For Whom The School Bell Tolls But Not The Statute Of Limitations: Minors And The Individuals With Disabilities Education Act, Lynn M. Daggett, Perry A. Zirkel, Leeann L. Gurysh

University of Michigan Journal of Law Reform

This Article explores whether claims under the federal special education statute should be tolled on account of minority. Adult disabled students typically assert this type of tolling claim when alleging statutory violations dating back ten or more years, when they were minors. However this tolling claim is decided, there may be undesired results. First, even if the student has a very strong case, the merits are never reached if the court dismisses the hearing request as untimely. Second, if the hearing request is timely and the case proceeds to the merits, the student must remain in her current educational placement, …

School-Based Mental Health Services Delivered By School Psychologists, Emily Luis

This study involved analyses of an existing database conducted for the purposes of identifying and understanding factors that are associated with the delivery of school-based mental health services by school psychologists. The study examined the average number of hours per week in which school psychologists engage in mental health services and the types of mental health services in which they engage. Factors such as training, desire to deliver mental health services, time available and support for mental health services were investigated. Predictors Of Attitudes And Turnover Intentions In People With Disabilities: The Importance Of Means-Efficacy, Naomi Charity Schmierer

This study surveyed 107 working college students with varying disabilities. Individual, job, and organizational characteristics were evaluated for their ability to predict job satisfaction, organizational commitment, and turnover cognitions. One area this characteristic that was explored was that of an individual's perception of organizational resources related to legally mandated reasonable accommodations. Using hierarchal regression this study found that self-efficacy, job characteristics, and means-efficacy were key predictors of job satisfaction. Means-efficacy was the only one of these that was a predictor of turnover intentions.

This work presents a history of a center for gay, lesbian, bisexual, and transgender (GLBT) students on the campus of Minnesota State University Mankato from its inception in 1978 through May of 2004. This history is constructed from extant archival materials, interviews with most of the former directors of the Center, and a sampling of articles about the center (known by a variety of names) and issues pertaining to GLBT students during this period taken from the campus newspaper at Minnesota State University, Mankato and the local newspaper in Mankato, Minnesota.

The authors begin with a discussion of of the duality in how children are viewed in both international and domestic law. Children are viewed as both under the protection and authority of adults, at the same time as being rights bearing individuals. Following recognition of the difficult tension created by this duality, these authors focus on its application in the balancing of the safe school environment with student freedom of expression. Lack of physical activity and overweight status continues to be a significant health problem in the United States. To assess the actual prevalence of these problems, we reviewed data from the School-based Health Promotion Centers in one middle school, and one High school in central Kentucky. A total of 232 6th graders and 607 9th graders were included. A total of 92% of 6th graders and 45% of 9th graders reported complete lack of regular exercise. 37% of 9th graders and 59% of 6th graders had inappropriate nutrition, 47% of 9th graders and 33% of 6th graders had Body Mass …

Most native-born, English-speaking Americans – if they understood that developing the native language is good for English and good for longterm academic achievement – would support bilingual education. The problem is, almost none of them have heard the case. Teaching students social values has long been associated with K-12 education (Solomon, Watson, Delucchi, Schaps, 1988). With the rise of anti social behavior among children and youth in schools (Volokh & Snell, 1998) practitioners and scholars alike are re-focusing their attention on implementing and empirically documenting social skill programs (Hellison, 2003; Solomon, Watson, Battistich, Schaps, & Delucchi, 1996; Martinek & Hellison, 1998; Shields & Bredemeier, 1995; DeBusk & Hellison, 1989).
