The paper will begin with background on prior US-Mexico investment programs, leading up to the passage of NAFTA. This will include a discussion of Fast Track legislation and the …

Portion Distortion Plays A Major Role In The American Obesity Epidemic, Amanda Kay Larsen May 2003

Portion Distortion Plays A Major Role In The American Obesity Epidemic, Amanda Kay Larsen

Undergraduate Honors Capstone Projects

The prevalence of overweight and obesity among the American population is on the rise. This epidemic can be attributed to an increase in energy intake. Research has shown that increased consumption is associated with both individual and societal factors including an increase in the size of portions, the influence of the food industry, and confusion on the part of the consumer. The findings indicate that dietitians and other healthcare providers need to do their part by informing society of the importance of decreasing portions and helping the consumer recognize appropriate portion sizes.

The Herbal Supplement Market In The United States: A Look At St. John's Wort, Lorena Lanford

Undergraduate Honors Capstone Projects

Herbal supplements have become increasingly popular in United States during the past decade. This trend begs the question: why are so many people turning to supplements?

The increased use of herbal supplementation appears to stem from a public demand for changes in health care. This paper will focus on the regulations placed on the supplement market and the impact that supplementation has on patient care. To illustrate these points, St. John's Wort (SJW) will be examined in detail.

Currently regulation in the United States comes from the Food and Drug Administration (FDA) and voluntary organizations within the supplement industry, such …

This Comment will examine the similarities and differences between the trademark protection laws with regard to the multi-cultural nature of the consuming public of the European Union and that of the United States, and then will recommend ways in which the laws can be harmonized to promote the congruent development and expansion of economic activities globally. This harmonization is necessary in light of the interplay between these schemes for protection of marks and the protection provided under the Paris Convention for the Protection of Industrial Property, the Madrid Agreement Concerning the International Registration of Marks, and the Madrid Protocol. A Solution To The Yahoo! Problem? The Ec E-Commerce Directive As A Model For International Cooperation On Internet Choice Of Law, Mark F. Kightlinger

Law Faculty Scholarly Articles

In May 2000, a French court decided that a French law banning the display of Nazi materials for sale applies to an auction website hosted by the California-based company Yahoo! Inc. The following year, at the request of Yahoo! Inc., a U.S. District Court declared that the French judgment was unenforceable in the United States because enforcing it would violate an important public policy-the First Amendment. These two cases have attracted considerable attention because they crystallize a difficult problem. The Internet is global. Every website potentially reaches every home on the planet. Thus, website content or activity that may be …

Twenty study participants rated the severity of their jet lag symptoms and their adherence to a light-exposure schedule calculated to accelerate adaptation to a new time zone. Companion Animal Demographics In The United States: A Historical Perspective, Elizabeth A. Clancy, Andrew N. Rowan Jan 2003

Companion Animal Demographics In The United States: A Historical Perspective, Elizabeth A. Clancy, Andrew N. Rowan

State of the Animals 2003

Modern American society recognizes the crucial role of data and information in evaluating and effectively addressing societal problems. Americans are bombarded with information on the economy, public health, social and psychological attitude trends, and other matters that are considered important. For example, no self-respecting politician would think of launching a political campaign or initiative without some sense of what the public might be worrying about. Addressing pet population issues should be no different. Data are needed in order to define the nature and scope of the dog and cat demographic challenge. Data can help people to understand the impact of …

Wild Horses And Burros In The United States, Allen T. Rutberg Jan 2003

Wild Horses And Burros In The United States, Allen T. Rutberg

State of the Animals 2003

Treatment of wild horses and burros has improved remarkably over the last fifty years. In the mid-twentieth century, free-ranging horses and burros suffered horribly at the hands of “mustangers” who captured them at will and whim, sometimes using the most brutal of techniques, including aerial pursuit and shooting or crippling key herd members. The horses were packed into livestock trucks hurt, bleeding, and exhausted, and shipped to slaughter without stopping for rest or watering (Ryden 1999). Unprotected by law, only the good will of a few ranchers protected these abused animals. Public awareness of the plight of the wild horses …

In order to assess the degree of education regarding pubertal development and sexuality, we conducted a survey of late adolescents (Median age 19 years) and parents of adolescents. A total of 409 adolescents (237 females, 172 males) and 124 parents completed the survey. 14.4% of teens (36.6% of …

Legal Movements In Intellectual Property: Trips, Unilateral Action, Bilateral Agreements, And Hiv/Aids, Margo A. Bagley

Faculty Articles

This Article begins with an overview of the relationship between the Agreement on Trade-Related Aspects of Intellectual Property Rights (the "TRIPS Agreement") and the HIV/AIDS pandemic which created the need for the Doha Declaration. It then discusses two trade-related movements, unilateral action and TRIPS-plus bilateral agreements, that call into question the long-term effectiveness of the TRIPS Agreement process, generally, and the benefits of the Doha Declaration, in particular, in addressing multiple facets of the access to essential medicines problem. This Article concludes that a consideration of these issues should be included in the development of any further TRIPS-related solutions to …

Financial Collapse And Class Status: Who Goes Bankrupt?, Elizabeth Warren

Osgoode Hall Law Journal

Data from the 2001 Consumer Bankruptcy Project permit a systematic analysis of the composition of those who file for personal bankruptcy, focusing on their education, occupation, and home ownership status. These attributes serve as a proxy for class identification. Based on these indicia, more than 90 per cent of the families in bankruptcy qualify as middle class. These data are a powerful reminder that whatever else might be said …

Yoga 'Holistic' Exercise In Ohio, Theresa Schmidt Jan 2003

Yoga 'Holistic' Exercise In Ohio, Theresa Schmidt

Honors Papers

Yoga is depicted in U.S. popular culture as the sacred practice of an ancient tradition, guaranteed to initiate the western participant into the secrets of health and well being, i.e. a low-impact exercise regimen. However, the yoga that is practiced in the U.S. is often removed from its actual history. The physical practices are regularly isolated from the holistic philosophy and come to be understood as the entirety of yoga and marketed as a "spiritual" form of exercise. This paper will explore literature relevant to these themes and examine the reasons for yoga's popularity and the manner in which it …

Of the discussions that took place at the highest policy levels during the administration of Dwight D. Eisenhower, those concerning the possibility of a diplomatic solution to the arms race with the Soviet Union were among the most urgent and, perhaps, the most consequential in their failure. Throughout that assessment phase, the National Security Council, the Joint Chiefs of Staff, and the Atomic Energy Commission joined in steadfast opposition to arms limitations. On the international plane, the …
