Measuring Circuit Splits: A Cautionary Note, Aaron-Andrew P. Bruhl Jan 2014

Measuring Circuit Splits: A Cautionary Note, Aaron-Andrew P. Bruhl

Faculty Publications

A number of researchers have recently published new measures of the Supreme Court’s behavior in resolving conflicts in the lower courts. These new measures represent an improvement over prior, cruder approaches, but it turns out that measuring the Court’s resolutions of conflicts is surprisingly difficult. The aim of this methodological comment is to describe those difficulties and to establish several conclusions that follow from them. First, the new measures of the Court’s behavior are certainly imprecise and may reflect biased samples. Second, using the Supreme Court Database, which some studies rely on to assemble a dataset of cases resolving conflicts, …

Writing Development Of Spanish-English Bilingual Students With Language Learning Disabilities, Robin L. Danzak, Elaine R. Silliman

Communication Disorders Faculty Publications

This chapter addresses Spanish-speaking, English Language Learners (ELLs) in the United States (U.S.) who are sequential bilinguals; that is, oral and written English is acquired as a second language (L2) at school. Within this population, substantial variation exists with regard to individual students’ language and literacy learning experiences. The specific focus here is the writing patterns of ELLs with atypical language development, who often present with multiple complexities in authenticating their language learning profiles in both Spanish and English.

Wheel Of Innovation : How Leaders' Attitudes And Behaviors Drive Disruptive Technology In The U.S. Navy, Eddy Wayne Witzel

Dissertations

Problem and Purpose

Innovative solutions in national defense are needed to respond to national security threats in our uncertain environment. Leader attitudes and behaviors have a substantial impact on innovation. Unfortunately we did not completely understand the effect of leader attitudes and behaviors on innovation and the team dynamics that lead to innovation, especially in the military. The purpose of this study was to determine how leadership attitudes and behaviors contribute to product innovation within the U.S. Navy and how leadership emerges within this complex adaptive system of innovation.

Method

The research was a qualitative design based on a multiple …

Spillover Across Remedies, Michael Coenen Jan 2014

Spillover Across Remedies, Michael Coenen

Journal Articles

Remedies influence rights, and rights apply across remedies. Combined together, these two phenomena produce the problem of spillover across remedies. The spillover problem occurs when considerations specific to one remedy affect the definition of a substantive rule that governs in other remedial settings. For example, the severe remedial consequences of suppressing incriminating evidence might generate substantive Fourth Amendment precedents that make other Fourth Amendment remedies (such as damage awards, injunctions, or ex ante denials of search warrants) more difficult to obtain. Or, the rule of lenity might yield a narrowed reading of a statutory rule in a criminal case, which …

Human–Wildlife Interactions

The Centers for Disease Control (CDC) and USDA Wildlife Services (WS) have been involved in an oral rabies vaccination (ORV) program for raccoons (Procyon lotor) that has slowed the westward spread of raccoon rabies. The objective of this study was to forecast the spread of the disease if an ORV zone was not maintained. A group decision-making process was designed to address the forecasting problem and was implemented using a group of 15 experts and 4 support personnel at a meeting at the USDA National Wildlife Research Center. Ten expansion regions were constructed that described the spread of …

The American Legal Profession In The Twenty-First Century, Stephen M. Sheppard Jan 2014

The American Legal Profession In The Twenty-First Century, Stephen M. Sheppard

Faculty Articles

Lawyers in the United States work in public service, private counseling, and dispute resolution, but many also work outside of traditional legal practice. The million-member American bar, second largest in the world, grows more diverse by gender, and ethnicity and older on average. All members of this learned profession must qualify by education or examination and by proof of good character and fitness before taking an oath to serve as an attorney. Thence, there are few limitations on the form of legal practice, though many law firms require an associateship before an attorney becomes an owner of the firm. Economic …

Brand Engagement In Self Concept (Besc) Among Millennials In The United States, Neleen Leslie, Jaejin Lee Jan 2014

Brand Engagement In Self Concept (Besc) Among Millennials In The United States, Neleen Leslie, Jaejin Lee

AMTP Proceedings 2014

“We are what we have.” This argument was forwarded by Belk (1988) in his exploration of peoples’ use of material objects to form, reflect and reinforce their identities. This concept is one that continues to be explored today. This paper examines Brand Engagement in Self Concept (BESC), consumers’ tendency to include important brands in their self-concept. BESC has potential for furthering our understanding of consumer behavior as it provides even greater psychological insight into why and how consumers relate to brands. This will allow researchers and practitioners alike to better understand and predict consumer behavior in various contexts. This study …

Information Disclosure On A Chinese Social Media Platform, Lixuan Zhang, Clinton Amos, Iryna Pentina, Bj Blackwood

AMTP Proceedings 2014

The nature of social media encourages people to contribute voluntarily to public web and inevitably, leaving a persistent and cumulative repository of personal information. Aware of the privacy risks, about one third of the Internet users in the United States have expressed concerns of their personal privacy. However, users are often cavalier in the protection of their own data profile. There is often a discrepancy between users’ intentions to protect privacy and their actual heavier. This behavior is often terms as “privacy paradox”. The privacy paradox might arise because users balance between risks and benefits of disclosing information on social …

Just Farming: An Environmental Justice Perspective On The Capacity Of Grassroots Organizations To Support The Rights Of Organic Farmers And Laborers, Rebecca Elaine Berkey

Antioch University Dissertations & Theses

This mixed methods study builds upon literature and research in environmental justice, public participation, and community development to examine how justice-related issues impact farmers and workers on organic farms in the Northeastern United States. It also examines how involvement in a grassroots organization helps farmers and workers address these issues. At the core of the study is an exploration of environmental justice and its applications at a broad, systemic level; an examination of the current context of laborers in organic agriculture in the Northeast; and finally an investigation of the effects of grassroots organizing within the Northeast Organic Farming Association …

Us Federal Climate Change Law In Obama’S Second Term, Michael B. Gerrard, Shelley Welton

Faculty Scholarship

This commentary details the United States’ progress in advancing climate change law since President Barrack Obama’s re-election in 2012, in spite of congressional dysfunction and opposition. It describes how the Obama administration is building upon earlier regulatory efforts by using existing statutory authority to regulate greenhouse gas emissions from both new and existing power plants. It also explains the important role the judiciary has played in facilitating more robust executive actions, while at the same time courts have rejected citizen efforts to force judicial remedies for the problem of climate change. Finally, it suggests some reasons why climate change has …

What's in a Game? Transmedia Storytelling and the Web-Game Genre of Online Chinese Popular Fiction by Heather Inwood

This paper uses a genre of online Chinese popular fiction known as Web-Game fiction as an entry point for exploring the influence of Massively Multiplayer Online Role Playing Games (MMORPGs) on linear narrative fiction. By offering a thick description of MMORPG gameplay and of gamers’ movements between online and offline worlds, Web-Game fiction narrates and “deinteractivates” the subjective experiences of players as they progress through the levels of online role-playing games. This essay proposes that the genre offers an alternative perspective …

Invasive Rodent Ecology, Impacts, And Management With An Emphasis On The United States, Gary W. Witmer, William C. Pitt, Gregg Howald

United States Department of Agriculture Wildlife Services: Staff Publications

Many invasive rodent species have become established in the United States and its territories, both on the mainland and on islands. While most were introduced accidently, some were introduced for food or fur. These rodents have caused serious impacts to native flora and fauna, agriculture, and other resources. They have caused the extinction of many species of birds in insular ecosystems. Although many methods are used to control or eradicate introduced rodents, rodenticides and traps are the main tools. Since the early 1990s, agencies have been eradicating rodents from various islands, primarily for conservation purposes. There have been numerous eradication …

One(?) Nation Overextended, Gary S. Lawson Jan 2014

One(?) Nation Overextended, Gary S. Lawson

The conventional wisdom prior to the founding was that republics needed to be small. The conventional wisdom today is that James Madison, and the example of the United States, proves this to be mistaken. But what if Madison was actually wrong and Montesquieu was right? In this article, I consider whether the United States has gotten too big for its Constitution, whether this massive size contributes to political dysfunction, and what might be done to remedy the problem if there is indeed a problem. I suggest that size can increase rather than decrease the dangers of faction because the increased …

Who Can’T Raise Capital? The Scylla And Charybdis Of Capital Formation, James D. Cox Jan 2014

Who Can’T Raise Capital? The Scylla And Charybdis Of Capital Formation, James D. Cox

Faculty Scholarship

There has long been complaints that the heavy regulatory hand of Blue Sky Law administrators prevents capital formation by small issuers. Using data recently collected by the SEC, the article reasons that the problems capital starved small issuers encounter is not the state regulator. The problems are elsewhere. The paper explores whether intermediation may ultimately enable more startups to raise needed funds. For this to occur, however, the paper explores the formidable obstacles the broker must overcome in meeting demanding suitability requirements.

Public Broadband Investment Priorities In The United States: An Analysis Of The Broadband Technology Opportunities Program, Robert Larose, Johannes M. Bauer, Kurt Demaagd, Han Ei Chew, Wenjuan Ma, Yumi Jung

Research Collection Office of Impact

In 2009, U.S. Congress approved $7.2. billion to accelerate the deployment of advanced broadband networks and services to unserved and underserved regions of the country. Although primarily a short-term response to the economic crisis, the appropriation also indicates a willingness to seek a new balance between private sector and public sector initiatives in the development of the nation's broadband infrastructure. This paper is a first step in assessing the potential impact of the new government initiatives. It discusses in detail one component of the overall program, the Broadband Technology Opportunities Program (BTOP). The rationales and objectives of BTOP and its …

Objectives: The primary objective was to expand upon results of a previously piloted patient perception survey with Healthcare Failure Mode and Effect Analysis (HFMEA), to identify areas within pharmacist-managed clinics needing improvement.

Methods: The survey was adapted for use in pharmacist-managed clinics. Patients completed the survey following regularly scheduled pharmacist appointments. Data were analyzed with a method adapted from HFMEA. Product scores could range from five to 25. A product of five indicates that pharmacists are doing a good job on the items that patients place the most value on, while a product score of 25 indicates that pharmacists are …

How Social Media Affect The Social Identity Of Mexican Americans, Kaitlin Eve Felsted

Theses and Dissertations

This is a thesis conducted qualitatively using the Grounded Theory approach where in-depth interviews were conducted with 12 legal Mexican Americans in order to understand how social media affect Mexican Americans' social identity. This effect was understood by discovering the relationships between social identity theory and integration. Results showed that Mexican Americans felt that social media helped them with their English skills and connected them to their friends and family in Mexico. Mexican Americans were able to use social media to connect to their in-group community, and Mexican American community leaders were able to connect Mexicans to their in-group within …

A Comparison Of Information Security Curricula In China And The Usa, Huaying Chen, Sean B. Maynard, Atif Ahmad

Australian Information Security Management Conference

Information Security (InfoSec) education varies in its content, focus and level of technicality across the world. In this paper we investigate the differences between graduate InfoSec programs in top universities in China and in the United States of America (USA). In China, curriculum emphasises Telecommunication, Computer Science and InfoSec Technology, whilst in the USA in addition to Computer Science and InfoSec Technology the curriculum also emphasises Enterprise‐level Security Strategy and Policy, InfoSec Management, and Cyber Law. The differences are significant and will have a profound impact on both the perceptions and capabilities of future generations of information security professionals on …

Online And In-Person Health-Seeking For Infertility, Kathleen S. Slauson-Blevins, Julia Mcquillan, Arthur L. Greil

Department of Sociology: Faculty Publications

Using data from Wave 1 (2004–2006) of the National Survey of Fertility Barriers (NSFB), a national probability sample of women ages 25–45, we examine online information-seeking among ever-infertile women. Of the 1352 women who met criteria for infertility, 459 (34%) neither talked to a doctor nor went online for information, 9% went online only for information, 32% talked to a doctor but did not go online, and 25% did both. Guided by Chrisman’s Health-Seeking Model and previous research on Internet use to obtain health information, we employ multinomial logistic regression to compare these four groups of ever-infertile women. Findings generally …

Political Participation Of The Indian Diaspora In The Usa, Vinod Janardhanan Nov 2013

Political Participation Of The Indian Diaspora In The Usa, Vinod Janardhanan

Journal of International and Global Studies

This essay aims to foreground the types and patterns of political participation of Asian Indians in the US and the change and continuity thereof since migration of the community began in significant numbers in the 20th century. It shows how immigration reforms and citizenship laws prevented the community, for over half a century (until at least 1965), from achieving a demographic critical mass, which is a crucial factor in becoming an effective player in the political system of the US, and the community’s reaction to these restrictions. Surveying the political participation of Indian Americans since the years prior to India’s …
