Revengence Taken: Russian Active Measures And Our Entrenched Racial Divide, Erin Berhan Jan 2022

Revengence Taken: Russian Active Measures And Our Entrenched Racial Divide, Erin Berhan

University of Miami Race & Social Justice Law Review

Our racial divide has always been a national security threat. An early observer of our American project, Alexis de Tocqueville, wrote about this threat to our future union in “Democracy in America,” learned by merely travelling the young nation thirty years before our Civil War.1 Despite generations of societal and legal evolution, our nation has not overcome the wounds and disabilities that our racial divide left behind — now ripe for modern security threats. In 2019, the United States Senate Select Committee on Intelligence released Volume II of their years long investigation into Russian Active Measures of interference with our …

Diversity And Inclusion Or Tokens? A Qualitative Study Of Black Women Academic Nurse Leaders In The United States, Kechi Iheduru-Anderson, Florence O Okoro, Shawana S Moore

College of Nursing Faculty Papers & Presentations

Severe under-representation of Black women academic nurse leaders persists in United States higher education, and a major research gap still exists regarding experiences of these leaders, and facilitators of and barriers to their success. Our objective was to examine how race and gender influence how Black women academic nurse leaders’ function in their leadership positions, how they are perceived by their peers, and how their perception of race, gender, class, and power influences diversity, equity, and inclusion initiatives in the workplace. Critical race theory was used as a guiding theory, and the study design involved narrative inquiry followed by thematic …

Models For Living: Critiques Of Midcentury Suburban Design, With A View From Lower Bucks County, Pa, Christopher J. Palladino

Theses and Dissertations

After World War II, millions of American servicemen returned home, anxious to put the war behind them, settle down, and begin a family. This resulted in an unprecedented spike in demand for housing, intensified by the low-interest loans granted by the G.I. Bill. Combined with an aggressive advertising campaign, longer term mortgages and an attractive and novel building plan made Levittown, PA an immediate success. Concurrently, geographical sectors of the United States witnessed an historical change in the manner in which homes were designed and constructed. Innovations such as mass production, the efficiency system, and the assembly line were expansively …

A Developing Italian Transnational Activism: Dialogues Between Italian Leftist Parties And American Political Organizations, 1935-1955, Matthew Daniel Halikias

Theses and Dissertations

This dissertation examines and explores through several case studies involving the political and intellectual significance of the development of a transnational dialogue between Italian leftist parties and American political organizations from the period before the Second World War to the Early Cold War period. An investigation of Girolamo Valenti and his actions with unions and labor-minded organizations demonstrates his activism with cultivating and establishing a strong relationship in the United States and Italy. This relationship materializes in the advocacy of relief for Italy after the Second World War, promoting for American involvements in Italian politics, and attempting to have an …

The Blind Spots Of Sociotechnical Imaginaries: Covid-19 Scepticism In Brazil, The United Kingdom And The United States, Renan Gonçalves Leonel Da Silva, Larry Au Jan 2022

The Blind Spots Of Sociotechnical Imaginaries: Covid-19 Scepticism In Brazil, The United Kingdom And The United States, Renan Gonçalves Leonel Da Silva, Larry Au

Publications and Research

During the first wave of the coronavirus pandemic in 2020, experts and policymakers mobilised various slogans to compel the public to help defeat COVID-19. By comparing Brazil, the United Kingdom and the United States, this study shows how dominant sociotechnical imaginaries tied to the slogans were mobilised. We argue that the blind spots of these dominant sociotechnical imaginaries contributed to subversive sociotechnical imaginaries and made room for COVID-19 scepticism. In Brazil, calls to ‘take care of yourself’ contributed to a sceptical stance that individualised responsibility. In the United Kingdom, calls to ‘protect the NHS’ contributed to sceptical accusations of whataboutism …

Courting American Capital: Public Relations And The Business Of Selling Ivorian Capitalism In The U.S., 1960-1980, Abou B. Bamba Jan 2022

Courting American Capital: Public Relations And The Business Of Selling Ivorian Capitalism In The U.S., 1960-1980, Abou B. Bamba

History Faculty Publications

This chapter is an invitation to reimagine the roles assigned to players in the history of capitalism on the global stage. It challenges aspects of the historiography of capitalism in the twentieth century, which tend to center on historical actors and institutions of the Global North. Even when actors in the Global South are discussed, it is usually to portray them as passive victims of an intractable system. By focusing on the Ivory Coast and its economic diplomacy toward the United States, I seek to destabilize this general picture.

Conjecture And Evidence: Discovering The Costs Of Contemporary American Political Ideals, Joseph C. Immormino Jan 2022

Conjecture And Evidence: Discovering The Costs Of Contemporary American Political Ideals, Joseph C. Immormino

CGU Theses & Dissertations

This dissertation offers an adaptation of the relative political capacity (RPC) research framework to domestic American politics, enabling a quantitative examination of the relative performance of state governments during the COVID-19 pandemic. Theoretically, I examine the notion that more politically capable states will be more effective in their efforts to mitigate mortality rates, and hypothesize that, in the United States, such a relationship is conditional upon the party identification of state leadership. The premise is tested by applying a series of multiplicative interaction models to a unique dataset spanning the first two years of the pandemic. Results confirm that measures …

Criminal Law—Dreaming Of A Drug War Reckoning, Luke Ryan, Molly Ryan Strehorn Jan 2022

Criminal Law—Dreaming Of A Drug War Reckoning, Luke Ryan, Molly Ryan Strehorn

Western New England Law Review

Day after day, government officials across the United States make public statements celebrating various “victories” in our never-ending War on Drugs. These shallow statements overlook the true cost of this “war” and perpetuate the binary idea that there will eventually be a winner and a loser. If we continue down the path of war, nobody wins. The following article assesses the impact of this war by imagining a public official having a moment of contrition and acknowledging the errors of our ways.

Administrative Law—Defamation By The Nation: The Westfall Act And Scope Of Employment For Elected Officials, Sean Buxton Jan 2022

Administrative Law—Defamation By The Nation: The Westfall Act And Scope Of Employment For Elected Officials, Sean Buxton

Western New England Law Review

Are members of Congress or the President immune from defamation suits? Officially, the law provides for no such immunity. However, a line of cases interpreting the Federal Tort Claims Act and the Westfall Act threaten to create such an immunity for all elected officials. In such a world, powerless people can be defamed by the most powerful officials in the country without any recourse in the court system to preserve their reputations.

Journalist E. Jean Carroll discovered the potential for such an immunity when she brought a defamation suit against President Donald Trump after he denied her allegations of rape …

Sports Law—Sports Gambling In A Post-Murphy World: Ensuring Emerging Sports Gambling Laws Adequately Protect The Integrity Of College Sports, Matthew Dziok Jan 2022

Sports Law—Sports Gambling In A Post-Murphy World: Ensuring Emerging Sports Gambling Laws Adequately Protect The Integrity Of College Sports, Matthew Dziok

Western New England Law Review

In 2018, the United States Supreme Court struck down the Professional and Amateur Sports Protection Act (PASPA), which prohibited states from authorizing sports gambling schemes. The Court in Murphy v. NCAA struck down PASPA on constitutional grounds, holding that the Act violated the anticommandeering doctrine of the Tenth Amendment. Before the Murphy decision, because of a grandfather provision in PASPA, Nevada was essentially the only state where it was legal to place a bet on a sporting event. Not surprisingly, after PASPA was struck down, numerous states have legalized sports gambling.

Perhaps one of the most important decisions state lawmakers …

Gerrymandering, Entrenchment, And “The Right To Alter Or Abolish”: Defining The Guarantee Clause As A Judicially Manageable Standard, James R. Brakebill Jan 2022

Gerrymandering, Entrenchment, And “The Right To Alter Or Abolish”: Defining The Guarantee Clause As A Judicially Manageable Standard, James R. Brakebill

Western New England Law Review

The Guarantee Clause provides that “[t]he United States shall guarantee to every State in this Union a Republican Form of Government.” Based on its original public meaning, the guarantee of a republican government protects core political rights and contains readily ascertainable standards founded on majority rule and a prohibition of minority-party entrenchment. The Supreme Court failed to develop a standard for adjudicating partisan gerrymandering claims because the Equal Protection Clause and the “one person, one vote” framework are fundamentally incompatible with the harms associated with partisan gerrymandering. Such claims involve harms to majority rights that strike at the core of …

Property Law—The Importance Of Intellectual Property Education In A Knowledge Economy, John J. Diffley, Diane R. Sabato, Richard H. Kosakowski

Western New England Law Review

Entrepreneurs, inventors, and innovators can be faced with an overwhelming amount of information and guidance when they plan their business startup. One area that is often neglected is the business’s intellectual property. In fact, it is critical to attend to the protection of IP early in the startup process. Entrepreneurs and others need to know what to protect, as well as when and how to protect it.

In the United States, IP accounts for thirty-eight percent of Gross Domestic Product, while IP and other intangible assets make up ninety percent of the market value of all S&P 500 companies. Increasingly, …

Beyond Compulsory Licensing: Pfizer Shares Its Covid-19 Medicines With The Patent Pool, Chenglin Liu Jan 2022

Beyond Compulsory Licensing: Pfizer Shares Its Covid-19 Medicines With The Patent Pool, Chenglin Liu

Faculty Articles

On March 15, 2022, the United States, European Union, India, and South Africa reached an agreement on the waiver of intellectual property rights (IP rights) for COVID-19 vaccines. The waiver agreement has rekindled the debate on the balance between IP rights protection and equitable access to medicines during a public health crisis. India, South Africa, and other developing countries maintain that a waiver was the only way to make vaccines affordable and accessible. Leading pharmaceutical companies argue that the waiver will stifle innovation and make lifesaving medicines less accessible. Both sides have seemingly overlooked Pfizer's voluntary agreement with the Medicines …

The Role Of The Article Iii Judge, Thomas B. Griffith Jan 2022

The Role Of The Article Iii Judge, Thomas B. Griffith

BYU Studies

The Constitution says precious little about the role envisioned for federal judges in the new government that document created: “The judicial power of the United States, shall be vested in one Supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The judges, both of the supreme and inferior courts, shall hold their offices during good behaviour, and shall, at stated times, receive for their services, a compensation, which shall not be diminished during their continuance in office.”

Preventing Maternal Deaths: A Critical Feminist Approach To Maternal Mortality In The United States, Jemalyn Harvey Jan 2022

Preventing Maternal Deaths: A Critical Feminist Approach To Maternal Mortality In The United States, Jemalyn Harvey

Saint Louis University Journal of Health Law & Policy

With roughly 700 women dying each year as a result of pregnancy and/or delivery complications, the United States has the highest rate of maternal deaths in the developed world. As each year passes, the maternal death rate continues to increase, despite the fact that sixty percent of these deaths are preventable. Factors such as quality care, receiving accurate and timely medical diagnoses, and recognizing urgent maternal warning signs all contribute to the preventability of deaths and why women, particularly women of color, so often fall victim to this tragic phenomenon. As an effort to address maternal death in the United …

Distracted Walking, Michael L. Smith Jan 2022

Distracted Walking, Michael L. Smith

Faculty Articles

Throughout the United States and across the world, cities are enacting bans on "distracted walking." These bans target cell phone users who cross the street while using a telephone. Doing so in certain cities may result in a fine, community service, or even jail. Drawing inspiration from municipalities, lawmakers in several states have proposed similar statewide legislation. Pushback against these measures is rare-as many people have either directly, or indirectly, experienced the slow and oblivious behavior of "smartphone zombies."

This Article surveys these laws and demonstrates that the science is, at best, mixed on whether device usage results in distraction …

A Critical Analysis Of American Foreign Policy In The Syrian Civil War, Sydney Heath Jan 2022

A Critical Analysis Of American Foreign Policy In The Syrian Civil War, Sydney Heath

CMC Senior Theses

This thesis explores the development of American policy in the Syrian Civil War, which began in 2011 and has caused the world’s largest refugee crisis, among other humanitarian issues. Through analyzing popular debates about U.S. foreign policy in Syria, this project attempts to determine how the United States should have responded to President Bashar al-Assad’s aggression towards his people in order to most effectively alleviate suffering. The analysis finds that the United States under President Obama missed a crucial opportunity to weaken Assad and prevent the suffering of millions of Syrians. This paper also explores the present day implications of …

The Faces Of War: Reintroducing Women's Narratives In War, Robin Makena Peterson Jan 2022

The Faces Of War: Reintroducing Women's Narratives In War, Robin Makena Peterson

CMC Senior Theses

Women take part in every war, but their accomplishments are mostly unacknowledged in the thousands of war stories told in the aftermath which tend to valorize men’s contributions as political leaders and soldiers. This erasure of women’s experience’s and agency in war holds true for war in Afghanistan, as well. This thesis identifies the gendered narratives told in books, movies, television shows, and the media but then offers, in contrast, narratives of Afghan and American women’s action during the forty years of war in Afghanistan. By sharing and contextualizing women’s stories, this paper strikes a blow against women’s erasure from …

Intangible Justice? Intellectual Property Disputes And Canadian Small Claims Courts, Anthony D. Rosborough, Reagan Seidler Jan 2022

Intangible Justice? Intellectual Property Disputes And Canadian Small Claims Courts, Anthony D. Rosborough, Reagan Seidler

Articles, Book Chapters, & Popular Press

This article investigates the jurisdiction and institutional competence of Canadian small claims courts and tribunals with respect to complex claims, and in particular, intellectual property (IP) claims. Recent research points to an increase in these types of claims. A doctrinal analysis finds small claims bodies have wide jurisdiction over intellectual property infringement, contract, and licensing disputes. They can also rule on issues of validity, though they cannot affect registrations in the databases of the Canadian Intellectual Property Office. Remedies including damages, accountings, and the recovery of infringing goods are available in many provinces. As to their capacity, the article assesses …

Armageddon Revisited: The 1973 Gubernatorial Election In Virginia, James R. Sweeney

Threatening a lawsuit, Howell prepared a memorandum to NBC citing evidence of voters changing their votes to Godwin, because as one put it, "A national network can't be wrong."78 Howell's memorandum also mentioned an indirect tie of McGee to Godwin. Godwin constantly demanded that Howell disclose how he would replace the revenue under his tax plan.43 Throughout the campaign, Godwin stressed inconsistencies between positions Howell took on various issues in 1973 and what he had said in the past. Godwin also cited Howell's endorsement of his candidacy for governor in 1965 and his comment in April that Godwin …

Understanding Public Support For Foreign Aid: A Cross-National Analysis, Erika Manning Jan 2022

Understanding Public Support For Foreign Aid: A Cross-National Analysis, Erika Manning

Mahurin Honors College Capstone Experience/Thesis Projects

This thesis examines how public support for bilateral foreign aid in democratic donor countries, namely the United States and South Korea, is influenced by various methods of policy framing. Despite the benefits of bilateral aid to both donor and recipient countries, public support for distributing it has been on the decline due to fears that aid is ineffective. However, this trend may also be the product of the publics’ perceptions of where aid is going and for what purpose. To determine the effects of type of aid and perceptions of recipient countries on support for foreign aid, I conducted a …

Let’S Get R.E.A.L.: Developing A Shared Definition Of Structural Racism Is The First Step Towards Health Equity, Deann Butler Jan 2022

Let’S Get R.E.A.L.: Developing A Shared Definition Of Structural Racism Is The First Step Towards Health Equity, Deann Butler

MUSC Theses and Dissertations

Recent events bought to the forefront the need to address structural racism in the US, specifically within the institution of healthcare. Organizations such as the American Public Health Association (APHA, 2021), American Medical Association (AMA) (O’Reilly, 2020), Center for Disease Control and Prevention (CDC) (Walensky, 2021) recognize racism as a fundamental driver of persistent health disparities in minority populations. Additionally, healthcare accreditation organizations such as National Council on Quality Assurance (NCQA, 2022) launched initiatives that strategically work to achieve health equity. More so, organizations across healthcare are creating roles such as Chief Health Equity Officer or Chief Diversity Officer to …

Revolution, Regime Change, And Rosewater: The United States’ Role In The Arab Spring, Grace Lewis Jan 2022

Revolution, Regime Change, And Rosewater: The United States’ Role In The Arab Spring, Grace Lewis

Capstone Showcase

This thesis seeks to determine which international relations theory best explains the United States involvement in the Arab Spring, and to ascertain if the goals set by those theories were met. Through the literature, I determine that two theories offer reasonable yet competing explanations of US involvement, and that these theories are first, defensive realism, and second, democratic peace theory. I employ the analytic method of pattern matching to compare each theory against the empirical record. In my analysis, I match empirical data from five affected countries to determine the strategic importance to the United States of the outcome of …

From Moral Panic To Permanent War: Rhetoric And The Road To Invading Iraq, Kai Philippe Jan 2022

From Moral Panic To Permanent War: Rhetoric And The Road To Invading Iraq, Kai Philippe

Honors Papers

This thesis seeks to understand the conditions in the United States post-9/11 that enabled the Bush administration to pursue a wide-ranging and all-encompassing “War on Terror,” with substantial support from the general public. I am principally focused on two significant facets of the War on Terror: the invasion of Iraq and the establishment of a permanent security state (and the interrelated creation of a new state of exception). I ask why the George W. Bush administration was so successful in generating support for both the invasion and occupation of Iraq, and for policies that violated fundamental civil liberties; I argue …
