Evaluation Of Sustainable Yield Of The Barton Springs Segment Of The Edwards Aquifer, Hays And Travis Counties, Central Texas Bseacd Report Of Investigations 2007-1201, Barton Springs/Edwards Aquifer Conservation District

KIP Data Sets and Technical Reports

EXECUTIVE SUMMARY The combined effects of drought and substantial pumping can result in a decline in water levels and spring flow in an aquifer. This report evaluates potential impacts on groundwater availability in the Barton Springs segment of the Edwards Aquifer (Barton Springs aquifer) during a recurrence of drought-of-record (1950's) conditions and various rates of pumping. A numerical groundwater model and hydrogeologic data were the primary tools used in this evaluation. The Barton Springs aquifer is an important groundwater resource for municipal, industrial, domestic, recreational, and ecological needs. Approximately 50,000 people depend on water from the Barton Springs aquifer as …

Chevron And Preemption, Nina A. Mendelson Jan 2004

Chevron And Preemption, Nina A. Mendelson

Articles

This Article takes a more functional approach to reconciling preemption doctrine with Chevron when Congress has not expressly delegated preemptive authority to an agency, an approach that considers a variety of concerns, including political accountability, institutional competence, and related concerns. The Article assumes that federalism values, such as ensuring core state regulatory authority and autonomy, are important and can be protected through political processes." It argues that although Congress's "regional structure" might hint at great sensitivity to state concerns, it actually may lead Congress to undervalue some federalism benefits that are more national in nature. Meanwhile, executive agencies generally have …

Geosciences and Geological and Petroleum Engineering Faculty Research & Creative Works

We investigated the bulk electrical conductivity and microbial population distribution in sediments at a site contaminated with light nonaqueous-phase liquid (LNAPL). The bulk conductivity was measured using in-situ vertical resistivity probes; the most probable number method was used to characterize the spatial distribution of aerobic heterotrophic and oil-degrading microbial populations. The purpose of this study was to assess if high conductivity observed at aged LNAPL-impacted sites may be related to microbial degradation of LNAPL. The results show higher bulk conductivity coincident with LNAPL-impacted zones, in contrast to geoelectrical models that predict lower conductivity in such zones. The highest bulk conductivity …

Johann August Weppen's Der Hessische Officer In Amerika And David Christoph Seybold's Reizenstein: The American Revolution And The German Bürgertum's Reassessment Of America, Virginia Sasser Delacey

Institute for the Humanities Theses

While American, British, and French reactions to the American Revolution are well-known, those of the German people are not, despite the presence of almost 30,000 German soldiers in America fighting for the British army and hundreds of German volunteers fighting for the American patriots. The participation of German soldiers on both sides of the conflict inspired numerous works of German poetry, prose, and drama, all largely forgotten in the wake of the French Revolution and the rise of German Classicism and Romanticism. This thesis examines two works that have received brief mention in the past two centuries: Der hessische Officier …

To Be Announced: Silence From The United States Supreme Court And Disagreement Among Lower Courts Suggest An Uncertain Future For Class-Wide Arbitration - Green Tree Fin. Corp. V. Bazzle, Jonathan R. Bunch

Journal of Dispute Resolution

With growth in the area of arbitration agreements relating to employment, credit cards, loans, and other form agreements, the issue of class-wide arbitration has become an area of significant judicial activity. However, increased judicial activity has not resulted in increased clarity; to the dismay of those parties seeking to pursue or avoid class-wide arbitration, the law on this issue has become unpredictable from jurisdiction to jurisdiction. The United States Supreme Court has expressed the importance of the class-action as a valuable device for vindicating plaintiffs' rights. Additionally, the Supreme Court has recognized arbitration as a valuable form of dispute resolution. …

Comparative Analysis Of Telecommunications Regulations: Pitfalls And Opportunities, Mary Newcomer Williams

Federal Communications Law Journal

Book Review: Controlling Market Power in Telecommunications: Antitrust vs. Sector-specific Regulation by Damien Geradin and Michel Kerf.
In this 2003 publication, the authors comprehensively review and analyze the telecommunications regulatory structure of five nations that have achieved some success in promoting competition in telecommunications markets. The authors engage in this analysis in order to evaluate the use of telecommunications sector-specific regulation versus more general, economywide antitrust regulation to accomplish specific goals related to promoting competition and efficiency in the provision of telecommunications services. This review describes the authors’ analysis and highlights its strengths and limitations. It also offers a few …

Field-Scale Estimation Of Volumetric Water Content Using Ground-Penetrating Radar Ground Wave Techniques, Katherine R. Grote, Susan Sharpless Hubbard, Yoram N. Rubin Nov 2003

Field-Scale Estimation Of Volumetric Water Content Using Ground-Penetrating Radar Ground Wave Techniques, Katherine R. Grote, Susan Sharpless Hubbard, Yoram N. Rubin

Geosciences and Geological and Petroleum Engineering Faculty Research & Creative Works

Ground-penetrating radar (GPR) ground wave techniques were applied to estimate soil water content in the uppermost ∼10 cm of a 3 acre California vineyard several times over 1 year. We collected densely spaced GPR travel time measurements using 900 and 450 MHz antennas and analyzed these data to estimate water content. The spatial distribution of water content across the vineyard did not change significantly with time, although the absolute water content values varied seasonally and with irrigation. The GPR estimates of water content were compared to gravimetric water content, time domain reflectometry, and soil texture measurements. The comparisons of GPR-derived …

A Gradual Shift In U.S. Privacy Laws Towards A Comprehensive Regime , Kamaal R. Zaidi Oct 2003

A Gradual Shift In U.S. Privacy Laws Towards A Comprehensive Regime , Kamaal R. Zaidi

ExpressO

This paper examines the current trends in a predominantly sectoral U.S. privacy regime that appears to be becoming more comprehensive in nature with respect to data privacy protection. This trend has been greatly attributed to the European Union's comprehensive position on data privacy protection. This paper investigates the growth in U.S. data privacy protection in relation to federal and state legislative history, federal administrative procedures, and private industry efforts. This shift from sectoral to comprehensive regimes is significant in the backdrop of U.S-EU trade relations.

How Safe Do Individuals Feel In Clayton County?, Scott M. Clemens

Theses and Dissertations

To determine if individuals feel safe in their communities, a self- administered questionnaire was distributed to six hundred residents of Clayton County, Georgia. In addition to overall safety, the survey sought to measure how being a victim of a burglary or rape and the level of income impacts the individuals' feeling of safety. The survey also sought to measure how safe those same individuals believed the community was for their children and how likely a terrorist attack was in the county. Non- probability sampling, specifically the accidental sample, was used for conducting the research. The results of the survey show …

The Invention Of Inflation-Indexed Bonds In Early America, Robert J. Shiller Oct 2003

The Invention Of Inflation-Indexed Bonds In Early America, Robert J. Shiller

Cowles Foundation Discussion Papers

The world’s first known inflation-indexed bonds were issued by the Commonwealth of Massachusetts in 1780 during the Revolutionary War. These bonds were invented to deal with severe wartime inflation and with angry discontent among soldiers in the U.S. Army with the decline in purchasing power of their pay. Although the bonds were successful, the concept of indexed bonds was abandoned after the immediate extreme inflationary environment passed, and largely forgotten until the twentieth century. In 1780, the bonds were viewed as at best only an irregular expedient, since there was no formulated economic theory to justify indexation.
