Under the Pennsylvania Constitution of 1968, Article V, § 5 established a single Courts of Common Pleas in each judicial district. Previously, there had been a variety of separate trial courts in Pennsylvania, e.g., common pleas, county courts, orphans, juvenile, oyer and terminer, etc. Under the new Constitution, all courts were merged into a single court of common pleas. In larger counties, like Philadelphia and Allegheny County, a separate family division consists of an Adult and Juvenile divisions.

The author created this paper for a class assignment testing students’ knowledge of constitutional law. The assignment was to write a legal brief addressing the constitutionality of a statewide mask mandate during the COVID-19 pandemic. COVID-19 is an airborne disease that can be transmitted from person to person up to six feet apart. The hypothetical facts provided for this brief were that a suit was filed in Pennsylvania state court by a group of individuals in opposition to the state’s mask mandate that was enacted to address the COVID-19 pandemic. Examining Overrepresentation In Special Education Amongst African Americans Diagnosed With Emotional Disturbance In The State Of Pennsylvania, Krisa Franzetta

This study examines the disproportionality in special education, regarding African American students being overrepresented, specifically under the disability category of Emotional Disturbance (ED) within the state of Pennsylvania. Demographic information was collected with the use of secondary data provided by the Pennsylvania Department of Education, using 648 educational programs across 29 intermediate units. Data were analyzed with statistical representation of percentages as related to risk composition and the E-Formula. The results yielded an average risk of African American students being two times more likely to be diagnosed with ED than their White peers. Additional results from the calculation of the …

The Culture Of Appalachian Coal Miners And Its Affect On Their Culture, Joanna Mary Ferrell

The purpose of this ethnographic study was to understand and describe the culture and history of the Appalachian coal mining community and how the culture is impacting their future if they face a mine closure. The theory guiding this study is the Cultural Identity Theory by Mary Jane Collier as it explains that the miners’ culture is influenced by those around them and can change based on their surroundings. There is also influence from mining history, which was explored in detail. Surveys, interviews, and observations were utilized to collect data as well as historic artifacts.

This study explored the experiences of nonviolent women offenders over the age of 50 of all ethnicities who were formerly incarcerated and their involvement with restorative justice and recidivism from a public policy perspective. Although there was prior research on reentry of ex-offenders, the problem was that few studies focused on the barriers and success factors of reentry services for older female ex-offenders 50 years or older. This project examines the reciprocal and evolving relationship between American women’s culture, vernacular religion, and the social development of American ethnicity. This project focuses on the roles of white ethnic women, both literary and real, in the construction, maintenance, and transmission of ethnic identity. The project highlights the connections between the folkloric performances of vernacular religion and the discursive articulation of ethnicity by focusing on two women writers and two groups of Slovak American women. The fiction of Kate Chopin and Anzia Yezierska illustrates how literary authors bring their contemporary concepts of folklore into their writing. The writings of these …

Sparked by the police killings of George Floyd and Breonna Taylor, the 2020 uprisings accelerated a momentum of abolitionist organizing that demands the defunding and dismantling of policing infrastructures. Although a growing body of legal scholarship recognizes abolitionist frameworks when examining conventional proposals for reform, critics mistakenly continue to disregard police abolition as an unrealistic solution. This Essay helps dispel this myth of “impracticality” and illustrates the pragmatism of abolition by identifying a community-driven effort that achieved a meaningful reduction in policing we now take for granted. As part of their traditional state police powers, states determine the eligibility requirements for their driver’s licenses. Standard eligibility requirements include proof of age, residency, identity, and knowledge. In the 1990s, some states amended their vehicle codes to require proof of lawful status, effectively barring undocumented immigrants from obtaining driver’s licenses.

In response to inconsistent issuance and verification standards, Congress passed the REAL ID Act of 2005. The Act prohibits federal agencies from accepting state driver’s licenses for official purposes unless states comply with minimum issuance and verification standards. These standards include requirements to verify Social Security numbers and lawful …

The U.S. Constitution provides criminal defendants the right to a court-appointed attorney but gives no similar protection to civil litigants. Although federal law does not supply any categorical rights to counsel for civil litigants, all 50 states have instituted the right in at least one category of civil law that substantially impacts individuals’ rights. Since 2017, several U.S. cities have enacted such a right for tenants facing eviction. Public trusts for natural resources incorporate both limits and duties on governments in their stewardship of those natural resources. They exist in every state in the United States—in constitutional provisions, statutes, and in common law. Yet the law recognizing public trusts for natural resources may contain only the most basic provisions—often just a sentence or two. The purpose and terms of these public trusts certainly answer some questions about the limits and duties of trustees, but they do not answer all questions. Along the banks of the Susquehanna River in early July 1778, a force of about 600 Loyalist and Native American raiders won a lopsided victory against 400 overwhelmed Patriot militiamen and regulars in the Wyoming Valley of Pennsylvania. While not well-known today, this battle—the Battle of Wyoming—had profound effects on the Revolutionary War and American culture and politics. Quite familiar to early Americans, this battle’s remembrance influenced the formation of national identity and informed Americans’ perceptions of their past and present over the course of the eighteenth and nineteenth centuries.

Pennsylvania farmer Robert Brace was sued by the federal government in 1987 for repairs he had made to an existing drainage system on his farm. The Third Circuit Court of Appeals held in 1994 that Brace’s repair activities did not constitute “normal agricultural activity” and were therefore subject to Clean Water Act regulation. After thirty years of battling the government, Brace has now filed an $8 million administrative action against the Environmental Protection Agency, the Army Corps of Engineers, and the United States Fish and Wildlife Service requesting financial compensation for improper regulatory enforcement that has resulted in millions of …

Prostitution is as old as human civilization itself. Throughout history, public attitudes toward prostituted women have varied greatly. But adverse consequences of the practice—usually imposed by men purchasing sexual services—have continuously been present. Prostituted women have regularly been subject to violence, discrimination, and indifference from their clients, the general public, and even law enforcement and judicial officers.

Jurisdictions can choose to adopt one of three general approaches to prostitution regulation: (1) criminalization; (2) legalization/ decriminalization; or (3) a hybrid approach known as the Nordic Model. The article focuses on a troubling aspect of contemporary judicial morality.

Impartiality—and the appearance of impartiality—are the foundation of judicial decision-making, judicial morality, and the public’s trust in the rule of law. Recusal, in which a jurist voluntarily removes himself or herself from participating in a case, is a process that attempts to preserve and promote the substance and the appearance of judicial impartiality. Nevertheless, the traditional common law recusal process, prevalent in many of our state court systems, manifestly subverts basic legal and ethical norms.

Analyzing The Response To Covid-19 In Pennsylvania State Correctional Institutions, Elizabeth A. Rousseau

To evaluate the effects of the COVID-19 outbreak on the Pennsylvania prison system, I collected data from the Pennsylvania Department of Corrections, the Pennsylvania Department of Health, and the Marshall Project. I supplemented the data with opinion pieces and journal articles discussing the specific issues that this pandemic imposes upon prisons in the United States. In sum, population data collected from the Department of Corrections showed that only a few State Correctional Institutions saw a steady decrease in population over the 25 day study period from from June 18th through July 13th (Pennsylvania Department of Corrections, 2020).
