My analysis begins in Part I with a short summary of brownfields law and policy, and a description of our current understanding of "sustainable development." There is no hard and fast definition of the term, but it is increasingly more clear that a body of sustainable development "law" will take shape as the product of a host of decisions made now and in the near future. The optimal way to ensure that brownfields programs mesh with this body of law-whatever it turns out to be-is to incorporate basic norms of sustainable development about which there is widespread agreement. Over the past ten years, sustainable development has been popularized by programs such as the President’s Council on Sustainable Development, the United Nation’s Agenda 21, and other sustainable development programs and initiatives in many countries, U.S. states and regions, and hundreds of American communities. These programs and initiatives have interpreted sustainability differently and tried different approaches and methods with varying success. We reviewed a selection of these programs to learn what methods and approaches have proven useful. Man Or Beast: The Convention On Biological Diversity And The Emerging Law Of Sustainable Development, W. Robert Ward

Vanderbilt Journal of Transnational Law

Mr. Ward explores the legal nature of the Convention on Biological Diversity by examining patterns in the development of international law. He considers two categories of global agreements: (1) novel issues agreements and (2) general principles agreements. The article defines these two types of agreements and then considers whether the Convention addresses a novel issue in conservation law. Mr. Ward argues that the Convention is instead a general principles agreement that marks a new development in international law. The article concludes by exploring how the Convention may influence the further evolution of the law of sustainable development.
