This Article considers how American political polarization and the substantive issues driving it raise unique challenges for adjudicating self-defense claims in contexts of political protest. We live in an age where roughly a quarter of the population believes it is at least sometimes justifiable to use violence in defense of political positions, making political partisans somewhat more likely to pose a genuine threat of bodily harm to opponents. Furthermore, the psychological literature shows that people are more likely to perceive threats from people with whom they politically disagree and that juries tend to evaluate reasonableness claims according to their own …

Federal tax law treats separate nonprofit corporations as distinct legal entities for almost all purposes, in common with most other areas of law. With respect to political activity, this means that one nonprofit corporation’s lobbying or election related actions are generally not attributed to another nonprofit corporation. This is the case even if the two entities have overlapping or even identical boards of directors. It is also the case even if the two entities collaborate regarding their respective activities and share employees, facilities, outside vendors, and other resources, as long as the entities reasonably allocate the costs for those shared …

This article seeks to establish a baseline for the political behavior and participation levels of Republican women by measuring six political activities. Using CCES 2020 self-selected survey data, the six political activities measured were: made a political donation, attended a march or protest, attended a political meeting, worked on a campaign, contacted a public official, displayed political signage. The political behavior and participation levels of Republican women were compared to the levels of Republican men and non-Republican women. This dissertation project used an interpretivist qualitative research design to study how the right-to-read claim made by seven teenagers attending Detroit public schools in 2016 reflects, addresses, or describes contemporary discussions about educational access. Using situational analysis (SA) as a theory/method, the entirety of the claim comprises the situation of the social phenomenon being studied, not the people. International labour mobility has increased Indonesian female migrant domestic workers' involvement in transnational labour organisations. Because of their precarious work, advocacy and unions are crucial to protecting them overseas. This paper examines the debates on the political activism of Indonesian female domestic workers and discusses the gap that migration scholars have not yet addressed. The study's conceptual core employs the concept of migrant political transnationalism, which generates the intersection of migrant citizenship and receiving country sovereignty. This essay outlines an approach to integrating Anne Finch’s work into an advanced undergraduate and/or graduate course on eighteenth-century satire, focusing particularly on her satirical verse fables. This approach encourages students to question common critical assumptions about women and satire, most particularly that women avoided satire due to its association with aggression and politics—assumptions Finch’s fables are well-suited to challenge. The essay focuses particularly on Finch’s verse fables "Upon an Impropable Undertaking," “The Eagle, the Sow, and the Cat,” and “The Owl Describing Her Young Ones.” In these poems, written in the aftermath of the Glorious Revolution, Finch employs violent …

American businesses and families are leaving Blue states in record numbers for destinations like Texas, Florida, and Georgia. This migration of people, businesses, and tax dollars has prompted claims of a “Blue state exodus” prompted by “leftist politicians imposing leftist ideology.” As expressed by Utah’s Senator Mike Lee, the “exodus” proves that “the Left’s policies don’t work.” But does the movement of taxpayers from Blue to Red states really signal a rejection of progressive policies? The U.S. Supreme Court has come to decide many of the most consequential and contentious aspects of social policy via its interpretations of the U.S. Constitution. Institutional features of the Court create significant pressure on the Justices to justify their decisions as applications of “law” rather than the practice of “politics.” Their perceived failure to do so calls forth criticism sounding in a variety of registers—ranging from allegations of a lack of neutrality, lack of impartiality, or lack of “principle,” to allegations of opportunism, disingenuousness, and hypocrisy. Does partisanship influence the way investors price financial assets? Using voter registration data of bankers originating large corporate loans, we show that bankers whose party differs from that of the U.S. President charge 7% higher loan spreads than other bankers. This effect holds regardless of borrowers’ partisanship, and becomes stronger for politically active bankers and when partisan media exhibit greater disagreement. Bankers do not match disproportionately with co-partisan borrowers but they lead syndicates more frequently with co-partisan bankers. Our results are not driven by bank or borrower fundamentals, but suggest that investor optimism, driven by political alignment, shapes asset prices.

Utah has a unique history of pioneer settlement connected to the Church of Jesus Christ of Latter-day Saints. This history has become a source of pride that began with the first white settlers. I have come to call this the “deseret pioneer” identity, to differentiate from other western settlers. From the nineteenth to the twenty-first century, politicians and agriculturalists used this “deseret pioneer” identity to thwart federal protections for wolves and respond to wilderness policies that made Utah the only “rocky-mountain” state to not have wolves in the twenty-first century.

The First Amendment, in certain circumstances, is used as a defense to “protect[] satire and parody as a form of free speech and expression.”2 When it comes to jokes, “[q]uestions . . . have arisen in case law [pertaining to satire typically] concerning libel, emotional distress and copyright infringement.”3 Further, in a right of publicity claim, “[t]he First Amendment clearly protects all but the most intrusive coverage of news, or details of a person’s private life, such as are reported in the tabloid press or talk shows.”4 This demonstrates that humor and satire have a close relationship with the First …

This dissertation addresses three fundamental questions regarding the politics of prosecutorial behavior. Specifically, it examines how the selectors of prosecutors influence prosecutorial decision-making under different selection methods, including electionbased systems and appointment-based systems. By using a political responsiveness framework and utilizing empirical strategies, including an experiment and the construction of prosecutor policy position data, this study offers novel insights into the subject. First, I find that voters care about prosecutors’ issue positions and rely on various cues to identify candidates whose policy positions align with their preferences, even in low-information elections. Second, elections show promise as a mechanism for holding …
