Modern Police Practices: Arizona V. Gant's Illusory Restriction Of Vehicle Searches Incident To Arrest, Seth W. Stoughton

In 2009, the Supreme Court overturned thirty years of precedent with a decision that purported to dramatically cut back on the ability of law enforcement officers to conduct warrantless vehicle searches incident to the arrest of a vehicle occupant. Scholars and commentators celebrated Arizona v. Gant’s constraint of police, and subsequent scholarship has focused exclusively on peripheral concerns such as alternative justifications for warrantless searches and Gant’s effect on non-vehicle searches. This Note challenges the core assumption that Gant will substantially limit vehicle searches incident to arrest, contending that Gant is far more permissive than it appears. In most cases, …

Remedying an elusive practice such as racial profiling remains a challenging issue for the judiciary and reformers must rely on other avenues for a solution. For example, even where evidence demonstrates that minorities are disproportionately stopped and searched, courts rarely recognize the victim's claim or provide relief. Thus, it is clear that courts will not be the catalysts of change. This Article argues that while courts may be reluctant to provide judicial remedies, police departments themselves should not ignore [minorities'] perceptions [of racial discrimination] and should take measures to reduce any possible profiling and increase partnerships with communities. ¡Silencio! Undocumented Immigrant Witnesses And The Right To Silence, Violeta R. Chapin

At a time referred to as "an unprecedented era of immigration enforcement," undocumented immigrants who have the misfortune to witness a crime in this country face a terrible decision. Calling the police to report that crime will likely lead to questions that reveal a witness's inmigration status, resulting in detention and deportation for the undocumented immigrant witness. Programs like Secure Communities and 287(g) partnerships evidence an increase in local immigration enforcement, and this Article argues that undocumented witnesses' only logical response to these programs is silence. This study focuses on how the 2001 consolidation of the Louisville Division of Police (LPD) and Jefferson County Police Department (JCPD) impacted police officers' perception of fairness of the process. To accomplish this, the study asked four research questions: 1) How do police officers view a just department?, 2) How do police officers' justice judgments affect their reaction to the organization and supervisors?, 3) How do police officers form overall perceptions of fairness?, and 4) How do LPD and JCPD officers differ in their perceptions of fairness of the consolidation? A popular axiom attributed to British policing is the police are the public and the public are the police. Inherent in this term is a blurring of the distinction between the police and the public they serve; the police are cast as being little different from the citizenry and citizens are cast into a role of responsibility for the safety and well-being of the community. Everyone who has been screened at an international border, scanned by an airport metal detector, or drug tested for public employment has been subjected to an administrative search. Since September 11th, the government has increasingly invoked the administrative search exception to justify more checkpoints, unprecedented subway searches, and extensive wiretaps. As science and technology advance, the frequency and scope of administrative searches will only expand. This thesis looks at the nature of violence with its endemic, and increasingly epidemic presence in Brazil. I analyze the structure of the justice system, police force, and the many governmental security programs in order to better explain why Brazil is so violent and its government has been unable to control this violence. Living under violent conditions, Brazil has become a society where the efficient functioning of the public sphere has been undermined. On November 26, 2008 ten armed terrorists from Lashka-e-Toiba utilised military assault style tactics to attack a number of establishments including restaurants and hotels in the city of Mumbai, India. This new attack paradigm indicated a significant shift in tactics from the placement of improvised explosive devices or deployment of suicide bombers, and contains valuable lessons for contemporary law enforcement particularly with regard to intelligence, response, and media management. In Whren, the United States Supreme Court sanctioned pretextual traffic stops. In practice the holding of Whren condones police investigations that target certain suspect classes of people, like Hispanics, for increased police scrutiny. In permitting pretextual stops, the Court ignored the risk that such practices will encourage police to distort the truth, overlooked the cost of under-enforcement of the laws, and ignored the consequences to the criminal justice system of race and ethnicity based discrimination.

Today, low-level state and local criminal laws figure critically in federal prosecutions, serving as the initial bases for police seizures that yield evidence leading to more serious federal charges (usually involving drugs or firearms). While police resort to such laws as pretexts to stop and arrest individuals has been frequently addressed, this article provides the first analysis of how federal courts actually interpret and apply the laws. In doing so, the article reveals a surprising reality, long dismissed as a doctrinal impossibility: federal judicial use of the analytic framework of Erie v. Tompkins to resolve criminal cases.

This research study presents results from an evaluation and cost effectiveness analysis of a regionalization of selected police services into a Law Enforcement Council approach, as practiced by the Metropolitan Law Enforcement Council (Metro-LEC). The Metro-LEC is a non-profit organization comprising forty three law enforcement agencies in the Commonwealth of Massachusetts. The results from wave two surveys administered to officers in the organization as well as a survey distributed to the Chief Executive Officers of the participating law enforcement agencies illustrate the overall effectiveness of the organization. The Military Police is a special federal police force in Canada with unique authority, designed to support military commanders both in operations and in garrison. However, it has historically been under the command of non-Military Police officers, and is consequently not governed like other police forces in Canada. Retention And Job Satisfaction Among Local Law Enforcement, Lisa N. Parron

This thesis is an exploratory study which examines the retention of police officers in the Norfolk Police Department. Focus group interviews with nine police officers provided the data for this study. Participants described aspects of their job that they enjoy and aspects of their job that could be improved. Themes identified include working conditions, supervisor relationships, interpersonal relationships, pay, responsibility, achievement and recognition, and appeal of the job.

This research was aimed at revealing what officers like and dislike about their job in order to reduce voluntary turnover and increase retention.

For many years law enforcement organizations have struggled to recruit personnel. At the same time, local community members have demanded that these same law enforcement organizations adapt their organizations to reflect the communities that they serve. In this project, the author reviewed programs utilized by other organizations and a limited number of police departments. After reviewing literature on mentoring programs, this author developed a best practices model mentoring program for police departments and included successful techniques that departments can use to tailor a program according to the needs of their community.

This dissertation examines the impact of international terrorism on the policing (both the policing structures and policing strategies) of large globaized cities, with a focus on New York City and London. Combining historical analysis, secondary source material, and extensive interviews with police officials and officers, it seeks to examine the underlying structural constraints and resources that lead these cities to internationalize their counterterrorism efforts.
