The Free Exercise Of Religion: A Sociological Approach, Joseph M. Dodge Ii

No overriding theory has heretofore been proposed capable of allocating the various rules of decision in free exercise cases according to an appropriate classification of fact situations. This Article suggests an objective sociological approach to defining and weighing the governmental and religious interests inhering in a given free exercise claim in order to eliminate value preferences from the constitutional weighing process. Religious interests will be ranked according to functional criteria internal to all religious systems and not dependent upon the belief content of any given sect. State interests will be analyzed in terms of formalized modes of governmental action involving …

Many problems facing the contemporary church stem from its past and present attempts to dichotomize man. Having split man's person into body and soul, material and spiritual, the church then demands allegiance to "either-or." The decision belongs to man. Either he flees the world and its possessions, or the world and its pleasures possess him. Today, more than ever before, churchmen realize that this decision is not so clearly drawn. Just as he is not exclusively material (the Marxist heresy), so man is not solely spirit (Christianity's overstatement). No longer can categories be labeled so neatly: religious and secular. Never …

Little research has been done on the attitudes of American Indian groups toward occupation, education, or occupational mobility. Although anthropologists have studied the American Indian since the early 1940's, they have tended to focus upon tribal groupings studying each as an isolated people bearing the survivals of an aboriginal culture.
