Should The Internet Exempt The Media Sector From The Antitrust Laws?, Thomas J. Horton, Robert H. Lande

This article examines whether the "old media" and the "new media", including the Internet, should be considered to be within the same relevant market for antitrust purposes. To do this the article first demonstrates that proper antitrust consideration of the role of non-price competition necessitates that “news” and “journalism” be analyzed in two distinct ways. First, every part of the operations of a newspaper (or other type of media source), including its investigative reporting and local coverage, should be assessed separately. Watching The Watchdogs: Defining Journalists In The United States, Wendy Marie Weinhold

The word journalist, and the domain of producers and texts that inhabit its boundaries, often lacks a clear and agreed definition. The dominant body of literature looks at journalists in the United States through a remote lens, locates them within a cadre of journalists operating out of a newsroom, and overlooks the multiple roles they inhabit at once. This dissertation represents an attempt to build on and extend the depth of definitions afforded the American print journalist offered in literature that dominates journalism studies. Samuel Adams is a well-known member of the American revolutionary era. A politician by trade, his writings are credited by some as sparking a flame which led to independence. Communicating primarily through his writings in official Massachusetts documents and articles in the Boston area newspapers, Adams was a significant figure of the time. Yet history has routinely characterized his persuasive techniques with varying degrees of honor or disgust. Shortly after the revolution, he was thought of in glowing terms, yet by the late 1800s, the name of Samuel Adams was associated with malicious demagoguery and propaganda. The following study investigates the best social media practices available for newspapers, with the goal of increasing social media followers and interaction, and gaining increased traffic and readers on a newspapers website. By taking the conclusions about best practices made in the study, the study also works to specifically form best practices recommendations for Mustang Daily, the student-run daily newspaper at California Polytechnic State University in San Luis Obispo, California. This study focuses on the best practices available in current social media by consulting existing literature on the subject and interviewing experts in the fields of media and social media. …

The author explores and surveys the legislative response to Zurcher v. Stanford Daily. While it is recognized that the debate and controversy is far from over, the resulting legislation, including the Privacy Protection Act of 1980, is viewed as being a significant contribution to the area of fourth amendment law. The author analyzes the applicable legislation in detail.

A Reporter's Privilege In Florida: Has The Conflict Between The First Amendment And Sixth Amendment Been Reconciled?, Jay B. Rosman
Barry Law Review
This article examines the reporter's privilege in Florida and the inherent conflict between the First Amendment and Sixth Amendment as it exists between the freedom of the press and the right to a fair trial. The salient question addressed is whether the conflict between the First Amendment and the Sixth Amendment has been reconciled on the issue of a reporter's privilege by Florida courts and the Florida Legislature. The author provides both an analytic and empirical study. Analytically, the article looks to the two amendments to define a reporter's privilege and considers the history of the privilege. In this article three important policy questions are suggested in light of signs of recent growth of nonprofit news and the possibility of a great deal more similar growth in the future: 1) Does nonprofit news production pose a plausible solution to the economic troubles of the U.S. news industry? 2) Would industrial subsidies of nonprofits, like those for “welfare state” health and human services co-production offer a potential solution to the economic problems of the U.S. news industry? 3) Can the currently evolving internet-based system of news production by volunteer citizens be sustainable in the long run?
