The 1846 Separation Of The New York Sisters: Conflict Over Mission Or Clash Of Wills?, Regina Bechtle S.C. Apr 1999

The 1846 Separation Of The New York Sisters: Conflict Over Mission Or Clash Of Wills?, Regina Bechtle S.C.

Vincentian Studies

In 1845, the leaders of the Sisters of Charity decided that they should withdraw from institutions for boys to stay faithful to the community’s original charism of educating girls. At the time about sixty sisters were responding to an urgent need for orphanages for boys and girls in New York. The boys had nowhere else to go. The sisters could either return to Emmitsburg or remain in New York, forming a new community under the bishop. Past studies of this separation have only considered the perspectives of Emmitsburg’s ecclesiastical superior and the bishop, thus seeing the sisters as caught up …

By What Authority? The Founding Of The Sisters Of Charity Of Cincinnati, Judith Metz S.C. Apr 1999

By What Authority? The Founding Of The Sisters Of Charity Of Cincinnati, Judith Metz S.C.

Vincentian Studies

Judith Metz explores what motivated a small group of Sisters of Charity to become a diocesan community, the Sisters of Charity of Cincinnati. American culture encouraged women to think independently and to be self-sufficient. Margaret George, the superior in Cincinnati, had a friendship with Elizabeth Seton that predated the founding of the Sisters of Charity, and she understood Elizabeth’s vision for the community. She and the other sisters had come to expect the flexibility and spirit of collaboration that had been present in the community’s government from its earliest days. Instead, it seemed that Emmitsburg was following the letter of …

The Changing Politics Of American Bankruptcy Reform, Elizabeth Warren Apr 1999

The Changing Politics Of American Bankruptcy Reform, Elizabeth Warren

Osgoode Hall Law Journal

The political atmosphere in which changes to the American bankruptcy laws occur has shifted since the adoption of the 1978 amendments to the United States Bankruptcy Code. Bankruptcy professionals, who once effectively controlled much of the legislative debate, have lost ground to creditors, who have become much more powerful in influencing bankruptcy legislation. The result has been the politicization of the debate and the setting of the stage for a series of amendments that have rhetorical appeal, but that do not reflect the underlying factual reality of the bankruptcy system.

An Analysis Of The Success And Failure Of The Collection And Interpretation Of American Intelligence, 1942-1989, Alexander Michael Gibby Apr 1999

An Analysis Of The Success And Failure Of The Collection And Interpretation Of American Intelligence, 1942-1989, Alexander Michael Gibby

History Theses & Dissertations

The purpose of this study is to investigate several types of American intelligence collectors. These collectors include human, airborne, shipborne, satellite, and signals. The time frame for this study will begin with the American involvement in the Second World War, commencing with Operation Torch in 1942, and end with the conclusion of the Cold War, marked by the fall of the Berlin Wall in 1989. The case-study format of the paper allows the author to focus on several important areas of intelligence collection, rather than dividing analysis over a great array of topics. The significance of the thesis to contemporary …

Can Everyone Make The Grade? Some Thoughts On Student Grading And Contemporary Classrooms, Jo M. Hendrickson, Robert A. Gable, M. Lee Manning Jan 1999

Can Everyone Make The Grade? Some Thoughts On Student Grading And Contemporary Classrooms, Jo M. Hendrickson, Robert A. Gable, M. Lee Manning

Communication Disorders & Special Education Faculty Publications

High school officials should consider alternative perspectives on grading in light of increasing student heterogeneity. Their challenge is to consider grading policies and practices that apply equally to students with and without diverse needs or disabilities. Schools should think about incorporating various combinations of percent, criterion-referenced, and norm-referenced grading into a more flexible policy on grading; ensure that student expectations are unambiguously described in writing and in sufficient detail; and subject their policies on grading to periodic review and be prepared to make any necessary modifications. Moreover, schools should collaborate with various stakeholders to develop policies on grading that guarantee …

Spoiling The Surprise: Constraints Facing Random Regulatory Inspections In Japan And The United States, Andrew Chin

Northwestern Journal of International Law & Business

This Article is organized as follows. Part I presents a rational actor model of legal compliance under an enforcement regime based on random inspections and identifies two classes of reforms that can be applied in combination to improve aggregate compliance. Part II introduces the problem of corrupt tip-offs into the model and argues that exogenous reforms are necessary to combat corruption. Part III surveys the use of random administrative inspections in the United States, reviews the approaches taken by four such programs to improve compliance and fight corruption, and describes the various constraints under which they must operate. Part IV …

Ordinary Women: Government And Custom In The Lives Of New Hampshire Women, 1690-1770, Marcia Schmidt Blaine Jan 1999

Ordinary Women: Government And Custom In The Lives Of New Hampshire Women, 1690-1770, Marcia Schmidt Blaine

Doctoral Dissertations

The prominence of patriarchy and common law has caused many historians to concentrate on the limitations placed on eighteenth-century Anglo-American women. The results often present women as objects, rather than subjects, of study. Using four major primary sources: Governor, Council and Assembly records, petitions, licensing materials, and treasury records, this study examines the relationship between ordinary women and the provincial government of New Hampshire in order to explain the customary options available to women in proceedings with the government. Even with a spouse still living, Anglo-American women acted as family agents and representatives when captured by the Native Americans and …

National Collecting Trends: Collection Analysis Methods And Findings, Anna H. Perrault Jan 1999

National Collecting Trends: Collection Analysis Methods And Findings, Anna H. Perrault

School of Information Faculty Publications

The primary focus of collection evaluation and assessment has been the subjective judgment of the strengths and weaknesses of library collections. The process has generally been a local application, often utilizing peer group comparative data. Quantitative collection analysis to support the subjective processes of collection evaluation and assessment is now almost universally conducted through extraction of data from local systems or network databases. National collecting patterns can be studied through the use of data extracted from the bibliographic utilities. This article examines the use of data from the OCLC/AMIGOS Collection Analysis CD and standard statistical series as a methodology for …

Domestic Visions And Shifting Identities: The Urban Novel And The Rise Of A Consumer Culture In America, 1852-1925, Nancy Helen Von Rosk Jan 1999

Domestic Visions And Shifting Identities: The Urban Novel And The Rise Of A Consumer Culture In America, 1852-1925, Nancy Helen Von Rosk

Doctoral Dissertations

Domestic Visions reexamines the tradition of the urban novel in America by reading the works of Nathaniel Hawthorne, Henry James, William Dean Howells, Theodore Dreiser, Paul Laurence Dunbar, Edith Wharton, Abraham Cahan and Anzia Yezierska within the historical and cultural contexts of an evolving urban consumer culture. Bringing together not only a wide range of canonical and non-canonical texts, but also an analysis of America's shifting domestic ideals over the last half of the nineteenth and early twentieth centuries, this study traces the impact of a new spectacular urban public culture on both the private realm and those who are …

"The Law Will Make You Smart": Legal Consciousness, Rights Rhetoric, And African American Identity Formation In Massachusetts, 1641-1855, Scott Hancock Jan 1999

"The Law Will Make You Smart": Legal Consciousness, Rights Rhetoric, And African American Identity Formation In Massachusetts, 1641-1855, Scott Hancock

Doctoral Dissertations

In 1834, one of the informal leaders of Boston's black community rebuked a black defendant in court, declaring "the law will make you smart." This dissertation uncovers how African Americans in Massachusetts did indeed become 'smart' through an ongoing engagement with the law for over two hundred years. While the law could be oppressive, the accessibility of the legal system in Massachusetts enabled black women and men, slave and free, to learn to use the law in efforts to exercise some control over their daily lives. In the deteriorating racial atmosphere during the first half of the nineteenth century, the …

Resolving Conflicting International Data Privacy Rules In Cyberspace, Joel R. Reidenberg Jan 1999

Resolving Conflicting International Data Privacy Rules In Cyberspace, Joel R. Reidenberg

Faculty Scholarship

While core principles for the fair treatment of personal information are common to democracies, privacy rights vary considerably across national borders. This article explores the divergences in approach and substance of data privacy between Europe and the United States. It argues that the specific privacy rules adopted in a country have a governance function. The article shows that national differences support two distinct political choices for the roles in democratic society assigned to the state, the market and the individual: either liberal, market-based governance or socially-protective, rights-based governance. These structural divergences make international cooperation imperative for effective data protection in …

A Comparative Case Study On Why Women Run For Public Office : Hillary Rodham Clinton & Elizabeth Hanford Dole, Ashley Elizabeth Lorenz Jan 1999

A Comparative Case Study On Why Women Run For Public Office : Hillary Rodham Clinton & Elizabeth Hanford Dole, Ashley Elizabeth Lorenz

Honors Theses

As our political history evolves, slowly but surely more and more women are running for public office. What are the things that propel women to run for local, state, or federal leadership positions? Are there certain factors that are contingent upon their embarkment into the political arena? The answers to these questions all contribute to the "creation," if you will, of a political woman. In order to better understand these factors and their effects, I will examine case studies of two women, Hillary Clinton and Elizabeth Dole, through the lenses of four such factors including the timing as it relates …

United States Business Travelers' Response To Price Changes And Overbooking: Its Effect On Intentional Loyalty In The Hospitality Industry, Nicholas Jee Gordon Jan 1999

United States Business Travelers' Response To Price Changes And Overbooking: Its Effect On Intentional Loyalty In The Hospitality Industry, Nicholas Jee Gordon

UNLV Retrospective Theses & Dissertations

Companies that have highly perishable inventories have used yield management quite extensively over the past decade. The process helps to maximize revenues based on demand. The airline industry was the first to adopt the process into a business setting and has seen varying results along the way. Much of the existing research is geared towards examining the revenue producing potential of the system. There has been little research however, to examine how this process of shifting price to manipulate demand effects customer loyalty; This research attempts to evaluate what the effects actually are when price is used as the major …

The Reality Gap Of Employee-Management Misperceptions: Comparing United States Air Force Services Squadron Members To Their Private Sector Counterparts, Michael Christopher Rakoczy Jan 1999

The Reality Gap Of Employee-Management Misperceptions: Comparing United States Air Force Services Squadron Members To Their Private Sector Counterparts, Michael Christopher Rakoczy

UNLV Retrospective Theses & Dissertations

This exploratory study examined employee-management misperceptions in the United States Air Force Services career field. The "reality gap," as defined, is the misperception of workers needs or wants by management. Employee and manager surveys from 1946, 1980, 1987, and 1991 which demonstrate this phenomenon are examined to establish the validity of the reality gap, the length of time it has existed, and the full ramifications of the extent of the gap. The reality gap is then shown as the precipitating factor toward employee dissatisfaction, leading directly to employee turnover. All of this is framed within the context of Management by …

Aliens, Bodies And Conspiracies: Regimes Of Truth In The X-Files, Leanne Mcrae Jan 1999

Aliens, Bodies And Conspiracies: Regimes Of Truth In The X-Files, Leanne Mcrae

Theses: Doctorates and Masters

The X-Files is a television program that first screened on Australian television in 1993. This thesis will investigate the role of The X-Files as a cultural text. The X-Files is a significant program, and has contributed to a shift in the way in which television texts represent ideas about society, knowledge and truth. This thesis argues that The X-Files presents ‘knowledge’ in particular ways, and makes it possible to think about the relationship between the body, knowledge, and society in ways which have not previously been so visible.

Commercial Speech In The Law Of The European Union: Lessons For The United States?, J. Steven Rich Dec 1998

Commercial Speech In The Law Of The European Union: Lessons For The United States?, J. Steven Rich

Federal Communications Law Journal

Both the United States and the countries that comprise the European Union have previously imposed limits on tobacco advertising. These restrictions prevent tobacco companies from advertising on broadcast television. Recently, the European Union adopted a new proposal that would expand restrictions by phasing out press and billboard advertisements, and prohibiting tobacco company sponsorship of sporting events. It seems certain that advertising interests in Europe will challenge the new proposal as a violation of freedom of expression. An analysis of the European Convention on Human Rights reveals that these challenges should ultimately succeed since the restriction on commercial speech is more …
