Psychiatric Assistance For Indigent Defendants Pleading Insanity: The Michigan Experience, Paul Zisla
University of Michigan Journal of Law Reform
The federal government and many states already provide psychiatric assistance to indigent defendants pleading insanity. Michigan's statutory scheme for delivering this service presents an opportunity to evaluate an approach that generally favors defendant interests in areas left unresolved by Ake. This Note undertakes that evaluation. Part I summarizes the Ake decision, key problem areas, and the research methodology. Part II describes the Michigan statutory system. Part III evaluates that system using data from interviews with legal and psychiatric practitioners and considers the consequences of Michigan's approach to the issues posed by Ake. The evaluation shows that Michigan's system …

Torts (Annual Survey Of Michigan Law, June 1, 1984 - May 31, 1985), Lawrence C. Mann
Law Faculty Research Publications
Areas of particular significance during the Survey period include products liability and governmental immunity. In the area of products liability, the Michigan Supreme Court declined to determine whether a manufacturer of birth control pills has a duty to warn the ultimate user, stating that this determination is best left to the legislature. The court's reluctance to rule in the area of products liability for drugs sharply contrasted with its willingness to abolish implied warranty as a theory of liability for design defects. In the area of governmental immunity, the supreme court restructured the governmental immunity doctrine to shield state and …

House Of Judah: The Problem Of Child Abuse And Neglect In Communes And Cults, Gregory M. Gochanour
University of Michigan Journal of Law Reform
This Note argues that although some modifications were appropriate, state intervention and removal of children, even from a commune or cult, should be handled through examination of each individual parent/child relationship. Part I examines the statutory and case law framework for state intervention and removal of children from the custody of abusive parents in Michigan, and discusses the policies supporting these laws. Part II examines the circumstances present in the House of Judah and notes the state's departures from the statutes and rules. Part III analyzes and evaluates the usefulness and wisdom of these departures. Finally, Part IV briefly proposes …

Progeny Testing Of Native Aspens And Their Hybrids For Biomass Production In Michigan, G.L. Reighard, J.W. Hanover
Aspen Bibliography
Anaspen progeny test consisting of 206 families of trembling aspen (Populus tremuloides), bigtooth apsen (P. grandidentata), and their hybrids (P. Xsmithii and P. Xrouleauiana) was planted on five Michigan sites and evaluated after two growing seasons. Growth performance of trembling aspen families when compared with all aspen taxa was above average and increased with the latitude of the plantation site. Backcrosses of trembling aspen males to white poplar-bigtooth aspen (P. Xrouleauiana) females produced the fastest growing families at all Lower Peninsula plantations. Most hybrid aspen (P. Xsmithii) families had growth rates below the planation …
