The United States Should Take A Page Out Of Canadian Law When It Comes To Privacy, Genetic And Otherwise, Ashley Rahaim Jun 2023

The United States Should Take A Page Out Of Canadian Law When It Comes To Privacy, Genetic And Otherwise, Ashley Rahaim

University of Miami Inter-American Law Review

Genetic information is intimate and telling data warranting privacy in public and private realms. The privacy protections offered in the United States and Canada vastly differ when it comes to genetic privacy. Search and seizure law mirrors the privacy gap in the countries, as well as their treatment of DNA database information.

This note explores the foreshadowing of the creation of genetic privacy laws and their varying levels of protection based on the way private information was treated by state actors through search and seizure caselaw, the creation of legal precedent, and the treatment of intimate personal data in the …

Seeing Race As We Are: Avoiding, Arguing, Aspiring, Michael A. Cowan Jun 2023

Seeing Race As We Are: Avoiding, Arguing, Aspiring, Michael A. Cowan

New England Journal of Public Policy

Racial conflict in the United States pushes people to positions of argument or avoidance, more or less intensely and for varying lengths of time, depending on external events like the murder of George Floyd. Neither stance produces the conversations required to seek common ground and compromise around racial issues. Argument alone deepens divisions and avoidance leaves them to metastasize in the social body. In an attempt to go beneath these two positions, this article first explains the role and form of interpretation in all conflict and dispute resolution and how it is shaped. Then it examines the concepts and strategies …

Why Teachers Feel Unprepared To Address The Social And Emotional Needs Of Students With Dyslexia, Darlene Breaux

Tapestry: Journal of Research in Education

Students with dyslexia simultaneously struggle with both literacy acquisition and poor self-esteem and undergo social-emotional learning difficulties. The purpose of this qualitative descriptive study was to explore elementary general education teachers’ perceptions regarding the dyslexia training they received for addressing the social and emotional learning (SEL) needs of children with dyslexia. The conceptual framework guiding this study was the five core competencies for SEL developed by the Collaborative for Academic, Social, and Emotional Learning. The researcher used a qualitative description research design involving semi structured interviews. The population included 10 elementary general education teachers who taught in first through fourth-grade …

Medicaid Expansion, Chemotherapy Delays, And Racial Disparities Among Women With Early-Stage Breast Cancer, Ya-Chen Shih

Faculty, Staff and Student Publications

BACKGROUND: Medicaid expansion under the Affordable Care Act extends eligibility for participating states and has been associated with improved outcomes by facilitating access to care. Delayed initiation of adjuvant chemotherapy is associated with worse outcomes among patients with early-stage breast cancer (BC). The impact of Medicaid expansion in narrowing delays by race and ethnicity has not been studied, to our knowledge.

METHODS: This was a population-based study using the National Cancer Database. Patients diagnosed with primary early-stage BC between 2007 and 2017 residing in states that underwent Medicaid expansion in January 2014 were included. Time to chemotherapy initiation and proportion …

The Use Of Arbitration Clauses By Social Media Websites: A Critique, Kavya Jha, Ananya Singh Jun 2023

The Use Of Arbitration Clauses By Social Media Websites: A Critique, Kavya Jha, Ananya Singh

Pepperdine Dispute Resolution Law Journal

The arbitration clauses contained in the Terms of Services (ToS) of most social media websites mandate arbitration and the waiver of class arbitration.1 In light of this reality, this article seeks to analyze the legal position with respect to mandatory arbitration and class arbitration waiver in the United States, India, and European Union (EU). It compares and juxtaposes the respective positions in these three jurisdictions to find that whereas the United States has been pro-arbitration to the extent of being detrimental to consumer interest, India has adopted an overly protectionist approach, while the EU has adopted an effective model to …

Adaptive Fascism: A Study Of Far-Right Politics In The Americas, Blake Mustachio Jun 2023

Adaptive Fascism: A Study Of Far-Right Politics In The Americas, Blake Mustachio

Master's Theses

Populism as a term is too ambiguous to describe the surge in far-right nationalistic leaders both during the Cold War and the present day. This paper proposes to solve this quagmire by proposing the term adaptive fascism. Adaptive fascism is the idea that far- right leaders using tactics that have legacies within fascist rhetoric have adapted the fascist rhetoric to fit more within the geopolitical situations of each leader’s respective time period. Looking at both leaders of the Cold War, including Jorge Videla of Argentina and Augusto Pinochet of Chile. As well as modern day leaders, Donald Trump of the …

Dementias Among Older Males And Females In The U.S. Medicare System With And Without Hiv, Abbey B Berenson, Jacques Baillargeon, Thomas P Giordano

Faculty, Staff and Students Publications

Background: Despite the growing concern that people with HIV (PWH) will experience a disproportionate burden of dementia as they age, very few studies have examined the sex-specific prevalence of dementia, including Alzheimer disease and related dementias (AD/ADRD) among older PWH versus people without HIV (PWOH) using large national samples.

Methods: We constructed successive cross-sectional cohorts including all PWH aged 65+ years from U.S. Medicare enrollees and PWOH in a 5% national sample of Medicare data from 2007 to 2019. All AD/ADRD cases were identified by ICD-9-CM/ICD-10-CM diagnosis codes. Prevalence of AD/ADRD was calculated for each calendar year by sex-age strata. …

Survival Of Middle Eastern And North African Individuals Diagnosed With Colorectal Cancer: A Population-Based Study In California, Hoda Anton-Culver

Faculty, Staff and Student Publications

BACKGROUND: Literature on colorectal cancer outcomes in individuals of Middle Eastern and North African (MENA) descent is limited. To address this gap, we estimated five-year colorectal cancer-specific survival by race and ethnicity, including MENA individuals, in a diverse, population-based sample in California.

METHODS: We identified adults (ages 18-79 years) diagnosed with a first or only colorectal cancer in 2004 to 2017 using the California Cancer Registry (CCR), including non-Hispanic White, non-Hispanic Black, non-Hispanic Asian, Hispanic, and MENA individuals. For each racial/ethnic group, we calculated five-year colorectal cancer-specific survival and used Cox proportional hazards regression models to examine the association of …

In the United States, preparing researchers and practitioners for careers in cancer requires multiple components for success. In this reflection article, we discuss our approach to designing a comprehensive research training program in cancer disparities. We focused on elements that provide students and early career scientists a deep understanding of disparities through first-hand experiences and skills training necessary to build a research career in the area. Our Educational Program sits within the framework of an NCI P20 program, "UHAND (University of Houston/MD Anderson Cancer Center)", jointly established by an NCI-designated comprehensive cancer center and a minority-serving university as a collaborative …

The Queer Life Of Lorena Hickok, Samantha D. Leyerle Jun 2023

The Queer Life Of Lorena Hickok, Samantha D. Leyerle

Dissertations, Theses, and Capstone Projects

This thesis explores the life of Lorena Hickok, a remarkable woman whose story has been glossed over throughout history. Hickok was an accomplished journalist and writer, and her life offers a fascinating glimpse into being queer in the early twentieth century. While much has been written about Hickok’s relationship with Eleanor Roosevelt, this thesis aims to go beyond their connection to examine Hickok’s entire life and experiences in greater detail. Through analyzing her work as a writer, as well as her personal correspondence and unpublished autobiography, this thesis illuminates the quiet details of defining moments in history, including the Great …

Classical Influences On Anti-Federalism In Late18th-Century America: An Analysis Of References To The Roman Republic, “Cato,” And Caesar In The Anti-Federalist Papers, Anastasia Kaliabakos May 2023

Classical Influences On Anti-Federalism In Late18th-Century America: An Analysis Of References To The Roman Republic, “Cato,” And Caesar In The Anti-Federalist Papers, Anastasia Kaliabakos

College Honors Program

As a classics major, connecting antiquity to the modern era has always been important to me. Studying the past as a way to inform our perspective on the present is often valuable: as Patrick Henry said, “I know of no way of judging the future but by the past.” Relating classics with the founding and constitutional periods of the United States of America is particularly revealing in one’s endeavor to explain the ideas and decisions from that time. A group of figures undoubtedly influenced by Greek and Roman antiquity was the Anti-Federalists. The Anti-Federalists were, in short, opposed to the …

The Intellectual And Diplomatic Discourse Of American Progressives And The Late Ottomans, 1830–1930, Brigitte Maricich Powell May 2023

The Intellectual And Diplomatic Discourse Of American Progressives And The Late Ottomans, 1830–1930, Brigitte Maricich Powell

Doctoral Dissertations and Projects

The American intellectual and diplomatic discourse with the late Ottoman Empire is an understudied field of history. Major works to date are primarily focused on the US relations with the Turkish Republic starting in 1924, which at best may highlight the Barbary Wars and the Treaties of 1830 and 1862 as a precursor. Few works offer, if any, a comprehensive insight into the diplomatic relationship that evolved between the US and the Near East from 1830 to 1930. This research is meant to fill the absence by probing into the service of key American diplomats and intellectuals who visited and …

Education And Welfare: Their Impact On The Experience Of Poverty In India And The United States, Anushka Rajani May 2023

Education And Welfare: Their Impact On The Experience Of Poverty In India And The United States, Anushka Rajani

Senior Theses

The experience of poverty and chances of upward mobility is drastically different in India and the United States. The following thesis contends that this is largely due to the current educational and welfare policies in place in these two nations. Education allows for a higher possibility of financial upward mobility by allowing students to learn skills that prepare them for higher-paying career paths. High-quality welfare gives recipients aid for their necessities while providing them time for growth to pursue financial independence. The following thesis investigates these policies and how accessible they make education and welfare to poor populations in India …

Integrating Tobacco Treatment Into Oncology Care: Reach And Effectiveness Of Evidence-Based Tobacco Treatment Across National Cancer Institute-Designated Cancer Centers, Sarah D Hohl, Alex T Ramsey, Li-Shiun Chen, Et Al. May 2023

Integrating Tobacco Treatment Into Oncology Care: Reach And Effectiveness Of Evidence-Based Tobacco Treatment Across National Cancer Institute-Designated Cancer Centers, Sarah D Hohl, Alex T Ramsey, Li-Shiun Chen, Et Al.

2020-Current year OA Pubs

PURPOSE: Quitting smoking improves patients' clinical outcomes, yet smoking is not commonly addressed as part of cancer care. The Cancer Center Cessation Initiative (C3I) supports National Cancer Institute-designated cancer centers to integrate tobacco treatment programs (TTPs) into routine cancer care. C3I centers vary in size, implementation strategies used, and treatment approaches. We examined associations of these contextual factors with treatment reach and smoking cessation effectiveness.

METHODS: This cross-sectional study used survey data from 28 C3I centers that reported tobacco treatment data during the first 6 months of 2021. Primary outcomes of interest were treatment reach (reach)-the proportion of patients identified …

Criminal Injustice: An Examination Of Racial Profiling And Discriminatory Police Practices In Canada And The United States, Patricia Advincula May 2023

Criminal Injustice: An Examination Of Racial Profiling And Discriminatory Police Practices In Canada And The United States, Patricia Advincula

Themis: Research Journal of Justice Studies and Forensic Science

The Black Lives Matter movement swept across the United States after the murders of black people at the hands of law enforcement. Not fully acknowledged in the media are the police brutality cases that have also occurred in Canada, a country that prides itself on tolerance, acceptance, and diversity. Police brutality is an unfortunate reality that stems from racial profiling, one of the many symptoms of historically oppressive institutions. In this paper, I will examine police coercion and racial profiling in Canada and the United States. This paper will employ a theoretical framework of conflict theory and minority threat hypothesis …

The Evolution Of Primary Care Telehealth Disparities During Covid-19: Retrospective Cohort Study, Rachel D'Amico, Patrick M Schnell, Randi Foraker, J Nwando Olayiwola, Daniel E Jonas, Seuli Bose Brill

2020-Current year OA Pubs

BACKGROUND: Telehealth has become widely used as a novel way to provide outpatient care during the COVID-19 pandemic, but data about telehealth use in primary care remain limited. Studies in other specialties raise concerns that telehealth may be widening existing health care disparities, requiring further scrutiny of trends in telehealth use.

OBJECTIVE: Our study aims to further characterize sociodemographic differences in primary care via telehealth compared to in-person office visits before and during the COVID-19 pandemic and determine if these disparities changed throughout 2020.

METHODS: We conducted a retrospective cohort study in a large US academic center with 46 primary …

The Railsplitter And The Pathfinder: The Relationship Between Abraham Lincoln And John C. Frémont, Kourtney Yantis May 2023

The Railsplitter And The Pathfinder: The Relationship Between Abraham Lincoln And John C. Frémont, Kourtney Yantis

Electronic Theses & Dissertations

This study serves as an analysis of the connections between Abraham Lincoln as President of the United States and John Charles Frémont as a Civil War general. Lincoln’s position within history is solid, unlike that of John C. Frémont. The thesis will elevate Frémont to a higher status as a historical figure by arguing that the emancipation edict that he issued for Missouri in August of 1861 would influence Abraham Lincoln’s preliminary emancipation proclamation of September 1862, even though Lincoln repealed Frémont’s decree. In biographies of each man, their interactions are merely a small part of the stories of their …

Working For The Benefit And Advancement Of Women: Three Women's Organizations That Commemorated The American Civil War, 1880-1920, Annette F. Guild

Masters Theses, 2020-current

In the past forty years, scholars and members of the public alike have obsessed over the complex legacy of the American Civil War (1861-1865). As debates over Confederate monuments and the United States’ racial past have frequently emerged in politics, many Americans have disagreed as to how the Civil War should be remembered. In examining the evolution of Civil War memory in American society, numerous scholars have noted the important role that women’s organizations played in influencing the Civil War’s collective memory in the fifty years following the conflict. However, while scholars have noted the significance of these organizations for …
