In April 2011, Lindsay Kamakahi caused an international stir by suing the American Society for Reproductive Medicine (ASRM), the Society for Assisted Reproductive Technology (SART), SART-member fertility clinics, and a number of egg donor agencies on behalf of herself and other oocyte donors. The suit challenged the ASRM-SART oocyte donor compensation guidelines, which limit payments to egg donors to $5,000 ($10,000 under special circumstances), as an illegal price-fixing agreement in violation of United States antitrust laws.

Ensuing discussion of the case has touched on familiar debates surrounding coercion, commodification, and exploitation. It has also revealed many misconceptions about oocyte donation, …

This thesis portfolio outlines the manner in which intellectual property rights (IPR) policies form, evolve, and are diffused into the international regime. It advances that the formation and evolution of IPR policies occur largely as a function of the economy. This process is evident both domestically and internationally, with a major policy division occurring between industrialized and developing states. This portfolio juxtaposes the evolution of the patent system in the United States of America with increases in economic activity from the Colonial period until 1930. Introduction

During the last century, much of the prairie within the Northern Great Plains has been plowed for cropland, planted with non-natives to maximize livestock production, or otherwise developed, making it one of the most threatened ecosystems in the United States. Within Nebraska, greater than 77% of the area of native mixed-grass prairie has been lost since European settlement (Samson and Knopf 1994). The National Park Service (NPS) plays an important role in preserving and restoring some of the last pieces of intact prairies within its boundaries. "This report describes new digital maps delineating areas of the United States, including Puerto Rico and the U.S. Virgin Islands, having karst or the potential for development of karst and pseudokarst. These maps show areas underlain by soluble rocks and also by volcanic rocks, sedimentary deposits, and permafrost that have potential for karst or pseudokarst development. All 50 States contain rocks with potential for karst development, and about 18 percent of their area is underlain by soluble rocks having karst or the potential for development of karst features. Domestic violence is the leading cause of homelessness among women and children. According to a 1997 survey of ten cities in the United States, 57% of homeless families left their homes due to domestic abuse (ACLU, 2008). One of the reasons that victims of domestic violence constitute a significant portion of the homeless population is the “zero tolerance” or “one-strike” policies of landlords. These policies authorize landlords to evict tenants once violence transpires in their residences, regardless of whether the tenant is responsible for or is the victim of domestic abuse. Benjamin Strong Jr. entered the banking industry after he graduated from public high school. Over the years he developed a deep knowledge of the banking history of the United States. Coupled with an intense interest in international affairs, he became a dominant force in U.S. monetary and banking affairs. In 1914 Strong was elected president of the Federal Reserve Bank of New York, where he served until his death in 1928.

Competition is at the heart of the religious market model, which serves as the primary counter theory to the longstanding concept that modernity inevitably included secularization. Using the United States as its primary example, the market model postulates that the longstanding presence of multiple religious offerings encouraged religious institutions to pay attention to popular religious needs and interest, in turn promoting their own continued vitality. In contrast, lack of competition prompted a certain lassitude among religious providers in Europe, leading to their ultimate inability to address the needs of European religious consumers. This issue of Quality/Calidad/Qualité highlights the experience of Scenarios USA, an innovative nonprofit program that has integrated a gender and rights perspective—and a critical-thinking approach—into sex education curricula, while fostering new pedagogies and greater awareness among teachers. Scenarios USA approaches sexual health not as a stand-alone issue but as intertwined with young people’s overall lives and agency. As such, the organization’s “sex ed” work is part of a broader strategy of fostering self-expression, leadership, and advocacy among youth, especially among those living in marginalized communities. During the time period between Reconstruction and the Deluxe Jim Crow era, African Americans were legally oppressed, which hindered their ability to live fully and equally in society with whites. This was especially true in terms of healthcare. Segregation laws were implemented to separate blacks from the rest of society in everyday life; the worst of these laws affected the ability of African Americans to gain access to medical care that was equal to whites. Warrant canaries have emerged as an intriguing tool for Internet companies to provide some measure of transparency for users while also complying with national security laws. Though there is at least a reasonable argument for the legality of warrant canaries in the U.S. based primarily on First Amendment "compelled speech" doctrine, the same cannot be said for the use of warrant canaries in other "Five Eyes” intelligence agency countries — United Kingdom, Canada, New Zealand, and Australia — where the legality of warrant canaries has yet to be examined in either cases or scholarship. There are two ways to read the Supreme Court’s decision in Shelby County Alabama v. Holder: as a minimalist decision or as a decision that undermines the basic infrastructure of voting rights policy, law, and jurisprudence. In this Article, we present the case for reading Shelby County as deeply destabilizing. We argue that Shelby County has undermined three assumptions that are foundational to voting rights policy, law, and jurisprudence. First, the Court has generally granted primacy of the federal government over the states. Second, the Court has deferred to Congress particularly where Congress is regulating at the intersection of race …

Models and representations help us understand complex phenomena. The Mercator map presents a familiar, two-dimensional view of our three-dimensional world, for example, but it can distort as much as it clarifies. In the natural sciences, too, there are very different ways of framing reality. The classic method developed by Leonard Euler measures a system from a fixed point. A competing method developed by Joseph Louis Lagrange measures from the perspective of a particle moving within the system. These Eulerian and Lagrangian methods of measurement dominate the physical sciences and provide different, though equally valid, measures of how the system operates. …

Objectives. Considering the differences in location, socioeconomic background, and cultural background, the aim of this study was to try to identify possible factors associated with the increased incidence of urolithiasis by comparing American and Brazilian children with stones.
Methods. Data of 222 American and 190 Brazilian children with urolithiasis were reviewed including age, gender, body mass index, imaging technique used (ultrasound and computed tomography), and 24-hour urine volume and chemistries.
Results. There were no differences between age and gender at diagnosis. Brazilian children were leaner but in no population did obesity rate exceed that of the general population. Ultrasound was …

The key to ending modern-day slavery of women and girls requires placing further support for education initiatives in origin countries. A pro-education approach has yielded the greatest return. Since the beginning of civilization to the present, people have been trafficked and enslaved. Movements to abolish slavery gained momentum at the beginning of the nineteenth century: Great Britain outlawed slave trading in 1807, the United States abolished slavery in 1865, the League of Nations enacted a treaty calling for the end of slavery in 1926, and the efforts have strengthened in modern times. This chapter addresses Spanish-speaking, English Language Learners (ELLs) in the United States (U.S.) who are sequential bilinguals; that is, oral and written English is acquired as a second language (L2) at school. Within this population, substantial variation exists with regard to individual students’ language and literacy learning experiences. The specific focus here is the writing patterns of ELLs with atypical language development, who often present with multiple complexities in authenticating their language learning profiles in both Spanish and English.

Innovative solutions in national defense are needed to respond to national security threats in our uncertain environment. Leader attitudes and behaviors have a substantial impact on innovation. Unfortunately we did not completely understand the effect of leader attitudes and behaviors on innovation and the team dynamics that lead to innovation, especially in the military. The purpose of this study was to determine how leadership attitudes and behaviors contribute to product innovation within the U.S. Navy and how leadership emerges within this complex adaptive system of innovation.

This Article asks what the Supreme Court’s opinion in United States v. Windsor stands for. It first shows that the opinion leans in the direction of marriage equality but ultimately resists any dispositive “equality” or “federalism” interpretation. The Article next examines why the opinion seems intended to preserve for itself a Delphic obscurity. The Article reads Windsor as an exemplar of what judicial opinions may look like in transition periods, when a Bickelian Court seeks to invite, not end, a national conversation, and to nudge it in a certain direction. Policy failures receive much attention from the public and from policy makers adjusting policy in response to failure. Yet, lessons learned from policy failures are necessarily ex post observations. Not only has the policy failed to achieve its purposes, but a great deal of political, institutional, temporal, and economic capital has been wasted. A new body of literature on policy success undertakes ex ante analysis of successful policy designs, instrument choices, and other policy-making variables to establish a framework for more effective policy making.
