Value Divergence In Global Intellectual Property Law, J. Janewa Oseitutu Oct 2012

Value Divergence In Global Intellectual Property Law, J. Janewa Oseitutu

Indiana Law Journal

It is a challenge for the United States to adequately protect the interests of its intellectual property industries. It is particularly difficult to effectively achieve this objective when the interests of the United States are not in line with the social, cultural, and economic goals of other nations. Yet, as a major exporter of intellectual property protected goods, the United States has an interest in negotiating effective international intellectual property agreements that are perceived to be legitimate by the state signatories and their constituents. Focusing on value divergence, this Article contributes to the growing body of literature on developing a …

Reforming The Good Moral Character Requirement For U.S. Citizenship, Kevin Lapp Oct 2012

Reforming The Good Moral Character Requirement For U.S. Citizenship, Kevin Lapp

Indiana Law Journal

This Article explores the impact of the convergence of criminal law and immigration law on the most valued government benefit in the land: citizenship. Specifically, it examines how criminal history influences the opportunity to naturalize through the good moral character requirement for U.S. citizenship.

Since 1790, naturalization applicants have been required to prove their good moral character. Enacted to ensure that applicants were fit for membership and would not be disruptive or destructive to the community, the character requirement also allowed for the reformation and eventual naturalization of those guilty of past misconduct. This Article shows that recent changes in …

Marked Out By The Will Of Heaven To Sway The Destinies Of Half The Globe:" The Peculiar Imperialism Of The United States And Russia, Christopher L. Miller Oct 2012

Marked Out By The Will Of Heaven To Sway The Destinies Of Half The Globe:" The Peculiar Imperialism Of The United States And Russia, Christopher L. Miller

History Faculty Publications

It is argued in this paper that during the era of global imperialism in the eighteenth and nineteenth centuries, while nations like Great Britain, France, and other European powers were amassing far-flung overseas empires, the United States and Russia engaged in a different form of imperialism. In the United States, what has traditionally been characterized as "frontier expansion," and not as "imperialism," has more recently been re-cast. Scholarship, especially since 1980, has characterized U.S. expansion from the initial 13 colonies on the Atlantic seaboard to the Pacific coast explicitly as imperialistic. Similarly, recent scholarship on Russian expansion has also questioned …

Elected Judges And Statutory Interpretation, Aaron-Andrew P. Bruhl, Ethan J. Leib Oct 2012

Elected Judges And Statutory Interpretation, Aaron-Andrew P. Bruhl, Ethan J. Leib

Faculty Publications

This Article considers whether differences in methods of judicial selection should influence how judges approach statutory interpretation. Courts and scholars have not given this question much sustained attention, but most would probably embrace the “unified model,” according to which appointed judges (such as federal judges) and elected judges (such as many state judges) are supposed to approach statutory text in identical ways. There is much to be said for the unified model—and we offer the first systematic defense of it. But the Article also attempts to make the best case for the more controversial but also plausible contrary view: that …

The Family And Medical Leave Act’S Impact On The Hospitality Industry: Implementing Policies To Ensure Continued Productivity, Katie O'Brien Coon Oct 2012

The Family And Medical Leave Act’S Impact On The Hospitality Industry: Implementing Policies To Ensure Continued Productivity, Katie O'Brien Coon

UNLV Theses, Dissertations, Professional Papers, and Capstones

The Family and Medical Leave Act, (FMLA), allows women and men to take up to 12 weeks leave to care for a newborn child (maternity leave) and/or care for sick family members. The Department of Labor states that:

FMLA entitles eligible employees of covered employers to take unpaid, job-protected leave for specified family and medical reasons with continuation of group health insurance coverage under the same terms and conditions as if the employee had not taken leave (Family and Medical Leave Act - Wage and Hour Division (WHD) - U.S. Department of Labor, 2012).

When an employee decides to take …

The Pros And Cons Of Outsourcing, Angela Smith

UNLV Theses, Dissertations, Professional Papers, and Capstones

Outsourcing has become increasingly popular to the public since the mid-20th century and has become more controversial in the last decade. The United States economy has been under the microscope for the last 4 years due to an economic recession. Outsourcing has been a subject of interest that has been brought up numerous times by economists. Offshore outsourcing is the main type of outsourcing that is of concern in relation to the United States economy. This topic is highly debated because of the unemployment rate in America.

Orientalism And Media Representations Of Iran In The Usa, Ashutosh Mishra Aug 2012

Orientalism And Media Representations Of Iran In The Usa, Ashutosh Mishra

Boise State University Theses and Dissertations

This thesis aims to understand the phenomenon called Orientalism and reviews how Edward Said elucidates this subject. Its key argument is that certain forms of representation, including those through mass media, can and often do consist of efforts to represent reality in a subtle manner, which may distort the picture to the disadvantage of one group, or set of persons, or even states. The efforts at such representation succeed on account of an existing power differential as well as a body of texts having already established what "knowledge" is, what truth is about a subject, without any countervailing capacity or …

Analysis Of Bank Failure And Size Of Assets, Guancun Zhong Aug 2012

Analysis Of Bank Failure And Size Of Assets, Guancun Zhong

UNLV Theses, Dissertations, Professional Papers, and Capstones

The financial health of the banking industry is an important prerequisite for economic stability and growth. Bank failures in the United States have run in cycles largely associated with the collapse of economic bubbles. The number of bank failures has increased dramatically over the last thirty years (Halling and Hayden, 2007). In this thesis, we try to address the following two questions: 1) What is the relationship, if any, between a bank's asset size and its likelihood of failures? 2) How can we use statistical tools to predict the numbers of bank failures in the future? Various modeling techniques are …

Montana Flume Flow Corrections Under Submerged Flow, Ryan P. Willeitner, Steven L. Barfuss, Michael C. Johnson Jul 2012

Montana Flume Flow Corrections Under Submerged Flow, Ryan P. Willeitner, Steven L. Barfuss, Michael C. Johnson

Civil and Environmental Engineering Faculty Publications

A Montana flume is a Parshall flume without a diverging downstream section and is used to measure open channel flow. Under free-flow conditions, the Parshall flume and the Montana flume have the same calibration characteristics, but under submerge flows, their calibrations significantly differ. Tests were conducted at the Utah Water Research Laboratory on an acrylic 15.2-cm (6-in.) Montana flume to determine the effects of submergence on the flow readings. This type of investigation has not been previously analyzed. It was found that a standard Parshall flume rating curve overpredicted flow rates in the submerged Montana flume, up to 48%. Parshall …

Jackson Estuarine Laboratory

Historic baselines are important in developing our understanding of ecosystems in the face of rapid global change. While a number of studies have sought to determine changes in extent of exploited habitats over historic timescales, few have quantified such changes prior to late twentieth century baselines. Here, we present, to our knowledge, the first ever large-scale quantitative assessment of the extent and biomass of marine habitat-forming species over a 100-year time frame. We examined records of wild native oyster abundance in the United States from a historic, yet already exploited, baseline between 1878 and 1935 (predominantly 1885–1915), and a current …

A Comparative Law Analysis Of Private Securities Litigation In The Wake Of Morrison V. National Australia Bank, Grant Swanson Jun 2012

A Comparative Law Analysis Of Private Securities Litigation In The Wake Of Morrison V. National Australia Bank, Grant Swanson

Chicago-Kent Law Review

This article examines the recent Supreme Court decision in Morrison v. National Australia Bank and its broad implications for private securities litigants going forward. Morrison overturned forty years of jurisprudence when it rejected the conduct and effects tests used in some form by every Circuit Court when determining the extraterritorial reach of Section 10(b) of the Securities Act. The Court instead adopted a transactional test requiring that the security be traded in the United States or otherwise domestic, substantially cutting back the reach of Section 10(b). As a result, many securities litigants will be forced to bring claims in the …

Fear Of Asking: Factors That Inhibit Latinos In Seeking And Obtaining Credit For Small Business, Brenda Hernandez

College of Management Honors Theses

Latino owned businesses and any minority business in general are important for the economy of the United States. They generate money that helps the economy grow and work. In the fiscal year of 2010, the Minority Business Development Agency of the United States Department of Commerce created 6,397 new jobs and helped minority owned businesses obtained almost 4 billion in contracts and capital. The numbers are record highs for the MBDA and it shows that minority businesses are growing now more than they were ever before. We Need To Talk And The Nation Is Watching: A Textual Analysis Of Drug Interventions, Bailey J. Denhalter

Communication

Addiction is something that millions of people struggle with. Many are unable to or do not realize that they have a problem. Previously kept as an embarrassing family secret, drug interventions have gone Hollywood. The entertainment industry began publicizing these once private affairs for the nation in the early 2000's; unfortunately, publicity does not ensure a problem will be addressed in the appropriate manner. Drug interventions are typically conducted in secret, away from the prying eyes of neighbors or community members. By a stroke of genius or insanity, the producers at A & E realized the American public's fascination with …
