Juvenile Diversion Programs: High-Risk Youth And Their Effect On Offense Targeting, Chelsey R. Warner Apr 2014

Juvenile Diversion Programs: High-Risk Youth And Their Effect On Offense Targeting, Chelsey R. Warner

Political Science Theses and Capstones

One of the largest problems that plague the juvenile justice system today is how to better handle juvenile crime without causing the juvenile to revert back to that behavior, but still helping them understand and acknowledge the crime they have committed. The state of Minnesota has created juvenile diversion programs as an attempt to aid in that endeavor. These programs however are under researched. The goal of this article is to shed some light on what those programs look like and how some counties programs vary from other programs on other counties; specifically focusing on the variation between offense-targeting for …

Sentencing And Prior Convictions: The Past, The Future, And The End Of The Prior-Conviction Exception To "Apprendi", Nancy J. King Apr 2014

Sentencing And Prior Convictions: The Past, The Future, And The End Of The Prior-Conviction Exception To "Apprendi", Nancy J. King

Vanderbilt Law School Faculty Publications

This article traces the fascinating history of early efforts to identify defendants and their prior convictions as well as the evolving use of prior convictions in aggravating punishment; examines how contemporary repeat offender penalties fall short of punishment goals and contribute to the racially lopsided profile of punishment today; and critiques potential justifications for the prior conviction exception to the rule in Apprendi v. New Jersey, arguing that the exception should be abandoned. The article summarizes empirical research testing the relationship between prior convictions and examining the efficacy of repeat offender sentences in reducing recidivism; collects commentary on the use …

The United States Prison System: A Comparative Analysis, Rachel O'Connor Mar 2014

The United States Prison System: A Comparative Analysis, Rachel O'Connor

USF Tampa Graduate Theses and Dissertations

Throughout history the penal system has been viewed as the paramount means of dealing with criminals, though its function has transformed throughout time. It has served as a pit for detaining suspected criminals, a home for the vagrant, an institution for the insane, a dreaded place of repute, quarters for cleansing and renewal, and an establishment of cataloged charges. The trials and transformations of history have developed and shaped the institution that we recognize today. Presently, the United States prison population far exceeds that of any other country in the world. The political climate, tough on crime policies, determinate sentencing, …

Adult Offender Recidivism Rates: How Effective Is Pre-Release And Vocational Education Programing And What Demographic Factors Contribute To An Offenders Return To Prison, James K. Bueche, Jr. Jan 2014

Adult Offender Recidivism Rates: How Effective Is Pre-Release And Vocational Education Programing And What Demographic Factors Contribute To An Offenders Return To Prison, James K. Bueche, Jr.

LSU Doctoral Dissertations

The primary purpose of this study was to determine if the Louisiana Department of Public Safety and Corrections’ 100 hour pre-release program and vocational education had a significant impact on offender recidivism. Additionally, a model of predicating offender recidivism using demographic data was another aspect of the study. Offenders in the study were 404 offenders who completed the pre-release program, 404 offenders who completed vocational education and 808 offenders who composed the control group. All offenders were released from prison in the year of 2010, and if they returned to prison between their release and December 31, 2013, they were …

Solitary Confinement, Public Safety, And Recdivism, Shira E. Gordon Jan 2014

Solitary Confinement, Public Safety, And Recdivism, Shira E. Gordon

University of Michigan Journal of Law Reform

As of 2005, about 80,000 prisoners were housed in solitary confinement in jails and in state and federal prisons in the United States. Prisoners in solitary confinement are generally housed in a cell for twenty-two to twenty-four hours a day with little human contact or interaction. The number of prisoners held in solitary confinement increased 40 percent between 1995 and 2000, in comparison to the growth in the total prison population of 28 percent. Concurrently, the duration of time that prisoners spend in solitary confinement also increased: nationally, most prisoners in solitary confinement spend more than five years there. The …

Evidence-Based Sentencing And The Scientific Rationalization Of Discrimination, Sonja B. Starr Jan 2014

Evidence-Based Sentencing And The Scientific Rationalization Of Discrimination, Sonja B. Starr

Articles

This Article critiques, on legal and empirical grounds, the growing trend of basing criminal sentences on actuarial recidivism risk prediction instruments that include demographic and socioeconomic variables. I argue that this practice violates the Equal Protection Clause and is bad policy: an explicit embrace of otherwise- condemned discrimination, sanitized by scientific language. To demonstrate that this practice raises serious constitutional concerns, I comprehensively review the relevant case law, much of which has been ignored by existing literature. To demonstrate that the policy is not justified by countervailing state interests, I review the empirical evidence underlying the instruments. I show that …

Post-Release Job Training And Enhanced Access To Employment Opportunities For Released Offenders: Incentives To Reducing Recidivism, Emmanuel Etim Umoh Jan 2014

Post-Release Job Training And Enhanced Access To Employment Opportunities For Released Offenders: Incentives To Reducing Recidivism, Emmanuel Etim Umoh

All ETDs from UAB

Researchers studying the effect of employment on recidivism have shown that offenders who are employed after serving time in prison are less likely to recidivate (Kyvsgaard, 1990). These scholars also indicated that employment for released offenders is positively related to a delay in re-offending. Such findings support the belief that job security increases the interval between release from prison and re-offending. In this study I expand on existing recidivism studies to investigate how post-release job training and greater access to employment opportunities for ex-prisoners affects recidivism. The effect of educational status is also measured to determine whether a high school …

Domestic Violence: Contemporary Interventions And The Rise Of Specialized Domestic Violence Units, Laura E. Anderson Jan 2014

Domestic Violence: Contemporary Interventions And The Rise Of Specialized Domestic Violence Units, Laura E. Anderson

Theses and Dissertations

This dissertation examines recidivism for domestic violence offenders under both traditional probation and specialized probation conditions. This research compares recidivism at a traditional probation locality (Riverside Criminal Justice Services) and a specialized domestic violence unit (Chesterfield Community Corrections Services) in order to determine the nature of recidivism at both localities. In addition, the research aims to identify individual risk factors which are statistically associated with recidivism. The research is based on secondary data and draws on offender criminal records generated by the Virginia State Police, as well the extraction of information from probation files at both localities. The multivariate models …

African American Men Who Give Voice To The Personal Transition From Criminality To Desistance, Naomi Nightingale Jan 2014

African American Men Who Give Voice To The Personal Transition From Criminality To Desistance, Naomi Nightingale

Antioch University Dissertations & Theses

The United States of America has more than 2.3 million persons incarcerated in state and federal prisons. In 2011 more than 700,000 prisoners were released from prisons back into the communities, mostly urban, from where they came.Upon their attempt to reenter society, persons released from prison are faced with overwhelming odds threatening their successful reentry at every critical element necessary for life and wellbeing—food, housing, health care, treatment for drug addictions, employment, counseling, family support and close personal relationships. This research reflects the voices of African American men who tell their personal stories of criminal life, imprisonment, recidivism, and the point at …

The Sexual History Polygraph Examination And Its Influences On Recidivism, Roger Cook, William Barkley, Peter B. Anderson Jan 2014

The Sexual History Polygraph Examination And Its Influences On Recidivism, Roger Cook, William Barkley, Peter B. Anderson

Journal of Sustainable Social Impact

The polygraph in postconviction sex offender testing is used to assist in the treatment and supervision of convicted sex offenders by more than 70% of the jurisdictions that supervise these offenders in the United States. Prior researchers have failed to convincingly demonstrate how the polygraph can be used to target risk behaviors and reduce recidivism. Consequently, the use of the sexual history polygraph examination (SHPE) has not been demonstrated to reduce recidivism. We sought answers as to how the SHPE influences the behaviors of sexual offenders required to undergo a SHPE, and whether or not there is a difference in …

Youth Recidivism: A Qualitative Study Of Risk And Resilience, Jesse M. Near Ms. Jan 2014

Youth Recidivism: A Qualitative Study Of Risk And Resilience, Jesse M. Near Ms.

Theses and Dissertations (Comprehensive)

Abstract

The rates of reoffending for Ontario youth are high and come at a significant cost to both society and the youths involved. Research to date has explored risk and protective factors. Despite this progress, the relationships between these factors and recidivism are not well understood. Knowing that a youth is exposed to any of these identified risk or protective factors does little to explain why these factors do not affect all youth equally and why some youths reoffend while others do not. Resilience theory has increasingly been used as the framework to explore the concept of recidivism. The present …

Reducing Recidivism Among Youthful Offenders: Evidence-Based Practice Strategies, Kate Shade Oct 2013

Reducing Recidivism Among Youthful Offenders: Evidence-Based Practice Strategies, Kate Shade

International Nursing Research Congress (INRC)

Session presented on: Wednesday, July 24, 2013:

In the United States, housing youth in prison with an orientation toward punishment is becoming a thing of the past. Instead, the justice system is returning to a rehabilitation model (Mendel, 2010). However, the U.S. continues to incarcerate more youth than any other country in the world (Raphael, 2011). Effective treatment programs are limited in number and are costly. A meta-analysis of interventions for youthful offenders determined that greater than 50% of the juveniles incarcerated in the U.S. return to the justice system as adults (Lipsey, 2009). The purpose of this presentation is …

Effects Of Racism And Discrimination On Personality Development Among African American Male Repeat Offenders, Tiffany Nicole Lockett Oct 2013

Effects Of Racism And Discrimination On Personality Development Among African American Male Repeat Offenders, Tiffany Nicole Lockett

Master's Theses

ABSTRACT

Effects of Racism and Discrimination on Personality Development among

African American Male Repeat Offenders

Tiffany Nicole Lockett

Throughout history in the United States, the African American community has consistently been the victim of social policies put in place to disenfranchise this population (Mauer & Chesney-Lind, 2002; Painter, 2007; Parham, White & Ajamu, 1999). With a longstanding presence of systemic racism and discrimination, the criminal justice system and the dominant culture continues to pathologize this minority group and advocate for increased penalties which further stigmatize African Americans, particularly males in this group (Reiman, 1996; Russell, 1998). Though most criminology research …

Examining Barriers To Reentry Faced By Offenders In A Metropolitan County Jail And Community Setting, Kelly J. Russell Aug 2013

Examining Barriers To Reentry Faced By Offenders In A Metropolitan County Jail And Community Setting, Kelly J. Russell

Regis University Student Publications (comprehensive collection)

This study uses a strain theory approach to examine the barriers to community reentry faced by individuals being released from county detention facilities. Individuals who are reentering the community from jail face a variety of challenges, particularly when trying to access community resources. In almost every community, barriers to offender reentry include, but are not limited to, housing, benefit acquisition, healthcare, access to medications, identification, transportation, mental health treatment, substance abuse treatment and employment. While there has certainly been an increase in the amount of programs and services available for former offenders, research analysis presented here will identify what these …

The New Paradigm Of Rehabilitation : A Meta-Analysis Of The Effectiveness Of Incarceration-Based Rehabilitation In Regards To Recidivism Reduction., Shaun Andrew Dixon 1985- Aug 2013

The New Paradigm Of Rehabilitation : A Meta-Analysis Of The Effectiveness Of Incarceration-Based Rehabilitation In Regards To Recidivism Reduction., Shaun Andrew Dixon 1985-

Electronic Theses and Dissertations

This study is a meta-analytic examination of incarceration-based rehabilitation and its ability to reduce recidivism. Substance abuse is a large problem within our convict population; many times it is a substance related conviction that is the cause of the inmates’ incarceration. Claims have been made for decades that if society can effectively rehabilitate these convicts, recidivism rates will be reduced, ultimately lowering incarceration rates. By creating a stringent criterion of inclusion, this study makes an “apples-to-apples” analysis of prior studies on the topic, examining twelve studies of incarceration-based rehabilitation and their outcome variables. The data was synthesized through meta-analytic techniques …

Studies On Religion And Recidivism: Focus On Roxbury, Dorchester, And Mattapan, George Walters-Sleyon Jul 2013

Studies On Religion And Recidivism: Focus On Roxbury, Dorchester, And Mattapan, George Walters-Sleyon

Trotter Review

This research article raises the question of whether religion can be considered a viable partner in the reduction of the high rate of recidivism associated with the increasing mass incarceration in the United States. Can sustainable transformation in the life of a prisoner or former prisoner as a result of religious conversion be subjected to evidenced-based practices to derive impartial conclusions about the value of religion in their lives? With a particular focus on three neighborhoods of Boston—Roxbury, Dorchester, and Mattapan—this study examines the relevance of religion and faith-based organizations in lowering the high rate of recidivism associated with incarceration …

Preventing Recidivism By Using The Theory Of Reintegrative Shaming With Conferences, Patrick G. Enters Jun 2013

Preventing Recidivism By Using The Theory Of Reintegrative Shaming With Conferences, Patrick G. Enters

Justice

Driving while intoxicated in the United States is a major problem with more than 31 percent of national driving fatalities caused by intoxicated drivers. The purpose of the present study is to identify the possibility between the use of reintegrative shaming with conferences and the likelihood that it will reduce the recidivism of driving while intoxicated. The study explores John Brathwaite's theory on reintegrative shaming and how that theory applies in conferences. The emerging theory o f Storylines from Robert Agnew is also explored in its importance when conducting these conferences. Studies conducted in Australia, Pennsylvania, Kansas and Alaska have …

Factor Structure And Construct Validity Of The Psychopathic Personality Inventory In A Forensic Sample, Valerie M. Gonsalves, Julia E. Mclawsen, Matthew T. Huss, Mario J. Scalora Jan 2013

Factor Structure And Construct Validity Of The Psychopathic Personality Inventory In A Forensic Sample, Valerie M. Gonsalves, Julia E. Mclawsen, Matthew T. Huss, Mario J. Scalora

University of Nebraska Public Policy Center: Publications

A wealth of research has underscored the strong relationship between PCL-R scores and recidivism. However, mounting criticism cites the PCL-R's cumbersome administration procedures and failure to adequately measure core features associated with the construct of psychopathy (Skeem, Polaschek, Patrick, & Lilienfeld, 2011). In light of these concerns, this study examined the PPI and the PPI-R, which were designed to measure core personality features associated with psychopathy (Lilienfeld & Andrews, 1996; Lilienfeld & Widows, 2005). Study one examined the PPI relative to the PCL-R and examined its factor structure. The instruments shared few significant correlations and neither the PCL-R nor the …

A Path Analysis On The Acquisition Of Mental Health Treatment And The Effect Of That Treatment On Subsequent Offending, Gabriel Jude Saucedo Jan 2013

A Path Analysis On The Acquisition Of Mental Health Treatment And The Effect Of That Treatment On Subsequent Offending, Gabriel Jude Saucedo

Theses Digitization Project

The purpose of this study was to determine how various demographic and systemic factors interacted to either facilitate or hinder the acquisition of mental health treatment, and if once acquired, what effect did that treatment have on subsequent offending. Mental health treatment is viewed as an effective and cost effective way of reducing offending in this population. Unfortunately, research also indicates that many juveniles due to various demographic and systemic impediments, do not acquire the mental health treatment they need. Consequently, their symptoms deteriorate to the point they manifest as delinquent.

Factors Related To Recidivism For Youthful Offenders, Christopher A. Mallett Jan 2013

Factors Related To Recidivism For Youthful Offenders, Christopher A. Mallett

Social Work Faculty Publications

Little is known about youth who were previously placed in a detention facility and what factors predict a subsequent recidivism to placement. This study of a two-county juvenile offender population (one urban and one rural) investigates what demographic, educational, mental health, substance dependence, and courtrelated variables predict recidivism to detention placement. Findings from logistic regression analysis indicate that seven variables significantly predict juvenile offenders’ recidivism placement, some expected and some unexpected. Predictors that made recidivism more likely include youth with a previous conduct disorder diagnosis, a self-reported previous suicide attempt, age, and number of court offenses. Conversely, predictors that made …

Factors Related To Recidivism Among Mentally Disordered Offenders : Differential Impact Of Historical And Dynamic Clinical Indicators Across Risk Level, Lori J. Torgersen Jan 2013

Factors Related To Recidivism Among Mentally Disordered Offenders : Differential Impact Of Historical And Dynamic Clinical Indicators Across Risk Level, Lori J. Torgersen

Legacy Theses & Dissertations (2009 - 2024)

Understanding the factors related to recidivism among mentally disordered offenders is important so that criminal justice and mental health systems can prioritize resources to intervene with those most likely to reoffend by targeting factors that are most likely to reduce risk. While there is a sound body of literature identifying the predictors of recidivism among non-disordered adult offenders, the same inquiry in the case of mentally disordered offenders has been more equivocal.

The Inter-Rater Reliability Of A Multi-Factor Sex Offender Risk Classification System : An Experimental Simulation, Elizabeth Rahmberg Walsh Jan 2013

The Inter-Rater Reliability Of A Multi-Factor Sex Offender Risk Classification System : An Experimental Simulation, Elizabeth Rahmberg Walsh

Legacy Theses & Dissertations (2009 - 2024)

This research is an experimental simulation that explores the interrater reliability of a multi-factor sex offender risk classification system, specifically, the system outlined by the Massachusetts Sex Offender Registration Act (SORA). In Study 1, professionals holding the terminal degree in their field and qualified for appointment to the Sex Offender Registry Board administered the Massachusetts Classification Worksheet to four sex offender cases. Study 2 involved the use of master's level participants (including professionals with master's degrees and graduate student participants) to administer the Massachusetts Classification Worksheet to the same four sex offender cases. Participants assessed the offenders' risk as either …

Taking Stock And Moving Forward To Improve Prison Visitation Practices: A Response To Prison Visitation Policies: A Fifty-State Survey, Philip Genty Jan 2013

Taking Stock And Moving Forward To Improve Prison Visitation Practices: A Response To Prison Visitation Policies: A Fifty-State Survey, Philip Genty

Faculty Scholarship

Prison Visitation Policies: A Fifty-State Survey' is a wonderful resource. The authors' painstaking research has resulted in a dataset of immense importance. In addition, the authors have gone beyond simply describing their findings and have highlighted some of the issues they believe to be most significant. The authors express the hope that their work will both provide a useful body of information and be a catalyst for the research of others. An additional goal, already accomplished to some extent, is that the compilation and presentation of information from all of the states and the Federal Bureau of Prisons will encourage …
