Dispossessing Resident Voice: Municipal Receiverships And The Public Trust, Juliet M. Moringiello Jan 2020

Dispossessing Resident Voice: Municipal Receiverships And The Public Trust, Juliet M. Moringiello

University of Michigan Journal of Law Reform

The residents of struggling cities suffer property dispossessions both as individual owners and as municipal residents. Their individual dispossessions are part of a cycle that often begins with industrial decline. In Detroit, for example, more than 100,000 residents have lost their homes to tax foreclosure over a four-year period that bracketed the city’s bankruptcy filing. Falling property values, job losses, and foreclosures affect municipal budgets by reducing tax revenues. As individual dispossessions exacerbate municipal financial crises, residents can also face the loss of municipal property. Struggling cities and towns often sell publicly owned property—from parks to parking systems—to balance municipal …

Detection And Classification Of Eurasian Watermilfoil With Multispectral Drone-Enabled Sensing, Colin Brooks Jan 2020

Detection And Classification Of Eurasian Watermilfoil With Multispectral Drone-Enabled Sensing, Colin Brooks

Dissertations, Master's Theses and Master's Reports

Littoral zones support growth of submerged aquatic vegetation, creating productive areas that provide food and habitat for fish, amphibians, macroinvertebrates, and other parts of the food web. Understanding macrophyte dynamics requires the identification of submerged aquatic vegetation (SAV) taxa, which can be possible if taxa of interest are spectrally distinct with data collected at appropriate scales. Eurasian watermilfoil, Myriophyllum spicatum or EWM, is a non-native SAV species that forms thick, often monotypic beds that reduce benthic species richness, restrict recreation, reduce property values, clog water intakes, and lower dissolved oxygen concentrations. Remote sensing of SAV species has to address the …

Effects Of Wild Pig Disturbance On Forest Vegetation And Soils, Steven M. Gray, Gary J. Roloff, Daniel B. Kramer, Dwayne R. Etter, Kurt C. Vercauteren, Robert A. Montgomery Jan 2020

Effects Of Wild Pig Disturbance On Forest Vegetation And Soils, Steven M. Gray, Gary J. Roloff, Daniel B. Kramer, Dwayne R. Etter, Kurt C. Vercauteren, Robert A. Montgomery

United States Department of Agriculture Wildlife Services: Staff Publications

In North America, wild pigs (Sus scrofa; feral pigs, feral swine, wild boars) are a widespread exotic species capable of creating large‐scale biotic and abiotic landscape perturbations. Quantification of wild pig environmental effects has been particularly problematic in northern climates, where they occur only recently as localized populations at low densities. Between 2016 and 2017, we assessed short‐term (within ~2 yrs of disturbance) effects of a low‐density wild pig population on forest features in the central Lower Peninsula of Michigan, USA. We identified 16 8‐ha sites using global positioning system locations from 7 radio‐collared wild pigs for sampling.Within each …

Effects Of Infanticide Risk And Timber Harvest On American Black Bear Space Use, D. Cody Norton Dec 2019

Effects Of Infanticide Risk And Timber Harvest On American Black Bear Space Use, D. Cody Norton

All NMU Master's Theses

Space use is an important aspect of bear ecology that maybe influenced by infanticide risk and timber harvest. I used generalized linear mixed models (GLMM) to determine if female American black bear (Ursus americanus) space use was consistent with avoidance behavior to reduce infanticide risk in the Upper Peninsula of Michigan during the 2009–2011 and 2013–2014 breeding seasons. Females with cubs occupied core areas and home ranges of similar size and relative probability of male use to females without cubs. Additionally, females with cubs did not reduce movements during times of day when male movements were greatest. Female …

Prenatal Drug Exposure As Aggravated Circumstances, Frank E. Vandervort Nov 2019

Prenatal Drug Exposure As Aggravated Circumstances, Frank E. Vandervort

Articles

In Michigan, "a child has a legal right to begin life with sound mind and body." Yet the family court may not assert Juvenile Code jurisdiction until after birth. In re Baby X addressed the question of whether a parent's prenatal conduct may form the basis for jurisdiction upon birth. It held that a mother's drug use during pregnancy is neglect, allowing the court to assert jurisdiction immediately upon the child's birth. In deciding Baby X, the Court specifically reserved the question of whether parental drug use during pregnancy might be sufficient to permanently deprive a parent of custody. …

Rural America's Drinking Water Crisis, Madison Condon Oct 2019

Rural America's Drinking Water Crisis, Madison Condon

Shorter Faculty Works

While Flint, Michigan, rightfully captures headlines, another water crisis affecting millions of Americans continues to go largely unnoticed. All across rural America, small community water systems are failing to protect public health due to a perfect storm of forces. Poor regulation of agricultural waste and other pollutants, shrinking populations, and aging infrastructure all contribute to the increasing incidents of water quality violations dotting the rural landscape. There are nearly 60 thousand community water systems in the United States and 93 percent of them serve populations of fewer than 10,000 people—67 percent serve populations of fewer than 500 people. In 2015, …

Reconciling Police Power Prerogatives, Public Trust Interests, And Private Property Rights Along Laurentian Great Lakes Shores, Richard K. Norton, Nancy H. Welsh May 2019

Reconciling Police Power Prerogatives, Public Trust Interests, And Private Property Rights Along Laurentian Great Lakes Shores, Richard K. Norton, Nancy H. Welsh

Michigan Journal of Environmental & Administrative Law

The United States has a north coast along its ‘inland seas’—the Laurentian Great Lakes. The country enjoys more than 4,500 miles of Great Lakes coastal shoreline, almost as much as its ocean coastal shorelines combined, excluding Alaska. The Great Lakes states are experiencing continued shorefront development and redevelopment, and there are growing calls to better manage shorelands for enhanced resiliency in the face of global climate change. The problem is that the most pleasant, fragile, and dangerous places are in high demand among coastal property owners, such that coastal development often yields the most tenacious of conflicts between public interests …

Masters Theses

This research explores the beliefs and experiences of stakeholders in a family literacy program through the Literacy Center of West Michigan and Head Start for Kent County. The program is currently developing a curriculum to improve outcomes for learner specific goals. Therefore, one motivation behind this research is to analyze the goals, needs, and understandings for the multiple stakeholders within the program. On a national scale, there exists a need to better define the goals of family literacy programming in general. Points of alignment and disconnect for the participants in this study reflect realities that extend beyond the program at …

The Democracy Ratchet, Derek T. Muller Apr 2019

The Democracy Ratchet, Derek T. Muller

Indiana Law Journal

This Article proceeds in five Parts. Part I identifies recent instances in which federal courts have invoked a version of the Democracy Ratchet. It identifies the salient traits of the Democracy Ratchet in these cases. Part II describes why the Democracy Ratchet has gained attention, primarily as a tactic of litigants and as a convenient benchmark in preliminary injunction cases. Part III examines the history of the major federal causes of action concerning election administration—Section 2 of the Voting Rights Act, the Burdick balancing test, and the Equal Protection Clause. In each, it traces the path of the doctrine to …

Implementation Of The Vaccines For Children Program In A Midwest, Urban Clinic Dedicated To The Underserved Population, Akmal Saydazamov Apr 2019

Implementation Of The Vaccines For Children Program In A Midwest, Urban Clinic Dedicated To The Underserved Population, Akmal Saydazamov

Doctoral Projects

Background: Low immunization rates weaken herd immunity and endanger children. The Safety Net Health Clinic (SNHC) study site serves an underprivileged and refugee population with significantly lower than ideal coverage. Series completion disparities persisted after control for demographic, access-to-care, poverty and language effects (Varan et al, 2016).

Objectives: SNHC implemented the Vaccines for Children (VFC) program in order to increase the vaccination rates among the underserved population.

Methods: As an efficacy study, the project focused on three major areas in the VFC implementation – cost, staff preparedness and patient need. Cost was determined by utilizing electronic medical records (EMR) and …

Who Takes The Bait? Non-Target Species Use Of Bear Hunter Bait Sites, Ellen M. Candler, William J. Severud, Joseph K. Bump Jan 2019

Who Takes The Bait? Non-Target Species Use Of Bear Hunter Bait Sites, Ellen M. Candler, William J. Severud, Joseph K. Bump

Human–Wildlife Interactions

Hunting bears (Ursus spp.) over baits is legal in many countries, states, and provinces, but the practice remains a controversial topic among wildlife managers, hunting groups, and the general public. The baits used to attract bears may also provide a pulsed resource on the landscape that can be used by other wildlife species, particularly carnivores. To determine what other species might use bear bait sites, we constructed and monitored 21 bear bait sites with camera traps from August to October 2016 in the western Upper Peninsula of Michigan, USA. The sites mimicked typical American black bear (U. americanus …

Examining Perceptions Of Service Quality Of Student Services And Satisfaction Among International Students At Universities In Indiana And Michigan, Mordekai Ochieng Ongo Jan 2019

Examining Perceptions Of Service Quality Of Student Services And Satisfaction Among International Students At Universities In Indiana And Michigan, Mordekai Ochieng Ongo

Dissertations

Problem

Universities in the United States face financial constraints, intense competition for students, declining student enrollment, and constant student attrition. However, an increasing number of international students seek higher education abroad, especially in the U.S. Providing quality services to these international students might help institutions attract and retain more of them. Unfortunately, little empirical research has been done on international students’ perceptions of service quality, especially of non-academic services. This study fills that gap by using a modified SERVPERF questionnaire to investigate international students perceived service quality and satisfaction at eight universities in Indiana and Michigan.

Method

The purpose of …

Northern Hardwood Silviculture: Preferences Among Family Forest Owners In The Western Upper Peninsula Of Michigan, Alexander C. Helman Jan 2019

Northern Hardwood Silviculture: Preferences Among Family Forest Owners In The Western Upper Peninsula Of Michigan, Alexander C. Helman

Dissertations, Master's Theses and Master's Reports

In the northern hardwood forests of the Western Upper Peninsula of Michigan, single-tree selection is the most commonly used silvicultural system. This system provides both a sustained yield of timber and attempts to emulate the windfall disturbance regime that determines the uneven aged structure of northern hardwood forests. However, with concerns about tree species diversity loss and a lack of early successional forests, even-aged regeneration methods are likely to become an increasingly crucial tool in the toolbox for managing northern hardwood forests of the Lake States. The forests of the Western Upper Peninsula are comprised of a mosaic of ownerships, …

Education Reform And Detroit’S Right To Literacy Litigation, Kristine L. Bowman Dec 2018

Education Reform And Detroit’S Right To Literacy Litigation, Kristine L. Bowman

Washington and Lee Law Review Online

Ongoing education reform litigation arising out of Detroit, Michigan presents an innovative claim: Children have an unenumerated federal constitutional right of access to literacy. On June 29, 2018, the district court granted defendants’ motion to dismiss. The case is now on appeal to the Sixth Circuit and is expected to be argued in the first half of 2019. This litigation has already broken new ground and, regardless of the ultimate outcome, it is valuable because it invites us to revisit fundamental questions about rights, remedies, and the role of courts in education reform.

Relationship Of Adult And Child Dietary Intakes In Michigan And Implications For Programming Region-Wide, Jiying Ling, Nagwan R. Zahry, Manfred Stommel, Mildred A. Horodynski

Journal of Extension

Healthful dietary intakes are crucial for stemming the current childhood obesity epidemic. We examined the dietary intakes of 392 Michigan children aged 1–12 years. About 70% and 58% of children ate fruits and vegetables, respectively, each day; 26% drank sugar-sweetened beverages; and 31% ate with a television on. Children's vegetable intakes were significantly and moderately correlated with their parents' vegetable intakes (r = .34–.38), but their fruit intakes were more related to their grandparents' fruit intakes (r = .31). Due to the relative representativeness of our sample and similarities in eating patterns across the region, Extension professionals may consider our …
