Combating Human Trafficking In The United States: Causes, Misconceptions, And Indicators, Mariah A. Andrade May 2019

Combating Human Trafficking In The United States: Causes, Misconceptions, And Indicators, Mariah A. Andrade

Masters Theses

Human trafficking is one of the biggest human rights issues today, with millions of men, women, and children being trafficked across the world. Of those millions of people, it’s estimated that roughly 14 to 17,000 foreign nationals are brought into the United States each year, in addition to our own citizens recruited into the industry. The largest issue that hinders the ability to combat human trafficking is the research surrounding this problem. There are many misconceptions about human trafficking, especially the fact that many people do not believe it is happening in the U.S. Modern day human trafficking takes many …

In Whose Interests Should A Company Be Run? Fiduciary Duties Of Directors During Corporate Failure In India: Looking To The West For Answers, Gautam Sundaresh

Michigan Business & Entrepreneurial Law Review

This Comment looks at the debate as it has played out in the legal jurisprudence of the U.S. and the U.K. The analysis of each considers the three financial stages of a corporation’s existence that are specifically addressed in the debate today, i.e.: (i) solvency; (ii) insolvency; and (iii) the zone of insolvency. After setting out the current position, this Comment specifically addresses the various shortcomings and criticisms of the models adopted by each jurisdiction and offers observations on the status quo and the implementation of these models. On this basis, this Comment goes on to propose a model to …

A Qualitative Study Of The Experience Of Miscarriage From Patients And Providers In The Rural U.S., Rebecca L. Upton

Sociology & Anthropology Faculty publications

This qualitative study examines how female patients in rural communities in the Midwest, who experienced at least one miscarriage, perceived their experience of pregnancy loss. Qualitative data were collected from 10 women who did experience at least one loss in addition to 10 participants who were providers or partners of the women were interviewed. The Socio-Ecological model informed the methodology and thematic analysis. Open-ended qualitative interviews provided the basis for the analysis. Transcribed narrative data were analyzed using standard coding procedures and MAXQDA software. Women who experienced miscarriage discussed how they made meaning of the experience within the context of …

Intergenerational Teenage Motherhood: Memory And Material Culture, Aspen Christian May 2019

Intergenerational Teenage Motherhood: Memory And Material Culture, Aspen Christian

Dissertations, Theses, and Capstone Projects

This paper explores how memories and material culture can be used to understand intergenerational teenage motherhood. Intimate, feminist ethnography is used to explore the experiences of my mother and my grandmother who were both teenage mothers. Teenage mothers are blamed for perpetuating a cycle of poverty in the United States by conservative and neoliberal adherents, yet women were young mothers throughout the history of the United States. In their minds, teenage mothers have daughters who become teenage mothers themselves, which then maintains poverty across generations. This project counters that false narrative by focusing on the experiences of intergenerational teenage mothers …

Does Family Income Determine A Children Future Educational Attainment Level?, Diaisha T. Richards May 2019

Does Family Income Determine A Children Future Educational Attainment Level?, Diaisha T. Richards

Applied Economics Theses

Family income and education have been a major concern in a variety of researches, and as a topic in society. These two components are a major concern because they are known to be key elements in determining future success for an individual. Various studies investigated the significance, correlations and impacts these two factors have on one another. It is common for the amount of family income obtained to determine how much education one will receive in the future. This study focuses on testing the hypothesis that family income determines how much education a child will receive in the future. By …

How Do Women Affect Politics And Legislation Among Distinct Nations?, Paulina Hatzipetrakos May 2019

How Do Women Affect Politics And Legislation Among Distinct Nations?, Paulina Hatzipetrakos

Political Science

How does the increase of women in the political realm affect legislation? It is critical to discover the answer to this presented question as it allows academics to better understand the past, present, and future of politics. Understanding why more women are entering the political world, and how they can influence the rate of policy change, presents academics with a basis to further analyze the impact of women in various disciplines. This study will attempt to prove that an increase of women in high-ranking, legislative positions will prompt an increase in progressive legislation. Historically, the implementation of progressive policies has …

Forward: Some Puzzles Of State Standing, Tara Leigh Grove May 2019

Forward: Some Puzzles Of State Standing, Tara Leigh Grove

Faculty Publications

When should states have standing? In recent years, there has been an explosion in literature on that question.1 Yet, even today, there seem to be as many questions as answers. In this Foreword to the Notre Dame Law Review’s 2019 Federal Courts, Practice, and Procedure Symposium on state standing, I discuss a few such puzzles. First, should states have “special” standing when they sue the federal government—that is, greater access to federal court than private parties? Second, and conversely, should states have at least “equal” access to federal court, or should they face more barriers than private parties? These questions …

Findings were recorded onto a standardized form by one of five trained examiners. Summary statistics were calculated, …

Female Genital Mutilation In The United States: Estimating The Number Of Girls At Risk, Phyllis Chesler May 2019

Female Genital Mutilation In The United States: Estimating The Number Of Girls At Risk, Phyllis Chesler

Dignity: A Journal of Analysis of Exploitation and Violence

Female genital mutilation (FGM) destroys the capacity of women to experience sexual pleasure. It causes serious medical complications such as bleeding, painful urination, cysts, dangerous and recurrent bladder and urinary tract infections, the growth of scar tissue that make marital intercourse a nightmare and that turns childbirth into an experience of danger and torture. Due to immigration, FGM now poses a potential health crisis in the West, both in Europe and in the United States. To estimate how many girls who live in the West are at risk, one can measure the prevalence of FGM in the non-Western countries where …

Venezuela's Collapsed Economy And The Resulting Effect On International Business With The United States, Sarah Caldwell Apr 2019

Venezuela's Collapsed Economy And The Resulting Effect On International Business With The United States, Sarah Caldwell

Senior Honors Theses

This thesis explores the current economic and political state of Venezuela, as well as the factors that contributed to the nation’s present challenges. By evaluating current information regarding international relations and international business affiliations, this study investigates and summarizes how Venezuela’s current instability has affected the country’s trade relations with the United States. The research found in this thesis demonstrates that the actions of Venezuela’s government have severely injured international business relations with multi-national firms operating out of the United States.

Beyond The Sentimental Cliche: How Local Communities Impact Residents And Shape Public Opinion, Kate Brunk Apr 2019

Beyond The Sentimental Cliche: How Local Communities Impact Residents And Shape Public Opinion, Kate Brunk

Theses and Dissertations

The Trump administration has recently established a rule that will prohibit abortion services providers from receiving Title X funds for the non-abortion family planning services they provide. Little public opinion research has focused on family planning and reproductive health topics outside of abortion. I find statistically significant experimental evidence that increasing perceptions of local need for a local reproductive health clinic caused subjects to be more supportive of federal reproductive health funding for local clinics. I did not find statistically significant correlational evidence that objective measures of poor reproductive health at the county level influence public opinion on federal reproductive …

The Banking/Commercial Separation Doctrine In Comparative Perspective, Cristie Ford Apr 2019

The Banking/Commercial Separation Doctrine In Comparative Perspective, Cristie Ford

All Faculty Publications

This report, prepared for the Department of Finance, Government of Canada, summarizes research undertaken across five jurisdictions – Australia, Japan, Singapore, the United Kingdom (UK), and the United States (US, federal level only) – with respect to a particular kind of boundary on the business of banking: the separation of banking business from commercial business. “Commercial” here means the provision of non-financial goods and services. This separation exists under what in the United States has long been referred to as the “banking/commercial separation doctrine”. The report considers the historical justifications for the doctrine in the context of the modern “business …

What Gun Safety And Access Policies Did Participants Think Would Be Effective In Preventing Accidental Gun Deaths?, Bridget O’Keefe, Stephen White Apr 2019

What Gun Safety And Access Policies Did Participants Think Would Be Effective In Preventing Accidental Gun Deaths?, Bridget O’Keefe, Stephen White

Thinking Matters Symposium Archive

Firearm-related incidents are often highly publicized tragedies that fuel unproductive political debates on gun policies at the local, state, and national levels. Current best practices in safe gun storage suggest that caregivers can protect their children from injury or death from an accidental gun discharge by keeping guns unloaded, locked up, and stored separately from their ammunition (Crifasi, Doucette, McGinty, Webster, & Barry, 2018). Child access prevention mechanisms including trigger locks, lock boxes, gun safes, and safe storage legislation are encouraged by the American Academy of Pediatrics (Dowd & Sege, 2012). This study gathers quantitative responses from 1,021 participants using …

Experiences Of Veterans With Ptsd And Sud In An Outpatient Setting, Andrew Breault, Hannah Shifflett-Kohler

Thinking Matters Symposium Archive

In 2014, there were approximately 7.9 million adults in the United States with co-occurring Post Traumatic Stress Disorder (PTSD) and Substance Use Disorders (SUD) (SAMHSA, 2014). Of the veterans who served in the conflicts in Iraq and Afghanistan alone, 30% of those in SUD treatment also meet the criteria for PTSD (Seal et al, 2008, pp. 476). Furthermore, statistics show that about 20 Veterans in the United States complete suicide daily (Spiva, 2019, p. 8). The Department of Veterans Affairs is urgently seeking successful approaches to addressing the high incidence of suicides among all veterans along with the low retention …

Perceptions Of Mental Health: Eight Conversations With Mainers From Africa, Teresa Sosa, Emelda Ogweta Apr 2019

Perceptions Of Mental Health: Eight Conversations With Mainers From Africa, Teresa Sosa, Emelda Ogweta

Thinking Matters Symposium Archive

As of 2016, 42 million refugees from around the world had been forced to flee their homes due to war, persecution, or natural disaster (George & Jettner, 2016). Due to these factors, as well as relocation and resettlement, refugees are at a significant risk for trauma and other mental health issues (George & Jettner, 2016). While the literature consistently validates this heightened risk for mental illness in refugees, more research is needed into refugee's perspectives on mental health. Through analysis of semi-structured interviews with eight refugees from Africa, this phenomenological study investigated refugee's perceptions of mental health and mental illness. …

Improving Safety On The Road Through Occupational Therapy Intervention, Katherine Uschmann, Zachary Childs Apr 2019

Improving Safety On The Road Through Occupational Therapy Intervention, Katherine Uschmann, Zachary Childs

Thinking Matters Symposium Archive

As the U.S. population ages, increasing the likelihood of impaired fitness-to-drive, the topic of road safety holds strong interest among numerous professionals. The field of occupational therapy (OT) affirms the importance of community mobility in supporting overall health and well-being. OT practitioners who encounter clients with questionable driving ability should refer them to driving specialists. However, the question remains what kind of interventions may help clients with cognitive decline who have the potential to return to safe driving. This project’s evidence search revealed a wide range of interventions that show promise including: classroom education (especially when augmented by on-road training), …

Prisons In The United States: A Need For Reform And Educational Rehabilitation, Amanda Alcox

Social Justice Student Work

The American criminal justice system holds almost 2.3 million people in 1,719 state prisons, 102 federal prisons, 1,852 juvenile correctional facilities, 3,163 local jails, and 80 Indian Country jails as well as in military prisons, immigration detention facilities, civil commitment centers, state psychiatric hospitals, and prisons in the U.S. territories. The United States has the highest incarceration rate in the world. Ex-convicts express that transitioning back into society, as well as finding employers willing to hire former inmates, is a difficult task. In this capstone, we will look at prison reform from the 1800s-to-today, we will determine which roles retributive …

Trips-Plus In China: How The United States Can Use Trips To Strengthen Trademark Minimum Standards In An Fta With China, Neal Hillam

Brigham Young University Prelaw Review

The United States and China have attempted to make a free trade agreement on several occasions over the last few years. A potential amalgamation between the two countries is of particular interest because the United States and China are two of the world’s largest economic powers. This paper discusses what trademark minimum standards should be placed in the agreement and proposes that explicit adherence to TRIPS be made the backbone. The paper will identify several specific trademark problems in China and how stricter adherence to TRIPS can abate these internal issues. The proposed method of using TRIPS as the backbone …

Testing The Gender Role-Perception Theory: A Proposed Explanation For The Lack Of Maternity Leave Policy In The United States, Erica R. Boucher Apr 2019

Testing The Gender Role-Perception Theory: A Proposed Explanation For The Lack Of Maternity Leave Policy In The United States, Erica R. Boucher

Student Publications

The United States is the only industrialized country in the world to not have a federally mandated paid maternity leave. While there is an obvious lack of maternity leave policy in the United States, there is not adequate explanation of this lack. There are some current theories used to explain this problem, such as Hofstede’s theory of individualism, and historical influence, but they are not able to fully explain why there is not maternity policy in the United States. A new proposed theory, the Gender Role-Perception Theory combines gender roles in the United States and attitudes/perceptions towards working mothers to …

International Inequality Or American Atrocity?: A Comparative Investigation Of Indigent Legal Representation In The United States And The European Union, Sydney Wilson Apr 2019

International Inequality Or American Atrocity?: A Comparative Investigation Of Indigent Legal Representation In The United States And The European Union, Sydney Wilson

Honors Thesis

Criminal justice systems across the globe are faced with multifaceted monetary limitations. The European Union and United States have similar overarching provisions ensuring that indigent defendants are guaranteed the right to counsel in legal proceedings with the possibility of infringing on their liberties. On the whole, they leave the decisions pertaining to each jurisdictions’ system up to the individual governments. This practice allows for differing systems, quality, and problems. The differences between the individual countries in the EU and in the states in America are not as vast as initially believed; therefore, the problems pertaining to indigent representation affect more …

A Comparison Of The United States And Costa Rican Health Care Systems And Their Influence On Immigrant Women's Maternal And Child Health Outcomes, Tamera R. Sullivan Apr 2019

A Comparison Of The United States And Costa Rican Health Care Systems And Their Influence On Immigrant Women's Maternal And Child Health Outcomes, Tamera R. Sullivan

Senior Theses

Health is a fundamental right for all humans, and every nation has a unique system for health care delivery. While the United States and Costa Rica follow two different welfare state models, there is still value in comparing the two countries. This project was inspired by my public health-based study abroad experience in Costa Rica in May 2018, which sparked a desire to learn more about the structures that form the health care system of each country. The United States has a more privatized and fragmented health care system, while Costa Rica has a public, universal health care system. Although …
