Moving Beyond The Wto: A Proposal To Adjudicate Gmo Disputes In An International Environmental Court, Marguerite A. Hutchinson Sep 2018

Moving Beyond The Wto: A Proposal To Adjudicate Gmo Disputes In An International Environmental Court, Marguerite A. Hutchinson

San Diego International Law Journal

This Article begins with a brief summary of the scientific basis of creating GMOs and its historic precursors. The second section provides an overview of risks to humans and the environment. The third part of this Article analyzes the arguments put forward by both the United States and the E.U., which have defined the conflict between blocs of countries pushing GMOs abroad and those who persistently reject them. The fourth section evaluates the respective regulatory schemes imposed on GMOs by the United States and Europe, domestically and by international treaty. The success of these systems is evaluated in the fifth …

Market Organisations And Institutions In America And England: Valuation In Corporate Bankruptcy, Sarah Paterson Sep 2018

Market Organisations And Institutions In America And England: Valuation In Corporate Bankruptcy, Sarah Paterson

Chicago-Kent Law Review

Courts in England and the United States have traditionally adopted different approaches to the question of valuation in debt restructuring cases. In England, courts have tended to determine whether to approve the allocation of equity in a debt restructuring by reference to the amounts creditors would have received if no debt restructuring had been agreed. The company has typically argued that if no debt restructuring had been agreed either the business or the assets would have been sold. Typically, some evidence of exposure of the business and assets to the market will be submitted to identify the value which would …

Immigration And Environment In The U.S.: A Spatial Study Of Air Quality, Guizhen Ma, Erin Trouth Hofmann Sep 2018

Immigration And Environment In The U.S.: A Spatial Study Of Air Quality, Guizhen Ma, Erin Trouth Hofmann

Sociology, Social Work and Anthropology Faculty Publications

Environmental consequences are frequently cited as a justification for restricting immigration to the United States, but there is little empirical research on the environmental consequences of immigration to support such arguments. The research that does exist shows immigration to be less environmentally harmful than native population growth, but is hampered by small samples and fails to account for spatial autocorrelation of air quality. We use the air quality domain of the Environmental Protection Agency’s Environmental Quality Index (EQI) to examine the association between immigrant and native populations and local air quality across all counties in the continental U.S. We employ …

2010-2019 OA Pubs

OBJECTIVE: Implementing evidence-based practices requires a multi-faceted approach. Electronic clinical decision support (ECDS) tools may encourage evidence-based practice adoption. However, data regarding the role of mobile ECDS tools in pediatrics is scant. Our objective is to describe the development, distribution, and usage patterns of a smartphone-based ECDS tool within a national practice standardization project.

MATERIALS AND METHODS: We developed a smartphone-based ECDS tool for use in the American Academy of Pediatrics, Value in Inpatient Pediatrics Network project entitled "Reducing Excessive Variation in the Infant Sepsis Evaluation (REVISE)." The mobile application (app), PedsGuide, was developed using evidence-based recommendations created by an …

Role Of Caregiver-Reported Outcomes In Identification Of Children With Prenatal Alcohol Exposure During The First Year Of Life, Ludmila N Bakhireva, Jean Lowe, Laura M Garrison, Sandra Cano, Yuridia Leyva, Fares Qeadan, Julia M Stephen

Pediatrics Research and Scholarship

BACKGROUND: Earlier identification of children with prenatal alcohol exposure (PAE) remains a challenge. The objective of this study was to identify neurobehavioral (NB) outcomes associated with PAE in infants.

METHODS: This manuscript evaluates NB outcomes at 6.33±1.12 months of age in 93 infants (39 PAE and 54 No-PAE) recruited prospectively into the ENRICH cohort. PAE was assessed by prospective repeated TLFB interviews and a panel of ethanol biomarkers. NB outcomes were evaluated by the Bayley Scales of Infant Development (BSID-III), Parenting Stress Index (PSI), Infant Behavior Questionnaire (IBQ-R), and Infant Sensory Profile (ISP).

RESULTS: Mean maternal age at enrollment was …

Managing Dissent, Timothy Zick Sep 2018

Managing Dissent, Timothy Zick

Faculty Publications

In his insightful new book, Managed Speech: The Roberts Court's First Amendment (2017), Professor Greg Magarian criticizes the Roberts Court for adopting a "managed speech" approach in its First Amendment cases. According to Professor Magarian, that approach gives too much power to private and governmental actors to manage public discourse, constrain dissident speakers, and instill social and political stability. This Article argues that at least insofar as it relates to many forms of public dissent, the managed speech approach is both deeply rooted in First Amendment jurisprudence and culturally prevalent. Historically, First Amendment jurisprudence has expressed support for narrowly managed …

Advancing Social Connection As A Public Health Priority In The United States, Julianne Holt-Lunstad, Theodore Robles, David A. Sbarra Sep 2018

Advancing Social Connection As A Public Health Priority In The United States, Julianne Holt-Lunstad, Theodore Robles, David A. Sbarra

Faculty Publications

A robust body of scientific evidence indicates that being embedded in high-quality close relationships and feeling socially connected to the people in your life is associated with decreased risk for all-cause mortality as well as a range of disease morbidities. Despite mounting evidence that the magnitude of these associations is comparable to many leading health determinants (that receive significant public health resources), government agencies, healthcare providers and associations, and public/private healthcare funders are slow to recognize human social relationships as either a health determinant or health risk marker in a manner that is comparable to other public health priorities. This …

Hyphenated Americans: Christian Arab-Americans’ Identity Struggle, Amanda Haddad Jobgen

Communication Theses - Archive

The topic of this thesis is the understudied minority of Christian Arab-Americans (CAAs), and this research addresses the issues CAAs face in the United States with special attention to the factors that influence their cultural identity. The thesis provides a historical background on how Christian Arabs came to the United States and explains the factors that influence their identity struggle. The theoretical framework of my research is based on Berry’s (1997) acculturation model. Ten participants were interviewed for this study, and a thematic analysis was conducted in order to determine the extent to which religiosity and perceived discrimination affects/influences the …

Exploring Female Genital Mutilation Practice Among West African Immigrants In The United States: A Community-Based Participatory Action Research Study, Kani Diop

Theses, Dissertations and Culminating Projects

This community-based participatory action research study’s primary purposes were first to reach a fuller understanding of the reasons for the continuation and perpetuation of FGM in the context of immigration and second to find out how the New York-New Jersey West African im/migrant community wanted to address FGM. This research afforded the conceptualization of West African im/migrant thoughts, tradeoffs considerations, and calculations behind the FGM decision-making process. The data divulged the West African im/migrants’ concept of mobility and reflect a specific idiosyncrasy in their relentless intent to return to their native countries. This conscious conviction brands them as migrants rather …

Background: During the 2014-2015 US influenza season, 320 cases of non-mumps parotitis (NMP) among residents of 21 states were reported to the Centers for Disease Control and Prevention (CDC). We conducted an epidemiologic and laboratory investigation to determine viral etiologies and clinical features of NMP during this unusually large occurrence.

Methods: NMP was defined as acute parotitis or other salivary gland swelling of >2 days duration in a person with a mumps- negative laboratory result. Using a standardized questionnaire, we collected demographic and clinical information. Buccal samples were tested at the CDC for selected viruses, including mumps, influenza, human parainfluenza …

The Texas Heart Institute Journal

Improving preparticipation screening of candidates for sports necessitates establishing the prevalence of high-risk cardiovascular conditions (hr-CVC) that predispose young people to sudden cardiac death (SCD). Our accurate, novel protocol chiefly involved the use of cardiac magnetic resonance (CMR) to estimate this prevalence.

Middle and high school students from a general United States population were screened by means of questionnaires, resting electrocardiograms, and CMR to determine the prevalence of 3 types of hr-CVC: electrocardiographic abnormalities, cardiomyopathies, and anomalous coronary artery origin from the opposite sinus with intramural coronary course (ACAOS-IM). We examined the range of normal left ventricular size and function …
