China's Human Rights Record From Most-Favored-Nation Status, Susan C. Morris
Graduate Program in International Studies Theses & Dissertations
Amid the globalization of markets and the interdependence of states, human rights violations throughout the world still persist. The purpose of this study is to investigate the relationship between the economic interdependence of nations and the moral responsibilities of nations by examining the case of the 1994 decision by the Clinton administration to delink China's human rights practices from most-favored-nation status.
The annual 1997 Freedom House world survey of human rights rated China at its lowest point and quoted that “the regime continues to have one of the worst human rights records in the world.”1 Yet despite China's ongoing human …

Using Mediation In Canadian Environmental Tribunals: Opportunities And Best Practices, Matthew Taylor, Patrick Field, William Tilleman, Lawrence Susskind
Dalhousie Law Journal
The popularity of alternate dispute resolution (ADR) has been growing for decades, particularly in the United States and now in Canada. Although ADR has become increasingly popular in the Canadian administrative context, it faces certain difficulties arising from the public interest mandate of many tribunals, in particular environmental tribunals. These difficulties include conventional and institutional problems, such as conflict assessment, communications with and between parties, selecting and training the mediator (tribunal member, staff, or third party?), and identification of the proper parties and competing interests. There are also concerns specific to Canadian environmental tribunals. How do they protect the public …

Legislative Intent And Statutory Interpretation In England And The United States: An Assessment Of The Impact Of Pepper V. Hart, Michael P. Healy
Legislative Intent And Statutory Interpretation In England And The United States: An Assessment Of The Impact Of Pepper V. Hart, Michael P. Healy
Law Faculty Scholarly Articles
Statutory interpretation is the process of discerning the meaning of legislation, and U.S. law has permitted courts to find meaning through a variety of often contradictory interpretive approaches. As a result, U.S. litigants often are uncertain about the interpretive approach a court will apply to a statute, even though the choice of the interpretive approach may determine the outcome of the litigation. Until the recent decision in Pepper (Inspector of Taxes) v. Hart, English approaches to statutory interpretation were more circumscribed because English courts foreclosed the intentionalist approach. This Article considers the impact that Pepper has had on statutory …

An Analysis Of The Impact Of The Internet As A Marketing Tool For Economic Development In Municipal Governments In The Western Region Of The United States, Jacquelin Risner
UNLV Theses, Dissertations, Professional Papers, and Capstones
This professional paper is a cross-sectional analysis of the western United States that explores the research question of whether the internet, when used as a marketing tool, has an impact on urban economic development for municipal governments. Economic development has changed throughout the years. It is now global in perspective. The necessity for municipal governments to compete on a global level requires an investigation into new technology and its importance to economic development efforts. Specifically, the advent of the internet and its significance to economic development in municipal governments was explored. A survey was constructed and sent to one hundred …

The Changing Character Of The American Catholic Church 1810–1850, Kathleen Flanagan S.C.
The Changing Character Of The American Catholic Church 1810–1850, Kathleen Flanagan S.C.
Vincentian Studies
The Church in the United States faced three main problems between 1810 and 1850: anti-Catholic prejudice, the question of how to educate Catholic children, and the need for care of orphans and the sick. Anti-Catholic prejudice in the United States, which abated somewhat immediately after the Revolution, reached new heights with the massive Irish and German immigration in this period. Conflicts between Catholics and Protestants over which version of the Bible would be used in schools and the bishops’ insistence that interpretation be provided with Bible study contributed to the prejudice. It also led to the formation of a separate …
By What Authority? The Founding Of The Sisters Of Charity Of Cincinnati, Judith Metz S.C.
By What Authority? The Founding Of The Sisters Of Charity Of Cincinnati, Judith Metz S.C.
Vincentian Studies
Judith Metz explores what motivated a small group of Sisters of Charity to become a diocesan community, the Sisters of Charity of Cincinnati. American culture encouraged women to think independently and to be self-sufficient. Margaret George, the superior in Cincinnati, had a friendship with Elizabeth Seton that predated the founding of the Sisters of Charity, and she understood Elizabeth’s vision for the community. She and the other sisters had come to expect the flexibility and spirit of collaboration that had been present in the community’s government from its earliest days. Instead, it seemed that Emmitsburg was following the letter of …
